Present: Mayor Rustad Councilman Malvin Councilman Hodges Councilman Blanchard Councilman Neisen MSP (Blanchard /Neisen) To approve the minutes of November 23, 1970. Residents Requests and Comments from the floor MSP (Malvin /Hodges) To issue two building permits to Michael Rich of T.M. Willmus Construction Company for two 35 unit apartment buildings subject to the approval of all construction plans by our inspection department and the fire department. Buildings are located West of the intersection of Long Lake Road and County Road H2. Roger Baumgartner questioned the authenticity of the building code since some items were crossed out with other items writtenlin. Information was given that all changes were per ordinance amendments. Clerk- Administrator Zylla's Report MSP (Rustad /Hodges) To approve the following licenses: Excavator Harry Koalska Contr. Co.; Heating Swenson Heating Air Conditioning; General Contractor Pierson Whitney, Inc. and R. D. Welty Sons. MSP (Blanchard /Malvin) To approve the following bills: General Checks #4718- 4760, Payroll Checks #1786 -1806, Bond Check 589 and WS- MINN -45 Checks 069, 072 and 073. Total disbursements $227,455.77. MSP (Rustad /Malvin) To approve Resolution #506 apportioning the assessments on Division #42504 for Ex N 100' of Lot 91 and all of 92 Spring Lake Park Knolls Addition. MSP (Neisen /Rustad) To authorize the attendance by W. Skiba and R. Edmond at the 15th Institute of Building Officials at the University of Minnesota on January 18th through the 20th and to pay the registration fee, parking and other necessary related expenses. Councilman Malvin asked about the status of the Industrial Development Committee. Councilman Neisen informed him that there have been no reports since September. Councilman Neisen seems to the the only remaining active member. Attorney Meyers' Report Attorney Meyers informed the Council that the court case of Mounds View versus Red Oak Estates comes to trial on January 4th and that all interested persons wanting to testify who bought on reliance of existing zoning should •:ontact him or the Clerk's Office. Bennett Goldberg was again denied his request for a mobile home sales lot on the Mermaid property. Mayor Rustad called the walkway vacation hearing to order at 8:30 P.M. Clerk Administrator Zylla read the legal notice published in the New Brighton Bulletin on November 25th and December 3rd. The Mayor asked for persons to speak for the vacation. Herb Widmer, 2126 Oakwood, complained of vandalism, snowmobiles and scooters, stating the walkway serves no useful purpose. James Ralph, 2119 Terrace, stated that he had his car painted and garage painted twice. Alexander Gadacz, 2127 Terrace, stated that the walkway was a general nuisance. Ronald Radzak, 2127 Oakwood said that it was a racetrack for snowmobiles and go- carts. Richard Brown, 2126 Terrace, inquired why the walkway south of Terrace was not vacated. Council previously assumed a culvert was there but since it is three lots away it could also be vacated. Mr. Brown does not request it's vacation at this time. Mayor Rustad closed the hearing at 8:39 P.M. MSP (Malvin /Hodges) To vacate the 11' MOL walkway located between Lots 8 and 9, 23 and 24 Block 1, and Lots 8 and 9, 24 and 25 Block 2 Pinewood Terrace. Res. #507. 5 Ayes Attorney Meyers explained th story of the Mounds View pot law as published in the Minneapolis Star the week of December 6th. 5 Ayes J 3 Mayor Rustad called the hearing to consider amending Ordinance 67 on lot sizes to order at 8:45 P.M. Clerk- Administrator Zylla read the legal notice published in the New Brighton Bulletin on November 25th and December 3rd. Attorney Meyers read the proposed ordinance. Robert Glazer doesn't want to see housing standards compromised. He suggested garages be rul uired and new structures be reviewed so they don't look alike. He does not oppose the lot size reduction. John Robertus asked the purpose of the reduction. Mayor Rusted explained that with sewer and water we would go back to 75' lots to conform to other villages. Mrs. Haake asked if 100' lots were required south of TH10. Mayor Rustad said previous to sewer some residence districts were 100' minimum. Chris Piehowski said that he was against the smaller lots because you can't build a house on a 75 foot lot. Roger Baumgartner was against the change also. He felt we should not concern ourselves with what is done in other communities. Councilman Malvin said everything else is comps red with other villages, like parks, golf courses, etc. Mayor Rustad called for objectors: Barbara Haake -1740 County Road 1, Chris Piehowski -2259 Pinewood Drive, Harcld Hjelle -5161 Red Oak Drive, John Robertus- 2055 County Road H, Jesse Varns -7350 Silver Lake Road, Richard Trautner 5105 Eastwood Road, Wayne Burmeister -7565 Knollwood Drive, Richard Brown -2126 Terrace, and Gerhard Voll -5085 Red Oak Drive. Jim Nerdahl, 7941 Edgewood Drive, stood and said he was for the change. Robert Glazer suggested a building advisory board. Some discussion followed on "235 Program" and FHA requirements. Attorney Meyers was directed to amend the building code to require at least one car garages and to increase the square footage requirement of houses. Mayor Rustad closed the hearing at 9:08 P.M. MSP (Rustad /M:zlvin) To adopt Ordinance #182 amending the reducing the lot sizes in R1 districts. Councilman Hodges stated small lots limit access to garages Councilman Blanchard said the favors weren't called for. Councilman Neisen stated he agreed with Don, that 80 or 85 zoning ordinance Neisen Naye Blanchard Aye Hodges Naye feet is needed. Malvin Aye Rustad Aye Attorney Meyers stated that amendments to the zoning ordinance require a 4/5s vote to pass. Motion stands defeated. Keith Harst&d, builder, stated the Mayor didn't cult for those in favor, and he built 22 homes in New Brighton last year from $36,000 $80,000 with the widest lot 80 feet. 4- Councilman Hodges talked about the Brauer Park Plan and the estimated costs of its implementation, approximately $2,000,000 according to Brauer and Associates. Councilman Hodges says he has talked to the Metro Council and the full plan does not have to be adopted to obtain federal and state funds. MSP (Hodges /Malvin) To raise the pay of the warming house attendants from $1.80 per hour to $2.00 per hour. MSP (Malvin /Blanchard) To hire the following rink attendants in 1970 -1971: Ken Lofquist, Norman Lelm, David Moore, Gust Larson, Tom Trefethen, Mike Hodges, Al VanR &ese, Ron Grobner, Kurt Kelner and Reed Krogh. Attorney Meyers presented a snowmobile ordinance. Discussion on terminology, and time allowed to operate followed. Attorney Meyers is to revise and resubmit the ordinance at the next meeting. Mayor Rustad left the meeting. A memorandum on the Joint Powers Act as it effects the proposed NSSSD advisory board was read by Attorney Meyers. Engineer Boehm Report MSP (Blanchard /Neisen) To approve Change Order #1 Schedule B Project 1968 -3 for a net decrease of $104.30 and a 60 day contract extension. 4 Ayes MSP (Neisen /Hodges) To approve Change Order #1 Schedule F Project 1968 -3 for a net addition of $1,425.10 and a 60 day contract extension. 4 Ayes MSP (Malvin /Blanchard) To approve Change Order #1 Schedule G Project 1968 -3 for a net decrease of $2,228.42 and a 60 day contract extension. 4 Ayes MSP (Neisen /Blanchard) To approve Check 070 and 071; $24,574.00 to Universal Tank for the final estimate on Project 1968 -3 Schedule D completed contract price $148,360.00; $84,809.98 to Petersen Templin for the final estimates on Schedules B, F and G completed contract price $317,173.70, $102,538.10 and $300,548.56 respectively, subject to HUD concurrence. And to enter into a one year mainten- ance agreement with the provision a certified check of $7,500 be retained by the Village of Mounds View from Petersen Templin as a guarantee that the remaining seeding and site work of $3,200 be completed this spring on contracts 8, F and G. 4 Ayes MSP (Hodges /Neisen) To certify to HUD that we have received no sales or excise tax refunds on Project 1968 -3 and if we do that they be deposited in the Bond Account and our grant reduced accordingly. 4 Ayes MSP (Hodges /Blanchard) 1'o enter into a lease agreement with White Oak Builders to use their man made lake as a skating rink this winter season. 4 Ayes MSP Blanchard /Neisen) To adjourn at 10:35 P.M. 4 Ayes Ikespedfully Submitted, Dennis S.
