HomeMy WebLinkAboutMinutes - 1961/08/14EXTRACT OF MINUTES OF MEETING OF THE VILLAGE COUNCIL OF THE VILLAGE OF MOUNDS VIEW, MINNESOTA Pursuant to due call and notice thereof, a regular meeting of the Village Council of the Village of Mounds View, Minnesota, was held at the Village Offices in said Village on Monday, August 14, 1961, at 8:00 o'clock P.M., C.D.S.T., with the following members present: Mayor Crane, Clerk Blanchard, Councilmen Christensen, Hodges and Malvin and the following members absent: none The Clerk announced that the assessments for Waterworks Improve- ment No. 1960 -3 had been prepared. After consideration of said assess- ments, member Blanchard introduced the following resolution and moved its adoption: RESOLUTION APPROVING ASSESSMENTS FOR WATERWORKS IMPROVEMENT NO. 1960 -3 AND CALLING A HEARING THEREON. BE IT RESOLVED By the Village Council of the Village of Mounds View, Minnesota, as follows: (1) That the special assessments heretofor prepared by the Clerk for Waterworks Improvement No. 1960 -3 are hereby approved and ordered filed in the office of the Village Clerk; and (2) That this Council shall meet at the time and place specified in the form of notice hereinafter contained for the purpose of conducting a public hearing on said assessments, and the Clerk is hereby authorized and directed to cause notice of said meeting to be mailed to the owners of the property to be assessed and to cause the following notice to be published in the official newspaper of the Village at least once, not later than two weeks prior to said meeting, which notice shall be in sub- stantially the following form: PROCEEDINGS OF THE VILLAGE COUNCIL VILLAGE OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA 000116 The regular meeting of the Mounds View Village Council was called to order by Mayor Crane at 8400 P.Mo August 14th, 1961 at the Red Oak School, Sherwood Rd. and Red Oak Dr., Minneapolis, Minnesota Present were: Mayor' Allan Crane Clerk: Lloyd Blanchard Trustees: Mel Christensen Perry Malvin Don Hodges Attorney: Richard Meyers Engineer: Leg Knutson Pub. Works: Walter Skiba Adm. Clerk: Paul Boog Motion 'made by Hodges to accept minutes of July 24th meeting as presented. Seconded by Malvin. 5 Ayes. Motion made by Christensen to accept minutes of July 31st meeting as presented. Seconded by Malvin. 5 Ayes. The attorney read a motion that he lrew up under the Council's direction regarding water filtration contract. Motion by Malvin to authorize execution of a contract with D.W. Hickey, upon the execution of an escrow agreement between the Village of Mounds View and the Turbomatic Co. and the First State Hank of New Brighton. The Escrow agreement shall cover 35,000.00 in bonds to guarentee satisfactory performance of the filtration plant covered by the contract and shall be in effect for three years from the acceptance date. The contract shall also embody the terms of a letter filed with the Village from the Turbomatic Co. signed by H.M. Mueller and dated August 14th, 1961. Seconded by Christensen. 5 Ayes. Motion carried. Mrs. Ralph Peterson raised a question regarding the water availabilit- date on project 1960 and 1960 -2. She was of the opionion and several Others in attendance agreed, that the availability date should have been six months after the notice was placed in the paper. After discussion by Council members and others the attorney stated that the Council had met the legal requirements of the Ordinance. Mayor Crane said that no date for the 3100.00 addition fee, that could be levied after Sept. 3Oth, was set because the Council did not wish to enforce that position of the Ordinance at this time. Mr. A Dlrs. Marvin 0lrsstead• appeared before the "Council to roil/miter a complaint regarding the Lambert 3a11 Field. Their home borders the playground on the East side and frequently foul balls are hit into thiex yard. They have given permission for the children to go around the fence or have a portable stile availab =e at games so the fence would not be climbed on, bnt the fence still gets bro%en and the owners are frequently requested to chase balls for the players. They also stated that some parents use foul language towards them and that small children are using the area along their fence as a tc.:.let. -2- 0001.17 The Council felt that relocating the field on this playground was the best solution to the problem: Mr. W.D. Frits asked for a motion from the Council to abandon this playground. No.action was taken on his request. Mr. Hodges, who represents the Council on the Parks Playgrounds Commission stated that the ball park would be moved before games were scheduled in the spring. The Police report for July was read and a copy placed on file in the Village office. The Police Commission report was read and the following action taken: Item #3. Mb tion by Crane to purchase a portable oxygen kit for approximately $80.00 and one mouth to mouth respiration kit for approximate: $12.00. Seconded by Blanchard. Ayes. Item #4. Motion by Crane to hire Eugen MacCauly as a consultant to help set up testing program for police applicants and incumbents and to set up procedures in the Police Department for an amount not to exceed $500.00. Seconded by Blanchard. Mr. Christensen asked for the exact items the consultant would undertake and furthur stated that he thought the attorney should go over this instead of hiring outside help. Mr. Crane stated it was the Commissions opinion that a better set of rules and regulations governing the Police Department and a set of rules on procedure was needed for the Commission 'itself,.amoung "bther'things. Upon call of the roll the following vote was taken. Malvin, Hodges, and Christensen, naye. Blanchard and Crane, aye. Motion lost. Item #7. Motion by Crane to have "Speeds Electrically Timed" signs purchased and placed at following locations: Co. Rd J. East Bound Lane at S.L.P. boundary, Co. Rd H2 East Bound Lane at Fridley boundary, Co. Rd H2 West Bound Lane at R'iway 8, Go. Rd I.West Bound Lane_at,Hityay 8, and Co. Rd I East Bound Lane at Hiway 10. Seconded by Malvin. 5 Ayes. Item #8. Motion by Crane to authorize payment to Police Chief Grabowski and Sgt. Rustad of the difference between the two party telephone and a private telephone. Seconded by Christensen. 5 Ayes.(Copy of police report on file.) Mr. W.O. Frits asked the Council what their intentions were regarding the drag strip built by Don Voge at the Twin City Speedway in our Village. against thQ Village Ordinance, as it creates a nuisance by din of the 9:30 A.M. Sunday races and the late racing at night. This was discussed at some lengths and the information was released that the Village has a case coming up in court regarding this matter. A fifteen minutes recess was called at this point. Meeting called to order by Mayor Crane at 9:30 P.M. Mr. Hodges reported that the Parks and Playgrounds Commission had met and discussed their winter program, setting up sizes and locations of skating and hockey .rinks. (Copy of minutes of meeting on file) -3- 000118 Mr. Frits stated that as the Irondale Inn was being vacated after purchase by the State Hiyuay Department, perhaps the Recreation Department could use the building on one of the Park sights. Mr. Hodges was instructed to investigate this matter. Mr. Malvin reported that the Lakeside Park Commission was having an overall plan drawn up for the Park and mould be meeting with the Council on this matter in the near future' Mr. Christensen moved that a work order to the county be sent to do the excavating work necessarl for the installation and the connection of condditto the existing culvert, fill material over conduit, and lowering of existing culvert to grade for the storm drainage of Lambert Playground. Seconded by Blanchard. 5 Ayes. Mr. Christensen reported that after a tour with Mr.Skiba a list of additional work to be done on the roads by the contractors will be submitted to the Village Engineer. He further reported that small patching jobs in the Village were being undertaken by the Village, with Village employees doing some of the work in an effort to cut costs on patching. Motion by Christensen to have work order sent to County to Scarify Pinewood Drive from Jackson to Quincy and to oil and sand. Work order to have notice to notify Village Engineer when work is to commence for possible grade corrections. Seconded by Malvin.. 5 Ayes. Mr. Christensen also reported that the pending work order are scheduled but he has not received any notification as to starting date. The matter of Gloria Circle drainage was brought up. It was stated that the flushing of the hydrants at the dead end of that water line will possibly cause a hazard this winter. The attorney was instructed to contact the contractor regarding the $500.00 dedicated for construction of Gloria Circle. Mr. Piehowski further reported that after further investigation the house at Sherwood and Fairchild was not sub standard. Motion by Crane to appoint Mr. Walter Weibel, 7150 Knollwood Dr., to the Planning Commission to fill the unexpired term of H. Carnes. Term expires December 31st, 1962. Seconded by Malvin. 5 Ayes. The Engineer reported that the contractor on project 1961 -1 would start work this week. The matter of right of way easement for Fairchild Ave. for the water project was brought up. Five of the residents concerned were present and expressed the view that 27 feet as proposed was actually more than needed to fill the Village requirements. After much discussion Mr. Crane moved that the Village acquire 17 additional feet on the West side of Fairchild Ave. Motion lost for lack of second. Mr. Christensen then instructed the three home- owners on the South end of the road to come to an agreement among themselves as to where they feel the water line should go. The engineer will then decide if their location of the line is feasable from an engineering stand point and to correct it if it is not feaseable. This would be the easement that would then be obtained. -4- Respectfully submitted by Lloyd J. Seconded by Crane. 5 Ayes, Motion by Christensen to approve plans from N.S.P. Gas Co. as corrected and to notify said company. Seconded by Crane. 5 Ayes. Motion by Blanchard to set assessment hearing for Water Project 1960 -3 on September 6th, 1961 at 8:00 P.M. at Red Oak School. Seconded by Malvin. 5 Ayes. The Clerk was instructed to send proper notices regarding this hearing. Motion by Christensen to refer the new plans for proposed highway 10 to the Village. Engineer for study and recommendation. Seconded by Hodges. 5 Ayes. Motion by Malvin to hire Wayne Leak as janitor for the Village office. Seconded by Blanchard. 5 Ayes. Motion by Malvin to pay bills submitted.1 Seconded by Crane. 5 Ayes. Motion by Malvin to approve license applications submitted. Seconded by Blanchard. 5 Ayes. Motion by Crane to pay the water assessment due on the Foley property purchased by the Village in the amount of $522.82. Seconded by Hodges. 5 Ayes. A memo was placed on file regarding the matter of a fence between a business and a residence and the matter was again referred to the Planning Commission. Motion to adjourn by Malvin. Motion by Malvin to authorize execution of a contract with D.W. Hickey, upon the execution cf an escrow agreement between the Village of Mounds View and the Turbomatic Co. and the First State Bank of New Brighton. The Escrow agreement shall cover $5,000.00 in bonds to guarentee satisfactory performance of the filtration plant covered by the contract and shall be in effect for three years from the acceptance date. The contract shall also embody the terms of a letter filed with the Village from the Turbomatice Co. sighed by H.M. Mueller and dated August 14th, 1961.
