VILLAGE OF MOUNDS VIEW
RAMSEY COUNTY, MINNESOTA
April 14, 1969
A Special Meeting of the Mounds View Village Council was called to order
by Mayor Rustad at 7:45 P.M. on Monday, April 14, 1969, at the Village
Hall, 2401 Highway #10, St. Paul, Minnesota 55112.

Clerk Zylla read the legal notice and attested to its publication in
the New Brighton Bulletin April 3rd and 10th, as follows: All that
part of the SW 1/4 of the SE 1/4 of Section 8, Township 30, Range 23
lying SWly of @ight -of -way of STH No. 10 and N of a line running
parallel with and distant 958.59' N of the Sly line of said 1/4 1/4
Section line; except -Part of the SW 1/4 of the SE 1/4 of Section 8,
Township 30, Range 23 described as follows: Beginning at the inter-
section of the N line of the SW 1/4 of the SE 1/4 of Section 8,
Township 30, Range 23 and the SWly right -of -way line of STH No.10;
thence W along said N line 125'; thence S at right angles to said
N line 105'; thence E parallel to said N line to the SWly right -of -way
line of said highway; thence NWIy along said right -of -way line to the
point of beginning. Rezone from R1 (Residential) to B3 (Commercial).
Mr. Ervin Herbst, petitioner, was present and said he desired property
to be rezoned commercial for a clinic. No further information was
available.
Mayor Rustad called for objections to the proposed rezoning. There
were none.

Mayor Rustad stated that no decision would be made at this time since

The Regular Meeting of the Mounds View Village Council was called to order
by Mayor Rustad at S:00 P.M. on Monday, April 14, 1969, at the Village Flail,
2401 Highway #10, St. Paul, Minnesota 55112.
MSP (Blanchard /Malvin) To approve the minutes of March 24th.
Mayor Rustad's Report
Mayor Rustad read the police report for March.
Clerk- Administrator Zylla's Report
MSP (Rustad /Malvin) To approve the following licenses: Cigarette Ron
Daves Skelly, Pete's Skelly; Excavating Gilbertson Sanitation;
General Contracting Viking Sign Service, Arvid Birkeland Company,
Toppari Cement, Jesco, Inc.; and Miscellaneous Gallagher's Service, Inc.
and J W Pickup Service. 3 Ayes
MSP (Malvin /Blanchard) To approve the following general checks #3186 -3223
and payroll checks #795 -816. Total disbursements $19,469.12. 3 Ayes
MSP (Rustad /Malvin) To approve a request for Robert Eigenheer to subdivide
Lot 14 and the E 130' of Lot 13 Block 2 Greenfield Addition into 4 lots
subject to signing the additional assessment agreement and the payment of
fees. 3 Ayes
MSP (Blanchard /Rustad) To approve Resolution #437 apportioning the
assessments on Division #40054 Lots 108 and 109 Knollwood Park Addition
for Wikner and Twin City Federal. 3 Ayes

Engineer Boehm
Building Inspector, Chris Piehowski, asked about the Dietz garage. Garage
was moved into the village illegally and as yet has not been removed.
Council told Mr. Piehowski to send Mr. Dietz a letter reminding him to have
the garage removed.
Attorney Meyers noted that we have a rezoning hearing April 28th in which
town houses are proposed but they are not specifically incorporated in our
zoning ordinance classification. Mr. Meyers recommends including them
under R -3.

Attom ey Meyers reported that we have a highway easement from R. Eigenheer
for the W 30' of Lot 14 Block 2 Greenfield Addition.
MSP (Blanchard /Malvin) To approve Resolution #438 deeding to R. Eigenheer
the E 33' of W 163' of Lot 14 Block 2 Greenfield Addition.
Engineer Boehm's Report

MSP (Malvin /Blanchard) To approve Change Order #1 for the repair of
Well #1. Adjusted contract price $4,936.00. 3
MSP (Rustad /Malvin) To approve Change Order #1 for 1968 -3 Schedule A.
MSP (Blanchard /Malvin) To approve Change Order #2 for 1968 -3 Schedule A. 3 Ayes:
MSP (Malvin /Rustad) To approve the final payment for Aamot Well Company
for Project 1968 -3 Schedule A, check #3224 for $3,343.50, and to enter into
a one year warranty period. Completed contract price $14,998.50.
Engineer Boehm suggested that the Council consider routing the water mains
for 1968 -3 to conform to the street pattern in the Pinecrest Properties
project.
Engineer Boehm also reported that none of the test wells for 1968 -3
Schedule A were satisfactory.
Rezoning hearing called to order by Mayor Rustad at 8:30 P.M. Clerk
Zylla read the legal notice and attested to its publication in the New
Brighton Bulletin April 3rd and 10th. The South 300' of Lot 61 Auditors
Subdivision No. 89. Rezone from R1 (Residential) to B3 (Commercial).
Mr. Gillespie, petitioner, spoke on his proposal to sell used cars and
do minor repair work. The following persons spoke against the rezoning:
Mr. James Gable, 7934 Fairchild would destroy property value.
Mr. Arnold Scholljergerdes, 7950 Fairchild- object sane reason, and can't
get FHA loans.
Mr. Robert Larson, 7960 Fairchild messy, buffer not adequate.
Mr. Jerome Rickard, 7980 Fairchild object same reason.
Mr. Robert Shelquist, 8025 Fairchild village planner said residences
should be protected, this is spot rezoning, no opportunity to buffer. it.
Mr. Palmer Larson used car lot detrimental.
Mrs. Robert Shelquist would set a precedent on Highway #10, single family
residences must be protected. It is up to Gillespie to accomodate people.
Mayor Rustad closed the hearing at 8:25 P.M. No formal action can be taken
at this time because only three members present and a 4/5s vote is needed.
Councilman Blanchard commented that he would vote against.
Councilman Malvin had no comment. Mayor Rustad stated he would go with
the people and deny the rezoning.
Robert Eigenheer asked about the extension of LaPorte West of Red Oak Drive.
