Inc. White Bear PROCEEDINGS OF THE VILLAGE COUNCIL VILLAGE OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA The regular meeting of the Mounds View Village Council was called to order by Mayor, Donald C. Hodges at 8:00 P.M., November 9, 1964 at 2401 Highway 10. Roll Call of Officers: Also Present: Adm. Clerk: Attorney: Engineer: 1,950.00 1,775.00 1,780.00 1,789.00 Donald C. Hodges Charles D. Boog Richard Meyers Shelly Boehm Motion by Hodges to allow Trustee Ingram Rusted, the Acting Mayor to sign the Village Voucher Checks in the Mayor's absence. Seconded by Rustad. 4 Ayes. Motion Carried. 030122 8:00 P.M. Mayor Hodges called three time for further bids on the Pick -up Truck. There being no further bids he declared the bids to be opened. The Administrative Clerk opened the bids and read the following: Name Bid Security 97.50 Check 5 Bond $100.00 Check 5 Bond 89.45 Check Mayor Hodges announced that the apparent low bidder was Midway Ford Company, St. Paul, Minnesota. Motion by Rustad to refer these truck bids to the Attorney for tabulations and to determine the low bid. Seconded by Schott. 4 Ayes. Motion Carried. Motion by Schott to approve the minutes of October 26, 1964 Council Meeting with one correction the word appearing on Page 1, Para. 9, change from rafts to rafters. Seconded by La Vaque. 4 Ayes. Motion Carried. Motion by La Vaque to approve the minutes of Special Meeting of November 4, 1964 as presented. Seconded by Schott. 4 Ayes. Motion Carried. Oi0123 Mr. Samuel B. Fried, Mounds View Justice of Peace, asked why his name was not placed first on the election ballot for J.P. in the November 3, 1964 Election. Mayor Hodges stated that apparently an error had been made in placing the names on the ballot. Mr. Fried stated that he was convinced that the placement of his name last on the ballot in violation of Minnesota Statue !205.05 was a deliberate attempt and an intentional and wilful act to influence the election and contributed to his defeat. Mr. Fried stated that thi s was a feloniousact as stated under State Statue 210.15. The person responsible was Paul Boog,stated Mr. Fried. Mr. Boog denied these charges and explained that this was very unfortunate. It was a technicallity and it was difficult to determine whose fault it was. Mr. Fried also stated that 200 additional ballots had been delivered to each of the precincts without the request by Officials in charge of the Precincts. Mrs. Florence Peterson, stated that she was the chairwoman in Precinct 2 and that she had requested additional ballots. Mrs.Ila Mc Cue stated that she was the chairwoman in Precinct #1 and that although she told Mrs. Fried on the telephone that she didn't specifically order the additional village ballots, as chairwoman, she placed an order for ballots and she received all the different ballots available. It was Mrs. Mc Cues opinion and others she talked to that the names on the ballots were rotated. Mr. Boog stated that both the Ramsey County Auditors and Mounds View Clerk's Office received requests for ballots and supplied the precincts with additional ballots. Mr. Fried read a written statement of all the charges. Mr. Fried asked the Council to set aside results of the election and to conduct another election for J.P. Ma-or Hodges stated that if there were no objections this request along with the charges would be referred to the Attorney for a legal opinion. The Attorney is to report to the Council by Monday, November 16, 1964. Mr. Rustad stated Mr. Fried was appointed by the Council and had done a good job. Mr. Joseph Stork, 8016 Red Oak Drive asked and received information on the drainage installation by his home. Mr. Joseph Dolphy, 1925 Highway 10, requested a license for a used car lot. He was informed that the request would go through the planning commission fist. He stated he was cleaning up his back yard. -2- Mr. Jesse Varns, 7350 Fairchild Asked the Council to request ISP to install gas on Fairchild Avenue. Mayor Hodges directed the Clerk's Office to write a letter to N.S.P. requesting a gas line on this street. Mrs. Ile Mc Cue suggested that the Council consider permanent voter registration by Mounds View. Mr. John Suilivan asked how the Election Judges were selected. Mr. Boog explained that a new list of the names of residents were compiled at each election. The list of names were submitted to the Council for their approval. The list is compiled f *om letter, phone calls and personal contact at the Village Hall, plus lists submitted by the Political Parties. -3- 0d0124 The Attorney and Engineer answered questions about the extension of Silver Lake Road.Construction of this street South of Highway 10 in 1965 but that North of Highway 10 is doubtful in 1965. Mayor Hodges read a letter from Mr. G.E.Harmon, requesting use of a rink designated as a hockey rink at Hillview and Lambert Parks and use of a non hockey rink at Hillview Park. Also requested warming horses open and warm with an attendant present. The hockey schedule is from 1 :00 P.M. to 2:30 P.M., January 2 to February 13, 1965, for 4th, 5th and 6th grade boys. Mayor Hodges submitted the annual report of the Suburban Ramsey County Nursing Service. Motion by Hodges to appoint the following to the Police Civil Service Commission to become effective January 1, 1965 Mr. Glen Dawson -2201 Lambert Avenue to the three year term. Mr. Donald Schaffhausen 2000 County Road H -2 to the two year term. Mr. Lowell Uber 2105 Hillview Road to the one year term. Seconded by Schott. 4 Ayes. Motion Carried. Trustee Rustad read the October B and E Patrol Report (on file) and the October Police Department Report. Motion by Rustad to install a street sign at the corner of Red Oak Drive and County Road H -2 and also a street sign at the corner of Red Oak Drive and Longview. Seconded by La Vague. 4 Ayes. Motion Carried. Motion by Rustad to instruct the Clerk to have N.S.P. install a street light at Red' Oak Drive and County Road H -2.• This request from a petition from residents in this area. Seconded by S7.hott. 4 Ayes. Motion Carried. Trustee Rustad stated that several persons had talked to him about fluoridation of Village water and he believed that a petition would be presented in the near future. 9:00 P.M. Mayor Hodges declared that the Public Improvement Hearing be opened to discuss the Water Main Extension on Fairchild Avenue from County Road H -2 to Woodcrest. The Administrative Clerk read the printed notice. The Engineer explained that the County intends to extend Silver Lake Road through Fairchild Avenueand it would be at least four years before any cut into the road for improvements could be made. The estimated cost is $4.00 per foot. The mayor asked for those in favor of this improvement. Mr. Mrs. George Koskinen 2061 Woodale Drive In Favor Mr. David Mueller 5169 Red Oak Drive In Favor. Mr. Ed Dropps 7039 Knollwood Drive In Favor Mrs. M. 'Winters 2049 Woodcrest Drive In Favor Mayor Hodges asked for those who opposed this project. None appeared. Mayor Hodges closed the Hon inn at 9:15 P.M. Trustee Rustad read the Civil Defense activities on Halloween Night. Read a thank you letter from the Mounds View Police Department to the Civil Defense. Reported that a Mr. Jack Yost is to conduct a Civil Defense course at the Village Hall. 1 -4 C Al25 Motion by La Vaque to reduce the water bill for Paul Hoffman, 7767 Long Lake Road to the six dollar. minimum. Seconded by Hodges. 4 Ayes. Motion Carried. Trustee La Vaque reported that a Certificate of Safety from the Water Works Association was received. Mr. La Vaque reported on the excessive amount of breaking of the warning markers and the vandalism regarding the sewer project. Trustee Schott read a letter from the Ramsey County Engineer stating that last year Mounds View Village used 4 tons of sand per while all other Villages only used one ton per mile for sanding their streets last winter. Mr. Sullivan, former Trustee, who was in charge of the street maintenance last year, stated that last winter the foreman was.given permission to order out sanding crews. Trustee Rustad stated he was dissatisfied with the results of last years street sanding. Trustee Schott said he would use other methods. Trustee Schott reported on the repairing of the streets in the C -1 C -3 areas and that Knollwood Drive, the worst one, had been repaired. Mr. Edmond requested information about a street lighting ordinance. Mr. Skiba requested an ordinance on Air Conditioning. Engineer Boehm explained the progress of the Sanitary Sewer Construction. Engineer Boehm presented and explained the following change orders: 2, Schedule A, 1 Schedule B, and 1 Schedule C. Motion by Hodges to approve change order 2, Schedule A by adding $2,475..00 to the contract lump sum. This is for tight sheeting on Sherwood Road and Jackson Drive. Seconded by Rustad. 4 Ayes. Motion carried. Motion by La Vaque to approve change order 1, Schedule B. RE to construct a cleanout manhole on the 8" C.I.F.M. on Edgewood at Bronson Drive. This manhole was added to the contract at the request of the State Board of Health. Addition to the contract of $475.00. Seconded by Rustad. 4 Ayes. Motion carried. Motion by Hodges to approve change order 1, Schedule C. To apply S.C. liquid asphalt material on streets in Mounds View at the rate of 19 cents per gallon where sewer and drainage lines have been constructed. Seconded by Schott. 4 Ayes. Motion carried. Engineer Boehm submitted a report on the proposed relocation of State Trunk Highway 10 across the Northeast corner of Mounds View. He suggested that prior to signing an agreement for construction with the Minnesota Highway Department the Village should consider several items pertaining to the land involved; Sanitary Sewer and Water Improvements and Village streets affected. The Council directed. the Engineer to check with the Highway Department for a meeting to resolve answers to these problems. (at the next agenda meeting if possible.) Attorney Meyers asked the Council to consider asking the Highway Department to move the proposed 10 further North because of the complications of their present plans. -5- 0u0126 Motion by Hodges to adopt Resolution 178 o give authority to the Village Attorney to acquire land to be r Sanitary Oft Sewer and drainage. To begin condemnation proceedings and to acquire easements 85, 90 thru 98, 100 thru 106, 108, 109, 112, 114, 115, 116, 129 thru 133, 135, 137, 139 thru 147, 149, 150, 151. Seconded by La Vaque. 4 Ayes. Motion Carried. Motion by Rustad to authorize the Mayor and Chief of Police to sign the set -up license for the Bel -Rae Ballroom. Seconded by La Vaque. 4 Ayes. Motion Carried. Motion by La Vaque to order the Water Mair Improvement Project on Fairchild from County Road H -2 to Woodcrest and to direct the Engineer to prepare the final plans and specs. Seconded by Schott. 4 Ayes. Motion Carried. Motion by La Vaque to authorize the Clerk to approve plans and advertise for bids for construction of Sanitary Sewer Improvement Project 1964 -3, including Water Main Improvement on Fairchild. Bids to be opened December 14, 1964, at 7:00 P.M.. Seconded by Hodges. 4 Ayes. Motion Carried. Attorney Meyers submitted a Water Drainage agreement with the Village of Shoreview. Motion by Schott to adopt Ordinance 120. An Ordinance amending Ordinance 56 relative to Plywood Roof Boards. Seconded by Rustad. 4 Ayes. Motion Carried. Mr. George Peppers, 7944 Greenfield Avenue complained that the street construction work on Johnson Drive extended beyond the limits agreed upon by the Council and the property owners. After discussion, Mayor Hodges directed the Clerk's Office to check the minutes and report back to the Council. Motion by Hodges to pay the bills submitted totaling $160,878.30. Seconded by Schott. 4 Ayes. Motion Carried, Motion by La Vaque to approve the licenses. (list attached) Seconded by Rustad. 4 Ayes. Motion Carried. A request from Bell Telephone Company to place buried cable on Groveland Road, South of Highway 10 was referred to the Engineer for approval. Motion by La Vaque to adjourn the meeting.
