The regular meeting of the Mounds View Village Council was
called to order at 8:12 P.M. by Mayor Allan B. Crane on November 14,
1960, at the Rod Oak School, located at Red Oak Drive and Sherwood
Road.

Mayor Crane called for bidsfor the police car and upon his
second call for bids declared the bids to be closed. Clerk c.-;
stated that he had received only one bid for the police car ihich
was read by him as received from the Midway Ford Company, 1850
University Avenue, St. Paul. 4otion by Smith, seconded by Christensen
that the bid be rejected due to the fact that the bid was made for
a 1960 car instead of a 1961 vehicle as quoted in the specifications;
and that the council again advertise for bids. 5 ayes; motion carried.
A discussion then followed on the date of closing of new bids and
whether or not the present car should be traded in. Mc;tion by Crane
seconded by Malvin that December 12, 1960, 8:00 P.M. be set as the
closing date for new bids on a 1961 police vehicle. 5 ayes for
approval; motion carried. The police commission members then stated
that they would contact dealers where possible and advise them of
the new closing date.
Mayor Crane asked for the reading of the minutes of the meeting
of September 26, 1960. Motion by Malvin, seconded by Christensen
that the minutes of the meeting of September 26 be approved without
reading as each member has had the minutes for etudy which was
received at the previous meeting. 5 ayes; motion carried.
The minutes of the mee.:ing of September 29, 1960 were not
presented due to technical information to be received from the fiscal
agent concerning this meeting. Said minutes not yet prepared.
The minutes of the meeting of October 10 were read by Clerk
Smith and corrected to read that the fourth paragraph Page 4 show
that Mr. Malvin and not Mr. Christensen had received the request
from the school district to paint crosswalks at school corners and
etc.. Motion by Malvin, seconded by Hodges that the minutes of
October 10 be accepted as read and corrected. 5 ayes; motion carried.
The minutes of the October 24 meeting were read by Clerk Smith
and Mayor Crane stated that the third pa ?graph on Page 4 should read
that he abstained from voting on the motion in that paragraph.

the page regarding the motion for advertising for water department

employees that the advertisement was for two part time employees
or full time employees instead off' kourA Trustee Christensen also
pointed out that the statement regarding the amount of water not
metered by the Neptune meter and the amount quoted in these minutes
as a cost to the users of the municipal water was figures which
were computed from the minimum charge for water used by the surround
ing villages and not a figure which will be used necessarily for
this village computing; the water rates. Attorney Meyers also wished
to clarify the statement on Page 6 regarding the deed for the land
at Hillview and Long Lake Road clarifying this that the Auditor's
office had stated that a tax abatement had been filed in 190E for
said land and that the deed would most likely be filed after that
time but had never been filed in the Auditor's office. Mr. Meyers
stated that he was looking for the deed but he wanted to make it
clear that he had not lost the deed since it had never been in his
possession due to the fact that at the time in question the year of
1956, Mr. Meyers was not the Village Attorney for the Mounds View
township. Motion by Hodges, seconded by Crane that the minutes of
the October 24 meeting be acEepted as corrected. 5 ayes; motion
carried.
The minutes of the November 9 meeting was read by Clerk Smith.
Motion by Christensen, seconded by Hodges to accept the minutes as
read. 5 ayes; motion carried.
Mrs. Ralph Peterson posed the question to the council regarding
the finishing of the streets which had been torn up by the
contractors for laying of the water lines. Mr. Knutson gave a
report on the progress on this item. Smith also asked what c•:uld
be done about Jackson Street in the Pinewood Terrace Addition which
was in very poor condition which had been patched in spots and also
other possible streets in the area which may be in no better condition.
Christensen stated that they had a list of complaints that he and
Mr. Frank Slipka of the County Engineer's office, had checked all
the roads twice and had contacted both contractors and covered the
village with each pointing out which streets and what had to be done
on those streets concerned.
Mr. Malvin asked again why the crosswalks at the schools had
not been marked as stated in a previous minutes as requested from
the school district. Trustee Christensen stated that the order had
been sent into the County Engineer's office but he would call and
follow up the schedule of work to be done.
Mr. Melberg appeared before the council requesting the council
consider the proposal for location of two service stations along
Highway 10 in the village. It was pointed out that the location
of one station would involve a rezoning problem and possible special
use permit. Said stations to be located on Highway 10 and Long
Lake Road and one at Groveland. Matter referred to the Clerk's
office for application for rezoning.

The plans for reconstruction of Highway 10 received in the Clerk's
office were presented by Mr. Lester Knutson of the Village Engineer's
office. Mr. Knutson pointed out the changes involved on the Highway
plan an what was involved in the village as far as access to said
Highway was concerned. Motion by Crane, seconded by Hodges to refer
the Highway plans for the reconstruction of Highway No 10 to the
Planning Commission for recommendation. 5 ayes; motion carried.
Mr. Crane stated that he had received a call concerning the
situation that a child had fallen into a ditch on the southwest corner
of the race track in the village and that the water was over the
child's head. Fortunately nothing serious had resulted from this but
the fact that the ditch was deep was considered a serious matter and
a detriment to the village. Trustee Christensen stated that he had
examined the full length of this ditch and found it to be stopped up
by the natural erosion of the sand back into the ditch. He stated
that he had called the state cepartment and suggested that they
recommend to the county that permanent improvements be made on this
ditch and that the Village of Mounds View council would consider
sharing the expense wherein it would be benefit Christensen stated
that he had received no reply concerning this since his call.
The Village Attorney brought up the subject of a letter regarding
the.rental ok the Arsenal sewer line. A copy of this lettet had been
forwarded to Mayor Ashbach of Arden: Hills and from what he had found
regarding this was finally determined that Mayor Crane was to meet
With Mayor Ashbach to discuss the sewer rental at the convenience of
both.
Mr. Knutson, of the Village Engineer's office, submitted plans
for water utility building which is to be built at the proposed site
of the new municipal center. Trustee Christensen reported On an
informal meeting of the Planning Commission and stated that in the
land use plan and also in the zoning code it was suggested that one
of three sites be considered for a civic center. One site located
at the junction of Long Lake Road and Highway 10; one across from
Mr. Walter Skiba's property and third site on the west side of the
triangle on the corner of Highway 10 and County Road I. No. 1 site
chosen by the Planning Commission is located in the area of the Foley's
tavern. The council concurred that the site chosen_ as the No. 1 by
the Professional Planner, Howard Dahlgren, be the best since the others
have certain conditions that did not seem to le -d themselves to a
civic eenter. Mr. Arthur McClure had been previously asked to
develop a plan for a civic center at the site No. 1 which he had
prepared and was presented to the council at this ime. Said plans
to be taken under consideration by the council and acted on at a
future meeting.
Mr. Knutson presented a letter from the Minnesota Highway
Department relative to next year's alottment of maintenance funds
under the National State Aid Quota for which the village is elligible.
Last year the village elected to receive 31,500 a mile which was
available to them. The other alternative was to take 25% of the total
State Aid alocation for the village which the village council decided
to pass. The alternative of taking the 25 percent total state aid
allocation involves an appreciable amount of bookkeeping and
accounting which had been considered by the council and which they

concurred th the 10 percent or difference between the alternative
would be consumed by bookkeeping or accounting cost. Mr. Knutson
stated that the Highway Department had to be notified in writing from
the village if the council elects to take the 25 percent for state
aid maintenance. Motion by Christensen seconded by Hodges to accept
the $1,500 a mile for state aid road maintenance rather than 250 of
the funds allocated to the Village of Mounds View for its state aid
roads. Upon the call of roll Malvin, Hodges, Smith, no; Christensen
and Crane, aye; motion lost. Mr. Knutsoh also asked that the council
approve the advertisement for bids on underground piping from the well
to the tower site to the distribution system allowing for the connection
within the well house structure. Motion by Crane, seconded by Malvin
to advertise for bids for the above piping on the 17th of November,
ar-i to receive bids on November 28 at 8100 P►M. 5 ayes, motion carriedl
Mr. Knutson also asked the council to consider and select a site for
a Second well which he stated should be started in the near future in
order to meet the heavy demand for water which will come next summer.
He also stated that approval for the advertisement for bids for this
new well would be desirable at this time. After discussion by the
council of the means of acquiring land for this new well it was decided
to discuss this matter before the next meeting and consider a decision
at that time.
The village attorney presented a resolution to the council advising
the Minnesota Highway Department of drainage problems along Highway 10-
62 in Ramsey County in which the village would like the Department of
Highways to take into consideration said drainage problem and its plans
and specifications. Motion by Crane, seconded by Christensen to
adopt said sssolution and forward it to the Highway Department. 5 ayes;
motion carried.
The attorney also brought up the subject regarding the deed for
Spring Lake Park Hillview Addition concerning Lots 7, 8, 25 and 26.
Said deed dated May 13, 1956. Motion by Christensen, seconded by
Crane that the attorney file said deed for the Hillview playground.
5 ayes; motion carried.
The Village Attorney also presented a resolution on the motion
for election of an adoption of optional plan A in which it was shown
the presentation of the question to be placed on the ballot. Attorney
Meyers stated that the Certificate of Adoption of Optional Plan A
has been drawn up and will be filed if passed. He also stated that
he has prepared a notice which should be published in the local
newspapers concerning this if passed. Clerk Smith raised question
of whether or not the Village of Mounds View could change he Optional
Plan A since the standard plan has not been in effect three years as
required for optional plans when adopted. The Village Attorney stated
that he had received a report from the Minnesota Leaque of Municipality
which stated that the three year limitation has no application to an
election on ono of the optional plans in a standard plan village

The subject concerning the reassessments for subdivisions which
are made after the assessments for water has been declared to the
County Auditor was brought to the attention of the council by the
village engineer, Lester Knutson. He stated that the reassessments
for such subdivisions could be prepared by that office or by the
Clerk's office whichever the council desired. Smith stated that he
felt the areas in question where lots are subdivided should be checked
by the engineers and possibly computed as far as the figures for the
depth and width of each lot is concerned. Motion by C rane, seconded
by Malvin that the reassessments for subdivisions be forwarded to the
Village Engineer for breakdown and compution. Upon discussion
Trustee Christensen suggested that a section map be forwarded to the
Clerk's office and that it be handled through the Clerk's office after
the first of the year however. Upon call of roll on the motion 5 ayes
for approval; motion carried.
The attorney gave a report on the condemnation of the O'Connell
property where the water tower and proposed pump house will be. He
stated that the O'Connells may take the case into court and if they
win the award would consider $2,500 per acre in this land which
includes possibly 7.1 acres of land. The award given by the commissioner
was stated by the attorney at approximately x1,500 an acre. Mr. Meyers
stated that they, the O'Connell peoples are open for negotiation
between the village but it was suggested by Trustee Malvin that the
council wait to see if the O'Connells file an action in court due to
the fact that negotiations can be carried on at most anytime in the
near future.
The village attorney also submitted a letter from the attorney
for John Robertus asking what action would desire to take in regards
to the defense and settlement of a law suit. Attorney Meyers
ecommended that the council take no action at this time because
.,aid law suit was not filed with the council.
Village Attorney also reported that Mr. Ahlers, Fiscal Agent
for the Village, stated that the village would be able to bond for
a sewer system even though it is only a five year contract, with
U.S. Gdvernment+ with the theory being that the village is pledging
its whole faith and credit for said system.
A member of the Police Department inquired whether or not the
village has an ordinance requiring people to stop for the police ear
and also whether they are required to tell the truth to an officer
when they are not under oath. Attorney Meyers was directed by the
council to draw up an ordinance covering these points if not already
covered by a subs ordiance.
Mrs. John Sullivan questioned the a,plication made previously
to the village by herself requestin she be appointed as an election
judge. She directed the question to Clerk Smith as to why she had
Mated she had not been considered and that such statement had been
made at the previous council meeting. Clerk Smith stated that he
had been informed that Mrs. Sullivan had left the precinct in the
middle of the work time and that said statement was noted on her
spplic:tion by the Clerk at that time. Smith stated that he had
contacted the clerk who was in charge of the election at that time
and it was stated that she had left the precinct due to sickness.

Mrs. Phyllis Blanchard asked the council in regards to the
peddlers permits whether they were necessary for the Camp Fire Girls
of which she is a leader, in order for them to sell candy in the
boundaries of the Village of Mounds View. Mrs. Blanchard was informed
that in accordance with the Ordinance they were required to have a
permit for such soliciting. Motion by Crane, seconded by Smith that
the Camp Fire Girls be licensed and the fee be waived for the sale of
candy in the village.

Smuts Explorer unit of which Mr, William Frits is a leader, be given

motion 5, ayes, motion carried.
The Police report was given by Mr. Robert Eickstedt which is on
file in the Clerk's Office. Mr. Eickstedt also tendered his resigna—
tion from the Police Commission effective November 14th, 1960 because
of other duti s. Motion by Hodges seconded by Christensen to accept
Mr. Eickstedt 's testgnation effective November 14, 1960. 5 ayes,
motion carried. Smith then asked Mr. Eickstedt if it was allright
with him if the village council forwarded a letter to his superior
on the Highway patrol where he is appointed af. a Highway Patrolman.
Motion by Christensen, seconded by Hodges to approve payment of
a bills. This also includes payknent of 03,909.03 to the Herbst
_.nstruction Company and ;13,996N8O to the Chicago Bridge and Iron

Motion by Hodges, seconded by Malvin, that the council hire halter
:.kiba as water superintendent for the village, 5 ayes, motion carried.
Motion by Crane, seconded by Hodges that the salary of $5,000.00 per
year be paid to Mr. Walter Skiba as Water Superintendent, effective
December 1, 1960. 5 ayes, motion carried. Smith then brought up
he question of payment x2 for mileage on the use of Mr. Skiba's truck.
�e council concurred that mileage xf for the use of his truck while
n the job would be discussed at a future date.
The subject of the location of the Ramsey County Park was discussed
by the council and the village attorney stated that a protest could
be registered on the location of the village :!ished to do so.
Mayor Crane announced that an informal discussion meeting will
be held Monday, November 21st at the village office. He also announce;
that the next regular meeting would be held November 28th at the Red
Cak School.

The Clerk presented the licenses (see list attached) for approval.
Motion by Crane seconded by Hodges, to ap:rove the licenses as read.
4 ayes, motion carried. (it is noted here that trustee Christensen
had left the meeting just previous to this motion.
Mr. Chris Piehowski read a r;;port ancerning the property at 754
Long Lake Road and that said pro perty is substandard. Attorney Meyers
was instructed to repare an affidavit to condemn the property at 754
Long Lake Road.

WHEREAS, pursuant to resolution of the Village Council of Mounds
View adapted the 14th day of November, 1960 the special assessments for the
construction of Watermain Improvements 1960..1, 1960-2, and 1960.-3 were levied
against the attached list of described property, said list made a part herein.
AND WfiMMS, the abmve mentioned properties have been conveyed
or replatted and are described according to the attabbed list, said list
made a part herein.
NOW, THEREFORE, BE IT RESOLVED BY THE VILLAGE COUNCIL OF MOUNDS
VIEW that the assessments for Water Main Tmnrcvemdents 1960-1, 1960-2 and
1960-3 against the heretofore mentioned properties, described further as
28230, 28188, 28090. 28078, 27964, and 27985 be correctly certified to the
Auditor of Hamsey County for further collection in the amounts stated on the
attached lists, said List made a part herein.
Seconded by Trustee and passed unanimously the
