Seconded by Rustad. 4 Ayes. Motion by Rustad to approve minutes of June 15, 1964 as presented. Seconded by Hodges. 4 Ayes. Mr. Hodges read Mr. Boogls report on the League Convention. (copy on file) Motion by Hodges to accept plans for Sanitary Sewer Project .964 -1 Schedule A B and C from the Engineer. Seconded by La Vaque. 4 Ayes. The Engineer was instructed to contact the prime contractor on Well 2 to direct Ziegler Company to repair a leaking hydraulic pump. Mr. La Vaque read the minutes of the Planning Commission Meeting. (copy on file) Mr. Rustad reported that the County had completed the patching of Village roads. Motion by Hodges to concur with the recommendation of the Building Inspector and the Planning Commission to approve plans of Clark Oil Refining Company for a service station at Highway 10 and County Road H -2 and authorize the Building Inspector to issue a building permit. Seconded by Rustad. 4 Ayes. The Engineer presented and read a report on Sanitary Sewer and Surface water drainage project 1964 -1. (copy on file) Motion by Blanchard to accept the Engineers recommendation and 1. To award bid for Schedule A Sanitary Sewer Project 1964 -1 to C. S. McCrossan ,Inc. in the amount of $517,534.10 2. To award bid for Schedule B, Sanitary Sewer Project 1964 -1 .o Orfei and Sons in the amount of $323,028.57. 3. To award bid for Schedule C Sanitary Sewer Project 1964 -1 to Orfei and Sons in the amount of $434,042.47. -2- [iAOG 4. 4. Award of bids subject to agreement between Village nand Highway Department for participation in cost of drainage program under Highway 8 and 5. Subject to the receipt from the Department of Health granting a permit for construction. Seconded by Rustad 4 Ayes. Mr. Blanchard read Resolution regarding 4 and 5 listed above. Motion by Rustad to adopt Resolution #163. (Highway Dept Agreement) Seconded by La Vaque. 4 Ayes. Motion by Rustad to adopt Resolution 164. (Health Department) Seconded by Blanchard. 4 Ayes. The Building Inspector presented plans for a ballroom to be constructed across Edgewood Drive from the Village Hall. Motion by Rustad to concur with the recommendation of the Building Inspector and Planning Commission and approve plans of Mark C. Jones Company for a ballroom to be constructed across from Village Hall. Seconded by La Vaque. 4 Ayes. Motion by La Vaque to complete rezoning and ammend Zoning Ordinance for above Ballroom property. Seconded by Hodges. 4 Ayes. At 9:00 P.M. The Mayor opened the Public Hearing for the former Gilbertson property on Highway 10. The Clerk read the published and mailed notices and Mr. Larson complied with a request from the Clerk to complete his application. The Plans were discussed and explained by Mr. Larson. The following citizens objected to the rezoning.: L. Mr. Pat Burns 7729 Groveland Road Does not want apartments in residentail area no objection to 13-3. 2. Mr. Glen Hanson 7767 Groveland Road same as above no objection to rezoning to B -3 3. Mr. Uber 2105 Hillview Road does not want either. 4. Mr. James Gabel 7934 Fairchild Avenue does not want either. The following person was in favor of the proposal: 1. Mr. Perry Malvin 8088 Sunnyside Road feels both deals would benefit the Village. The Mayor called for further statements and there were none. The Mayor closed the Public Hearing. Motion by Rustad to rezone the following property.: Starting at the N.. corner of Lot 59 Auditors Subdivision #89, Thence South 300' thence East 152', thence North 218', thence back to point of beginning. (front portion) from R1 -A to B -3 upon approval of application of a building permit for stated use for property. Seconded by La Vaque. 4 Ayes. Motion by Blanchard to rezone All of Lot 59, Auditors Sub divison 89 except a parcel of land described as follows: Starting at the N.''. Corner of Lot 59 Auditors Subdivison It 39 thence South 300' thence East 153', Thence North 213', thence back to point of beginning from R -la to R -3 upon approval of application of a building )ermit. Seconded by La Vaque. Blanchard, Hodges, La Vaque, Aye. ustad Naye. -3- C :0 The Mayor opened the Public Hearing regardiog the former Lambert Property North of the Village Hall. The Clerk read the published and mailed legal notice and stated that all forms were in order. The Mayor called for pro or con opinions on this matter. No one wished to make a statement. The mayor closed the hearing. Motion by La Vaque to rezone the N'' Quarter of the NW Quarter Section 8, Township 3J, Range 23, except the South 15 acres thereof and except the West 388.5 feet thereof and except the East 541.96 feet thereof and the West 930.46 feet of the North 321.5 feet thereof subject to County Road I, upon approval of application of a building permit. Seconded by Hodges. 4 Ayes. Motion by Rustad to approve preliminary Plat Plans for above property. (copy on file) Seconded by La Vaque. 4 Ayes. The Mayor opened the Public Hearing on the road improvement project for Johnson Terrace Addition. The Clerk read the published and mailed legal notice. The Mayor called for opinions, pro or con, on the subject. Several questionswere raised and answered. The Mayor closed the hearing. Motion by Rustad to order improvement and direct the Engineer to request County to do this work, eliminating the East -West portion of Johnson Drive. Seconded by Hodges. The Clerk stated that there was not sufficient funds in the Road .and Bridge Fund account to pay for this project. Roll Call on motion: Blanchard, La Vaque, Hodges Naye Rustad Aye. After some discussion as to procedure: Motion by Rustad to order improvement and have Village Engineer request county to do this work. Project financing to be borrowed from l Dater Utility Fund at 3% interest on loan to Road and Bridge Fund. Seconded by Blanchard. 4 Ayes. Motion by Blanchard to pay bills submitted totaling Seconded by Rustad. 4 Ayes. Motion by Blanchard to approve licenses submitted. (1.1.st attached) Seconded by Rustad. 4 Ayes. Motion by Blanchard upon advise from the Fiscal Consultant that on Tuesday, the 14th of July, 1964 at 8:00 P.M. the Council will receive, open and consider sealed bids for the purchase of $1,575,000 General Obligation Temporary Improvement Bonds of the Village to be issued pursuant to Minnesota Statutes, Section 429.091, Subdivision 3 for the purpose of financing part of the cost of a sanitary sewer improvement for said Village. Said bonds vill be dated August 1, 1964 in denominations to be specified by the purchaser will mature on August 1, 1966 without option of prior payment and will bear interest at a rate to be designated by the purchaser in multiples of or 1 /10 of 1% per annum payable on February 1, 1965 and semiannually thereafter on each August 1 and February 1. All Bonds shall bear interest at a single basic rate from date of issue until paid, but in additon may bear interest at an additional rate for a limited period in total amount nct to exceed $15,750 interest at such additional rate to be represented by "B" Coupons, Principal and interest will be payable at a suitable bank to be designated by the purchaser. The Motion was seconded by La Vaque. 4 Ayes. Motion by Blanchard to pay the adjusted bill to the Attorney totaling $1100.00 Seconded by Rustad. 4 Ayes. Motion by Hodges to approve Subdivision request for Mr. Donald Grant 6950 Knollwood Drive upon receipt of fee and completed application. Seconded by Blanchard. 4 Ayes. Motion by Hodges to appoint Mr. Art. E. Schott 7841 Spring Lake Road as Councilman to fill the unexpired term of John Sullivan. (To December 31, 1964) Seconded by Rusted. 4 Ayes. The Clerk more Mr. Schott in as Councilman and he was seated. Motion by Schott to adjourn, Seconded by La Vague. 4 Ayes. Meeting adjourned at 10:55 P.M.
