HomeMy WebLinkAboutMinutes - 1969/02/10The Regular Meeting of the Mounds View Village Council was called to order by Mayor Rustad at 8:01 P.M. on Monday, February 10, 1969, at the Village Hall, 2401 Highway #10, St. Paul, Minnesota 55112. Present: Mayor Rustad Councilman Malvin Councilman Johnson Councilman Hodges Councilman Blanchard PROCEEDINGS OF THE VILLAGE COUNCIL VILLAGE OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA February 10, 1969 Also Present: Clerk Administrator Zylla Attorney Meyers Engineer Bot-hm MSP (Blanchard /Johnson) To approve the minutes of January 27th with the following corrections: Page 5 Paragraph 6, Change Curtis Johnson to Ernest Johnson and Page 5 Paragraph 9, Paul Pasch to Paul Pashibin. Residents Requests and Comments Mayor Rustad read a news telegram entitled "Your Role in Preparing the Twin Cities Area for the Year 2000 Subject will be part of a half hour television show at 9:00 P.M., Tuesday, February llth. 4 Ayes Malvin Abstained Mrs. W. J. Graffinger, 2229 County Road H2, requests information on what is going in in the area located South of County Road H2, West of Highway #8 and North of Highway #10. The Council explained that there will be a hearing March 10th at which a proposed multiple dwelling and shopping center development will be heard. Land immediately across the street from her is presently zoned for multiple dwelling. Mrs. John Gutenhauf would like no parking signs put up on County Road H2 between Jackson and Highway #10. The Council reacted favorably and stated they would discuss the possibility of installing signs with the Chief of Police. A letter was also read from Senator Tom Grieg thanking the Village Council for their support against the Metropolitan Sewer Bill (Senate file 237). Representative Carl Moen also sent a letter, read by the Mayor, in which he voiced his disapproval of the bill (House file #335). Representative Moen also sent a copy of a bill calling for the abolition of County Board and other county agencies and municipalities and establishing a single county government. Representative Moen requested the Councils opinion of the bill. MSP (Blanchard /Johnson) To send a letter to Representative Moen and Senator Grieg stating Council opposition to this bill and their desire to see the bill defeated in its present form. 5 Ayes Mayor Rustad read a letter which he proposed be sent to Senator Ashbach in which Council opposition to the Metropolitan Sewer Bill was made clear. The letter states that the Metropolitan Sewer Bill was vague and presently not in the best interests of the citizens of Mounds View. 2 Mayor also read the Police Report for January and the B E Report for the year. Mayor Rustad, as Police Commissioner, recommended that effective March 1st Patrolman Tim Smith be moved to juvenile investigating officer at no change in his present salary. Officer John Kardell to Sergeant, his salary to be increased from $650 a month to $675 per month thereafter effective January 1, 1970 sergeants salary would be increased to $50 per month above patrolmans. Sergeant Duane Hagen promoted to Captain. His salary to remain the same at $735 per month. Permanent salary for captain will be $35 above sergeant in 1970. The above officers would be on a six month probation period before ratings would become permanent. MSP (Rustad /Johnson) To approve the above promotions effective March 1, 1969. 5 Ayes MSP (Rustad /Johnson) To appoint Perry Malvin acting Mayor for 1969. 5 Ayes Clerk- Administrator Zylla's Report MSP (Blanchard /Hodges) To approve the attendance of Clerk Zylla with all fees for a conference for Municipal Clerks;Finance Officers March llth and 12th at the Pick Nicollet Hotel, Minneapolis, Minnesota. The conference is sponsored by the League of Minnesota Municipalities. Registration fee is $25.00. Clerk Zylla also announced that a legislative briefing conference will be held February 27th at 10:00 A.M. at the Holiday Inn in St. Paul to explain legislation at the current session and to permit municipal officials to discuss these measures with their legislators at the capitol. This conference is also sponsored by the League of Minnesota Municipalities. Clerk Zylla read a letter which was recently sent to the NSSSD regarding the possible drainage problems in the area of judical ditch #1 near the NSSSD excavation. A reply was also read in which James Wolff Construction Company was put on notice of his responsibility in maintaining the drainage and his responsibility of any damages that occur because adequate drainage has not been maintained. Utilities Superintendent Skiba commented that a man hole cover has been removed from the sanitary sewer main in the area by unknown persons to allow surface water drainage to empty into our sanitary sewer system. Councilman Malvin commented on the need to have the area near the maintenance building cleaned of the NSSSD's contractors equipment upon completion of the job. MSP (Blanchard /Johnson) To confiscate meter deposits to cover delinquent bills for 1968. Total billing for 1968 was $120,364.55. The total bills uncollectable $831.49 to which meter deposits of $736.09 are applied, leaving a final balance uncollectable of $95.40 or .08% of the total billing. MSP (Johnson /Hodges) To approve General Contracting licenses for Sinco Construction, Inc. and Husnik and Johnson. MSP (Johnson /Malvin) To approve the bills as follows: General Ck #s 3054- 3095, Payroll Ck #s 681 706 and Bond Ck# 472. MSP (Rustad /Johnson) To approve Resolution #429 Division #39791 an apportionment of assessments due to a street dedication of 33 feet on Parcel #59 -0080- 050 -29. Lot on the Southeast corner of County Road I and Woodlawn Drive. 5 Ayes 5 Ayes 5 Ayes 5 Ayes 3 MSP (Johnson /Malvin) To approve Resolution #430, Division #39806 setting up an easement for road across the South end of Lot 37, Knollwood Park Addition. 5 MSP (Malvin /Hodges) To approve Resolution #431, Division #39805 taking an additional five feet from Groveland Road across the front of the North 75 feet of the East 200 feet of Lot 47, Auditors Subdivision #89. MSP (Johnson /Hodges) To approve Resolution #432 apportioning assessments on Division 39830 Spring Lake Park Hillview Lot 119. MSP (Blanchard /Malvin) To approve Resolution #433 authorizing the Mayor and Clerk to execute an agreement between the City of Fridley and the Village of Mounds View for the purpose of permitting certain residents in the Village of Mounds View to connect onto the City of Fridley's municipal sanitary sewer system. The agreement was read and signed by the Mayor and Clerk. Clerk Zylla asked the Council if the Council had any policy on snow plow damage to residential property in the Village. The Council stated that residents should contact Ramsey County but they felt that, as in the past, the county would take no action. Councilman Malvin no report. Councilman Hodges no report. Councilman Johnson's Report Councilman Johnson stated he attended a special meeting of the NSSSD last week. Conclusion of the meeting was that the Metropolitan Sewer Bill was a bad bill and that it was vague. Councilman Johnson stated that there will be a discussion of the Minneapolis offer tomorrow evening and a general review of the Metropolitan Council Bill and the NSSSD position on the bill will take place again. Councilman Johnson read a report of total gallons of water pumped during 1968. Total gallons for a 12 month period 161,999,000 gallons. Councilman Blanchard's Report Councilman Blanchard stated that generally he felt that streets were well plowed and that Ramsey County was doing a fine job. He stated that we are the only municipality effectively cleaning our fire hydrants. A resident, Harry Gumm, requested information on the possibility of fencing between the parsonage on County Road 1 and Long Lake Road and a new apartment building being constructed to the East. Council stated they felt the owner would comply with fencing requirements and that Building Inspector Piehowski should oversee the situation. Attorney Meyers' Report Attorney Meyers presented a highway easement from Robert Eigenheer. The East 33 feet of Lot 14 Block 2 Greenfield Addition. The attorney stated we need a certificate of title and a legal description of the easement which we are going to release in order to complete the necessary documents. 5 Aye 5 5 Ayes! i 4 MSP (Blanchard /Malvin) To approve Resolution #434 abating 33 feet of water and sewer assessments on Parcel #59- 0080 140 -29 (refer to Division #39791). Total abatement $348.15. Attorney Meyers presented a subdivision filed by F. N. Shaffer ;Malty Company, George Gustafson agent, which called for an additional assessment. MSP (Johnson /Hodges) To approve the subdivision of Lot 72 Spring Lake Park Hillview Addition subject to the signing of the additional assessment agreement or the payment of the additional assessment. The attorney presented a resolution releasing certain easements on Lots 1 -8, Block 1 Parkview Terrace. Easements are utility and drainage easements which no longer are necessitated. MSP (Rustad/Hodges) To rescind Resolution #428 previously passed abating easements in Parkview Terrace. MSP (Rustad /Johnson) To approve Resolution #435 vacating, releasing and discharging certain utility and drainage easements in above mentioned Parkview Terrace on said Lots 1 -8. Attorney Meyers presented his resume' of senate file #237, Metropolitan Sewer Bill. Attorney Meyers also read a memorandum regarding public hearings relative to rezoning. In essence it stated the Planning Commission may hold public hearings but if this is the case the Council should act as an appeals board so that no one is denied their rights under the due process clause of the constitution. Mayor Rustad stated that at the Planning Commission meeting of January 21st the Planning Commission had recommended to issue a special use permit to Mr. William Gillespie to sell cars at 2045 Highway #10. The Council advised that the Planning Commission should readvise Mr. Gillespie to either attempt to have the property permanently rezoned or to drop the matter. That a special use permit could not be issued since the property is zoned R1. Engineer Boehm's Report 5 Ayes 5 Ayes 5 Ayes 5 Ayes MSP (Johnson /Malvin) To approve Ordinance #163 rezoning all property in the Village of Mounds View presently zoned shopping center S -C to commercial B3. 4 Ayes Blanchard Naye Engineer Boehm presented the proposed plat for Dailey Homes. Daileys Red Oak Plat Estates contained eight lots. Engineer's office has corrected the previously incorrect legal description on the proposed plat. MSP (Hodges /Johnson) To approve the preliminary plat for Dailey Homes Inc. Subdivision is South of 8290 Red Oak Drive. 5 Ayes Engineer presented plans and specifications for Street Improvement Project 1969 -1 continuation of Sewer and Water Improvement Project 1968 -2 Parkview Terrace. The engineer also presented specifications for the improvement of Well #1. Well in general is lacking pumping capability which it originally had when it was first installed and the Council had felt that the pump was in need of a general overhaul. MSP (Hodges /Johnson) To approve plans and specifications and to set the bid date for 12:00 noon February 24th. 5 Ayes 5 Engineer commented on the test well construction, that it doesn't look like Aamot can complete the project by February 15th and there is a $50.00 per day penalty after the 15th. Resident, James Neardahl, desired information on whether the Council desires to Protect themselves on resubmitted requests for rezoning. Presently the Council has a 30 day limit before a previously heard proposal cal be resubmitted. Mrs. Gutenhauf requested information on when Mr. Bob Waste is going to put in an incinerator. Mrs. Gutenhauf was told to contact Mr. Fagestrom, our Fire Chief. She also desired information on what to do about rats in the summer. Council told Mrs. Gutenhauf that if rats are a problem that she should come back to the Council. MSP (Johnson /Hodges) To adjourn at 9:13 P.M. Re Submitted, Dennis S. Zyl Clerk- Administrator
