Present: Also Present: Mayor Rustad Clerk- Administrator Zylla Councilman Malvin Attorney Schumacher Councilman Johnson Engineer Boehm Councilman Hodges Councilman Blanchard MSP (Johnson /Blanchard) To approve the minutes of February 10, 1969. 5 Ayes Mayor Rustad's Report Mayor Rustad read a petition for sewer, water, and street improvements between Edgewood and Woodlawn North of County Road I to Hillview Road. MSP (Blanchard /Hodges) To order the Engineer to prepare preliminary plans and cost estimate. MSP (Malvin /Johnson) To grant Mrs. Jaycees the use of the village hall March 1st, 11:00 -12:30 and 2:00 -3:30 subject to the usual conditions. Mayor Rustad read a letter sent to the Commissioner of Highways from Senator T. Grieg on a proposed semaphore across from the Underdahl and Beim property. MSP (Johnson /Malvin) To approve a subdivision and variance request for White Oak Builders for Parcel #59- 0060 070 -30, the Southeast corner of Ardan and Eastwood Road subject to signing of additional assessment agreement and the payment of fees. Clerk- Administrator Zylla's Report MSP (Rustad /Hodges) To approve the following general contractor licenses: G L Builders and Rand Construction. MSP (Rustad /Johnson) To approve the following checks: General 3096 -3126, Bond 473 and Payroll 708 -740, check #707 voided. MSP (Hodges /Malvin) To approve the assignment of securities agreement between the Village of Mounds View and the First State Bank of New Brighton. MSP (Blanchard /Johnson) To approve Resolution #436 apportionment of assessments on Division 39569. Includes an additional assessment agreement signed by White Oak Builders and Raymond and Ann Buhil. Clerk Zylla reported on incidence of snow fleas near Sherwood and Woodlawn this day. An entomologist from the Department of Agriculture investigated and confirmed that the small black insects were snow fleas and there was no cause for alarm. 5 Ayes Ayes Ayes 5 Ayes 5 Ayes 5 Ayes 5 Ayes Councilman Hodges' Report 2 Councilman Hodges presented the "Ramsey County Outdoor Recreation Plan" prepared by the City of St. Paul. Councilman Hodges stated there will be a recreation meeting February 26th at 7:00 P.M. Councilman Hodges also announced that all ice rinks have been closed and that he attended a meeting recently in which the establishment of a youth center was discussed. Councilman Blanchard's Report Councilman Blanchard announced that there will be a human rights commission meeting Thursday night. Councilman Blanchard also commented that Village streets are going to get wetter but that the County and Village crews were out opening drains. The Civil Defense are ready in case of flooding and the Governor has declared a state of emergency. Councilman Johnson's Report Councilman Johnson reported that the resolution passed by the Mounds View Council requesting study of the Minneapolis offer has not been acted on as yet since NSSSD has not officially received a bona fide offer from Minneapolis for sewer capacity. Councilman Johnson also presented a proposal for floridation equipment. MSP (Johnson /Malvin) To purchase floridation equipment from Hawkins Chemicals Inc. for a total cost of $1,745.00. Mayor Rustad asked reporter, G. Skiba, to mention in the Bulletin that in no case are garbage cans to be placed by the curb in Mounds View. Our ordinance forbids the cans no closer than the side of the dwelling. Councilman Malvin's Report MSP (Rustad /Malvin) To set rezoning hearing for Ervin Herbst for March 24 at 8:30 P.M. Generally 6.23 acres located in Southwest 1/4 of the Southeast 1/4 of Section 8 lying Southwesterly of T.H. 10 and North of a line running parallel and distant 958.59 feet North of the Southerly line of said quarter section line. Request R1 to 83. Walter Skiba commented that Ramsey County will be posting their roads soon. Council advised Clerk to send a work order to Ramsey County requesting them to post our streets also. Malvin reported that Fire Chief Fagestrom had stated that our fire hydrants look good. He also would like our maintenance men to be volunteer firemen during the day while they work for the Village. Attorney advised that the men may legally belong. Council desired to discuss further with the Fire Chief. 5 Ayes 5 Ayes Regular meeting recessed and Mayor Rustad opened the improvement hearing at 8:30 P.M. Clerk Zylla read the legal notice. Improvement Project 1968 -5 Sanitary Sewer, Water, and Street extensions on proposed Knollwood !'rive midway between Spring Lakt- Road and Groveland Road from Ardan to Count; Road J and on Ardan from Spring Lake Road to Groveland Road. Estimated cost $152,498.00. Water assessed 100% Sewer 75% Water lateral $4.40 Street and Drainage 12.33 Sewer lateral $5.85 Sanitary Sewer Service $166.00 Water Service $158.00 Total assessment for an 80 foot lot including services $2,129.00. Arthur Zielinski presented a petition signed by 16 property owners against the proposal about 13 present in person. Mrs. C. B. Ford wished to know why the street was necessary? The Engineer explained that a petition was received signed by owners of at least 35% of the property. Hearing required by law. Mrs. Bruflodt against the proposal also, too expensive. Council called attention to the petitions for and against the improvement three names are on both petitions. Patrick Novak said he didn't know what he signed. John Juntunen said he didn't sign both. Arthur Zielinski questioned lot sizes. Mrs. C. Ford said too expensive to pay for sewer, water, and street on front and back and she doesn't intend to sell her property. Delmar Ford said assessments are too high couldn't realize enough profit. Patrick Novak agreed with Ford. Jim Lund,developer, stated good lots sell for $3,500. Robert Gardner, a petitioner, explained that he was for the improvement. The Engineer figured that annual installments with interest would average $40.82 for sewer and $32.81 for water for an 80 foot lot. The Engineer gave a brief history of the future street hearings held May and June of 1968. Councilman Malvin commented that people sign anything these days in discussion of Novak, Juntunen and Shankeys names on both petitions. Councilman Blanchard asked Engineer how the costs compared? Favorably was the response. Some discussion on the value of a 30 foot easement ensued. The Attorney explained the process and how in this case awards would be nominal. Mrs. Ford said asseasuertt would put her out in the street. DeGardner explained that assessments can be assumed by the builder. Mayor Rustad closed the hearing at 9:20 P.M. Motion made by Blanchard and seconded by Johnson to deny the improvement. Councilman Johnson explained he can't be for when only one petitioner showed up. Mayor Rustad again emphasized be careful what you sign. We have to pay engineering and administration costs to hold these hearings. Councilman Malvin stated we held this hearing by law. Councilman Blanchard prophesied that in three years there will be a street there. Motion reread. MSP (Blanchard /Johnson) To deny the improvement as petitioned and the Ardan Avenue portion. 5 minute recess at 9:25 P.M. Meeting reconvened at 9:33 PM. 3 Howard Thorsen of Dailey Homes wished final approval of his plat Red Oak Estates. MSP (Rustad /Johnson) To approve the final plat of Dailev's Red Oak Estates and to authorize the Clerk to sign. James Schumacher substituting for Richard Meyers, had no report. 5 Ayes 5 Ayes Engineer- Boehm's Report Engineer Boehm presented list of bids from bid opening at 12 noon today. Engineer reported that test well drilling should be complete in a week to ten days. Council recommended the Engineer attend a meeting at the Golder Valley Highway Headquarters on federal aid for streets.
