PROCEEDINGS OF THE VILLAGE COUNCIL
VILLAGE OF MOUNDS VIEW
RAMSEY COUNTY, MINNESOTA
April 12, 1971
The Regular Meeting of the Mounds View Village Council was called to order by
Mayor Rustad at 8:00 P.M. on Monday, April 12, 1971 at the Village Hall, 2401
Highway #10, St. Paul, Minnesota 55112.

MSP (Blanchard /Hodges) To approve the minutes of March 22, 1971.
MSP (Hodges /Neisen) To approve the minutes of March 29, 1971.
Residents Requests and Comments from the floor
Mrs. Harold Hjelle of the Provisional League of Women Voters presented a 32 page
booklet to Mayor Rustad which describes the history and operation of the Village,
together with facts on the School District, voter information, etc.
Keith Harstad requested tentative approval of a drainage plan to excavate fill
from the mid-block between Red Oak and Sunnyside from County Road H2 to Woodcrest.
Excavation would allow the construction of walkout basement homes.
MSP (Neisen /Blanchard) To grant a special permit to Keith Harstad to excavate
the described area subject to receipt of a letter from the Metro Sewer Board that
the existing manholes can be lowered and subject to the approval of our Village
engineer.
Approval of the final plat for Red Oak Estates was denied because there was no
hard copy. Denial was also given to move tenants into the uncompleted apartment
building at 7780 Silver Lake Road until the building inspector has issued the
certificate of completion.

MSP (Rustad/Blanchard) To install a street light on Irondale Road midway between
County Road H2 and Clearview. 5 Ayes
Mayor Rustad called the easement vacation hearing to order at 8:22 P.M. Clerk
Administrator read the legal notice and attested to its publication April 1st
and 8th, 1971, in the New Brighton Bulletin. Legal description Except the
W 5 feet, the S 10 feet of N 15 feet of Lot 1, Block 1, Eibenheer Fourth
Addition, property known as 8208 Fairchild Avenue.
No one for or against.
Mayor Rustad closed the hearing at 8 :25 P.M.
MSP (Neisen /Johnson) To adopt Resolution #517 vacating the easement as per
the legal notice.

Mayor Rustad called the second easement vacation hearing to order at 8:25 P.M.
Clerk- Administrator Zylla read the legal and attested to its publication in
the New Brighton Bulletin on April lst and 8th, 1971. Legal description
The N 4 1/2 feet of the S 12 1/2 feet of Lot 4, Block 1, East Oaks Addition
property known as 8267 Red Oak Drive.
No one for or against.
Mayor Rustad closed the hearing at 8 :28 P.M.
MSP (Hodges /Blanchard) To adopt Resolution #518 vacating the easement as
per the legal notice.
Mayor Rustad called the hearing to consider amending the square footage
requirement of dwellings and requiring a garage to order at 8:30 P.M.
Clerk- Administrator Zylla read the legal notice and attested to its
publication in the New Brighton Bulletin April 1st and 8th, 1971. He
announced that individual letters were sent to 21 general contractors
informing them of the hearing.
Robert Glazer, 2375 Hillview Road, requested the Council's views on the
proposed amendments.
-uncilman Johnson "tested that he would like to see the minimum size house
either 1,050, 1,060, or 1,070 square feet. He favored decreasing the side
yard set back on a garage side to 5 feet. He also wanted a double garage
(attached or detached) as a requirement.
Councilman Neisen favored a 1,050 square foot requirement with provision
for a garage at a later date. He stated that he hated to see people priced
out of the marls t
Councilman Hodges stated he would like to see the area moved to between
1,008 and 1,040 but he was against garages. He felt the cost of a home
was high enough.
Councilman Blanchard agreed that a larger square footage was needed but was
against the garage requirement. He did favor an ordinance requiring
placement of the house for a garage at a later date.
Mayor Rustad felt that the two story house area should be larger also. He
stated that to increase the area on a one story over 1,008 would cause
considerably more expense. He favored making provision for a garage but
not requiring it.
Discussion on types of houses and taxation of split entry homes followed.
Councilman Neisen stated that 75% of the basement of a split entry house
is taxed as living area.
Larry Vossen of VoCo Construction felt a requirement of 1,050 on a one story
with 912 on a split entry was a good size.
Philip Fauchald, 8270 Red Oak Drive, believed the garage should not be
required but room should be allowed for it.
Ron Lilliencrantz of Charles Adams Realtors stated that any bedroom put in
the basement of a split entry was counted as another bedroom according to
the Board of Realtors. He gave the Council information on the HUD 235 or
low income housing program. He stated that in his opinion no homes will be
constructed under this program in Mounds View.
Mrs. Robert Shelquist, 8025 Fairchild Avenue, favored increased square
footage and double garages. She stated we do not discriminate against
low income families, that in the past the Village has thought small.
Robert Glazer stated he would rather see a garage required and the square
footage requirement relaxed.

Councilman Johnson commented on his reasons for voting as he did. He stated that
Mounds View is about 60% developed and the question is whether we are going to
allow homes of $20- 24,000 or between $24- 28,000. He said that you can't use the
arguement that people can't afford homes if the price increases. Increases in
the construction requirements is good planning. Prime concern is with the
prople in the Village. Furthermore, builders determine the destiny of the
Village. We do have 235 homes now and few homes are not constructed without
garages presently.
MSP (Neisen/Blanchard) To require the location of a new house on a lot such
that a two car garage can be constructed at a later date.

R1 district from 10 feet to 5 feet. (Ordinance #186) 5 Ayes

MSP (Neisen /Hodges) To prohibit construction in any R1 district of any room
less than 10 feet wide except bathroom, and any room with a floor area of less
than 110 square feet except kitchen and bathroom.
Attorney Meyers was directed to prepare one ordinance incorporating all the
changes. (Ordinance 185)
Walter O'Connell, 2260 Highway #10, inquired as to whether Mr. Herbst was going
to develop his property this year as there has been a problem with blowing sand.
The Clerk's office is to contact Mr. Herbst.
Carol Baumgartner, 7585 Knollwood Drive, inquired as to the status of the village
newsletter and the leash law. After discussion it was decided to continue to
explore the costs of the newsletter. The dog ordinance amendment is to come
later in the meeting.
Mayor Rustad suggested possible legislation against trail bikes. Councilman
Neisen stated what is needed is stricter enforcement of the present laws.
MSP (Neisen /Blanchard) To approve the following licenses: Cement Work
Reynolds and Gagnon, Albin L. Katzner Cement Company, Don Zebro Cement Company;
Excavating Lloyd's Excavating; Garbage /Rubbish Hauler J W Pickup Service,
Rubbish Removal Inc.; General Contractor Lyle J. Kaufenberg; Heating
D D Anderson Heating Plumbing Inc.; Mobile Sewage Carrier Northern
Cesspool; and Roofing D. F. Vizechy Cont. Co., Inc.
Clerk- Administrator Zylla announced receipt of the agreement with Blaine allowing
certain residents on County Road J west of Spring Lake Road to connect to
Blaine's sewer and water system.

MSP (Johnson /Hodges) To advertise for bids for village hall alterations
Project 1971 -2, carpeting and painting, for May 3rd at 12 noon. 5 Ayes
MSP (Rustad /Hodges) To adopt Resolution #519 apportioning the assessments on
Division #42835. 5 Ayes
MSP (Blanchard /Neisen) To adopt Resolution #520 apportioning the assessments

Councilman Hodges' Report
Councilman Hodges announced receipt of a letter from the Lake Region Hockey
Association thanking us for the use of the hockey rinks this past year.
Councilman Hodges also presented a check for $75.00 from the Mounds View Jaycees
for park improvements.
MSP (Hodges /Rusted) To appoint Mrs. Barbara Haake to the Mounds View Recreation

Councilman Neiaen's Report
MSP (Neisen /Ruetad) To send Art Holm to the Water Works Operators School from
May 3 5 and Larry Decheine to the Waste Water Operators Institute from May 5 7
and to pay all related expenses. 5 Ayes
MSP (Neisen /Ruetad) To advertise for bids on April 24th at 12 noon for a tractor
to be used in general village maintenance including mowing and ice rink snow
removal.
MSP (Neisen /Hodges) To set a hearing on May 17th at 7:00 P.M. to consider a
renumbering of certain properties in the Village and a possible postal zone change.5 Ayes
Attorney Meyers' Report
Attorney Meyers announced that Mr. Quayle of Ramsey County was preparing papers
necessary to release the Chies Construction Company money to the Village.
Attorney Meyers presented an ordinance to amend the present dog ordinance requiring
higher license, impounding and board fees. After discussion it was decided to
raise the license fee for males and spayed females to $3.00 and unspayed females
to $6.00 rather than $12.00. Cats were also to be excluded in the amendment.
MSP (Blanchard /Hodges) To enter into a new contract with Comstock Davis to
provide consulting engineering services to the Village.
MSP (Neisen /Johnson) To adjourn at 11:06 P.M.
