Members present: Mayor: Allan Crane Clerk: Lloyd J. Blanchard Trustees: Perry Malvin Melford Christensen Donald Hodges Adm. clerk: Paul Boog Engineer: Les Knutson Public Works Supt; Walter Skiba Meeting adjorned at 9 :00 P.M. PLANT PERFORMANCE GUARANTEE The Filter Plant is guaranteed as follows: 1) It shall be free from defective materials and /or workmanship for a period of one (1) year from date of final acceptance of the Plant. The manu- facturer shall replace any parts proved defective within that period at no cost to the Village. 2) The manufacturer guarantees that the Plant shall be capable of being backwashed by any one of the following methods: a) By raw well water with both well pumps operating at a combined minimum rate of 1,500 G.P.M. b) By effluent from one filter on stream, supplemented by water from system. c) By effluent from one filter on stream, supplemented by raw well water. d) By filtered water from system. The manufacturer guarantees that the filters will be back washed clean at a wash rate of 1,500 G.P.M. per compartment, followed by a brief downflow rinse to drain, by any of the above methods. 3) When operating at a combined rate of not over 2,000 G.P.M. for both filters on water of similar characteristics to that shown by the Engineers' specifications, the Plant shall reduce iron in the filter effluent to a residual not in excess of 0.3 ppm. The filter effluent shall not contain sufficient air to cause the condition known as "white water." Conditioned upon operating the Plant in accordance with its printed instructions and subject to normal maintenance and attrition loss of filter media, the manufacturer guarantees the performance specified in this Section (3) for a period of three (3) years from the date of final acceptance of the plant by the Village. Should the Plant fail to comply with the provisions of this section any time within three (3) years from date of acceptance, the manufacturer guarantees to correct the deficiencies responsible at no cost to the Village. NESSEAS, The Legislature of the State of Minnesota has passed and adopted in amended form In both the House of Representatives and the Senate certain enabling legislation commonly called the North Suburban Ant, and WHEREAS, Such Legislation nevertheless empowers the City of Fridley and City of Coon Bapids, and the villages of Brooklyn Park, Blaine, Mounds View, and Spring Lake Park, to form for their use a sewer district within the area comprising their municipalities, and WHISSAS, Thera 1s an urgent need to form a sewer district within such area to provide the essential services of sewerage collection, treatment and disposal to each of such municipalities and the inhabitants thereof, and WHIMS, Section 4 of such ant provides that proceedinga for the establishment of a district under the act are initiated by a resoltuion of the governing body of one or more of the affected municipalities, NOW, THEREFORE, BE IT BEEOLLVED, BY THE VILLAGE OF ROUNDS VIEW as follows: 1. That the City of Fridley and City of Coon Rapids, and the villages of Brooklyn Park, Blaine, Mounds View, and Spring Lake Park shall create a sanitary sewer district. 2. That upon the receipt of the resolution by the City of Fridley and the forwarding of similiar resolutions to the City of Fridley by the above na municipalities a notice shall be published in the legal newspaper for gee *h governallntal subdivision enumerated above.
