Achterkirch The Clerk read the minutes of the meeting of April 6, 1959. Motion by Sullivan seconded by Christensen to approve the minutes as read. The Clerk read the minutes of the meeting of April 20, 1959. A correction was made to the minutes that a motion should have been inserted that Officer Grabowski receive a raise in salary from $50.00 to $100.00 a month. Motion by Christensen seconded by Sullivan that the minutes be approved as read. Motion carried unanimously. Mr. Hellerstedt appeared before the council in regards to rezoning of the property in the triangle between Highway 8 and Highway 10 from farm residential to industrial. A recommendation from the Planning Commission was read suggesting denial of this rezoning. notion by Sullivan seconded by Christensen to concur with the recommendation of the Planning Commission and deny rezoning of the property from farm residential to industrial as described in the petition by Mr. Hellerstedt, an agent for the Glisan Realty. Motion carried unanimously. Mr. Hellerstedt requested that this property then be rezoned to commercial instead of industrial, Motion by Smith that the rezoning for commercial be referred to the Planning Commission and the $10.00 fee for said rezoning be waived in view of the fact that a 'l0.Otcreieriing fee has been paid previously. ?lotion amended by Sullivan that a new application for rezoning to commercial be tendered to the Planning Commission. Motion seconded by Sullivan and carried unanimously. Mr. Sem Dalberg appeared before the council requesting division of Lot 86 Spring Lake Park molls Addition into two 84- foot lots. Motion by Smith, seconded by Christensen that the division of Lot 86 Spring Lake Park Knolls Addition be referred to the Planning Commission for recommendation. Motion carried unanimously. Mr. George Gustafson appeared before the council reauesting snb. division of Lot 69 under Sub 89. Motion by Sullivan, seconded by Christensen that the plat for Lot 69 under Sub 89 and the preliminary sketch thereof be referred to the Planning Commission for recommendation and thet when referred back to the council for action the plat for this sub division be formalized. notion carried unanimously. Mss, Alma Bacon appeared before tl,e council and presented a report concerning the situation of burning of garbage by incinerator methods. It wa- pointed out by Mrs. Bacon that for purpose of conservation, garbage could be processed and used as fertilizer; a program which she feels that all villages should try to promote. Mayor Gibson stated that the members of t"e council would read the report and make disposition thereof as soon as possible. Mr. Ed Gerner of Pinewood Drive appeared before the council reeesing e culvert on County Road I stating that said culvert is rot peoperly mair.tained to dissipate the flow of water during heavy rains rind that the water becks up to his louse. Mayor Cihson stated that necessary action would le taken on this and tl nt the county would be notified so that Vey could take steps to correct this situation. 68 Mr. John Koontz, Building Inspector, appeared before the council to report what appears to be a violation of the building code by Mr. Benthrup at 8159 Red Oak Drive. Mr. Koontz stated that the house of Mr. Benthrup was built into a double bungalow instead of the single unit dwelling for which the building permit was issued. Mr. Koontz also reported that another family is living there but that Mr. Benthrup stated they are his guests. After discussion a motion was made by Sullivan, seconded be Smith that Mr. Betthrup, 8159 Red Oak Drive, be written a letter requesting his appearance at the council meeting of May 18 in regards to his property and also request that the building inspector be present at the meeting of May 18 with a copy of the building plans presented to him at the time the 'permit was issued in June 1958. Trustee Sullivan also moved that Mr. Benthrup bring with him his plans for the house in which he is in the process of building at,8159 Red Oak Drive, formerly known as the Virkinis house. Motion carried unanimously, A Curfew Ordinance was read by Mayor Gibson. Notion by Sullivan, seconded by Smith that the council refer the curfew ordinance to the committee appointed for that purpose for consideration and recommendation and that formal action be taken at the next council meeting or May 18. Smith, Christensen, Sullivan, aye; Gibson, no Motion by Sullivan, seconded by Christensen that a letter be written to Northwest HydrogasCompany requesting representative of that company appear at the Nay 18th council meeting in regards to a report by the Heating Inspector that said company is operating in the village without a heating contracting license. Motion carried unanimously. Motion by Gibson, seconded by Christensen that T signs be installed on. Jackson Drive at Pinewood, Terrace, Oakwood and Hillview. Notion carried unanimously. Motion 1 Sullivan, seconded by Gibson that load restriction signs in the village be removed. Motion carried unanimously. Motion by Gibson, seconded by Sullivan for approval of the notice of weed publication in the. papers, Motion carried unanimously. The council directed that a letter be written to Mr. Van Elsberg, Need Inspector, instructing him to apnear at the Nay 18th meeting of the Village Council for discussion of the weed situation in the village. Nor. Skiba, Plumbing Inspector, appeared before the council with information that a citizen of the village had complained to him in regards to the depth of wells allowed to be built by contractors within the village. The complaint was stated that his well has been causing much trouble because of the shallow depth. After much discussion of the depth of wells in the village the council` felt that this was not a council problem and that the owner of said property must ask relief of this situation from the contractor who installed such well. Motion by Sullivan, seconded by Christensen to approve an expenditure of not more than $75.00 to be used by Mayor Gibson in connection with his attendance at the Minnesota Municipalities Coneention. Motion carried unanimously. Motion by Christensen, seconded by Sullivan that the Civil Defense Director be allowed to order necessary badges and ceps for new men graduating from Civil Defense classes. Motion carried unanimously. Mayor Gibson read a letter addressed to Trustee Achterkirch from the aief of Police, Johan Och, stating with regret that he wan tendering resignation effective May 31st, as per letter directed to him at t?e last neeting of the Village Council. Meeting was set for May 6, 1959 at 9:3C P.I'. at the Vi'_laee Hall with the Police Commission and the Council. 69 Meeting was set for May 9th at 7:00 P.M. for tho council to meet with the police officers and dog catcher to discuss the dog situation in the village. Motion by Sullivan, seconded by Smith that in view of the raid conducted by the Mayor on the Meadow Brook Inn and of the results steming from such raid the license of the Meadow Brook Inn be taken away for 60 days effective immediately. Motion carried unanimously. Motion amended by Sullivan that the council suspend the beer, dance and cigarette license of the Meadow Brook Inn. _Seconded by Smith. Motion carried unanimously. After discussion'betkeen Mr. Comstock, the village engineer, and the council a motion was made by Christensen to amend a previous council motion to approve the sewer and water contract to be forewarded to the Mouse and Home Finance Agency and sign such contract showing good faith between the village and engineer. Motion carried unanimously. Motion by Gibson, seconded by Christensert that Project 1 of 1959 State Aid Survey be accepted and that engineer, Mr. Comstock, work with the Minnesota Highway Department in complating the state highway study for Mounds View. A special meeting of tho Village of Mounds View was called to order at 10:15 P.M., Wednesday, May 6, 1959, at the Village Hall, 1450 est Highway 96. The following members were present: Mayor: James S• 1. Gibson Clerk: Earl E. Smith Trustees: Reuben G. Achter?tirch Melford C. Christensen John L. Sullivan Special meeting convened at 10 :15 P.M., Wednesday, May 6th to decide the case of Mrs. Wagamon Sons, proprietors of Meadow Brook Inn, in the revocation of the Malt Liquor License and Dance License at said establishment by action of the council on May 4, 1959. Action was taken by the main fact that a minor was arrested who admittedly had a drink in the place and had in his possession a falsified identification card and a drivers license which had expired in 1958. Smith Clerk 71 Motion by Achterkirch seconded by Sullivan that the council concur with its previous action and uphold the suspension of the aforementioned licenses for a period of 60 days commending from date of May 4, 1959. Motion carried unanimously. Motion by Christensen seconded by Smith to adjourn meeting at 1:25 A.M. Thursday morning. Motion carried unanimously. Achterkdreh Melford Christensen Meeting called to order et 7:14 P.M. May 7, 1959 at the home of Mayor James Gibson for discussion of the Meadow Brook licenses. The reason for altering the original suspension reducing the term to 10 days was considered after further investigation and finding that the violation *gas more 1f1Y GO of a minor nature than originally believed. The proprietors of the Meadowbrook had been doing there utmost to keep the minors out of their establishment. Motion by Achterkirch seconded by Smith that the suspension be modified to ten days, and that 'any further violations will be grounds for permanent revocation of the licenses. Motion carried unanimously. Meeting adjourned at 8:10 P.M. Sullivan Deputy Clerk: Betty Walbridge Legal Counsel: Richard Meyers Treasurer: Irene Edberg The Clerk read the minutes of the meeting of May 4, 1959 and the following corrections were made lemeto. In Paragraph #3 stating the appearance of Mr. Dahlberg before the council requesting Division of Lot 86 Spring Lake Park Knolls Addition that sentence is corrected to read requesting Division of Lot 86 Spring Lake Park Hillview Addition. In Paragraph #4 stating appearance of Mr. George Gustafson before the council requesting sub— division of Lot 69 under Sub 89 that sentence is corrected to read under Lot 69 under Auditor's Sub 89. Paragraph #10 stating a motion that T signs be installed on Jackson Drive, Pinewood, Terrace, Oakwood and Hillview is corrected to read that a curve sign be installed at Pinewood Drive and T signs installed on the other aforementioned streets. In Paragraph #5 regarding the appearance of Mrs. Bacon before the council in discussing the incinerator problem that portion of the parasraph stating that Mayor Gibson had stated that the members of the council would read the report and make disposition thereof as soon as possible is stricken from the minutes. Motion by Sullivan seconded by Gibson that the minutes be approved as amended. Motion carried unanimously. The Clerk read the minutes of a special meeting of the Village Council on May 6, 1959 and the minutes were corrected to read that the meeting nes called to order to discuss the Cade of Mrs. Wagamon end Sons, M eadowbrook Inn, instead of called to order to decide the case. The minutes were also corrected to red that the Malt Liquor License and Dance License were suspended instead of revoked ar stated in the minutes Motion by The Clerk road the minutes of a special meetir at the 1,oe of James I:. Motion ere" amended motfon secored by 2u1liv-in notion carrie unanimously. 74 Mrs. 1ilson appeared before the council regarding the division of lot 86 Spring Lake Park Hill1iew Addition requesting the council take action regarding the division of this lot. n view of the fact that the sub— division of this lot has not yet been presented to the Planning Commission it was decided that this request be tabled until the Planning Commission has returned the request of this sub division to the council for action on June 1st, 1959. Miss Sandy Taylor, a member of the committee appointed to read and study the Curfew Ordinance appeared before the council with the Civil Defense Director, Mr. Rusted. Miss Taylor dated that insofar as the teenagers were concerned who were members of the committee, the Curfew Ordinance seemed to be fair in all respects. The council amended Section 4 of the Ordinance to read "The Mayor, upon the request of the i Superin— 5bte leader tendent of School or other responsible youth youth l.auai• in the Village of Mounds View may designate certain nights during the school year as "School Nights" or "Youth Nights Motion by Sullivan, seconded by Christensen to approve Ordinance #57, Curfew O rdinance, as amended. Motion carried unanimously. Mr. Charles Bubar, a representative of the Northwest dydrogas Company, appeared by request of the council regarding a heating contracting license. Mr. Bubar stated that the 'Northwest ydrogas Company installed the gas tanks and extended the lines into the house with a shutoff valve and that to his knowledge a heating contracting license was not required unless installation of the tank and line was made to an appliance. After review of the building code and an interpretation of this code by the village attorney it was agreed that such installation did not require a license and that minor repairs of such installations after the original installation also did not require a license. Mr. Van Elsburg, the weed inspector for the village, appeared by request of the council in regards to the eradication of noxious weeds. Mr. Van Elsburg was instructed to use chemicals on public property only and that use of chemicals by the weed inspector on private property would not be compensated for by the village. Mr. Van Elsburg was also instructed that if he used chemicals on private property bills for such service should be submitted by Van Elsburg to the county for collection. Motion by Gibson, seconded by Sullivan that t1°.00 be given to the Planning Commission for expenses incurred ',y thst committee. 1°a otion carried unanimously. Clerk Smith pointed out, however, that monies expended by the Planning Commission must be accounted for and submitted to the Clerk for purpose of future financial statements. Mr. George Chabot, 2474 County Road H arneared before the council requesting the moving of a garage into the village to be placed on his property. Mr. Chabot was instructed by the council to comply with Ordinance #62 subject, Moving of Houses into the Village, and submit an application according to that ordinance. Mr. Rusted, Civil Defense Chairman, appeared before the council requesting that the 1956 police car currently to be disposed of by sale be turned over to the Civil Defense for use by that organization. The release of said police ca- to Civil Defense was tabled until the June 1st meeting pending the investigation of :Hatching funds by the Civil Defense organization and the rendition of a report to the council at the June 1st meeting. Clerk Smith read a letter from tor. Rer.trup w'o had requested to appear et the May 18th meeting of the vi11nre council hut was absent to an alleged sickness. By Mr. Bentrup's letter it was stated by him thr-.t he would rot erperr at a village council meeting as requested due to an opinion h'; Mr. pentrup that the council lacked the authority to request his arnear for Tiest5 oning the remodeling of the ouse at 8159 75 Red Qak Drive. The building inspector, Pir. ioort::, appeared before the council with the- original; plane submitted by Mr. Bentrup ghowing the propoaed deling of the house in -.question and that this house did not comply with the structure of the original plans. It was also brought to the attention of the council that +I`1r. Bentrup'hed installed-50 feet of drainfield on his proporty, installation by; the Gilbertson &'S+urface' Company. Motion made by Gibson, seconded by Achterkirch that a letter be written' to Gilbertson Surface in regards to installation of such drainfield without a permit and that a double permit fee be requested and that the firm be instructed that further violatinns of the permit may cause the suspension or revocation of their license,' Motion carried unanimously. Motion by Achterkirch, seconded by Gibson that the resignation of the Chief of Police, John Och, be accepted. Achterkirch, 'Christensen,'Sullivan, Gibson aye. Smith no. Motion, carried. r r A report was read by Trustee Achterkirch regarding the position of Chief of Police after May 31st that the Police Commission recommended that the ranking officer, Sergeant R obertus, fill this position, on a temporary basis. It was requested by the council that the police commission obtain a new Chief of Police within six months. Motion`, by Gibson that the police officers be compensated for extra time worked other officers are on vacation and When the reduction of the force is in effect 1st. Motion lost for lack of a second. A discussion in regard to the police radio in tl:e 1956 police vehicle to Donald Bona, the village dog catcher was tabled until further investigation is made by the council. The following items on the Agenda were tabled until the June 1st meeting of the Village Council: The Fire Prevention Ordinance. A Letter from the Post Office subject of which is unknown. Resolution concerning the League of Municipalities. The discussion of claim vouchers recently acted on in the State Legislature. The discussion regarding the subject of recreation. The council was advised of a meeting of the Pamsey County Municipal Officials would be held at the Roseville Village Hall on Hay 27 at 8:00 P.I. in regards to garbage proposals and the problem of garbage incineration by municipalities. A meeting was called to be held with the Local Planning Commission on Saturday, May 23, at 3:30 1'.I'. A meeting was called between Fayor Gibson; John Koontz, building inspector; ::ally Skiba, heating inspector; and Trustee Achterkirch, who were to meet at the Babins1 -1 housing project at 7:00 P.M., Tuesday, "ay 19, tc inspect the transit chimneys which are being built on said houses in the Twelve Oaks A:Idition Hod 0a;, Drive. Said division is east of Long Lake Road and classified as R104, west of Long Lake Road is classified as R105.
