The regular meeting of the Mounds View village council and executive staff wart called to order by !acting Mayor Christensen at 8:06 P. Ml on Monday, June 13, 1960 at the Rod Oak School, Sherewood Road and Red Oak Drive. Members presents Clerk Earl E. Smith Trustees: Melford Christensen Donald Hodges Perry Malvin Attorney: Engineer: Member absent: Mayor Richard G. Meyers Lester Knutson Allan B. Crane Acting Mayor Melford Christensen opened the meeting by announcing the low bidder on the water works improvement 1960 -2 as Sandstrom and Hefner, Inc. Motion by Hodges, seconded by Mal- vin, to award the contract for water works improvement 1960 -2 (laterals in the Pinewood area and Twelve Oaks area) to Sandstrom and Hefner, Inc. 4 ayes, motion carried. Acting Mayor Christensen than mentioned that the assessment roll for the waterworks Improvement program was to be prepared in the immediate future which entailed much detailed work and the council had decided that the firm of Comstock and Davis would be the logical firm to complete this task.. Motion then made by Malvin, seconded by Smith to authorize Comstock and Davis Village Engineers to prepare the assessment roll for -rater Project 1960 -1 and 1960 -2. Cost of said preparation to be 1 per -cent of the construction cost. 4 Ayes, motion carried. Motion by Smith, seconded by Malvin to authorize Comstock and Davis to separately contract with inspectors required for the daily inspections of the waterworks construction projects as dis- cussed previously at an adgenda meeting with the council and Vil- lage Engineers. 4 ayes, motion carried. The question of the placement of water lines from the mains and laterals to each individta4 home in the village was raised by some of the citizens present at the meeting and as previously discussed at the adgenda meeting, the Attorney for the village was instructed to prepare an Ordinance covering the specifications for construction of water linos from the mains and latterals to each home. Mr. Glen Dawson, a member of the Police Commiesion reported on the activities of that commission. He stated that the commission had interviewed throe men for the job as patrolman and after careful consideration+ recommended that Mr. Carter Caldwell be hired for tho job as patrolman. Melford Christensen then asked Chief Robertua if ho concurred with the comskission's recommendation and received an affirmative answer. The question of salary to be paid to Mrl Caldwell was then dis-. cussed and Mr. Robertus stated that he thought Mr. Caldwell should start at the same rate as previous patrolmen at $75.00 a month, retroactive to Juno let at which time Mr. Caldwell had begun his training with the Mounds View Village Police Force. Motion by Hodges, seconded by Malvin to hire Carter Caldwell as police or- floor at $75.00 per month retroactive to June 1, 1960. 4 ayes, motion oarried. Mr. Chris Piewhowski, Building Inspector for the village, appeared before the council and reported that he had received an application from a Mr. Theodore U. Holston for building of a double bungalow on land zoned class A residential. Mr. Piehoweki was instructed to return the application to Mr. Holston with in- formation that the applicant would have to apply for rezoning with the Clerk's Office and the application cleared through the Planning Commission in order to build double bungclows in the location desired. The subject of Northeast Construction building fonrplexea instead of duplexes as required in their building permits was again brought to the attention of the council. The Village Attorney, Mr. Meyers, reported that there are only two ways to correct the situation, Ono was to take them into Justice Court and the other by issuing an injunction against them. The ceeneil then instructed the building inspector to take action against tho proper parties concerned in Justice Court and see that the permits for duplexes be produced. Motion by Smith, seconded by Christen- son to instruct the Building Inspector that when court action is brought against the Northeast Counstruction Company (MA. Donald Babinski) that Mr. Babinski be instructed to produce his permit and plans for the duplexes and the Building Inspector determine whether Mr. Babinski is conforming to the plans or if not, coaso from the non conformance of said plans and that is such is not done by the builder, the council to take action in the form of an injunction against the builder. 4 ayes, motion carried. The question of licensing builders in the village was die cussed by the council as to what legal work can be carried on by the builder holding a General Contracting Liceneo. The council decided that all General Contracting applications should be ohacked for by the Village attorney for legality. Mr. Carl E. G. Larson appeared before the council regarding the zoning of His property which onco held a commercial zoning and was changed under tho new rezoning. Mr. Larson presented a copy showing the proper zoning of his land by legal methods in 1948, and ho mentioned that a former council had rezoned his land to commercial at that time. Mr, Larson was referred to thn Plan- ning Commission fur intvasLsgatian of the change in his zoning by that committee. Motion by Hodgos seconded by Malvin to approve tho following bills for payment. 4 ayos motion carried. GJ0048 Tho subject of cutting woods and xlxxxlt spraying of nox- ious weeds in the villago was brought to the attention of the council and Mr. Richard Birdsall, :reed Inspector for the villago, was instructed to start cutting woods and all necessary spraying as required by law. subjoct of the purchase of a tractor by the village was discussed which is equipment necessary for cutting weods on parks and playgrounds and for tho upkeep of village property. ?;otion by Christenson, secondod by Malvin that tae council -authorize purchase of the Ford Tractor from Richard Birdsall or the sum of 0750.00 with the understanding that the equipment ir. Birdsall has for the tractor be included in the purchase price. 4 ayos, motion carried. The 'Toll Inspector, Mr. Skiba presented a question to the council concerning the construction of now houses on proporty whore the mains and laterals aro to bo placed. He stated that the council had amended the well ordinance to provide for greater depth of wolls but that tho buildors constructing housos where wator will bo available, fool that whero they had to provide deep walls it would be a disadvantage to them when water would be avail- able to those housos in a short time. Mr. Skiba was informed that said buildors or i. -rsons desiring to build homes on streets to which water would be available shortly, could waive tho deep well requirements and construct a shallow asa well on their pro- perty providing they sign a wator hook -up agreement with the vil- lago which includos a provision that said builder or ownor will hook up with the village water system as soon as it becomes avail- able on that stroot and to said house. The water hookup agree- ment will become part of the records on file in the county court- house concerning that home. Clerk Smith road a letter from the Northern States Power Company concerning installation of gas at 5055 5057 and 50 5099 Sunnyside Road. Council instruct Clerk to h ve Deputy to call Northern States Power to inform thaem not to install gas at the aforementioned adressos. Motion by Malvin, seconded by Hodges to adjourn at 10:07 P. M. 4 ayes, motion carried. On advice of the Attorney the meeting was again called to order by the council at 10:17 p. m. to consider the matter of instructing tho V_llagc Enginoor to have the well driller proceed with the construction of the woll. The Attorney was instructod to draw up a form for the contractor to sign regarding the well construction to reloase the village from any damages which might be incurred by the contractor as a r,sult of this action. 4 ayes, motion carried. lotion by Smith, seconded by Christensen to adjourn at 10 :20 P.
