Council o* the Village of Mounds View was called to order by Mayor Gibson at 8:00 P.M. on January 20, 1959, at the Village Hall, 1450 W. Nighway 96. James Gibson Earl E. Smith Reuben G. Achterkirch Melford C. Christensen John L. Sullivan Mary Jean Milbrandt Richard Meyers car were read: Trade -In Net Price 3,046.48 950.00 1,980.00' 1,877.79 1,984.71 2,730.00 966.45 2,500.00- Sedan) 965.45 2,426.00 47 Motion by Achterkirch, seconded by Christensen to accept bid from Clayton Anderson Motors without trade -in. 5 ayes. The minutes of the January 2nd recessed meeting were corrected to show James Gibson as Chairman of the Police Commission and Reuben Achterkirch as Vice Chairman. Motion by Sullivan, seconded by Achterkirch to approve the minutes as corrected. Mr. James Manson, 8145 Groveland Rd. was requested to correct the situation of junked cars on his property as soon as possible. Mr. Leonard Babinski discussed with the Council the possibility of building double bungalows on the property between Sunnyside and Redoak north of County Road H and South of 4ioodcrest Drive. Mr. Babinski was informed he should obtain a petition from the adjoining property owners and the matter would then be referred to the Planning Committee. Ingram C. Rusted was sworn in by Clerk Earl Smith as Mounds View Civil Defense Director. Mr. Bentrup presented a survey of a lot located on Red Oak Drive described as follows: The South one hundred thirty (130) feet of the west one hundred (112) feet of the east one hundred forty -five (145) feet of the north four hundred five (405) feet of the out eight hundred ten (81o) feet of the west five hundreJ twenty eight (528) feet of the Northeast Quarter (TIE) of Section Six (6), Township Thirty (30), R_r.ge Twenty Three (23), Ramsey County, Minnesota, subject to a road easement ov,:r the east thirty tree (33) feet thereof. Motion ly Gibson, seconded by ".c' terkirch to approve Lo+. 5 ayes. 48 Motion by Sullivan, seconded by Smith to alert re=,olutien lo. 16 authorizi g the execution of a fire protection contract. 5 ayes. Mr. Ray Hagglund of R. Thomas Co. showed Plans of a done in conjunction with Judicial' pitch #1 in 1954. The Aagglund for presenting tte plane for their observation. requested to submit a letter giving an estimate cost for study based on the information which he already 1 drainage survey study council thanked Mr. Mr. Haglund was a village sewer survey The building inspector was requested that if he issue any permits outside of the Clerk's office that those permits be mailed or brought to tl,e Clerk's Office within 2 days.. Motion by Achterkirch, seconded by Sullivan to appoint John O. Koontz as Building Inspector. 5 ayes. Upon recommendation of Electrical Inspector Edmond motion by Achterkirch, seconded by Sullivan to approve electrical contracting license for Bill Richmond Electric Co., 5 ayes. In bringing up the matter of the recommendation of an engineer Trustee Sullivan pointed out that it had been an item of considerable controversy in the past. He stated he had spoken to a Planning Committee member who had said he was very impressed with Engineer Bonestroo's work. He also stated that he had talked with an engineer who said that Otto Bonestroo was a most brilliant engineer and that he probably would become one of the most prominent engineers in the state of Minnesota. Motion by Sullivan; seconded by Achterkirch to appoint Otto G. Bonestroo and Associates as village engineers. Clerk Smith stated that he felt this was a bad time to bring up the appointment of the engineer again. After further� discussion the following vote was taken: Achterkirch and Sullivan, aye; Christensen, Smith and Gibson, no. The motion was defeated. Mr. Crane, Planning Committee Chairman, reported that the Planning Committee was holding two meetings the end of January at which time an engineer should be present. Trustee Sullivan stated that for the next few months and the next few years the Village would he needing considerable technical help with the state aid road project, sewer, sanitary sewer and water projects. Motion by Christensen, seconded by Gibson that the attorney write to Otto Bonestroo notifying him that the storm sewer survey has been discontinued for the present. In view of the fact that Mr. Bonestroo has not been reappointed the Village Engineer he should be requested to submit his reasonable expenses, if any, pertaining to the storm sewer survey project. These expenses are to be referred to the attorney for his examination and recommendation. 4 ayes, Sullivan no. Trustee Sullivan pointed out that the storm sewer study would be a project in addition to the regular village engineer's services and that perhaps the Council would consider an application from Mr. Bonestroo to do the storm sewer study. Motion by Achterkirch, seconded by Smith to recess the meeting until 1:00 P.M. Saturday, January 24, 5 ayes. The adjourned meeting was reconvened and called to order by the Mayor at 1:05 P.M. January 24. M. Lee and Mr. Melberg spoke critt t,e Courcil regarding the Skiba property and their plans for commercial development for that area. They informed the Council that they were conductirg an economic zurvoy which would be completed in approximately a week and they would have additional information for the Council at that time. The Council spoke with Mr. Comstock of Comstock andDavis with position of Village Engineer, The Mayor read the Lakeside Park Ordinance, Discussion of the Ordinance followed. Mr. Haugen stated that the park in its present status had been built by "doing it yourself He said that the Park had <a v arming noose and lighting and that certainly the villages should now take over and maintain and improve th park. Motion by Christensen, seconded by Smith that our Attorney be instructed to write for an Attorney General's opi=nion as follows: That a complete copy of the ordinance be sent to him and the following question asked without further comment.` I request an opinion on the legality of this ordinance and a statement as to whether the law preventing public institutions, such as school districts, from purchasing real estate which has anything less than a fee simple title'is applicable to municipalities as regards this case. Voting aye Christensen and Smith; no, Achterkirch, Sullivan and Gibson. Motion def George Gustafson stated that the villages would be getting a S20,000 property for 31,000 so what are we waiting for. It was brought up that perhaps Ramsey County would develop the property on the East and South aide of the l as a park. Trustee Sullivan said that developing that area should not be a detriment to Lakeside Park. Trustee Achterkirc stated that this was not a haphazard or hair brain idea, that a lot of ,good people had worked hard on the reports, that he was 1000 for it and he'd' like not to be on the Council if they do not pass the Ordinance. Allen Crane, Chairman of the Planning Commission cited the recommendation of the Planning Consultant in General Planning Report #3. Mayor Gibson said he would like the new members of the Council to have a chance to study the Ordinance and put it on the agenda for the February 2nd meeting to be voted on at that time. Mr. Frits said he felt they should accept the attorney's advice as legal and go ahead with the thing as the tine element war very important. The Council would have to set up their commission members and they in turn set up a program for the year. Clerk Smith said he would never vote on anything until he was informed of all the facts. Motion by Achterkirch, seconded by Sullivan to adopt the Lakeside Park Ordinance, Voting aye Achterkirch and Sullivan; abstaining, Christensen, Smith and Gibson, Mayor Gibson stated that the Ordinance would appear as Item 3 on the agenda for the February 2nd meeting and it would be voted on favorably or unfavorably at that time. Motion by Achterkirch, seconded -y Gibson that the Village purchase new equipment for the new police car and dispose of the old equipment entact the old car. 5 ayes. Motion made t,y Gibson, seconded by Sullivan to appoint Leone Filavinka assistant aose-sor for the Village of Mounds View for 1959. 5 ayes. The financial statement war tabled until February 2nd.
