HomeMy WebLinkAboutMinutes - 1963/03/25PROCEEDINGS OF THE VILLAGE COUNCIL VILLAGE OF MOUNDS VIEW 030030 RAMSEY COUNTY, MINNESOTA The regular meeting of the Mounds View Village Council was called to order by Mayor Crane at 8:00 P.M., March 25, 1963 at 2401 Highway 10. Boog Walter Skiba Milt Stole Phyllis Blanchard Charles LaVaque Charlotte Forslund The Public Hearing for rezoning for Mr. Clarence Peterson was opened by Mayor Crane Mr. John Bell, Attorney for petitioner, presented drawings and plot plans for the proposed liquor establishment. In pleading for the rezoning Mr. Bell stated the following: Petitioner has support of more than 50% of adjoining property owners. Proposed use would give full utilization of land. Proposed use would be a credit to the community from an esthetic view point. Proposed building would be an off and on sale liquor establishment. The Attorney read Ordinance 66,Section 7, Sub division 3, governing the proximity of liquor establishments to Churches Schools. Mr. Meyers stated that it was his opinion that the intent of the Council regarding this Ordinance at the time of passage was that the wording "Church Property" meant the property that a Church sits on. Several residents raised questions as to the legal and moral questions involved. The question or discussion period continued for some time. Mr. Stole, Chairman of the Planning Commission, read the minutes of the Planning Commission Meeting regarding this matter. (on file) (Planning Commission vote 4 -3 in favor of rezoning.) Letters from local Churches were read and filed. Motion by Crane that property owned by a Church which is contiguous to property which is owned and regularly or daily used for worship or other Christian purpose shall be considered Church property as mentioned in Ordinance 66, Section 7, Sub division 3. Seconded by Malvin. Roll Call: Blanchard Naye; Crane, Hodges, Malvin, Sullivan, Aye. Motion Carried. -2- 0J0031 The Applicant. in view of this action withdrew his application for rezoning. Motion by Blanchard to refund fees paid by applicant because of previous action. Seconded by Sullivan. 5 Ayes. Hearing closed by Mayor Crane at 9:50 P.M. Recessed Meeting for ten minutes. Meeting called to order and Public Hearing for Mr. Hugo Bjarkmann property opened at 10 :00 P.M. Mr. Kvalheim, Attorney for Petitioner, presented the tentative plans for the development and answered several questions from the floor. The approximate amount of income that the Village would receive from this development in the way of taxes was discussed. The Mayor called for objectors to the proposal three times. There were no objectors, The Mayor called for pro$onents of the plan and they were as follows: Mr. Ralph Peterson Feels the development would be an asset to the Village. Mr. C. Jaeger 1955 Bronson Drive Feels that the Village is acting more progressively There being no further statements the Mayor declared the hearing closed. Motion By Sullivan to adopt the rezoning and issue the special use permit as requested for the Mobile Home Park upon application for and approval of a building permit. Seconded by Malvin, 5 Ayes. A proposed ordinance regarding Mobile Home Parks was discussed. Motion by Sullivan to adopt Ordinance 98. Seconded by Blanchard, 5 Ayes. Motion by Sullivan to accept minutes of March 11, meeting as presented, Seconded by Malvin. 5 Ayes. A comprehensive Civil Defense Report of goals and aims of the Civil Defense Department was presented by Mr. Charles Jackson, Civil Defense Director Motion by Malvin to adopt Civil Defense outline of goals and aims as presented, Seconded by Blanchard. (copy on file) 5 Ayes. Following itsmairought from floor by citizens: 1. Engineer instructed to have contractor grade excavation banks where fill was removed for Hillview Porject. 2. Engineer instructed to check drainage pipe outlet on park, blocked by peat removed from Hillview Project. 3. Request for a tennis court at Hillview Park. Referred to recreation committee, 4. A memo presented by Mr, Mr. Bell (J.P.) regarding Municipal Courts. 5. Village Attorney instructed to investigate cost and income from present joint Municipal Courts in the State. Motion by Sullivan to refund money for liquor licenses to Mr. Clarence Peterson 870 Oakwood Drive. Seconded by Crane. 5 Ayes. -3- Respectfull)Submitted, Lloyd' J. Blanchard 'llage Clerk 0J0032 Mr. Sullivan reported that he was investigating a dump truck for Village use at a cost of approximately $900.00. A letter from NSSSD was read by Mayor Crane and a meeting was set with the Board and Village Council in Council Chambers at 4:00 P.M., Monday, April 1, 1963. The Engineer presented Estimate 1 for the Walbon Construction Company on the Hillview Road Project. The Engineer stated that the water tests taken in the Village and reports on them were not yet complete. (Hot water tank damage) A resolution regarding 35W plans v• ^s referred to the Attorney ?nd Engineer for study and recommendation. The Attorney was instructed to investigate state and local laws regarding Beauty Shops and to report at the next regular meeting, The Attorney was instructed to prepare an amendment to the Liquor Ordinance along the general lines of action taken at this meeting. Mr. Skiba was given the authority to issue over weight permits to trucks doing emergency fuel delivery or cesspool pumping in the Village. A letter from the County Engineer and County Board regarding Judicial Ditch 1 was referred to the Engineer for study and recommenda- tion and also for ascertaining costs of dragline rental. Motion by Blanchard to purchase one copy of League of Minnesota Municipalities Handbook. Seconded by Hodges. 5 Ayes. Motion by Blanchard to authorize Mr. Paul Boog to attend a course at the University of Minnesota Center for Continuation Study on April 8th and 9th. Seconded by Crane. 5 Aye% Motion by Blanchard to approve license and pay bills submitted including Engineer's Estimate 1 for Hillview Road project Seconded -by Malvin. (list attached) 5 Ayes. Motion by Blanchard to send work order to N,S.P. for one 6,000 lumen street light at the dead end of Fairchild Avenue, North .of County Road H as petitioned. Seconded by Hodges. 5 Ayes s Mr. Skiba was instructed to cause dead end signs and barricades to be placed on Fairchild Avenue and at the West end of Woodcrest Drive in the Twelve Oaks Aroa. The Clerk was instructed to have the Sub division regulations reprinted at a cost not to exceed $50.00 Motion by Sullivan to appoint Mrs. Bernice Ehlers as Village Assessor.
