Appointments Planning Commission fl, f PROCEEDINGS OF THE VILLAGE COUNCIL RAMSEY COUNTY, MINNESOTA VILLAGE OF MOUNDS VIEW L f JANUARY 9, 1967 The regular meeting of the Mounds View Village Council was called to order by Mayor Rustad at 8:00 p.m. on Monday, January 9, 1967 at the Village Hall, 2401 Highway #10, St. Paul, Minnesota 55112. Motion Carried 4 Ayes (Malvin Abstaining) No requests or comments from residents. MOTION made, (Rustad) seconded (Malvin), to appoint Richard Meyers as Attorney for 1967. Motion Carried 5 Ayes MOTION made, (Rustad) seconded (Malvin) to appoint Comstock and Davis, Inc. as Engineers for 1967. AMENDMENT made, (Walser) seconded (Lang) to postpone the appointment of the Engineers pending the out —come 6f the current controversy with 1 Lametti .and to permit further discussion and consideration of the appoint a A discussion of engineering questions between council memo 'irs, citizens and the Engineer followed. The vote on the amendment polled Trustee Lang and Clerk Walser FOR and Mayor Rustad, Trustee Johnson and Trustee Malvin AGAINST. Amendment defeated Further discussion of engineering pri,blems between the Council floor and Engineer followed. The report of the Associated General Contractors of Minnesota, Inc. was discussed and the possibility of a law suit over the °.ametti controversy was mentioned. The Engineer explained at length, the reasons for various change orders and commented oa the difficulties encountered in th3 sewer project under question. He also indicated that the Lametti Company had never shown cause or justification for the additional sums that they had requested. Motion Carried Motion made, (Rustad) seconded (Johnson), to appoint Dr. Sartor as Health Officer for 1967. Motion Carried 5 Ayes The appointment of the Dog Catcher was deferred by Mayor Rustad after comments on B E and Bruce Flemings' D Service as to equipment,` service provided and costs by both Trustee Malvin and Clerk 'falser. Bruce ,Fleming, who had been invited to appear and explain his service, was not present. Motion r_.ade. (Rustad) Seconded (Johnson), to appoint tally Skiba as Public Works Superintendent for 1967. Motion Carried 5 Ayes Motion made, (Rustad) seconded (Malvin) to appoint Ronald Fagestrer as Fire Marshall for 1967. Motion made, (Rustad) seconded (Malvin) to approve the follm ng appointments to the Planning Commission for 1967. Council Representative Gary Lang Chairman Milt Stole Charlotte Foreslund Phyllis Blanchard George Gustafson Alvin Hillsdale Charles Larson Don Erickson James Burgraff Gary Lang and Milt Stole were directed to contact the others and verify their continued participation. Motion Carried 5 Ayes Motion made, (Rustad) seconded (Johnson) to appoint Robert '_lser as Registrar of Voters for 1967 at `u10.00 per monthly salary. Motion Carried 5 Ayes The appointment of the Fiscal Agent was deferred by Mayor Rustad. Mayor Rustad reported that the old police car previously turned .over to the water and sewer department will be used by ':Dally Skiba in place of his privately owned vehicle for certain village business. Motion made (Johnson) seconded (Malvin) to discontinue the $50.00 monthly allowance to '.Wally Skiba for truck expenses. Insurance cover— age on the truck will also be dropped. Motion Carried 5 Ayes Clerk Walser announced that financial fact sheets will be provided at future meetings. Clerk Walser announced that an apparent shortage of $29.20 existed in the Clerks' Office as of January 1, 1967. Mayor Rustad Appointed Gary Lang as representative of the council to the Metro Tax Study Meeting to be held Wednesday, January 11, in Edina High School. Mayor Rustad referred the letter setting up a meeting with State Highway Department Officials regarding access of county roads with highways to the engineer. Motion made, (Walser) seconded (Rustad) to approve Resolutions 4270, #271, #272, #273, #274, regarding Lot Splits for tax apportion— ment purposes. Motion Carried 5 Ayes Motion made, (Walser) seconded (Rustad) to approve the purchase of 7 4 ^e equipment consisting of a hot plate (8.95) and a stencil file (59.50), Motion Carried 5 Ayes Motion made, (Walser) seconded (Lang) to recind payment of check #P 2979 to Joanne Le Casse in the amount of $174,30 and refer the matter to the attorney for further study. Mr. Blanchard challenged the legality of the Treasurer in not approving an authorized check. Mr. Blanchard cited previous cases when additional pay had been granted to terminating employees. Irene Edberg, Treasurer, defended her action and stated t' ^k had not yet been signed by the Clerk at the time 10 ol::., on, The Clerk reviewed the details of the matter and su90.sted that payment was NOT in lieu of notice as some previous cases had been. The attorney concurred with the act_on taken, but will study the matter further and issue a legal opinion later. Trustee Lang reported that residents had complained about the slow snow removal during the recent storm and commented that the county was apparently somewhat over extended on its capability due to recent add- itions to the list of roads serviced by the County. Mayor Rustad requested that Trustee Lang meet with the commissioner and discuss the problem. Motion made, (Rustad) seconded (Lang) to set the Clerks' salary at $50.00 per month. Motion Carried 5 Ayes No reports from Village Inspectors. Motion made, (Rustad) seconded (Johnson) to raise the salary of Jacob R. Gross to $2.00 per hour. Motion Carried 5 Ayes Mayor Rustad reported that ','ally Skiba had requested a large -Lank for flushing jobs and mentioned costs of around $3, Referred to the engineer for study. The attorney reviewed the history of meetings and negotiations with the village maintenance employees union. The proposed resolution was read #276) establishing salaries. Approximately $29.00 in costs per man, each month, insurance is also provided. Motion made, (Johnson) seconded (Malvin) to approve the resolution #276) setting wages at $510.00 per month for maintenance employees with the superintends t recieving $580.00 per month. Motion Carried 5 Ayes Motion made, ?alser) seconded (Malvin) to authorize the hiring of Irene Edberg (the Elected Treasurer) as a part -time clerk typist at a rate of $1.80 per hour. Motion Carried 5 Ayes The Attorney stated that in his opinion the employment of this elected official in a clerk typist capacity was legal. Motion made, (Walser) seconded (Rustad) to continue the appointment of Marilyn Lidberg as Deputy Clerk. Motion Carried 5 Ayes Trustee Malvin read the police report for the month of December 1966 and the yearly report for 1966. Trustee Malvin referred to a recent fast, efficient cracking of a burglary ring by the police Chief, Ernie Grabowski and commended him on his excellent record in the performance of his duties. Motion made, (Malvin) seconded (Johnson) to direct the attorney to prepare a standard agreement form for use by Bel Rae or other local establishments that employ off -duty Mounds View Policemen. The agreement will transfer responsibility for insurance and liability to the establishment employing the policeman. Motion Carried 5 Ayes Minnesota Zoological Societies establishing of a metropolitian Area Zoo at Battle Creek. Motion made, (Rustad) seconded (Walser) to approve the resolution #277) supporting the Battle Creek Metropolitian Zoo. Motion Carried 5 Ayes The attorney submitted copies of the proposed street opening ordinance for study by the council. Motion made, (Johnson) seconded (Rustad) to direct the Attorney to make a cmprehensive study of all insurance needs of the village and report to the council. Motion Carried 5 Ayes The attorney reported that the Greene case trial had resulted in the awarding of a directed verdict to the Village of Mounds View. The plaintiff has until January 13, to appeal. Motion made, (Malvin) seconded (Johnson) to set the police salaries at $675.00 per month for the Police Chief, $610.00 per month for the Sergeant, and the patrolman at $550.00 per month for John Kardell, $500.00 per month for Tim Smith and $475.00 per month for George Katser- es. Officer Katseres to recieve this salary effective May 1, 1967 after completing his six months probation period. Motion Carried 5 Ayes Motion by Walser to publish an extract of minutes withdrawn pending a study of cost involved. The Engineer reported having sent letters to the highway depart ment.on revocation of Groveland from Knollwood to Highway #10 as an MSA Street and requesting designation as MSA Street for Edgewood from County Road I to Hillview and New Arden Avenue from Long Lake Road to Spring Lake Road. This will require a resolution by the council. The Engineer reported difficulity in sealing leaks on current sewer construction due to low temperatures.
