HomeMy WebLinkAboutMinutes - 1960/05/02The special meeting of the Mounds View Village Coun ^il was called to order at 8 P.M., May 2nd, 1960, at the Arden Hills Village Hall, 1450 W. Hwy. 96, New Brighton, 12, Minnesota. Present were: PROCEEDINGS OF THE VILLAGE COUNCIL 630027 VILLAGE OF MOUNDS VIES'! RAMSEY COUNTY, MINNESOTA Mayor: Allan B. Crane Clerk Earl E. Smith Trusteest Melford C. Christenson Donald Hodges Perry Malvin Attorney: Richard Meyers Engineers: E.V. Comstock Lester Knutson Fiscal Agents: Mr. Ehlers and Mr. Mann Previous to the meeting ayor Crane called for bids on the Project 1960 -1 on two occasions and promptly at 8 O'Clock he announced that the bids were closed. The meeting then opened with the reading of the bids by the Clerk and by the Engineer, Mr. Comstock, :aid after the bids were rand it was announced that the low bidders names would be announced at the next council meeting on May 9, 1960. Motion by Crane, seconded by Malvin to accept and approve all bids for Project #1960 -1, 5 ayes, soticn n The subject of the liquor ordinance was again presented to the council by Mayor Crane and Trustee Christensen reminded the council that in order to legally vote on the liquor question main a motion must be made to remov.: the liquor ordinance from the table as said ordinance was tabled at the previous meeting. Motion by Hodges, seconded by Malvin to remove the liquor ordinance from the table. 5 ayes, motion carried. A lengthy discus;'on followed from the citizens assembled and members of the council regarding the subject of municipal liquor,police protection, private licenses concerning the liquor problem. Motion by Kalvin, seconded by Hodges to adopt the liquor ordinance as corrected. Crane, Malvin, Hodges, .::e; Christensen and Smith, no; motion carried. A report was given to the council by tha Planning Commission Chairman, Mr. Stole, stating the action taken in the following cases: request by Mrs. Bacon for filling station site to bo rezoned,tabled by the Commission; setback variance request by Ir. Wayne Larson, recommendation to be given to the council at the next meeting; request by Mr. Braaten for subdivision of a lot and to build a secon building site on one lot for the housing of antique cars, recommended by Commission that request not be approved. Motion by Crane, seconded by Smith to deny the application for rezoning and subdivision of Mr. Braaten's property and the building of a second house on the division of one lot for the housing of antique automobiles. 5 ayes, motion carried. Proceedings of the Village Council 5/2/6o 030528 The Planning Commission also stated that the Commercial Trailer Sales and Service request for rezoning and building of two buildings for Sales and ,Service receive tentative denial for approval by Commission but to be acted on officially at the next Commission'meetinge The application by Mr. Groberg for an addition of a 100 foot building onto the first addition on the Cities Service. Gasoline station on County Road `I and Adams be returned because of the fact that said building does not conform with the subdivision regulations and that the following items are not shown in the plans presented to the council by Mr. Groberg: No lot contours. 2. No soil tests, 3. Designers name not present on plans. 4. Parking area questionable. 5. No provision for sidewalks. Motion by Christensen, seconded by Smith that the above items be conformed to by the builder, Mr! Groberg, before approval or final approval of the building can be given. 5 ayes, motion carried. Mr._ Groberg, who was present at the meeting, stated that he was submitting new plans in conformance with these requirements. Mr. Stole brought up the subject of a Industrial Developmpent committee and suggested that such committee be formed by the council for that purpose. He also suggested Mr. Arthur McClure and Mr. George Gustafson be appointed to this committee. Matter was tabled for further study by the council. The subject of a division of a lot for Mrs. Bak was discussed and motion by Christensen, seconded by Malvin that preliminary approval for division of said lot be granted pending approval by the Planning Commission at their next meeting. 5 ayes, motion carried. Mr. Weaver, attorney for Mr. Wallace Groberg, presented the information regarding the water problem on Mr. Groberg's property on Bronson Drive and that he understood that the council had approved building of that property by Mr. Groberg providing adequate protection be taken regarding the storm iwater run off into the area behind the proposed building project. (It was mentioned that possibly a storm fenc:> of some kind could be erected around the hazardous area). Mr. Weaver was informed by the council that the only solution to the problem would be to drain this water by storm sewer system and that approval for the building project had not been granted at this time due to this condition. Clerk Smith read a letter to the council regarding the issuance of a receipt for each check submitted for the building projects on Bronson Drive which was requested bI Mr. Groberg. Motion by Christensen, seconded by Crane to return the checks for each of the building projects on Bronson Hrive and for the proposed building of the 100 foot addition on the gasoline station on County Road I and Adams Street, said checks to be mailed by registered mail. Crane, Christensen and Smith; aye; Hodges and Malvin, no. Motion carried. The building inspector, Mr. Chris Piehowski, presented a summons to the council which was served on him by a sheriff's deputy which was prepared by the attorney for Mr. Groberg. Said summons prepared by a complaint by Mr. Groberg that Mr. Piehowski maliciously served Mr Groberg with a warrant for him to appear in the justice Proceedings of the Village Council 5 /2/60 G 0 29 court for non performance of the building code Li, respect that he did not have a building permit for the addition which Mr. Groberg is building on his home. Upon questioning the attorney for Mr. Groberg and Mr. Groberg himself the summons had been prepared and the fact that Mr. Groberg was not the owner. of the house but that the property was in the name of his wife, Clerk Smith questioned Mr. Meyers, attorney for the village, to the effect that Mr. Meyers had accompanied Mr. Piehowski when Mr. Piehowski had red tagged the property in question for non compliance to the building code. Mr. Meyers stated that he did accompany the building inspector and in view of that fact such action has n' doubt made him_a witness to the act. Motion by Crane, seconded by Smith to refer the summons to the attorney for the village. 5,ayes1 motion carried. Motion by Crane, seconded by Malrin to return.the•plans concerning the building of the 100 foot addition to the g soline station on County Road I and Adams by Mr. Groberg as said plan does not comply with the building code. 5 ayes, motion carried. It was also mentioned that concerning the property on Bronson Drive presently under construction by Mr. Groberg and in view of the fact that the builder, Mr. Groberg, has created a deep hole in that area by the remo■*al cf earth it was discussed that a hearing should be proposed to d termine the feelings of the people in the immediate area especially :in regards to the safety of the children of the surrounding families: No immediate action taken on said hearing♦ Mr. Piehowski, village building inspector, stated that the Mueller Bros. were presently building on another section of their property without a permit and that he understood council action would be required concerning the property in question: Motion by Smith, seconded by Malvin that the Mueller Bros: apply for sub- division of the plat or property in question. 5 ayes, motion carried: The attorney read a resolution appropriating and requesting funds for engineering studies by North Suburban Sewage Committee of which the village is a member. Motion by Christensen, seconded by Smith to adopt the resolution appropriating funds for engineering studies by the North Suburban Sewage Committee. 5 ayes, motion carried. The engineer reported that the final plans for the Project 1960 -2 the construction of laterals in the Pinewood area and Twelve Oaks area have been completed and that bids should be called as soon as possible. Motion by Crane, seconded by Hodges to accept the final plans for Project 1960 -2 and order the advertising for bids to be held at the Arden Hills village hall at 8:00 P.M. on May 31st, 1960. 5 ayes, motion carried. The engineer also reported that the section maps could be purchased through H. A. Rogers Company for a small sum of 32.72, which is a service given by that company to the village which would cost much more to private individuals and other companies. Motion by Crane, seconded by Malvin that a check for 32.72 be prepared for the purchase of section maps from H. A. Rogers Co. 5 ayes, motion carried. E. Village Clerk.__ 0JOE 32 Mr. Robertus the Chief of Police of the village presented speoi- fioations for a new police vebiole whioh was recommended by a latter from the county attorney which'which was recommended by a Grand Jury that all police vehicles of 561600 miles of service or more be re- placed. Said specifications referred to the clerk for presentatiion at the next met1ng. Mr: Robertus also read the polioe report for the month of april which was placed on file in the village office. Motion by Malvin seconded by Hodges to a4joura at 11:03 p. mm. EXTRACT OF MINUTES OF MEETING OF THE VILLAGE COUNCIL OF THE VILLAGE OF MOUNDS VIEW, MINNESOTA Pursuant to due call and notice thereof, a special meeting of the Village Council of the Village of Mounds View, Minnesota, was held at the Arden Hills Village Hall in the Village of Arden Hills, Minnesota, on Monday, May 2, 1960 at 8:00 o'clock P. M., with the following members present: Cane, Smith, Hodges, Christensen Malvin and the following members absent: None. The Clerk then presented Affidavits of Publication in the official newspaper and '_n the Construction Bulletin of a Notice to Contractors to submit bids for the construction of Waterworks Improvement No. 1960 -1. Saic3. affidavits were examined, approved and ordered filed.
