HomeMy WebLinkAboutMinutes - 1968/05/13PROCEEDINGS OF THE VILLAGE COUNCIL VILLAGE OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA May 13, 1968 The Regular Meeting of the Mounds View Village Council was called to order by Mayor Rustad at 8:05 P.M. on Monday, May 13, 1968, at the Village Hall, 2401 Highway 10, St. Paul, Minnesota 55112. Present: Mayor Rustad Clerk Walser Trustee Johnson Trustee Malvin Trustee Lang (Lang /Johnson) To approve the minutes of M /S /P (Johnson /Malvin) To approve the minutes Wa1ly;Wilson of the Spring Lake Park Lions Club a carnival in =Mounds View on the land bordered Road H2 and Silver Lake Road June 19 23. The agenda meeting. Mr. Hayward, Blaine VFW, wants sales at the carnival on Saturday and Sunday. Ay Also Present: Attorney Meyers Engineer Boehm April 22nd. of April 26th. requested permission to conduct by TH #10, Long Lake Road, County Council will review this at the the Council's permission for beer Wayne Mecl, 6969 Knollwood Drive, wished to have a letter stating the north half of his lot (S 1/2 of Lot 103 Knollwood Park Addition) was a buildable lot before it was condemned by NSSSD for the interceptor line. Since it was assessed on the 201 foot side, a letter will be sent to Attorney Meyers stating it was considered a buildable lot. Mr. `D.'Wahl of Colonial Village Mobile Home Park presented a check from the Highway Department with the Village named therein and requested it be signed and returned to him since all assessments are paid. M /S /P (Malvin /Lang) To authorize the Mayor and the Clerk to sign the check for Colonial Village Mobile Homes. A letter will be prepared to FHA for Mr. Dahl, 2909 Glenwood, Minneapolis, Minn. 55405, indicating that Quincy and Hillview are Village streets and that they will be maintained. Mr. Werner thanked the Council for their MAC activity and interest and suggested further points of continuing concern. M /S /P (Rustad /Walser) To purchase a transcript of the MAC hearings. 5 Ayes 5 Ayes John Sadlowsky requested a garage variance at 5072 Brighton Lane. M /S /P (Rustad /Malvin) To approve the side set back variance at 5072 Brighton Lane. 5 Ayes A resident stated that parking on Oakwood by the park during ball games creates a safety problem. Trustee Johnson will have the Police check it out. The TOPS Club requested use of the Village Hall for a dance on May 24th. The Council will permit the use subl to normal conditions. A petition to Anoka County from residents around Judicial Ditch ill was read, requesting the ditch be cleaned out and tiled. Mayor Rustad called a recess at 8:29 P.M. Rezoning hearing was opened at 8:30 Downing Addition Lot 6 Block 1 R1 to R2 The notice was read and the Clerk announced that all owners per abstract were notified. Mr. Downing discussed his plans and showed Plana and a lot layout chart. A petition was presented signed by five of the surrounding residents. Mayor Rusted called for objections three times None! The hearing was closed at 8:35 P.M. This action was approved by the Planning Commission. M /S /P (Johnson /Lang) To conditionally rezone property for duplex building as described. Regular meeting resumed. M /S /P (Walser /Austad) To approve the following licenses: C S Blacktopping asphalt license, Kustom Builders Company, Pinewood Contracting and Sign Crafters general contractors license, and Pinewood Sewer Water Service excavating license. M/S/P (Walser /Austad) To approve payment of bills as represented by checks numbered 2370 2417 (general) and 250 268 (payroll). Mr. Haes presented a letter requesting the Lake Side Park monies be paid and that the $3,500 amount be raised to $4,000. The Council will review the budget and make a decision at that time. Trustee Malvin discussed the proposed easement for a Highway 10 bypass through Wayside Park because of the NSSSD sewer line. The Clerk read the letter of request from NSSSD. Attorney Meyers discussed a cash allowance for regrading and sod or mat left for Village use for park access and /or parking area as con siderations for granting easements. The Highway Department will be contacted by the Engineer regarding access from Highway 10. NSSSD will be invited to attend the sMay `20th agenda meeting to discuss the bypass. Trustee Johnson read the April Police report and B E report. Trustee Johnson recommended amending 83 section of zoning ordinance to make all service stations by Special use permit only. The Attorney will prepare the amendment. Trustee Johnson suggested putting time limits on all conditional rezonings. The Attorney and Council discussed the problem and 90 days was the tentatively agreed time limit for getting building permits. The Attorney was requested to prepare the amendment. Present conditionals will have 90 days to act. Rezoning hearing was opened at 9:00 That part of the Northeast 1/4 of the Northeast 1/4 of Section 7, Township 30, Range 23, Ramsey County, Minnesota described as follows: Beginning at the Southeast corner of said Northeast 1/4 of the Northeast 1 /4;thence West along the South line of said Northeast 1/4 of the Northeast 1/4 a distance of 310.5 feet; thence North parallel with the East line of said Northeast 1/4 of the Northeast 1/4 a distance of 366.55 feet; to the South line of the right of way of Trunk Highway; thence Southeasterly along the South line of said right of way a distance of 409.14 feet to the East line of said Northeast 1/4 of the Northeast 1/4; thence South along the East line of said Northeast 1/4 of the Northeast 1/4 a distance of 95.14 feet to the point of beginning, except the East 33 feet thereof taken for road purposes. Generally located on the Southwest corner of Trunk Highway 10 and Long Lake Road. 1 -1 to B -3 Special Use. (Mobile home sales) The notice was read and the Clerk attested to notices sent. Stan Peickert of Par Ex'homes presented the layout and described the proposed development. P. H. Carr, attorney representing Emeny Realty, objected on basis of effect to the adjacent surrounding property. He indicates that all adjoining property owners except Phillips 66 were contacted and objected. Ray Flader, attorney representing O'Neil property across Long Lake Road, objects on basis of effect to their land and proposed use thereof. Objecting letter from Mr. Nilva was read, property west of Long Lake Road on side of TH #10. Mr. Peickert commented on the objections raised. He stated that traffic would be light; that adjacent property will also have to be rezoned; that the use is rather temporary (if use permit was renewed yearly) and could be used for other things later when other (like shopping center) development occurs. The property would be attractively developed now! Mr. Minor discussed his plans for use of the adjacent land and his objections to mobile home sales use. Mayor Rustad cal led for objections 3 times None! Hearing closed at 9:25 P.M. The Council commented in opposition on basis of negligible increase in accessed valuation. Trustee Lang stated that street sweeping has been completed. The bill was a little over $1,500. He also commented on the Launching Pad problem with unfinished land. The office was directed to send a second letter and copy of nuisance ordinance to the Launching Pad but Mr. Skiba will see him personally and suggest seeding with oats first. Wally Skiba suggested the Council meet with Eigenheer and declare water availability to control the $100 late fee handling will be considered after final acceptance of water project. The walkway from Erickson to Adams was discussed. The easement will be checked. Civil Defense reported they have members attending a "light rescue" school. Attorney Meyers requested legals on all conditionally rezoned property. The Lametti case comes to trial on May 21, 1968. Howard Larson's lot split George Gustafson indicated that new owner will pay all assessments due in cash. The Council can be covered by workmans compensation when on Village business if Council action is taken. Office will check on cost. 4- Engineer Boehm reported on his review of the use of plastic pipe in buildings of the Village. The Engineer feels Village action can authorize this use, subject to recommended types and use considerations. Mayor; Rustad requested the Engineer draft an amendment to the building code permitting use of plastic pipe. Engineer Boehm proposed that the Edgewood lift staion be replaced with gravity line to new main line. M /S /P. (Rustad /Lang) To direct Engineer to prepare preliminary report and cost estimate on gravity, line installation. M /S /P (Rustad /Lang) To prepare the final plans and specifications for the test well program- HUD grant. Plotting of lots between Groveland and Spring Lake Road and South of County Road I was discussed. Only requirement will be to provide an abstract.
