Gibson at 8 :00 P.M. on October 6, 1959, at the Village hall, 1450 West Highway The folloTting members were present: Mayor: James W. Gibson Clerk: Earl E. Smith Trustees: Ilelford Christensen Donald Hodges perry Na lvin Deputy Clerk: Betty Walbridge Legal Councel: Richard Meyers' Engineer: C.V. Comstock Mr. Robert Hook appeared before the council in regards to his application for a building permit for the erection of aparement houses on County Road I east of the Sunrise Methodist Church. Motion by Gibson, seconded by Christensen that a building permit be fee granted as Mr. Hook had complied wits the requests of the council. Motion carried unarimo>sly. Mr. Wallace Groberg appeared before the council in regards to his application for several building permits. Mr. Allan Crane, Chairman of the Planning Cormi ^lion, reported on his findings. The council recommended that the applications for building permits be given to the building inspector for further action stating certain conditions to be met providing i'Ir. Groberg submits new applications: In regards to Mr. Groberg building multiple dwellings on County Road I west of Adams Street it was suggested that the recommendation of the planning commission be complied with and that Mr. Groberg fulfill the requirements of this recommendation and of the building code an submit the necessary documents to the building inspector before the building permits are issued. Motion by Gibson, seconded by Malvin that 1 r. Groberg be granted a special use pert it for the construction of an addition to tle service station building and that he conform to tie building code and requirements of the plumbing inspector and building inspector in regards to construction of the iuil The .above motion stricken. Notion by Gibson, seconded by Christensen that .T•:r. Motion by Christensen, seconded by Hodges to table the resolution regarding North Suburban Hospital Association entering into a hospital district subdivision until the can obtain further data or a retort which can be studied when available from the Hospital Association. Gilson, Hodges, Christensen, li alvin, aye; Smith, absent. Motion carried. Motion by Malvin, seconded by Christensen that the council forward a letter to the Highway Department rejecting their plans. Gibson, dodges, Christensen, 1 Ialvin, aye; Smith, absent. Motion carried. David W. Anderson appeared before the council in regards to Lot 56, Spring Lake Park Hillview Addition, East 86 feet of the north 117 feet of Lot 56. The lot Mr. Anderson wishes to build on does not have a large enough area for a drainfield and his neighbor's drainfield is on this property. The problem of Mr. Anderson was referred to the plumbing inspector and if he can work out the problem with his neighbor a building permit will be granted. Mr. Howard Nelson, 2204 Lois Drive, appeared before the council to complain that Earl Smith inferred that he had the authority of a police officer. The opinion of the attorney was that this was not a couneil matter. Mr. Kenneth Ballinger appeared before the council in regards to the allocation of more funds for Civil Defense in the 3960 budget and also requesting that .the Civil Defense be given the old police car for u9e as a rescue vehicle. According to the Chief of Police; and a mechanic interested in purchasing the car, the vehicle is in very poor condition,,: worth approximately $15 The sale of the police car tabled and the +condition of the car to be investigated and a report returned at the next meeting. Mayor Gibson will meet with Kenneth Ballinger and (.'ivil Defense Director, Ingram liustad, in regards to the police car and report at the next meeting. Allan Crane, of the Planning Commission, suggested the council concur with Spring Lake P :fec 'Till„aee in the presentation of a resolution to the Minnesota Highway Department to increase efforts to complete the re- lane on Highway 10 from the junetion of highway 8 to the west limits of our rillade. 109 31 Chief of Police John Robertus presented a letter to the Council from Patrolman Schaffhausen tendering h's resignation October 16, 1959. Motion by Gibson, seconded by Hodges that Roy Schaffhausen's resignation be accepted and Mayor Gibson to write a letter to sir. Schaffhausen. Gibson, Hodges, Malvin, Smith, aye; Christensen, abstain. Motion carried. Motion by Gibson, seconded by Hodges that Officer Rustad's salary be increased to per month effective October 16, 1959. Motion carried unanimously. Motion by Gibson, seconded by :smith to promote Officer Grabowski from patrolman to, sergeant effective October 16, 1959 with a $10.00 per month increase in salary. Motion carried unanimously. The ordinance regulating burning in the village tabled until the next council meeting after study by the council. Motion by Gibson, seconded by Malvin that the County be authorized to do the necessary patching of Village streets and to pl4ce a request with the county for snow plowin;. Motion parried unanimously. Motion by Christensen, seconded by Malvin that a streetlight be installed at the intersection of Sherwood Road and Eastwood Drive. Motion carried unanimously. Motion by Gibson, seconded by Ilodges that the Village Engineer be instructed to bring the plat maps up to date and a copy be given to the Planning Commission. Motion carried unanimously. A letter to be directed to the County Auditor, County Assessor, and County Engineer's office that when plats are filed with them, a separate file be kept for our Village Engineer so that our plat maps in the future may be kept up to date without a considerable amount of searching. Motion by Gibson, seconded by Christensen budget for 1960 of 319,500. for Road Bridge Fund, 324,500. for General Fund. Motion carried unanimously. for approval of the Mrs. Alice Frits reported the hockey rink has been moved to Edgewood School. Mayor Gibson appointed a committee of Allan Crane, Walter Skiba, Robert Edmond and the Mayor to draw up a to present to people requesting subdivision of a piece a building permit, etc. Meeting Monday night, October 110 Motion by Christensen that all the books over which the Clerk has jurisdiction and is required to keep be kept in whichever place or whatever place is safe in his opinion whether that be in the fire proof file in the office or whether it be in a fireproof file in his home or wherever it may be in his opinion. Motion lost for lack of a second. The subject of Clerk Smith stating he could not find enough time to properly fulfill the duties of his office was discussed by the council. Smith stated that due to other council business requiring all members, his time was limited in conducting office procedures, maintaining financial records and proper supervision of the office. Smith submitted a request that the office be open all day Saturday from 8 :00 until 5 :00 o' cloo:;. .3d that he would give up his present part time job in order to comply with the demands made previously by Mayor Gibson. Smith also proposed that the Deputy Clerk's hours be adjusted as to time and days of duty in order to compensate for the aforementioned Saturday duty, in order to avoid additional Village clerical costs. Attorney Meyers read several Attorney General's opinions regarding such requests, who have held that a Clerk's salary .an be adjusted only at the beginning of his term. Attorney Meyers stated that by a request of the council he had checked the liquor laws and that the village could not act on any petition request for liquor until the village was incorporated for a period of two years. Allan Crane had an opinion in regards to a liquor license for the village. He will check with the attorney and report back at the next meeting. The attorney reported that we cannot give money for the Teen Club as requested at the last council meeting. A letter was written to the Mutual Insurance Company by the Village Attorney informing them the Village hall at 1k50 West Highway 96 has been sold. The matter of a resolution for the issuance of Village Warrants bearing 5°o interest up to the amount of $10,000. referred to the attorney to report back at the October 20 meeting. Chris Piehowski, short procedure of property, 13 at 7 P.M. Meeting to be held in the Village office, October 15, at 7 :00 P.5!. with the Village Attorney, Village Engineer and Village Fiscal Agent with the Village Council to go over the water report of the Village Engineer.
