Acting Mayor Blanchard at 8 :05 P.M. on Monday, August 23, 1971 at the Village
Hall, 2401 Highway #10, St. Paul, Minnesota 55112.

MSP (Neisen /Blanchard) To approve the minutes of August 9th.
Residents Requests and Comments from the floor
MSP (Neisen /Hodges) To approve the variance request of Wallace Schuldt, 7887
Spring Lake Road, to construct an addition to the existing garage within 3k feet
of the lot line, subject to fees.
Council granted the variance because the additional delay until the next Planning
Commission meeting would cause undue hardship to Mr. Schuldt. Mr. Johnson, however,
reiterated that this is not the method of getting variances granted.
Mr. Teslow, 7932 Fairchild, inquired as to what further action had been taken to
alleviate his drainage problem. Mr. Boehm read a letter to the hydraulics
engineer of the Minnesota State Highway Department which as of this date has
not been met with a reply.

MSP (Hodges /Neisen) To approve the following licenses: Cement Work Valley
Const.; Excavating Harold Hennum, Dale Gile Const. Co.; General Contractor
New Housing Concepts, Inc., Nicholls Const. Co., Scott Const., Bud Johnson Const.
Co.; Heating Custom Heating; Commercial Kennel Sham -O -Jet Kennels;
Residential Harold Brandt, Our Matchmaker Kennels; Sewer Water Beyer's
Excavating and Sam Zappa Contracting. 4 Ayes
MSP (Neisen /Johnson) To approve the bills as follows: General Checks 5396
5428 and Payroll Checks 2233 2261. Total disbursements $18,706.18 plus a
transfer of $116.55, check #598. 4 Ayes

MSP (Hodges /Neisen) To approve Resolution #531 abating area assessments
on parcel #59 -0080- 180 -50. Water area assessment abated $156.94, sewer area
assessment abated $1,070.17. Abatement is necessary to correct original
assessments and in order to process Division #43352 apportioning the assessments
for Randoms First Addition.
MSP (Neisen /Johnson) To approve Resolution #532 abating assessments on parcel
#59- 0080 180 -50 necessitated by the platting of Random's First Addition. Abating
92.89 feet of water lateral assessment totaling $510.89, abatement of water
service assessment $125.11, abatement of sanitary sewer assessment $293.48,
abatement of street lateral footage assessment $84.66. Abatement necessary
because of the dedication of Skiba Drive plus a 6.44 foot excess assessment
plus a water assessment being incorrectly charged to this parcel. 4 Ayes
MSP (Johnson /Hodges) To approve Resolution #533 apportioning the assessments
on Division #43352 for Random Addition. 4 Ayes
Clerk- Administrator Zylla informed the Council that certain property had
forfeited to the State of Minnesota for delinquent taxes. On property
#59 -0060- 040 -31 it would be desireable to obtain the E 30' for a future
street. On parcel #59- 4200 340 -00 it possible would be desireable to obtain
the entire lot for a future extension of Spring Lake Road. On parcel
#59 -5500- 190 -02, a multiple zone lot, the Village would have no interest.
The staff was instructed to prepare the necessary resolutions obtaining the
property which the Village felt it needed.
Clerk- Administrator Zylla informed the Council that Moody's Investment Services
has refused to grant the BAA Bond rating. That they were very much impressed
with the financial picture of the Village but they would like to see an additional
two year history before they would again consider changing the rating.
Clerk- Administrator Zylla also noted that at the present time there has been
no response by Mr. Lloyd Moen of Moen Excavating to the bill that was sent to
him for damage caused to our sewer main on the 8300 block of Eastwood Road.
MSP (Neisen /Hodges) To refer the bill totaling about $2,900 to Attorre y Meyers
so that he may proceed to attempt for collection.
Clerk- Administrator Zylla informed the Council that at the present time we are
in the process of completing sewer and water extensions to various plats in the
Village. That to alleviate future problems which may arise by citizens complaining
because they have no blacktop streets which will not be constructed until the
summer of 72, consideration should be given to having affidavits signed by the
home owner acknowledging this fact. The Council agreed with the policy and
informed the staff to implement it however necessary.
Clerk- Administrator Zylla also announced that the first newsletter would be out
by late September. In addition, a $20,000 bond has been issued on himself as
per the audit report.
Councilman Hodges' Report
Councilman Hodges read excerpts of the Recreation Committee meeting minutes of
July 20th. He stated that there was another meeting scheduled for tomorrow night.
He felt he was very much interested in having an appraiser examine the Minar Ford
property which the Park Committee is interested in acquiring for a park site. He
also requests that the maintenance department consider moving the warming house
which has been given to the Village by New Brighton at the earliest possible date.

Councilman Neisen's Report
Councilman Neisen reported that the maintenance department is currently finishing
the crackfilling on the streets to be sealcoated.
Councilman Johnson's Report
Councilman Johnson read the minutes of the Planning Commission meeting of August 17th.
MSP (Blanchard /Hodges) To approve the preliminary plat of five lots for Jim Lund
Second Addition. Legal description of the existing lots: All of lot 12 and 13
except the N 90' of the E 130' of Block 2 Greenfield Addition. 4 Ayes
MSP (Johnson /Hodges) To issue a building permit to James Lund to construct a
single family home on Lot 2 Jim Lund Second Addition., 4 Ayes
Attorney Meyers gave the Council an interpretation of Section 3.4 regarding
accessory buildings and set backs stating that a garage is an accessory building
and that unless it is constructed nearer than six feet to a home it must be
constructed in the rear yard. It appeared that in no case could a garage be
further ahead of the house than the front line. The Council referred the matter
back to the Planning Commission to study clarification of the ordinance.
MSP (Neisen /Johnson) To approve the Subdivision of lot 80 and the S 38' of
Lot 81 Spring Lake Park Knolls Addition into two 85' lots subject to granting
of an easement on the W 30'. Subdivision application for John Wharton, 7190
Silver Lake Road.
Councilman Johnson read a letter from the George M. Hanson Company stating that
they are planning their work program and they would like to have Council
consideration to retaining them as auditors for 1971. There was no action
taken at this time on this request.
Councilman Blanchard announced that next Monday would be the first Village
budget meeting for 1972 budget.
Attorney Meyers' Report
Attorney Meyers reported on the Community One proposal stating that the New
Brighton Village attorney had requested an opinion from the Attorney General
on the legality of expending funds for this purpose. The Council decided to
take no action until the opinion has been granted.
Engineer Boehm's Report
MSP (Blanchard /Neisen) To set an assessment hearing for Project 1971 -1 and
1971 -la Sewer and Water for September 13th at 8:30 p.m.
Engineer Boehm reported on the street mileage to be sealcoated this year and
1972 and 1973. He stated that in 1971 10.2 miles will be sealcoated. The cost
will be approximately $27,000. In 1972 5.3 miles and in 1973 6.6 miles will be
sealcoated. Total estimated cost of the 72 and 73 sealcoat using 1971 prices
would be approximately $30,000. He felt the Village should consider combining
the 1972 and 1973 sealcoat program.

Engineer Boehm reported that work on Sewer and Water Project 1971 -1 and 1971 -1a
was progressing and he felt that the completion could be by mid September.
The sealcaat program would be started this week weather permitting.
