HomeMy WebLinkAboutMinutes - 1971/09/13Present: Acting Mayor Blanchard Councilman Hodges Councilman Neisen Councilman Johnson Absent: Mayor Rustad PROCEEDINGS OF THE VILLAGE COUNCIL VILLAGE OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA September 13, 1971 The Regular Meeting of the Mounds View Village Council was called to order by Acting Mayor Blanchard at 8 :00 P.M. on Monday, September 13, 1971 at the Village Hal 1, 2401 Highway #10, St. Paul, Minnesota 55112. Also Present: Clerk- Administrator Zylla Attorney Meyers Engineer Boehm MSP (Neisen /Hodges) To approve the minutes of August 23, 1971. 4 Ayes MSP (Neisen /Johnson) To approve tha minutes of August 25, 1971. 4 Ayes R. :.e4uests and Comments from the floor M:. w, 7932 Fairchild, again requested information as to the progress that has peen made on alleviating his drainage problem. Engineer Boehm informed him that he has received a letter dated August 23rd from the Highway Department in which they say thay will be cleaning out the ditch and increasing the culvert size from 15" to 18 Mr. Teslow felt that this would not solve the problem and he again requested information whether he could change his single family residence from one family to two family. When Mr. Teslow found out that an application for rezoning would cost $50.00 he left the meeting hurriedly. Acting Mayor Blanchard's Report Acting Mayor Blanchard read the Police report for August. Acting Mayor Blanchard announced the following new policy on police squad cars. He stated that it was the intention of the Village Council to advertise for bids in the future for sedans and not station wagons. He felt that the Unity Hospital ambulance service could more than handle the few emergency calls which would require stretchers and that the extra cost does not warrant purchasing station wagons versus plain cars. MSP (Blanchard /Neisen) To authorize the advertisement for bids for a 1972 4 door sedan through the Ramsey County Joint Purchasing Agreement. Clerk- Administrator Zylla's Report MSP (Hodges /Neisen) To approve the following licenses: Cement Work Al Zeis Cement Co., Inc., Sharp Concrete Construction Inc.; Excavating Jerry's Excavating; Gasoline Station Mounds View Union 76- Dennis Erickson; General Contractor Scott A. McLand, Good Value Homes, Leonard Goodroad, Allen George Construction Company, SCS Construction Company, Robert Lloyd Cont., Kurup Const. Inc.; and Roofing Richard Hedum. 4 Ayes 4 Ayes tiv 2 MSP (Hodges /Blanchard) To approve the following checks Check #5429 consecutive through 5478, Payroll check #'s 2262 consecutive through 2282, bond check #599. Total disbursements $197,504.20. In addition, to approve general check #5477 for $165,859.00 transferring money from the water utility, sewer utility and project account to the bond redemption account to reimburse the bond account for the levy reduction per Resolution #504 dated October 12th, 1970. Also to approve check #600 totalling $925.00 transferring money from the 68 -3 bond fund to the general account project fund to pay a portion of check number #5475. Acting Mayor Blanchard called the assessment hearing for Sanitary Sewer, Water and Drainage Project 1971 -1 and 1971 -la to order at 8:33 P.M. Clerk- Administrator Zylla read the legal notice and attested to its publication in the New Brighton Bulletin on August 26th and September 2nd, 1971. An error was noted in the legal notice in the statement "every lot, piece and parcel abutting on Spring View Lane". It is noted in the minutes that the following persons received legal notice in which the estimated costs per foot were included: Random, Inc., White Oak Builders, Keith Harstad, Anthony Holschuh, Spring Lake Park Lutheran Church, Vern Sinierson, Gordon Aspenson, David Mueller, Charles Charrier and Howard Thorson. Engineer Boehm made the presentation on behalf of the Village. He stated that the rate per front foot on sanitary sewer lateral was $7.75, water main lateral $4.65, drainage lateral $6.95. He also stated that sanitary sewer services were $157.50 each and water services were $145.50 each. He said that this compared with an estimated cost at the improvement hearing of $9.00 per front foot for sanitary sewer, $6.10 per front foot for water lateral, $230.00 each for sanitary sewer and $210.00 each for water services, He stated that the drainage installation was originally planned to be put in with the street project but that since so much excavating had to be done it was decided '.o include it with the sewer and water project. He did feel, however, that the $12.40 estimate for street surfacing would be reduced by an mount as yet undetermined because of a fact that the drainage was constructed in this project. Ed Dropps of White Oak Builders questioned whether credit was given for the previous sanitary sewer and water street assessment on Woodcrest Drive and on Woodale Drive. Engineer Boehm explained that yes, they were and in addition, abatements were granted because of the creation of the north -south streets. Mr. Dropps inquired as to whether only the north side of Woodcrest and Woodale was assessed for drainage? Mr. Boehm explained that yes under this assessment only the north side is. He stated that this assessment is not a storm sewer, it is only a drainage assessment which is rdcessary because of the construction of blacktop streets in the area. He felt that the people on the south side in effect had paid this assessment when they were assessed for sanitary sewer when their street was constructed. Acting Mayor Blanchard asked if the drainage would have been built if the project had not been started. Engineer Boehm stated that in his opinion no it would not have been. 4 Ayes 3 Mr. Dropps felt that it would have been necessary at least on Long Lake Road. Mr. Dropps stated that he was unaware when he petitioned for the improvements that it included storm sewer. Engineer. Boehm again reiterated that this was not a storm sewer, that it was merely a drainage assessment connected with the construction of the blacktop streets. He stated that it could have been called street preparation costs. Engineer Boehm stated the major cost of the drainage assessment is street preparation. He stated that at least 20,000 yards had to be excavated. Acting Mayor Blanchard called for objections. Ed Dropps of White Oak Builders objected to the drainage assessment on Woodale Drive between Long Lake Road and Eastwood Road. There were no other objections. Acting Mayor Blanchard closed the assessment hearing at 9:10 P.M. Attorney Meyers stated that the only question to be decided by the Council is whether the properties that are being assessed in this hearing are benefited by the full amount of the assessment. If they are not benefited in the determination of the Council, the Council has two al.ernatives. Number one, it could reassess the project including the properties that were not originally included in the improvement hearing, or two, it could place a portion of the assessment cost on the tax rolls. Councilman Neisen stated that he could not show cause to assess the people south of Woodale Drive. Councilman Johnson did not want to comment on the assessment roll since he lived on Greenwood Drive just south of Woodale Drive and may be included in the prpposed assessment area. MSP (Neisen /Hodges) That the following finding of fact be made a part of the record. That the Council has made a determination that the properties included in the assessment roll are benefited to the amount of $7.75 front foot for sanitary sewer lateral, $4.65 a front foot for lateral water, $6.95 a front foot for drainage lateral, $157.50 each for sanitary sewer services and $145.50 each for water services, and therefore they agree to adopt the assessment roll for Project 1971 -1 and 1971 -la (Resolution #536) authorizing the assessment to be levied over 20 years at 87 interest. Johnson Abstained The Council heard a proposal by Mrs. Kay Zwernik, director of the'North Suburban Day Activity Center program which provides preschool and school services to mentally retarded children and young adults in the north suburban area. Mrs. Zwernik gave the Council a historical review of the center and the services which they do provide. She stated that the pilot project began in 1961 and that through the enactment of the daytime activity center bill they are able to match locally raised funds with state funds on a 50 -50 basis. She stated that the average yearly cost per participant was $1,300, versus a cost of between $4,000 and $5,000 to care for a patient in a state hospital. She stated that her 71 -72 budget was $84,437 and that the organization was seeking a combined total of $6,000 from all the communities served in the north suburban area, Mounds View, Arden Hills, Shoreview, New Brighton, Roseville and St. Anthony. She stated that they are requesting from Mounds View a total of $692.40 for the budget year 71 -72. Mrs. Zwernik stated the aim of the program was to place all mentally retarded children in the school system eventually. 3 Ayes 4 Vern Sinderson speaking as a representative of the Mounds View Lions spoke of the wonderful work that this organization had been involved in, and his involvement with the North Suburban Day Activity Center. The assistant pastor of the Spring Lake Park Lutheran Church, Mr. Miskowiec, spoke of his experience in that he had a child enrolled in the program at one time. Mrs. Anderson, a Mounds View resident, told how she had spent a total of $14,000 in medical costs alone for her three year old retarded child, presently enrolled in the program. MSP (Johnson /Hodges) To make provision in the 1972 Mounds View budget to pay $700 to the North Suburban Day Activity Center in January of 1972. MSP (Hodges /Neisen) To approve Resolution #537 abating $385 from D.P. 35, $3,389.50 from D.P. 47, $165 from D.P. 84 for a total of $3,939.50 for Division #43368. Abatement was necessary because of the Council's short side policy. Provision is to be made to repay the abated amounts from any surplus project proveeds. MSP (Blanhard /Neisen) To approve Resolution #538 apportioning the assessments on Division #43368, Red Oak Estates. 4 Ayes MSP (Neisen /Hodges) To appoint the following persons to read meters for 1971; Neil Valley, Kenneth Lidberg, Marlyn Ryti, Greg Groberg, Jean Miller, Pat McNary, Elmer Adleman, Fred Peterson, and Edward Loomis. 4 Ayes Councilman Hodges' Report Councilman Hodges read portions of the Recreation Committee meeting minutes. He stated that Cushman Minor was coming to a recreation meeting in the future to discuss the property which the Village wants to acquire for a park site on Silver Lake Road and County Road H2. Councilman Hodges stated that the Recreation Committee had decided that a minimum of $444,477 would be necessary to upgrade existing parks and to acquire the Silver Lake Road park site. It was the feeling of the Council that one question be put on the ballot in November rather than two questions, one concerning voting on acquisition and one concerning voting on improving existing parks. MSP (Neisen /Johnson) To authorize Councilman Hodges to contact Ehlers and Associates for a computer run to estimate the cost in dollars and mills of the proposed bond issue. Councilman Hodges also stated that Community One was looking for a liason with the Mounds View Council. Councilman Neisen's Report Councilman Neisen stated that he was wondering why Mr. Lund was building two homes on the 7800 block of Bona Road since the Council only authorized the issuance of one building permit. Clerk- Administrator Zylla had no answer and was instructed to request Mr. Lund to appear with his final plat at the next regular meeting. 4 Ayes 4 Ayes 4 Ayes 5 Councilman Johnson's Report MSP (Johnson /Neisen) To hire the firm of George M. Hanson Company to audit for the year ending 1971 for a cost of $3,000. Councilman Johnson inquired as to why there was a sign advertising a double bungalow on the corner of H2 and Silver Lake Road. He was informed that the property was zoned multiple dwelling. MSP (Johnson ?Hodges) To authorize Attorney _Meyers to make an examination as to, one, whether we should go in `with an established municipal court, two, whether we should establish a new system with the surrounding communities which still have the justice courts or three, we should keep what we now have. Attorney Meyers was also directed to check on the legal aspect of deleting the position of treasurer and including the responsibility under the Clerk. Attorney Meyers' Report Attorney Meyers stated that as yet he has heard nothing of the disposition of the Chies refund from Ramsey County. He stated he has not seen the Attorney General's opinion on Comm±1nity One which ruled in favor of the Joint Powers agreement for its support. Engineer Boehm's Report Engineer Boehm stated that the Teslow problem brings to light one important feeling which the Councilmen should keep aware of and that is that someday we are going to have to face the fact that storm sewer is going to be needed within the community.
