Roll call was taken by Clerk Present were: Mayor: Allan B. Crane Adm. Deputy Clerk Paul E. Boog Trustees: Donald Hodges Perry Malvin John Sullivan Absent: Clerk: Lloyd J. Blanchard Also Present: Attorney: Richard Meyers Engineer: Les Knutson Public Works Walter Skiba OdO 109 The Mayor opened the Public Hearing for water extension on La Porte Drive. Mayor Crane called for objections to the water main extension on LaPort Drive from Edgewood to Jackson no objections; the Mayor called for those in favor none appeared. The Mayor declared the hearing closed. Motion by Malvin to order Water Improvement 1962 -3 as described: LaPort Drive from Edgewood to Jackson Edgewood Drive from Sherwood to Arden Sherwood Drive from Edgewood to Jackson Jackson Drive from Sherwood to La Port Johnson Drive from Greenfield Place to Sherwood and to order final plans thereon. Seconded by Sullivan. 4 Ayes. Motion Carried. Motion by Hodges to order Water Improvement 1962 -2, Eastwood from Sherwood to County Road J and to order final plans. Seconded by Crane. 4 Ayes. Motion Carried. Motion by Crane to advertise for bids on Water Projects 1962 -2 and 1962 -3 to be opena 8:00 P.M., September 10,1962. Seconded by Malvin. 4 Ayes. Motion Carried. Motion by Crane to set August 27, 1962 at 8:00 P.M. date for Public Hearing for Water Improvement 1962 -3A, on Woodlawn from Sherwood to the North, to serve property owned by Ambrose DeGross, 8123 Woodlawn, Jack Standfield,8126 Woodlawn. Seconded by Sullivan. 4Ayes. Motion Carried. -2- The Attorney was instructed that he would be held responsible for all legal publications. Motion by Hodges to correct minutes of July 23rd Council meeting by adding "September 10, 1962" to the fourth line from the bottom of Page #3 line corrected would read "Hillview Road Project tentative date for bids September 10,1962 and to approve minutes as corrected. Seconded by Malvin. 4 Ayes. Motion Carried. Motion by Malvin to correct July 30th minutes of Special Meeting to read "however alternates #2 and #3 are eliminated thus making the D.W, hickey Company the low bidder in the amount of $25,040.00 and approve minutes as corrected. Seconded by Crane; 4 Ayes. Motion Carried. Questions as to the method of reassessing lots that are being or will be subdivided referred to the Engineer and Attorney for study and recommendation. Motion by Sullivan to set August 27, 1962, 8 :30 P.M. as hearing date to rezone Lot #58, Auditor's Subdivision #89 from R1 -A to B -3 Retail Business as requested by Mr. Andrew Simon to build a Supper Club and Motel. Seconded by Malvin. 4 Ayes. Motion Carried. Motion by Sullivan to grant a variance to allow Mr. James Haluptzok to move his garage three feet from the lot line the garage is now located on the lot line of the North one half of Lot #21, Spring Lake Park Hillview This is a hardship case due to the area. Seconded by Malvin, 4 Ayes. Motion Carried. 0J011.0 Attorney Meyers reported that the easements on the Haluptzok Terrace Development have been sent nut. Mr. Walter Skiba introduced Mr. Donald Nelson and Mr. Donald Nichols, land developers, interested in building and developing land between Highway 8 and Highway #10. The Council explained the zoning, water, storm and sanitary sewer facilities within Mounds View. Motion by Sullivan to adopt Ordinance #94, as an amendment lo Liquor Ordinance #53. Seconded by Malvin. Mrs. Bernice Ehlers, 6939 Pleasant Veiw Drive and Mrs. Ila McCue, 7310 Fairchild both opposed the. adoption of this Ordinance. It was explained thatthis amendment also clarified Ordinance #53. 4 Ayes, Motion carried. Mrs. Nick Kuehn, 2721 La Port Drive questioned the authority of the Police Department. She was notified of the Police Commission meeting to be held at the Village Hall on August 23, 1962. Mrs. Kuehn complained about the tall grass and weeds on both Lambert and Sherwood. She was notified that Keith Ewers, the weed inspector would be informed of this condition to determine whether it was a Village matter. Mrs. Kuehn questioned the tax structure. All available information was given to her. -3- 0J0111 Crane read the July report of the Police Department which showed 5,420 miles patroled, 183 calls in the Village answered, 49 traffic tags issued, with 6 accidents, 7 hospital runs and 6 juveniles sent to court. Crane presented and explained resolution regarding NSSD Federal grant for disposal plant. Malvin reported on the activities at Lakeside Park. Sullivan reviewed bids for surfacing parking lot, preferred County to dothe work. Reported that grading was done on Gloria Circle. Milt Stole read minutes of August 9, 1962, joint meeting of Planning Commission and Industrial Development Committee. The recommendations of the Planner were read: (A) The request of a foundry between Highway #10 and eounty Road H -2. Since a foundry is classed as heavy industry, the location suggested would not be compatable, (B) Locate the Drive -In Theater, South of Highway #10, and the proper zone a special use under B -3. Motion by Sullivan to issue a special use permit to allow Mt. C. 3raathcn+ to have three excess utility buildings located at County Roau H -2 and Fairchild for one year. It would not be deterrent to anyone. Seconded by Crane. 4 Ayes. Motion Carried. Chris Piehowski, Building Inspector, recommended that the residential building at 8281 Spring Lake Park Road be con- demned, house had been red tagged in 1957; matter referred to Attorney. Motion by Hodges to pay bills submitted. Seconded by Crane. 4 Ayes. Motion carried. Motion by Crane that the grades and elevation for constructing Village sidewalks to be supplied by the Village Engineer, but the cost of staking to be incurred by the individual, although the Village Engineer would be allowed to do this at np cost to the Village. Seconded by Hodges. 4 Ayes, Motion arried. Les Knutson reported that the temporary drainage at Bronson and Groveland is being checked. Mc by Crane to authorize the Village Engineer to prepare the proposed standard street design with estimated cost. At least three or four different designs to apply for the whole area, the per foot cost of each type, plus the over all cost. Seconded by Sullivan. 4 Ayes. Motion Carried. Knutson reported that the Babinski drainage was checked that Dr. Barr, State Health Officer, will investigate this sewer problem. Mayor Crane read a copy of a letter from the Village Health Officer, Dr. Houle, regarding this area having overflow and seepage from the sewage systems in violation of the Mounds View Village Health Law. -4 The Clerk was instructed to write a letter to the Village of New Brighton to request a temporary connection to their sanitary sewer system at County Road H as an emergency measure to help eliviate this unsanitary sewage condition in the Babinski area. The Clerk was also insturcted to write a letter to the Minnesota State Health Department to determine what power or authority the St.has to remedy this problem. The Engineer reported that the State Aid Plans for Hillview went to the Highway Department, August 6, 1962. Motion by Crane to pay Dunkley Estimate #2 for $3,144.92. Seconded by Sullivan. 4 Ayes. Motion Carried. The Engineers Change Order #1 for Well #2 a deduct in the alternate was received. Attorney Meyers was instructed to prepare different methods of assessment procedures for sanitary and storm sewer and for rebuilding village streets The Attorney reported that the easements for the Haluptzok Terrace had been sent out. Motion by Crane to sign the Northern States Power Gas Contract to provide gas for the new pump at Well #2 and to have the Village Attorney write a letter notifying N.S.P. tht the Village does not foresee any use of a stand -by system in the future and to approve payment of $2,400.00 deposit. Seconded by Hodges. 4 Ayes. Motion Carried. Motion by Crane c:: sign the Fire Contract as submitted by Attorney Meyers with the Spring Lake Fire Department for $4,593.64 for 1963. Seconded by Hodges. 4 Ayes. Motion Carried. Motion by Sullivan to adopt Ordinance #95 (rezone Harris property from R1 to R3) Seconded by Malvin. 4 Ayes. Motion Carried. Motion by Sullivan to adopt Resolution #110 changing assessments due to sub division. Seconded by Malvin. 4 Ayes Motion Carried. Motion by Crane to paythe expenses incurred by the Boy Scouts cleaning village property on August 25, 1962. Seconded by Sullivan, 4 Ayes. Motion Carried. Motion by Hodges to set the fee for mowing weeds on private property at Four dollars and fifty cents per hour Seconded by Sullivan. 4 Ayes. Motion Carried. Motion by Sullivan to approve the licenses. (list attached) Seconded by Hodges, 4 Ayes. Motion Carried. Motion by Hodges to appoint the following as election judges: Precinct #1 Iva Mae Petron, Grace Allickson and Bernice Schaffhausen; 030112 -5 Precinct #2 Lila Hauberg, Betty Simmonson and Bernice 0J0113 Hafslund;" Precinct #3 Ada Sopkawiak, Romona Thompson and June Schaffhuasen. Seconded by Sullivan, 4 Ayes. Motion Carried. Motion by Crane to request Northern States Power to install 6,000 lumen streetlights at the intersection of Edgewood Drive and 'Clearview Avenue. Also at the intersection of Irondale Road and Clearview Avenue as requested in petition submitted if these are included in the master street lighting plan sub mitted by.N.S.P.
