Home My WebLink AboutMinutes - 1969/05/16PROCEEDINGS OF THE VILLAGE COUNCIL VILLAGE OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA May 26, 1969 The Regular Meeting of the Mounds View Village Council was called to order by Acting Mayor Malvin at 8:00 P.M. on Monday, May 26, 1969, at the Village Hall, 2401 Highway #10, St. Paul, Minnesota 55112. Present: Acting Mayor Malvin Councilman Johnson Councilman Hodges Councilman Blanchard Absent: Also Present: Clerk- Administrator Zylla Attorney Meyers Engineer Comstock Mayor Rustad MSP (Johnson /Blanchard) To approve the minutes of May 12, 1969. 4 Ayes Residents Requests and Comments: Six persons from the Highway #10, Fairchild area appeared requesting further action be taken to restrain W. Gillespie, 2045 Highway #10, from continuing to sell cars in violation of our zoning ordinance. A court date has been set in New Brighton municipal court for June 27. Attorney Meyers spoke in behalf of the Council explaining the difficulties and costs involved in pursuing a restraining order. Mr. Peterson, attorney for Gillespie, expressed his desire not to see the Council put to any great expense. He stated that most of the used cars were stock accumulated for spring. Mr. Gillespie supposedly was caught in the build -up while simultaneously having his request for rezoning denied. The validity of this statement was questioned by Mr. Jim Gable and Mr. Robert Larson. Mr. Larson stated Mr. Gillespie promised to stop selling cars long ago. Mr. Gable stated his inventory is more than just his own. It was noted K. Krager, 1945 Highway #10, was also operating in violation of Ordinance #67. MSP (Johnson /Blanchard) To issue a restraining order on both W. Gillespie at 2045 Highway #10 and Kenneth Krager at 1945 Highway #10 if their businesses are not stopped and if they continue to be in violation of Village ordinances by June 15. Attorney is directed to proceed June 16th with the necessary measures and the police are to notify Mr. Krager of the Council decision. George Gustafson, planning commission member, stated that there is a definite need to study restrictive zoning for portions of Highway #10 with the high value per square foot of Highway #10 frontage. Clerk- Administrator Zylla's Report MSP (Johnson /Hodges) To approve the following licenses: Asphalt C S Black:opping, H 0 Blacktop Company; General Contractor Barry Biugstad Cement Cont., E. E. Gustafson, Dailey Homes, Inc.; Excavating Dailey Homes, Inc.; Dance Set Up Bel -Rae Ballroom; Off Sale Intoxicating Liquor Mermaid Liquor Store, B R Liquor, Donatelle's Supper Club and Simon's Liquor Store, Inc. 4 Ayes Ayes MSP (Malvin /Hodges) To approve the general checks 3282 3307 and payroll checks 864 891. Total disbursements $9,036.67. 4 Ayes MSP (Hodges /Blanchard) To approve the building plans for Country Kitchen Restaurant subject to the vacation of the necessary easements. 4 Ayes MSP (Malvin /Johnson) To approve the purchase of two new typewriters from Hagen Office Supply, one for the police and one for the office, at a retail cost of $337.50 each less trade. 4 Ayes MSP (Johnson /Malvin) To approve the transfer of an on sale and off sale liqucr license and all other existing licenses from Ervin Herbst to Stanley Horowicki and Lawrence Cichy at the Mermaid Supper Club conditional upon sale. 4 Ayes Councilman Johnson's Report Councilman Johnson stated that the Metro Sewer Bill has been signed and passed into law. In addition, Mel Christensen has resigned as Clerk of the NSSSD effective July 1. Councilman Hodges' Report 2 MSP (Hodges /Malvin) To hire Gary Korf as full time park maintenance man on a six month probationary period at a gross salary of $500 per month.retroactive to May 15th. G. Korf has been highly recommended by both the park committee and Wally Skiba maintenance superintendent. Councilman Hodges asked about the large influx of billboards on Highway #10. Mounds View has no restrictions at the present time. Clerk's office is directed to obtain various ordinances pertaining to billboards so that the Planning Commission may study as a possible amendment to Ordinance #67. Councilman Blanchard's Report Councilman Blanchard read the Planning Commission minutes of May 20th. Keith Harstad, developer, requested a third rezoning hearing on the land located South of County Road H2 between Red Oak and Long Lake Road after the special study committee presents their report to the Council. Attorney stated that the proposed ordinance revision that he has tonight would prohibit a rehearing unless a petition was signed by 50% of the persons in attendance at the last hearing or unless the petitioner waited six months. Mr. Harstad desired to have another hearing before the ordinance was passed. He stated that his revised plan eliminated the apartment buildings in the area receiving the heaviest opposition at the last hearing. MS 1 (Blanchard /Malvin) To set a rezoning hearing for R Oak Estates for July 14th at 8:30 P.M. Malvin -Aye, Blanchard -Aye, Johnson -Naye, Hodges -Naye It was also decided to hold off the passing of the Ordinance #67 revision until a later date. 4 Ayes MSP (Blanchard /Malvin) To approve the preliminary plat for Walter Skiba on Lot 3 and N 1/2 of Lot 4 Block 1 Greenfield Addition. 4 Ayes MSP (Johnson /Hodges) To approve the preliminary plat for Ernest Danielson on N 405' of S 2835' of E 528' of W 2112' of NE 1/4 of Section 6 subject to obtaining any necessary easements. 4 Ayes MSP (Blanchard /Johnson) To approve the preliminary plat for Eigenheers 4th Addition on Lot 66 Auditors Subdivision #89 Ex S 95' subject to payment of fees and the signing of any additional assessment agreements. 4 Ayes 3 MSP (Blanchard /Johnson) To approve the preliminary plat for Robert DeGardner on Lot 77 Auditcrs Subdivision #89 subject to proposed Arden. 4 Ayes MSP (Johnson /Hodges) To direct the Engineer to prepare a preliminary report and cost estimate for the extension of sewer, water and streets in DeGardner Addition subject to the payment of preliminary costs if the project is aborted. 4 Ayes MSP (Blanchard /Johnson) To allow the Clerk to attend the League of Minnesota Municipalities Convention June 18 -20 at the St. Paul Hilton and to pay all related expenses. 4 Ayes MSP (Malvin /Johnson) To allow Councilman J. Blanchard to attend the Human Relations seminar at Mankato State College June 16 -18 and to pay all related expenses. MSP (Blanchard /Johnson) Effective June 1 to change Mr. Skiba's title and duties as follows: Relieve him of the duties and title of Superintendent of Public Works and change him to Village Building Inspector. Duties of this position will include the plumbing, heating and well inspection. To increase his pay to $10,000 per year plus the agreed upon hospitilization reimbursement subject to a 60 day probationary period. Further to promote Mr. Art Holm to Acting Superintendent of Public Works, to assume the duties vacated by Mr. Skiba with a 60 day probationary period. Salary during this 60 days to be $678.00 per month plus the agreed upon hospitilization reimbursement. Salary to be re- evaluated after completion of satisfactory probation period. 4 Ayes MSP (Blanchard /Johnson) To dispense with the services of Building Inspector Chris Piehowski effective June 1. 4 Ayes Attorney was directed to amend the applicable sections of the building code. Superintendent Skiba reported that his men are patching streets and doing minor sod repair work. Attorney Meyers' Report Attorney Meyers presented copies of the proposed Ordinance #67 revisions. A copy of the proposed park ordinance was also presented to Councilman Hodges. MSP (Johnson /Blanchard) To approve the adoption of Ordinance #166 prohibiting the unreasonable acceleration of a motor vehicle (anti- screech ordinance). Engineer Comstock's Report MSP (Blanchard /Johnson) To order the Engineer to prepare the preliminary report and cost estimate for the installation of sewer and water services and street on Greenwood Drive from County Road I N to the present bituminous surface Improvement was initiated by a petition signed by White Oak Builders.
