Comstock Minutes of the previous r,eetin; were tabled for readin,• due to the absence of the Clerk, who was attendin; election duties. I :r. Stole, Chairman of the A.anning Commission, reported on the minutes of the meeting of that Committee held August 23, 1960. hr. Stole reported on the followin; requests for action by the ilannina Commission: (1) Request by 3ror.son- Erickson to sub- divide a portion of Lot 62, 1nollwood'Park, Ramsey County into three (3) lots accordin; to a sketch submitted; (2) request by Er. Simon of Simon's Grocery located on :pry. 10 and i:nollwood for a setback variance in order to build an addition onto his store to be used for a liquor store. The request by Bronson Erie :eon to sub divide Lot 62 was discussed by the Council and motion by Christenson, second by Malvin that said company re-submit a subdivision for the entire lot in accordance with the rccomriendaticn of the iTanning Commission. 4 ayes, motion carried. The second request submitted to the :lnnnin; Commission con cernin; the variance setback requested by I"r. Simon .;as discussed at previous neetin-s and the Council concurred that said variance should not be arproved. To formalize this action, Mayor Crane moved, Christenson seconded to deny ir. Lind appeared before the Council requesting subdivision of Lot No. 73, S Lake Park Hillview Addition into two lots- -110 ft. wide and 132 ft. wide. Upon quostionin, Mr. Lind; the Council was inforaled that Kr. D..hlmeier was the true owner of the property concerned and that Mr. Lind could not legally make application for the subdivision of said land. I;r. .:r.;ne therefore suggested that hr. Li take no action on this until formal application for sub- division -,r. ..c•.hlmeier has been made in the Village Clerk's office. Mr. slenn ,.awson, .d ice ;oom'_ssion member, read the monthly •olice report, hich is on filo in the Clerk's office and also submitted the following recommendations to the G..•uncil: (1) to call for bids for a new 1961 police car- -said bids to be submitted Kit :1 without a trade -in; (2) :Recommendation that the Council submit an ad in the legal newspaper and such other newspapers as may be desired, notifyin„ those interested that applications will be t,`en to fill the position of patrolman in i-.ounds View Village. Mayor Grano instructed tho attorney to Prepare the bids for a ,lolice car and suggested that the closing date be delayed until all 1,61 models are on the market. a•.: yor Crane also rnn..unced that an ..dvertisement for police applicants was iiiserted in the previous week's newspaper. ,.c also stated that said applications would be Wept on file until such time as it is necessary to hire a patrolman. .ttrr_ey i:cyers ..resented the water assessment resolution to the Council for approval. Mr. Leroy i.rrsolias appeared before the Council and said that a draina, ;e ditch is boin„ constructed on his property and insofar as he knows, an easement for ouch ditch does not exist. Iir. Naroolias was infornod by the Council that the En ;ineor would in- veoti,ato thin and a further report would be Wade to the Council. The subject of replacement of tar or street surfacinG on Jackson Drivo at allview was brou=ht to the attention of the Council. The Eneinoor stated that this section was not included in the ori;inal construction bid and that it appears that the roconditionin..; of this street :could be the responsibility of tho Village instead of the contractor for the construction project con- cerned. It was also stated that the contracten firm of Sandstrom c i;afner would cican the streets after tho service connections are completed in the areas for which they contracted. hr. lialvin brou' ht to the attention of the Council the question of whether or not tho contract with tho construction firms contain a clause showin- whether the contractor is held or is not held responsible for re- soddinl; of boulevards. The Attorney was instruc- ted to examine the contract of ;rojects 1960 -1 and 1960 -2 to deter- mine this question. i.r. Stole su-,;ected that the individual resi- dents pay for their own re- so:'.din of bculovc.rds rather than on a villa -e aide basis, which wculd perhaps involve further assessments for such rc- sodding. Er. Christenson suC,ested that this may be covor•ed by the Nuisance Ordinance and that a complaint could be filed in the Justico Court if necessary. It was brought to the attention of t':e Council that a petition was delivered to the Council requesting the Council to restore the boulevards and streets to their normal condition on Terrace Drive between :iwy. 8 and ?uincy St. The question was posed as to what action has been taken or would be taken by the Council regardin3 this petition. Layor Crane stated that he would locate this petition and action would be taken thereon by the Council. Mayor Crane mentioned an item on the agenda- -said item a request by Firs. Squires for placement of a house trailer on their property. Motion by Crane, seconded by Hodges to deny said request. 4 ayes, motion carried. It was brou3ht to the attention of the Council that residents aro seeking information concernin; the specifications for the con- nection of inside plumbing to t water meter. The Council instructed the Engineer to investigate specifications concernin; this and repc:t to the Council at a future meeting. Motion by Christenson, seconded by i_alvin to approve payment of the bills (see list attached). 4 ayes, motion carried.
