VILLAGE OF MOUNDS VIEW
RAMSEY COUNTY, MINNESOTA
April 28, 1969
The Regular Meeting of the Mounds View Village Council was called to order by
Mayor Rustad at 8:00 P.M. on Monday, April 28, 1969, at the Village Hall, 2401
Highway #10, St. Paul, Minnesota 55112.

MSP (Blanchard /Malvin) To approve the minutes of the regular and special meetings
of April 14, 1969. 4 Ayes

MSP (Johnson /Blanchard) To approve the minutes of the special meeting of
April 21. 5 Ayes
Boehm's Report
Engineer reported that an application has been made with the Department of Trans-
portation for a permit for a water tower in Section 17. A special hearing will
be held May 22nd to decide on the feasibility of this water tower. The Engineer
advised it was a mere formality.
The Engineer also reported a letter was received from HUD in which they agreed to
the rerouting of the water mains in the Pinecrest Properties Addition.
The Engineer also stated that as of yet he has not talked to Dunkley Surfacing on
the feasibility of surfacing the walkway by Edgewood Jr. High School.
Mayor Rustad excused Engineer Boehm from the meeting.
Residents Requests and Comments:
Ray Jones from Superior Oil Company presented a proposal to abandon a service road
on the property at TH #10 and Highway Avenue. A representative from Country Kitchen,
et al were present also. Some discussion ensued at which time the Mayor suggested
that the Mr. Jones return at the agenda meeting to discuss the prospect of the
abandonment of the service road at greater length. Country Kitchen would like to
construct a restaurant up to the property line.
Mayor Rustad's Report
Mayor Rustad read an invitation from Lake Region Blue Line Club in which a member
of the Council or Recreation Committee was invited to a breakfast May 3rd at
8:00 A.M. to discuss the new ice arenas.
Mayor Rustad also read the Planning Commission minutes of April 15th.

MSP (Blanchard /Hodges) To approve the subdivision request for Elmer Trefethen
to divide Lot 134 Spring Lake Park Hillview Addition into the N 85' and the
S 80'

MSP (Malvin /Hodges) To approve the subdivision request for Brentwood Development
Company to divide Lot 47 Spring Lake Park Hillview Addition into the N 1/2 and the
S 1/2.

MSP (Johnson /Malvin) To approve the subdivision request for Brentwood Development
Company to divide Subject to road and except the W 2112' and except the E 327.7'
the S 162' of the NE 1/4 of Section 6 into a 91' lot and an 80' lot, 30' taken for
road.

MSP (Blanchard /Hodges) To approve the subdivision request for James Lund to
divide in half Lots 13 and 20 Spring Lake Park Hillview Addition.
MSP (Rustad /Malvin) Mayor Rustad moved that the Village Attorney be instructed
to review our present zoning ordinances and to do the necessary research to prepare
appropriate amendments to our ordinance regarding rehearing on zoning matters that
have been previously denied by the Council. 5 Ayes
MSP (Blanchard /Johnson) To deny the rezoning request from R1 to B3 for William
Gillespie, 2045 Highway #10. The S 300' of Lot 61 Auditors Subdivision #89. 5 Ayes
MSP (Malvin /Hodges) To approve the Herbst rezoning request from R1 To B3 for
the land generally located 1,000' NW of the intersection of County Road H and
Highway #10. Legal description: All that part of the SW 1/4 of the SE 1/4 of
Section 8, Township 30, Range 23 lying SWly of right -of -way of STH #10 and N of
a line running parallel with and distant 958.59' N of the Sly line of said 1/4
1/4 Section line; except Part of the SW 1/4 of the SE 1/4 of Section 8,
Township 30, Range 23 described as follows: Beginning at the intersection of the
N line of the SW 1/4 of the SE 1/4 of Section 8, Township 30, Range 23 and the
SWly right -of -way of STH #10; thence W along said N line 125'; thence S at right
angles to said N line 105'; thence E parallel to said N line to the SWly right -of
way line of said Highway; thence NWly along said right -of -way line to the point of
beginning.

Clerk Administrator Zylla's Report
MSP (Johnson /Malvin) To approve the following licenses Excavating United
Sewer and Water; General Contractor DeVac Sales. 5 Ayes
MSP (Rustad /Malvin) To approve the following checks: General checks #3225 -3250
and Payroll checks #817 -844. Total disbursements $12,995.59. 5 Ayes
Clerk Zylla announced that he is preparing an instructional sheet on how to compute
yourlropTty tax from your tax statement. The sheets should be ready in the Village
Hall by Tuesday.
Mayor Rustad called the rezoning hearing to order at 8:30 P.M.
Mayor Rusted asked for petitions. Harold Hjelle, 5161 Red Oak, presented petitions
against the rezoning. 299 names on the petitions. Howard Niesen, 5150 lrondale
Road, presented petitions with 129 names against the rezoning.

Clerk Zylla attested to its publication in the New Brighton Bulletin April 17 and 24.
Wood
Proposal Perry Copeland, attorney, presented the petitioners requests. The
project included the development of approximately 75 acres. 19.1 acres to single
family dwellings, 21.8 acres to multiple dwellings, 12 acres to town house.
development, 13.2 acres to commercial development and 2.18 acres to limited
business.
People:- Mr. Copeland said that the 391 apartment units would bring in approximately
899 people with an average of 2.3 persons per unit. 98 town houses at 3.2 people
per unit would bring in 313 people. 70 homes with 5 persons per unit would bring
in 350 people. Total project would bring in 1,562 people. If all homes were
constructed the total project would bring in 1,352 people.
Taxes 391 apartment units would have a market value of $5,865,000.00. The town
houses would have a market value of $2,940,000.00. The homes would have a market
value of $2,100,000.00. Commercial area would have a market value of $2,125,000.00
and the limited business area would have a commercial value of $1,000,000.00. Total
market value of the project $14,155,000.00. Full and true $4,900,000.00. Assessed
value $1,960,000.00. Using the current mill rate the Village would take in from
the project $45,080.00. The school district would take in $466,480.00.
Schools The number of school age children per unit would range from .1 to .16.
The apartments would bring in 51 school age children. The town houses 98 chiidr--n.
Homes, 140 children. Total 290 school age children. Cost of educating one child
$600.00. Total cost of educating all the children in the project $174,000.00. This
would be $292,480.00 less than the school taxes it would produce. School net loss
$86,000.00 per year if all homes were constructed.
Streets 19 blocks of residential streets would have to be constructed if the land
was not rezoned. If the land is rezoned only 6 blocks would have to be constructed.
Connection Charges to Sewer NSSSD would get connection charges totaling $116,000.00,
for the proposed project.
Mr. Copeland stated that the soil and subsoil was bad in some of the area. He said
there was a ditch running through the property which would interfere with the
economic use of the property for single family homes. Also recreation was provided
for by the development. Mr. Copeland concluded his proposal.
Mr. Simpson, what about cars?

Henry Dyslin, 5092 Brighton Lane, asked are the town houses for sale? Reply Yes.
Clement Fountaine, 5167 Red Oak Drive, what assurances development would be as
proposed? Village could enforce restrictions if they saw fit. Restrictions could
be placed prior to construction or zoning.
Ernie Johnson, 8009 Red Oak Drive, what is completion date? Three years completion
date, start single family homes on south first. What about recreation? Swimming
pools, tennis, tot lots provided.
Lloyd Buelt, 5085 Brighton Lane, school children can't utilize theme features.
William Lyes, 5054 Sunnyside Road, can they legally ask us to show cause why it
can't be rezoned?
Attorney answered, Mr. Lyes reference to Sunnyside duplexes not related to this
proposal.
Gerald Tesch, 5135 Long Lake Road, why not build all R -1 first? Street layout
would be different.
Norman Chervany, 2595 Woodcrest, why does project have to jut so far into residential?
Environmentally and socially what will project do? Somebody forgot something in
previous meeting. Arguments presented for the proposal while staggering are not
important. Objector.
Ralph Hanggi, 2475 Woodale Drive, noisy;.
Donald Sandstrom, 5130 Greenwood Drive, number of units vacant? Has survey been
taken? Does current population justify need? Mayor stated trend to build 1:1
John Simpson, 5046 Eastwood Road, what makes it feasible for apartments and not homes?

Mrs. DiGiovanni, 5115 Long Lake Road, is all area F bad? Can people afford rent?
Objects to F.
Henry Dyslin, will vote for it if stick to proposal.
Gary Payment, 5165 Red Oak Drive, opposed.
Charles Ross, 5142 Eastwood, enough apartments, objects.
John Krawczyk, 5128 Eastwood, can people live that close together?
Mr. Copeland stated only three persons per acre over single family homes.
Ernie Johnson, storm sewer? Can't go into NSSSD. Is water available? Mayor
ruled him out of order.

Gerald Tesch, opposed. Who will stand cost of County Roads?
Walter Kastner, 5066 Longview, informed rezoning North of Woodale only.
Arden Wahlberg, 5092 Red Oak Drive, fewer people would want to move into
residential areas.
Developer would take out 30 single family permits before they started.
Mayor Rustad at this time appointed a committee to study Village zoning with
particular attention directed to apartments.

MSP (Rustad/Malvin) To approve the above committee appointments. 5 Ayes
Patrick Ubl, 5169 Red Oak Drive, ordinance adopted yet for town houses? No.
Jim Nerdahl, 7941 Edgewood Drive, police and fire will increase. Will streets be
dedicated? Yes.
Keith Harstad asked what about a J pattern for town houses. Would people approve
the project then.
Mayor Rustad stated that we can't change the proposal at this time.
Diane Williams, 5166 Longview, palatable. Motive money. Our motives residential.
Pat Gammell, 5080 Longview, what type of students would project bring in?
Mr. Copeland, apartments not second class.
Mrs. Jean DiGiovanni, not lower grade.
Roger Nielsen, 2233 Knoll Drive, interested citizen. How many apartments now
and in process?
Don Muller, 5115 Greenwood Drive, moved out to Mounds View to get residential.
Show of hands: Against: Approximately 110, For: 8
Ernie Gustafson, 2525 County Road I, taxes going up up. Home doesn't pay.
Martin Ehrhardt, 5126 Greenwood Drive, wants 30 day delay. People expressed
their opinion.
Mr. Copeland, very obvious not as many people opposed this time and not as strong.
Project not affecting the health, safety and welfare of the Village. Village not
run by committees.
Mayor Rustad closed the hearing at 9:56 P.M.
Comments from the Council:

Councilman Blanchard: Mr. Copeland did a good job. I'm least affected. It is
easy for him to say it will not bother him. Rights have to be considered and for
every right an obligation. We, as Councilmen, have both. As Councilman I would
vote in favor for the best interestes of the Village.
Councilman Johnson: Saturday I walked the land. Indeed some land appropriate for
use other than residential but there are also other areas in the village. Based on
percentages we will have a reasonable number of multiple family dwellings without
these. I would vote against.
Councilman Hodges: I agree with Councilman Johnson. I realize some land area is
bad, at least in the Northeast part. Up to hog farm good land use for single
family however, if B could be dropped I would vote for it.
Councilman Malvin: I've listened to all the complaints, the phone calls and
threats. When we had sewer and water people made the same threats. The project
is a good thing at:d I am for it.
Mayor Rustad: No comment except to disagree with Mr. Copeland. Always felt in
matters that concern people they have a choice. More to rezoning than money,
would be against.
MSP (Hodges /Johnson) To deny the rezoning request. Discussion I will consider
my health Blanchard. Copeland Can we resolve something tonight? Not legal or
fair was the reply.

Councilman Johnson's Report
New sewer bill has us in a caretaker position. It is the original bill and
it is no good.
Councilman Hodges' Report
May 6th Recreation Meeting at the Village Hall. Have received numerous requests
for use of soft ball diamonds.
Attorney Meyers' Report
Nordling Terrace vacation of easements requested.
MSP (Rustad/Johnson) Permission to prepare necessary documents after approval
from Engineer.
MSP (Malvin /Hodges) To approve preliminary plat for Eigenheer's 3rd Addition.
Small skating rink on property at Greenwood and County Road H discussed.
MSP (Johnson /Malvin) To adjourn at 10:08 P.M.
