PROCEEDINGS OF TIIE VILLAGE COUNCIL
VILLAGE OF MOUNDS VIEW
RAMSEY COUNTY, MINNESOTA
May 2 1968
The Regular Meeting of the Mounds View Village Council was called to order by
Mayor Rusted at 8:00 P.M. on Monday, May 27, 1968, at the Village Hall, 2401
Highway #10, St. Paul, Minnesota 55112.
Also Present: Attorney Meyers
Engineer Boehm
Absent: Trustee Lang
Approval of the May 13th minutes was deferred to the next meeting.
Mr. Dahl of Colonial Village discussed an assessment split. It will be taken
care of later in the meeting.
A petition signed by all residents on St. Stephens requesting a street light
was read by Mayor Rusted.
M /S /P (Malvin /Johnson) To install a street light in the middle of the block
on St. Stephens Street. 4 Ayes
A letter from MAC announcing a meeting on May 31, 1968, at 9:30 A.M. at the
Anoka County Courthouse was read by Mayor Rusted.
'1 Mayor Rustad read Planning Commission recommendations for Council consideration.

Merwin Barth requested a lot split and variance (recommended by the Planning
Commission), for Lots 1 and 2, Block 5, LaPorte Meadows Smuder Addition. Road
access was discussed and the availability of water and sewer were detailed by
the engineer.
M /S /P (Rustad /Malvin) To approve the Smuder preliminary plat and variance
subject to the signing of an assessment agreement. 4 Ayes
Merwin Barth requested approval of a preliminary plat, approved by the Planning
Commission with a 75 foot variance on the frontages of a 26 lot addition.
Part of Lots 38 and 39 and all of Lot 41, Auditors Subdivision #89.
M /S /P (Johnson /Malvin) To approve the preliminary plat of the 26 lot
Barth Wakiriak Addition with variances. 4 Ayes
Donald Drung requested a subdivision of Lot 75 Spring Lake Park Knolls
Addition. Approved by Planning Commission. House placement on lots in
reference to street right of ways to provide access was discussed.
M /S /P (Malvin /Johnson) To approve the lot split for Donald Drung subject
to the signing of an assessment agreement and per Planning Commission plan
to set house as far South and as far back as possible on lot.
Richard Birdsall, 2251 Pinewood Drive requested a special use permit to
install copying machines in his basement for one year and renewable by
the Council. Approved by the Planning Commis ion. The attorney advised
that no special use permit is required subject to compliance with the
zoning ordinance.

Eigenheer, Lot 9, Block 3, Eigenheer 2nd Addition.
M/S/P (Rustad/Malvin) To approve variance for Orville Sachs, 2242 Lois
Drive, Lot 7, Block 18, Pinewood Terrace #5.
M /S /P (Malvin /Johnson) To approve variance for Mr. Biskey, 5155 Greenwood
Drive, Lot 1, Block 2, Clint's Addition.
Howard Larson lot split, West 80 feet of Lot 41, was discussed. Assessment
payments were presented for additional amounts.
M /S /P (Malvin /Johnson) To approve the Howard Larson lot split.
The Planning Commission report was submitted for filing.
Mayor Rusted read a letter from Northern States Power explaining a gas rate
increase.

and enter into the one year maintenance agreement for Project 1967 -5.
M /S /P (Walser /Rusted) To approve the following licenses: Mermaid Cocktail
Lounge, Simon's Linuor Store, Inc. off sale liquor licenses; Mermaid Cocktail
Lounge on sale liquor license; Larson Excavating, Kadlec Excavating, Olsons
Plumbing Company excavating licenses; Staber Construction, McCall and Company,
Giertsen Company, Gorco Construction Company, White Oak Builders, Inc. general
contracting licenses; Mermaid Cocktail Lounge cabaret license? Mermaid Cocktail
Lounge food license; Bel Rae Ballroom dance license; B H Blacktopping
Company, All Service Blacktopping, Inc. Asphalt licenses; Geo. Sedgwick Heating
and Air Conditioning Company, Advances Heating and Air Conditioning heating
and air conditioning licenses.
Clerk Walser announced that no abstract was received for the hearing scheduled
for 8:30 for improvement project 1968- 2(Park View Terrace) so the hearing will
not be held.
The Maynard Jurgensen request regarding a concrete slab will not require Council
action.

M /S.P (Malvin /Johnson) To declare water available for 1967 -5 project as
of this date. (They will have six months to pay without a late hookup charge). 4 Ayes
Trustee Johnson advised that signs along Oakwood, limiting parking to only
one side of the street will be up in one week.
Attorney Meyers submitted a draft to the Engineer, of a proposed ordinance
to allow use of non- metallic pipe, for review before Council action.
Attorney Meyers presented an ordinance to regulate service station construction
and to limit rezoning time.
M /S /P (Malvin /Johnson) To adopt Ordinance #150, removing service stations
from permitted used to uses by special use permit under B -3 zoning, and to
set a 90 day time limit, on all conditional re- zonings.
Attorney Meyers presented information explaining action required to have
the Council covered by Workmen's Compensation. He will prepare an
ordinance.
Attorney Meyers reported on court trials. The Lametti case history was
reviewed. The difference between their bid and the actual cost by another
contractor was the amount of our lawsuit against them. The jury has ruled
that it was not an honest mistake and Lametti is liable but the amount has
not yet been set.

Engineer Boehm reported on the Adams to Erickson and Erickson to Quincy
walkways. They are on the maps and exist and should require no action.
M /S /P (Austad /Malvin) To accept the final plans and specifications for
street improvement Project 1968 -1, a sewer and water continuation of 1967 -5.
The bid opening will be at 12:00 noon on June 17th. 4 Ayes
Engineer Boehm suggested setting a hearing date on the new water project
involving the HUD grant.
M /S /P (Austad /Walser) To set the hearing for 7:00 on June 25, 1968, for
Water Improvement Project 1968 -3. 4 Ayes
Engineer Boehm reported that Mr. Gustafson has announced proposed street
development hearings for next week, June 4, 5, 6 and June 11 and 12, for
several areas.
Mr. Earl Smith questioned the walkway between Quincy and Erickson Road.
There seems to be a misunderstanding of where the easement is located. The
Village Engineer and Attorney will investigate.
