VILLAGE OF MOUNDS VIEW
COUNTY OF RAMSEY
STATE OF MINNESOTA
At a regular meeting of the Village Council held at 8:00 P.M.
CDST on the 23rd day of June 1969 at the Village Hall, 2401 Highway 10,
St. Paul, Minnesota 55112, with the following members present: Rusted,
Malvin, Johnson, Hodges, Blanchard
and the following members absent: None
Member Johnson moved the following:
A RESOLUTION TO THE NORTH SUBURBAN SANITARY SEWER
DISTRICT RELATIVE TO TEMPORARY CONNECTIONS BY THE
VILLAGE OF MOUNDS VIEW
WHEREAS, the Village of Mounds View has been a member
of the North Suburban Sanitary Sewer District since its creation in
1961, and
WHEREAS, the Village of Mounds View entered into a Sewer
Use Agreement with the North Suburban Sanitary Sewer District which
established the method of financing the general obligation bonds
issued by the District, which included user and connection charges, and
WHEREAS, the Village of Mounds View has paid its connection
and user charges, and
WHEREAS, the 1969 Minnesota Legislature passed legislation
creating the Metropolitan Sewer Service Board (Laws 1969, Chapter 449)
which will succeed the North Suburban Sanitary Sewer District January
1, 1971, and which may acquire the assets, interceptors, and other
appurtenances built by and owned by the North Suburban Sanitary Sewer
District on or before January 1, 1971, and
WHEREAS, the North Suburban Sanitary Sewer. District and
the City of Fridley entered into a supplemental agreement to the
Sewer Use Agreement, which has been interpreted by the District Court
to allow the City of Fridley to temporarily connect to the North
Suburban Sanitary Sewer District interceptors, and that connection
charges for such temporary connections are deferred until the District
establishes a need for the capacity temporarily so used, and
WHEREAS, the Sewer Use Agreement provides that any provisions
granted to a member community that vary the Sewer Use Agreement shall
apply equally to all of the member communities,
NOW, THEREFORE, BE IT RESOLVED by the Village Council of the
Village of Mounds View:
1. That since temporary connections are permitted to
the North Suburban Sanitary Sewer District interceptors, the Village
of Mounds View hereby notifies the North Suburban Sanitary Sewer
District that all connections to the North Suburban Sanitary Sewer
District interceptors made subsequent to the 1st day of January
1969 are temporary connections.
2. The permanent alternative to the temporary connections
being made by the Village of Mounds View are the facilities to be
acquired or constructed by the Metropolitan Sewer Service Board pursuant
to Laws 1969, Chapter 449.
3. That the method of financing said permanent alternative
will be pursuant to Laws 1969, Chapter 449.
4. That the plans for the construction of the permanent
alternative are to be prepared by the Metropolitan Sewer Service Board
pursuant to Laws 1969, Chapter 449.
The motion was seconded by Member Blanchard Those

whereupon the Mayor declared the resolution duly adopted this 23
day of June

I, the undersigned, being the duly qualified and acting
Clerk of the Village of Mounds View, Minnesota, do hereby certify that
I have carefully compared the attached and foregoing extrct of minutes
of a meeting of the governing body of the above municipality held on
the date therein indicated, and that the same is a full, true and
correct copy of said minutes, insofar as the same relate to a
resolution to the North Suburban Sanitary Sewer District relative to
temporary connections by the Village of Mounds View.
