PROCEEDINGS OF THE VILLAGE COUNCIL

The regular meeting of the Mounds View Village Council
was called to order by Mayor Hodges at 3:00 P.M., December 14, 1964
at 2401 Highway 10.

The Mayor called three times for further bids for Sanitary
Sewer Improvement Project 1964 -3 lateral and road.
The Mayor closed the bidding and directed the Clerk and
Engineer to open the twelve bids, copy attached.
The Mayor asked if there were any bids submitted and not
read. There were none.
Motion by Blanchard to refer bids to the Engineer for
tabulation and recommendation. Seconded by Schott. 5 Ayes. Motion
Carried.
Motion by Rustad to approve minutes of November 23, 1964
meeting. Seconded by La Vague. 5 Ayes. Motion Carried.
Trustee Rustad stated he was dissatisfied with the plowing
of Village streets. Rustad reported that a County Foreman approached
him to sign a paper before snow removal could begin. Trustee Rustad
asked questions as to the procedure of removing snow in prwvious years.
Clerk Blanchard reported on the progress of the :•North
Suburban Sanitary Sewer District. He stated that August 1, 1965 is the
date set for NSSSD to hook onto the Mounds View sewer system.
Blanchard announced that State Representative, Robert Ashback, is in
favor of a metro sewer plan if Regional plants are allowed.
The Clerk's Office had received information that a house on
La Porte Drive had their well dried up due to the sewer construction
in that area. The Engineer stated the emergency would last for 2 to 4
weeks and that the water table would come back up after the construction
was completed.
Motion by Rustad to instruct ''alter Skiba to contact some area
water installation contractor to get the lowest bid for this work.
To authorize the Attorney to draft an agreement for the owners to sign
to granting permission to enter onto and install water on the property.
Also to authorize Walter Skiba to hire the contractor after the owners
have signed the agreement. Seconded by Blanchard. 5 Ayes. Motion
carried.

Mr. Foss submitted the Norseman Plot plan for approval.
Motion by Le Vaque to approve the final plat plan for
Norseman 1st Addition and authorize the Mayor and Clerk to sign it.
(Located at County Road H -2 and Raymond Avenue 14 duplexes)
Seconded by Schott. 5 Ayes. Motion Carried.
Mr. E. John :Abdo, Attorney, representing Harold Ellsworth
and Harry Fankhanel who applied for a special use permit to build a
Mobile Home Park on the Moga Rice Creek Area.
Motion by La Vaque to refer this matter to the Planning
Commission. Seconded by Hodges. 5 Ayes. Motion Carried.
Mr. Ramacher, Manager of the Bel Rae Ballroom, requested
permission from the Village Council to install a reflector on the
Village Water Tower. This reflector is to allow live T.V. to be
broadcast from the Ballroom.
Motion by Hodges to refer to the Attorney the question
of legality of leasing Public property to private individuals and
instruct the Attorney to give an opinion on the request to permit
installation of a reflector on the Mounds View Water Tower to be used
as a TV antenna. The Council would call a special meeting to discuss
and to take action on this request. Seconded by La Vaque. 5 Ayes.
Motion. carried.
Mayor Hodges stated that the dog catcher had been instructed
to enforce the dog control ordinance at all Village Skating rinks.
Mr. A. Hillsdale requested information on the drainage
problem on Bronson Road and Adams. This was referred to the Engineer.
Mayor Hodges reported on the Mobile Home Park Developement
meeting held on December 7, 1964 at the Village Hall. This
referred to the Moga -Rice Creek area.
Mayor Hodges reported on the December 10, 1964 meeting in
St. Paul for the Suburban Mayor and Officials. The meeting requested
by Mayor Vavolis, spent time discussing the entire range of suburban
problems.
Mayor Hodges reported that the ice skating rinks are ready,
the warming houses are open, and attendents are working.
Trustee Rustad asked about having a warming house on Spring
Lake. Mayor Hodges reported that some steps are being planned toward
this goal.
Trustee Rustad read the Police report for November. (on file)
After some discussion about winter parking near the apartments on
Groberg Avenue the Council decided to enforce the Snow Bird Ordinance.
Rusted read the B and E Patrol report for November.
Rusted reported on the meeting held with the Minnesota
Highway Department.
Motion by Rustad to adopt Resolut'on 180 pproval of Trunk
Highway 3547 Plans from Arms Plant to Nort C to Limits, Portion
Layout 6D.S.P. 6284 -21; 0280 -01. 5econdetl�-h Alanchard. 5 Ayes.
Motion Carried.

Trustee La Vaque reported that the water hydrants had been
installed on Lambert and Hillvew Parks by Clark and Moore with Village
help. Because of the cold weather, the Water Department has had to
repair some frozen water meters.
Trustee La Vaque reported that three deliquent water
accounts were going to be shut off from Municipal Water.
Trustee Schott read a letter from the Ramsey County
Engineer's Office stating the snow plowing and sanding procedure
for the 1964 -65 winter and that no special attention would be given
to dead ends, driveways, and cul de sacs. The County would not
accept the responsibility for damage to mail boxes.
Motion by Blanchard to deny the request for a subdivision
by Ansel Gardner for Lot 14, Block 12, Greenfield Addition, for the
lots to be 65' wide. Seconded by La Vaque. 5 Ayes. Motion Carried.
Motion by Hodges to approve Charles Jackson's request to
hold up the remainder of the funds in the Civil Defense Budget in
1964 and carry over these funds and add them to the 1965 budget.
Seconded by Rustad. Roll Call on Motion. Rustad, Hodges, La Vaque
Aye; Blanchard and Schott Nay. Motion Carried.
Motion by La Vaque to accept the applications for
membership in the Water Works Association for Walter Skiba.
Seconded by Hodges. 5 Ayes. Motion Carried.
Engineer Boehm reported on the Sanitary Sewer Interceptor
System progress in the Village. He explained about the servicing
of the N.E. Portion of the Village. This matter to be.discussed at
the next agenda meeting and the land owners to be invited to attend.
Motion by Blanchard to instruct the Engineer to prepare
the assessment roles for the Sanitary S' Interceptor and Drainage
Improvement Project 1964 -1, the 1964 -2 lift stations, the Street and
Water Improvement 1964 -1 Fourth and Woodcrest: The Street and
Water Improvement 1964 -2, Quincy Street, North of Hillview.
Seconded by La Vaque. 5 Ayes. Motion Carried.
Engineer Boehm asked about the extension of Water and
Sewer on County Road H from Irondale Road to Highway 10. This
matter was referred to the next agenda meeting.
Attorney Meyers reviewed the --ss of the case of
Samuel B. Fried, Contest of the J. P. ..,.eLxion. Meyers stated
that the Court in a preliminary hearing had denied his petition
to dismiss the suit of Samuel B. Fried. Meyers thought that Fried
would be the contestant and the apparent election winner, Charles Hall,
the contesiee along with Village Clerk Blanchard. Until the Court
makes a determination, Clerk Blanchard is prohibited from issuing
an election certificate to Charles Hall even though the Council has
canvassed the election results and declared Hall, the candidate
with the plurality of votes. If the Court did rule for Fried
the Village would then wait the Courts counsel on the next step.

Fried stated that it seemed to him that Meyers is represent ?J
the matter in Hall's behalf. Meyers said he didn't care who was the
J.P. Meyers also said that it hadn't been the Council that brought
the matter into the newspapers and courts. That since it was, the
Council felt it had the right to protect the Clerk's Office. Trustee
La Vaque called Fried's accusation a reflection on the whole group.
Mr. Fried stated he did not believe that the Village Attorney
needed to represent the Clerk. Mr. Blanchard stated that he did not agree
with Mr. Fried. Mr. Fried accused Adm. Clerk, Mr. Boog of malfeasance
of office.
Mr. Blanchard stated that since Mr. Fried had accused Adm.
Clerk, Paul Boog, of wilfull and deliberate intention in committing
the error on the ballots the Council must protect the Clerk's Office.
Fried stated that these things might not come up. Meyers said these
things should come in since they are the basis of the Court Trial.
Motion by Blanchard in regards to the election contest of
Samuel B. Fried, the Village Attorney should represent the Village
Clerk and his staff at all hearings§ trials, and appeals regarding
this matter. Seconded by La Vaque. Roll Call of Officers: Hodges,
Blanchard Schott, La Vaque, Rustad, Aye. No Nayes. Motion Carried.
Mayor Hodges stated that the Council should back up the
Clerk's Office. Meyers stated that the trial would begin at 9:30 A.M.
December 21, 1964. Mr. Fried invited the Council to attend.
Meyers reported that he had contacted a Mr. Forsman from the
Bell Telephone Company. There is no charge to the Village for the
installation of telephone cable.
Motion by La Vaque to adopt Ordinance 123. An Ordinance
designating Johnson Drive. Seconded by Rustad. 5 Ayes. Motion Carried.
Motion by Blanchard to adopt Resolution 181 o correct
assessments. MA 35- Lateral Water Improvement 1 and 1960 -2,
Division 34356, MA 34, Area Water Improvement 1960 -1 and 1960 -2,
Division 34356, MA 33, Street Improvement 58, Division 34354.
Seconded by Rustad. 5 Ayes. Motion Carried.
Motion by Blanchard to accept the recommendations of the
Engineer as the low bidders for the Sewer Lateral Improvement Project
1964 -3. The low bidders are as follows:

and authorize the Clerk and Mayor to execute the contracts after

Motion by Blanchard to approve the list of licenses
submitted. Seconded by La Vaque. 5 Ayes. Motion Carrie -1.
Motion by Blanchard to pay the bills totaling 173,024.73.

Clerk Blanchard read the financial report of Lakeside Park
Commission for the period 2 -18 -64 to 12 -1 -64.
Meyers asked about the financing of the sewer improvement
Project, He was instructed to continue.
Motion by Blanchard to advertise for bids for an Office
Billing Machine to open the bids on January 11, 1965 at 8:00 P.M.
Seconded by La Vague. 5 Ayes. Motion carried.
Motion by Blanchard to grant a half day holiday on the
24th of December and the 31st of December. Seconded by Rustad.

Mayor Hodges directed the Clerk's Office to draft a Holiday
Policy for the coming year.
Motion by Blanchard to declare that Municipal Water is
available on Water. Improvement Project 1963 -1. (Mueller Addition
and Groveland Extension) The residents have until June 30th, 1965
to hook -up to the Water system before the $100.00 water hook -up
charge would be applied. Seconded by La Vague. 5 Ayes, Motion carried.
