CDST on the 28th day of July, 1969, at thn Village Hall, 2401 Highway 10, St. Paul, Minnesota, 55112, with the following members present: Rustad, Malvin, and Blanchard and the following members absent: Johnson z& Hodges Member Blanchard moved the following: A RESOLUTION TO THE NORTH SUBURBAN SANITARY SEWER DISTRICT RELATIVE TO CONNECTION CHARGE REIMBURSEMENTS AND AMENDMENTS TO THE SEWER USE AGREEMENT WHEREAS, the Village of Mounds View has been a member of the North Suburban Sanitary Sewer District since its creation in 1961, and WHEREAS, on the 9th day of March, 1964, the Village of Mounds View entered into a Sewer Use Agreement with the North Suburban Sanitary Sewer District which established a method of financing the functions and obligations of the District, which include user and connection charges, and WHEREAS, the 1969 Minnesota Legislature adopted legislation creating the Metropolitan Sewer Service Board (Laws 1969, Chapter 449), and WHEREAS, the Village of Mounds View has paid to the North Suburban Sanitary Sewer District for connection charges to date the total amount of Two Hundred Seventy -four Thousand Nine Hundred Twenty -five Dollars ($274,925.00), and user charges in excess of Seventy -five thousand three hundred twenty nine Dollars and Fifty Cents (75,329.50), and WHEREAS, the connection charge method of financing was adopted by the District to accommodate property owners within the District who did not have an immediate need for sewage disposal facilities, in effect eliminating the need for an ad valorem tax levy, and WHEREAS, Laws 1969, Chapter 449 authorizes the levying of ad valorem taxes by the Metropolitan Sewer Service Board, and it is eminent that said tax levies will be made to finance the construction, operation, maintenance and purchase of facilities within the seven county Metropolitan Sewer District, and WHEREAS, those property owners in the North Suburban Sanitary Sewer District who have and will pay connection charges until the corporate existence of the North Suburban Sanitary Sewer District is terminated on January 1, 1971, will also be subject to an ad valorem tax levy by the Metropolitan Sewer Service Board which the Village Council of the Village of Mounds View finds would be inequitable, and WHEREAS, it is the understanding of the Village of Mounds View that the North Suburban Sanitary Sewer District is the only District utilizing the connection charge method of financing construction of its facilities, and WHEREAS, a Mounds View resident pays Nine Dollars ($9.00) per quarter per rec for sewer service, whereas the use charges for the City of Minneapolis are Two Dollars and fifty cents ($2.50)per quarter and for the City of St. Paul Three Dollars and sixty cents ($3.60) per quarter, and WHEREAS, continuation of the connection charge method of financing of the present sewer use charges put the municipalities in the North Suburban Sanitary Sewer District at an economic disadvantage in relation to the rest of the Metropolitan area, and WHEREAS, Laws 1969, Chapter 449 has created the seven county Metropolitan Sewer Service Board and delegated to it the responsibilities for the construction of the necessary facilities for sewage treatment, and WHEREAS, it is no longer necessary for the North Suburban Sanitary Sewer District to expend sums of money for the construction of sewage treatment plants in the North Suburban Area when this function has now been acquired by the Metropolitan Sewer Service Board NOW, THEREFORE, BE IT RESOLVED by the Village Council of the Village of Mounds View as follows: 1. That the North Suburban Sanitary Sewer District immediately cease and desist from authorizing the expenditure of any further sums of money for the planning, acquiring or construction of a sewage treatment plant in the North Suburban Sanitary Sewer District area until said functions have been assumed by the Metropolitan Sewer Service Board pursuant to Laws 1969, Chapter 449. 2. That the North Suburban Sanitary Sewer District take the appropriate measures to request the Metropolitan Sewer Service Board to proceed with the acquisition of a plant site and the construction of a regional treatment plant according to its own plans and specifications. 3. That this resolution constitutes notice pursuant to paragraph 4.03 of the Sewer Use Agreement No. 5 executed by the North Suburban Sanitary Sewer District and the Village of Mounds View on the 9th day of March, 1964, whereby the Village of Mounds View hereby requests that certain changes and /or modifications be made in the Sewer Use Agreement to provide as follows: a. In an effort to equalize the economic impact of a Metropolitan tax levy for sanitary sewer facilities, an amendment to the Sewer Use Agreement eliminating the connection charge method of financing, reducing the user charge so that no user in the North Suburban Sanitary Sewer pays more than the lowest charge currently in force in the seven county Metropolitan area. b. In an effort to equalize the economic impact of a tax levy on those property owners and users in the North Suburban Sanitary Sewer District who have paid connection charges, an amendment or modification to the Sewer Use Agreement or some other action whereby connection charges, and if possible, user charges to the extent that said user charges exceed the lowest user charge in the seven county metropolitan area in effect since 1964, shall be refunded to the municipality within the North Suburban Sanitary Sewer District where the property and /or user was located at the time the connection charge and excess user charges were paid. 4. Be it further resolved that the North Suburban Sanitary Sewer District, after modifying the Sewer Use Agreement, and refunding the connection charges and excess user charges paid into said District, notify the Metropolitan Sewer Service Board the budgetary requirements necessary to properly administrate the North Suburban Sanitary Sewer District which includes debt service. The motion was seconded by Member Rustad Those voting in favor: Rustad, Malvin, Blanchard those voting against: None whereupon the Mayor declared the resolution duly adopted this 28th day of July 1969.
