RESOLUTION REVISING THE INTRODUCTION SECTION AND SECTIONS 1.05
AND 1.37 OF THE CITY OF MOUNDS VIEW PERSONNEL MANUAL
WHEREAS, the League of Minnesota Cities has suggested that the City of Mounds
View add "disclaiming" language to its Personnel Manual which would assert three points:
1. The City Council retains the right and discretion to modify the Personnel
Manual as it may see fit and without any notice,
2. The City Council retains responsibility for any necessary interpretation of
any policy or provision therein, and
3. Nothing in the Personnel Manual should be construed to be a contract.
WHEREAS, the City Council has been made aware of an inconsistency between
Section 1.05 and Section 1.37 or the Personnel Manual regarding probationary employees;
and,
WHEREAS, the City Council has been made aware of an inconsistency between
Section 1.05 of the Personnel Manual and Section 106.03, Subd lb(9) of the City Code
regarding terminations.
NOW, THEREFORE BE IT RESOLVED, that the Mounds View City Council
approves the following revision to the introductory passage of the Mounds View Personnel
Manual, as follows:
The City reserves the right, at its discretion, to change or terminate any
provision of this handbook or to add new provisions at any time without prior
notification. Responsibility for final interpretation of any specific issues
as thev relate to policies, procedures, and benefits lies with City
Council. Suggestions you have for changes in the City's personnel policies
are welcome and should be submitted in writing to the City Administrator. If,
and whenever, information in this packet conflicts with a union contract, the
union contract shall override the packet information. This Personnel Manual
itself is not an employment contract, and nothing herein should be
construed as such.

NOW, THEREFORE BE IT FURTHER RESOLVED, that the Mounds View City
Council approves the following revision to Section 1.05 (Discipline Policy) of the Mounds
View Personnel Manual, as follows:
Disciplinary action for just cause may be handled as deemed appropriate by
the City. This policy does not apply to new probationary employees. New
probationary employees may be disciplined or terminated at any time, for
any reason, which does not violate the law, subject to the rights of veterans.
NOW, THEREFORE BE IT FURTHER RESOLVED, that the Mounds View City
Council approves the following revision to Section 1.05 (B)4 of the Mounds View Personnel
Manual, as follows:
The City Administrator, or the Department Head with the concurrence of
the City Administrator, may recommend termination of an employee.

NOW, THEREFORE BE IT FINALLY RESOLVED, that the Mounds View City
Council approves the following revision to Section 1.37 (Probationary Period Policy) of the
Mounds View Personnel Manual, as follows:
New, probationary employees may be terminated by the City Council, with
or without cause at any time, subject to the rights of veterans.
