HomeMy WebLinkAboutMinutes - 1960/12/12Clerk C G EXTRACT OF MINUTES OF REGULAR MEETING OF THE VILLAGE COUNCIL OF THE VILLAGE OF MOUNDS VIEW, MINNESOTA At a regular meeting held on the 12th day of December, 1960 at o'clock p.m. in the Red Oak School within the Village of Mounds View the following resolution was moved by Councilman and seconded by Councilman /4 A RESOLUTION GRANTING A SPECIAL USE PERMIT FOR THE CONSTRUCTION OF A GASOLINE SERVICE STATION. WHEREAS, The Village Council was requested to issue a special use permit for the construction and operation of a gasoline service station, an,! WHEREAS, pursuant to Ordinance 67, Section 3.8 a hearing was held at 8 :00 o'clock p.m. on December 12, 1960, and WHEREAS, the Council voted to issue said special use permit, NOW, THEREFORE BE IT RESOLVED, That a special use permit for the following described property authorizing the construction and operation of a gasoline service station is hereby granted by the Village Council of the Village of Mounds View: That part of the Northeast 1/4 of the Northeast 1/4 of Section 7, Township 30, Range 23, Ramsey County, Minnesota described an follows: Beginning at the Southeast corner of said Northeast 1/4 of the Northeast 1/4, thence West along the South line of said 1/4 a distance of 310.5 feet, thence North on a line parallel with the East line of said 1/4 a distance of 416.5 feet to the South line of the right of way of Trunk Highway, thence Southeasterly along the South line of said right of way a distance of 409.2 feet to the East line of said 1/4, thencs South along the Zest line of said 1/4 a distance of 145.2 feet to the point of beginning except therefrom the East 33 feet for road. CJ01;36 Proceedings of the Village Council, Dec. 12th (Cont'd) pg. 2 The hearing for a special use permit requested by Mr. Melberg in ..rder to build a filling station at the southwest corner of Hwy. 10 and Long Lake Road was then opened. Mr. Stole reported that the I1ann_'.n' Commission has considered this request and feels that the property is ideally situated for a filling station. M.r. Bill Frits asked what orcentage of village property is zoned industrial as opposed to property for special use permit. He feels that the Council is abort :.nt the purpose of zoning this land industrial by issuing a spacial :se permit. He feels that we would be limiting industrial doveiopmer"- in the area along Long Lake Road by removing one of the accesses to she property. Trustee Christensen stated that there is at present only one owner of all of the industrial land there except for the corner owned by Mr. Melberg and that owner could build his own road to suit his needs. Notion by Christensen to accept Mr. Melberg's application for special use permit and that he be given permission to erect and operate a gasoline filling station on the parcel in question. Motion seconded by Hodges. 5 ayes for approval, motion carried. The hearing notice on condemnation of sub standard house at 7856 Long Lake Road was read by t'io Attorney. The owners were present and had received the notice. Mr. Meyers stated that the owners have 30 days to carry out the Council's recommendations on this property. The _uilding Inspector, Electrical Inspector and Plumbing Inspector stated ;;hat the place should be cleaned up, it needs a new chimney and a fire .iaor in the rear, the electrical system is definitely a hazard and that .J part of the system is acceptable, and that the drain from the kitchen .ink way be too close to the well. Motion by Mayor Crane, seconded Hodges to tako final action on this at the January 9th meeting. eyes for approval, motion carried. The suggestion was made by stee Christensen that the inspectors get together with the owners z ,ive them an idea of what is expected of them to get the building __z shape. The September 29, 1960 minutes were road by Clerk Smith. Motion Idges, seconded by Malvin to accept the minutes as read. 5 ayes approval, motion carried. Clerk Smith read the minutes of the November 28, 1960 meeting. 1.ayor Crane asked that the word "waive" in the last line of the third :aragraph on page 2 be changed to "amend Clerk Smith stated that _a the third paragraph from the bottom of page 5, the lot number ::ould be "65" instead of "55 Motion by Christensen, seconded by :.dgos to accept the minutes as corrected. 5 ayes for approval, .otion carried. The minutes of the December 8, 1960 meeting were road by Clerk ith. Those were tho minutes of the Annual Village Election. Motion Malvin, seconded by Hodges to approve them as read. Mayor Crane :ced if the vote on Plan A by precincts could be obtained. This will added to the minutes. 5 ayes for approval, motion carried. Page (2) Pala (3) 0.:0137 Hr. Crandell, representing the Metropolitan Mosquito Control Commission, appeared before the council and presented a map of the mosquito breeding sites in Mounds View village. Mr. Crandell stated that this map is presented with the hope that the contractors doing work in Mounds View will be shown the map and asked to fU1 in a few of these sites where possible. Mr. Harvey Melby appeared before the council and reported that he had gontlto the Justice of Peace Court after his appearance at the last council meeting but was informed by the Justice of Peace thataccording ika to the Village ordinances the Building Inspector held jurisdiction over his complaint registered against Mr. Conrad Anderson at 8357 Eastwood. Mr. Anderson who was present, informed the coUh it that he had no idea he had broken any law by selling Christmas trees at his reidence and parking trucks in his yard; that he would rectify the situation and would appreciate knowing hos long he had to do this. He also inz..ired if he could purchase the lot neat to his for parking his trucks but he was infrmed by the village attorney that the ordinance in question would not permit this. Motion by Crane, seconded by Malvin that the owner eliminate any business enterprises not allowed by village ordinances by January 1, 1961 and that if such was not taken care of by that time the Building Inspector be instructed to sign a complaint against Mr. Anderson. 5 ayes, motion carried. The Building Inspector was also instructed to inspect Mr. Andersonns lot and stable to determine if they comply with the ordinance cofering this. Mr. Leonard Lindstoone of Bronson*Erickson Company, appeared before the council regarding the subdivision of a lot at County Road H2 and Spring Lake Park Road. The present owner of this lot, Mr. Edmund Voltin, had been requested R y the Planning Commission to prepare and present to that commission a preliminary plat showing location of the present house, etc. Mr. Lindstone stated that, however, Mr. Voltin has not done this and the prospective purchaser, Mr. Sweeley, would like to culminate and conclude this transaction. Motion by Crane, seconded by Malvin to ten tativelyapprove the subdivision_ of said lot 140 feet by 107 feet pending recommendar tion from the planning Commission after the survey and plot plan is submitted. 5 ayes, motion carried. The Park and Playground Committee report was given by Trustee Hodges. He stated that the Committee will try to flood the rinks at Billviow, Oakwood and Lambert by abridges yetion, A discussion followed regarding the purchase of a trailer to hail the tractor. Motion by Hodges, seconded by Crane to inspect the trailer suggested by Mr. Stole and if it doesnnt meet the specifications required, the village will purchase the trailer allready suggested (6 x 12 feet, 3 inch channel construction, dual wheels) for the price of $160.00, 5 ayes, notion carried. Mr. grits inquired into the disposition of the two acres of land at the Hill viewand Long Lake Road playground which had been deeded to the village by Bronson,- Erickson. Attorney Meyers stated that he had found the certificate of title this day and that he would now file the deed for the village. Mr. Walter Skiba inquired as to what the council desired to do about sealf for the water meters. Mr. Skiba was instructed to purchase a tool having some tyre of die which would stamp the words "Mounds View" on the water meter seals. Mr. Skiba also reported that the well is drilled ho the depth of about 830 feet and now ready to be cased. Clerk Smith inquired from the Village Engineer Representative, Mr. Knutson as to when the village could expect to have water ready for service to homes in the village. Mr. Knutson stated that if all went well service may be expected sometime in January. Trustee Hodges inquired from Mr. Skiba as to wbyy the street signs were not replaced on Red Oak Drive after construction and he was informed that they were replaced by the contractor but were removed by Halloween pranksters and now will rive to be replaced by the village. Mrs. Ralph Peterson brought up the subject of the placement of stop signs on the new Highway #10. Trustee Christensen stated the he would investigate this situation. Mr. Knutson presented the council with a map of proposbd village thoroughfares which was received from Mr. Dahlgren the village Planner. This map will be studied by the council and discussed at a later meetin Mr. Knutson also reported on the matter of the road right -of -way and drainage c'.'.tch at Red Oak sad Woodcrest, The location of a lot corner stake is *laced on =_t of the ditch which placed the lot on the right -of -way. This problem arose '''cause the rotginal surfacing of Woodcrest was not buil& onthe right -of -way but .rth of it. Trustee Christensen said he feels that a spillway sould be built a the northwest corner to ease this situation. Attorney Meyers will check to see there are easements involved. Mr. Knutson and Mr. Skiba met with two Northern States Power Co. Represents '7es to discuss the route for service to the well site. They feel that the best 7 is to come from the south side of Highway 10 along the east side of the Edgewood ;ad right -of -way. Mr. Knutson also stated that it is contemplated to build a temporary sttucture at the well site to serve as a well house. This would be of wood frame, sheathing, ^rd weatherproofing. It was suggested by Mr. Blanchard that this could later be ..sad for a warming house. The tentative specifications covering basement meter settings were ready by the Village Attorney. The subject of temporary water usage by conttactors was brought up, and Mr. Meyers village attorney, was instructed to draw up an amend- ment to the Water Ordinance regarding the furnishing of meters for this use. Mayor Crane announced that the Mounds View mill rate for 1961 is 85.68 plus 120.96 for schools, for a total of 206.64 which is an increase of 5.31 mills over last Motion by Crane, seconded by Malvin to pass the ordinance prohibiting flight to avoid arrest. 5 ayes, motion carried. Motion by Christensen, seconded by Crane that the Clerk be instructed to place an at in the local newspapers advertising for a dogcatcher in the village of Mounds j iew. 5 ayes, notion carried. Regarding an opinion regarding citizens complaint s of Ordinance violations, :torney Meyers said that he feels that in technical ordinances, it should be spelled „ut who should sign complaints and enforce the laws. Page (4) OJGI39 Mr. Skiba was instructed to supply the village with a Certificate of Insurance on his truck, Clerk Smith brought up the subject of insurance on the other inspeo- tor's cars. They, tam are also instructed to bring in Certificate of Insurance. Motion by Crane, seconded by Certain Lends as Non Conservation After discussion, motion by Management Consultant Service to office. Christensen, Hodges and Christensen to adopt the Resolution classifying Lands. 5 ayes, motion carried. Crane, seconded by Hodges to hire the Minnesota survey administrative procedures in the village CranP, eye; Malvin and Smith, No. Motion carried. Motion was then made by Hodges, seconded by Crane that the village spend not more than $250.00 for this survey. Smith, Christensen, Crane, Hodges aye; Malvin, no. Motion carried. Hodges moved, Christensen seconded to approve payment of Bills for which the claims have been signed. Christensen, Smith, Crane, Hodges, aye; Malvin, no. Motion carried. Discussion followed on the amount of the check made out to Frank Slipka and also what to do with a bill for groceries submitted by the Civil Defense Unit. Motion by Malvin, seconded by Hodges to have the Civil Defense pay their own grocery bills. Christensen, and Smith, abstain; Crane, Hodges and Malvin, aye; Motion carried. Clerk Smith turned over information to the Attorney with which to prepare a resolution to place the water assessment back on the tax rolls on the property of Dail T. Pearson at 7485 Hnollwood. XXXXIDEME Smith stated that he check in payment for this assessment had returned from the bank showing payment had been stopped. Smith also stated that he had called Mr. and Mrs. Pearson and they wished to place the assessment back on the tax rolls. Motion by Crane seconded by Smith to have the Attorney prepare a resolution for this purpose. 5 ayes, motion carried. Clerk Smith reported that he was informed that the Babinskixs intend to sell their duplexes under the impression that said duplexes can be made into fourplexes. The council stated that they would watch for advertising on this matter and take formal action then is such is done. Clerk Smith asked permission to transfer certain bills paid from the General Fund into the Water Fund which should have been paid out of that fund, The council concurred and granted permission. Mayor Crane announced that the Council will hold a meeting at the village office on Tuesday, January 3, 1961 at 7:00 p. m. to conduct certain required business. He also stated that the regular meeting of the Council will be held at the Red Oak School on Monday, January 9th, at XX 8 :00 p. m. The police report was read and Hodges moved, Crane seconded that the Police report bs accepted as presented. 5 XX ayes, motion carried. Motion by Crane, seconded by Hodges to approve peddler's licenses (list attached). 5 ayes, notion carried.
