HomeMy WebLinkAboutMinutes - 1969/11/10Present: Mayor Rustad Councilman Malvin Councilman Johnson Councilman Hodges Councilman Blanchard PROCEEDINGS OF THE VILLAGE COUNCIL VILLAGE OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA NOVEMBER 10, 1969 The Regular Meeting of the Mounds View Village Council was called to order by Mayor Rustad at 8:00 P.M. on Monday, November 10, 1969, at the Village Hall, 2401 Highway #10, St. Paul, Minnesota 55112. Also Present: Clerk- Administrator Zylla Attorney Meyers Engineer Boehm MSP (Johnson /Blanchard) To approve the minutes of October 27, 1969. MSP (Malvin /Hodges) To approve the minutes of the special meeting of November 5, 1969. Mayor Rustad's Repo:: Mayor Rustad read the police report for October. Clerk Administrator Zylla's Report MSP (Johnson /Malvin) To approve the following licenses: Asphalt Modern Blacktop Company; Heating and Air Conditioning Thompson Air Conditioning Company; and Sewer and Water Lloyd Moen. MSP (Rustad /Hodges) To approve the bills as follows: General Ck #s 3683 3730 and Payroll Ck #s 1136 -1154. Total disbursements $16,1.02.04. MSP (Rustad /Johnson) To approve Resolution #462 apportioning the assessments on Division #41078. MSP (Malvin /Hodges) To approve the use of the village hall on Sunday, November 21st from 2:00 to 5:00 P.M. for Mrs. Minnie Wyatt subject to payment of a $12.00 fee plus the usual clean up conditions. MSP (Hodges /Malvin) To approve the use of the village hall on Sundays for religious services subject to obtaining periodic approval from the Clerk Administrator. The request was made by Mr. and Mrs. E. Lee Parson, 7940 Sunnyside Road. A request for the use of the hall by Jerome A. Gierok to conduct square dance classes on Sunday evenings from January 4th until May 10th from 7:15 P.M. to 10:00 P.M. was tabled. Mayor Rustad recognized the new Mounds View councilman, Howard Neisen, 5150 Irondale Road, who was in the audience. 5 Ayes 5 Ayes 5 Ayes 5 Ayes 5 Ayes 5 Ayes 5 Ayes Councilman Johnson's Report Councilman Johnson reported there will be a NSSSD meeting Tuesday night to renegotiate existing contracts. Councilman Hodges' Report Attorney Meyers' Report 2 Councilman Hodges announced that he had obtained some information regarding federal funds for park planning from Attorney Meyers. He also informed the Council of the new recreation members as of the last meeting, Thomas Nelson, Edward Lanz, Gary Reineike, Wayne Burmeister and Roger Baumgartner. Mr. Hodges reviewed the minutes of the November 5th recreation meeting. Mr. Hodges also stated that the piece of tax forfeited land located West of Long Lake Road and South of Arden was still being looked at by the Recreation Committee, however he felt that it probably would be put up for sale. MSP (Blanchard /Malvin) To approve Resolution #463 authorizing the Village Clerk to apply for tax relief on certain lands in the Village of Mounds View. 5 Ayes Attorney Meyers announced that the Chies Brothers legal action is still in process. Attorney Meyers stated that the Council should go on record stating that it was not solely the Mounds View Council who was and who is opposed to the sewage treatment plant in Minneapolis. Chairman Honsey of the Metropolitan Sewer Beard also has gone on record against the plant in a newspaper article. Attorney Meyers also stated that we have seemed to have reached a stalemate with the Highway Department on carrier pipes under new Highway #10. Engineer Boehm's Report Engineer Boehm stated that a preconstruction conference will be held November 20th with the individual companies who were awarded HUD contracts under Project 1968 -3. Engineer Boehm also stated that under Schedule C the contractor has laid 2,000 feet of pipe. Layne- Minnesota has begun two wells each of which are at approximately 100 feet. That the booster station adjacent to the Police station has had some concrete poured. Engineer Boehm also felt that Krohn Drainage Company deserved some recognition for doing the digging for the repair of the gate valve at Woodcrest and Irondale at no cost to Mounds View. Clerk- Administrator Zylla announced that Ramsey County has issued a check to Mounds View Village for $13,027.48 as Ramsey County's share in storm sewer construction on or around state aid roads. Engineer Boehm also stated we have applied for more federal funds for Project 1968 -3. A five minute recess was called. 3 Mayor Rustad called the rezoning hearing to order at 8:30 P.M. Clerk- Administrator Zylla read the legal notice and attested to its publication in the New Brighton Bulletin October 30th and November 6th. Notices were sent to 20 persons. Legal description Lots 5 through 23, Block 3, Greenfield Plat #2. Rezoning request is from R1 to B3. Mr. Ernest Gustafson, petitioner, showed the Council and the audience a couple of drawings which showed the proposed development of the area. Mr. Gustafson stated that he had planned for a smorgosbord restaurant and that he was negotiating with Red Owl and Snyder Drug and that miscellaneous shops would also be included. Mrs. Lewanowicz, 7630 Greenfield Avenue, was opposed because of the traffic, the additional people and the noise the development would make. Mr. Arthur Olmstead, Sr., 8042 Sunnyside, asked about the tree screening in the back of the development. Otto Jeffries, 7628 Greenfield, was also opposed. He stated the project was against the intended purpose of the zoning laws. There was no logical development and that it does not protect the residential home owner. He also stated that more ideal tracts exist in the Village, particularly on Highway #10. Mr. Jeffries also added that Edgewood was not even a through street and that he seriously doubted that the center could be successful. He cited the size of the property as a limitation. Gary Sward, 7644 Greenfield, stated that he was building a new home and that he felt that this would cause his home to loose value. Dick Mosman, 7656 Greenfield, asked about the kind of shops. Mr. Mosman discussed reputation of developers, franchise in general. He stated that the idea was not bad if you could guarantee the success of the project, but at the present time he opposes it. Mayor asked for other objectors. Mr. Jeffries asked Mr. Gustafson why the Council should favor him over the residential objectors in the audience. Mayor Rustad ruled this question out of order and stated that the Council was impersonal. Howard Neisen, 5150 Irondale Road, inquired into the process of the Pinecrest Properties shopping center. He stated that he wants to see business but he also believes in a strong zoning ordinance. James Nerdahl stated that he had a neutral view of the project but that he thought that the developer should provide information on taxes. Mr. Gustafson explained that in his estimation after talking with the assessors office the project would probably be taxed around $22,000 annually. He also stated that eventually Edgewood would be a through street. Mayor Rustad closed the hearing at 9:00 P.M. Councilman Malvin stated that the Council was not a body which did favors in answer to Mr. Jeffries previous remark but rather that they were an unbiased impartial body who acted in the best interest of the community. 4 Councilman Blanchard stated that many times a project may cost him votes personally but that he feels that he also should always act in the best interests of the community. Councilman Hodges stated that in the area there was spot rezoning now but he asked if this is the right place for the development proposed. Councilman Johnson stated that he could not see the development in the area which it is in at the present time. Councilman Malvin asked about the commitment which Red Owl was supposed to have made to Mr. Gustafson. Councilman Malvin stated that it seemed any developer that appeared with plans for a shopping center had received tentative approval from Red Owl. MSP (Johnson /Blanchard) To deny the zoning request as petitioned. 5 Ayes Attorney Meyers was given approval to attend a recreation meeting on December 10th at which possible federal assistance for park development would be discussed.
