Present: Mayor Neisen Councilman Hodges Councilman Johnson Councilman Baumgartner Councilman Pickar PROCEEDINGS OF THE VILLAGE COUNCIL VILLAGE OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA January 31, 1972 The Regular Meeting of the Mounds View Village Council was called to order by Mayor Neisen at 8:00 P.M. on Monday, January 31, 1972 at the Village Hall, 2401 Highway #10, St. Paul, Minnesota 55112. Also Present: Clerk- Administrator Zylla Attorney Meyers Engineer Boehm MSP (Hodges /Baumgartner) To approve the minutes of January 10th. MSP (Neisen /Hodges) To approve the minutes of January 26th. Mayor Neisen's Report Mayor Neisen read portions of the police report for the year 1971. Clerk- Administrator Zylla's Report MSP (Johnson /Pickar) To approve the following licenses: Heating Anoka Plumbing Heating, D D Anderson Heating Plumbing, Inc., Complete Air Heating Cooling Inc.; General Contractor Myrum Builders; Cigarette and Gasoline Station Elmer Peterson d /b /a Pete's Skelly, Dennis R. Erickson d /b /a Mounds View 76. MSP (Hodges /Baumgartner) To authorize the confiscation of meter deposits to cover delinquent bills for the year 1971. Clerk- Administrator Zylla read a list of the persons and the addresses from which deposits were confiscated. He stated that there was only $30.04 out of a total billing in excess of $200,000 which was not covered by meter deposits. Clerk Zylla read a letter from Mrs. Kay Swernik, Program Director for the North Suburban Day Activities Center, in which she expressed her gratitude that the Council approved their request for funds and budgeted the money for their organization. Clerk- Administrator Zylla presented two estimates for remodeling the maintenance building to include enlarging the police quarters and providing space for the maintenance department in the area known as the Civil Defense room. Two bids were submitted with the apparent low bidder Ebel Ramacher Corporation at a total cost of $788. The other bidder was Victor Loeffler Construction for a total bid of $1,569.50. Mayor Neisen called the hearing to consider rezoning and a special use permit for Keith Harstad to order at 8:30 P.M. 5 Ayes 5 Ayes 5 Ayes 5 Ayes MSP (NeiseniJohnson) To receive the 1971 Financial StfIte.aent from the Clerk and to authorize its publication in abbreviated form. 5 Ayes Rezoning from R1 to 83 legal description: E 410' of Unplatted Lands, ex Red Oak Estates, the following: N 3/4 of NE 1/4 of SE 1/4 N 3/4 of the E 1/2 of the NW 1/4 of the SE 1/4 (Subj to rds) in Sec. 7, T 30, R 23. Special use permit to construct town houses legal description: Ex E 410' and W 790' of Unplatted Lands, f Ex Red Oak Estates the following N 3/4 of NE 1/4 of SE 1/4 of N 3/4 of the E 1/2 of NW 1/4 of Sec. 7, T 30, R 23. 2 Clerk Zylla stated that the legal notice was published in the New Brighton Bulletin on January 13th and 20th and fourteen individuals were sent notice of hearing. He stated that on January 19th a card was sent to these same individuals advising them that the hearing had been cancelled. The reading of the legal notice was dispensed with but Clerk Zylla described the location of the area under consideration. Councilman Johnson made the following statement. "Mr. Harstad was requested at a previous meeting to supply to the Planning Commission and then the Council certain information relative to soil conditions of the proposed site for commercial development. Mr. Harstad was also asked to supply other information that would aid the Planning Commission and Council in its deliberations. The minutes of the January 18, 1972 Planning Commission meeting indicate as follows: "Keith.Harstad not here. No action taken." In view of Mr. Harstad's failure to appear at the January 18, 1972 Planning Commission hearing and in view of the lack of information presented to the Council I move MSP (Johnson /Pickar) That the hearing for rezoning and special use permit requested by Mr. Harstad be terminated and that he proceed to reapply for rezoning and for special use permit pursuant to our zoning ordinance." MSP (Hodges /Johnson) To adjourn the hearing at 8:38 P.M. Mr. Harstad stated that he had forgot about having to attend the Planning Commission meeting since he had been there previously. (R 2fer to Council minutes of Dec. 13th.) Mr. Harstad was present at the hearing, did not object to the Council action and left the hall shortly after the hearing was adjourned. MSP (Baumgartner /Johnson) To delay action on expansion at the maintenance building until the Council has a further chance to reach a decision among themselves as to the space needs of the maintenance department. Jerry Blanchard and Gerald Fields were invited to attend the next agenda meeting to discuss their space needs relative to the Boy Scouts and the Civil Defense respectively. MSP (Hodges Pickar) To adopt Resolution #562 apportioning the assessments on Division #44315 Chapman Addition. 5 Ayes MSP (Neisen /Johnson) To waive the requirement of Ordinance #192 known as the Personnel Ordinance that comp time be taken within two weeks after it is earned for Gary Korf so that he may accumulate enough time to go to tl. League sponsored Minnesota State Fire School on April 24th through the 27th. MSP (Johnson /Blanchard) To authorize Attorney Meyers to review the file accumulated by Clerk Zylla relative to the Irondale Road water assessment which has been challenged by White Oak Builders and of which they are currently in arrears totaling $1,500 from reviously agreed upon amount. 5 Ayes 5 Ayes 5 Ayes 5 Ayes 5 Ayes 0 3 Councilman Johnson instructed Attorney Meyers to determine whether we have rI legal basis to go after the entire amount in full. Councilman Johnson's Report p Councilman Johnson stated that fire hydrants in the Village were presently being cleared of snow and that residents could assist in keeping they hydrants near their homes cleared thereby saving the municipality the expense involved in doing the job. Councilman Baumgartner's Report Councilman Baumgartner stated that a list of proposed improvements and suggested maintenance for 1972 will be submitted shortly to the Clerk. Councilman Baumgartner stated that the Boy Scouts will be requested to aid in a park clean up on April 29th. Councilman Baumgartner also stated his desire to have a few new members on the Recreation Committee. Councilman Baumgartner read the Planning Commission minutes from January 18th. MSP (Baumgartner /Hodges) To approve the subdivision of Except the N 184' and Except the S 191' of the N 375' of the W 234.1' of Lot 38 Auditor's Subdivision 89 into a lot 85 feet by 211 feet bordering on Spring Lake Road and the part remaining subject to granting a 30 foot easement to highway on the East. MSP (Hodges /Pickar) To approve the issuance of a special permit to Arnold Elmquist of 8140 Long Lake Road to construct a 12' X 30' accessory building. After some discussion as to whether the semi trailer parked on the Minar Property is a trailer or a sign, the Clerk stated he would send Wilmus Properties a building permit application for a sign in order that they could comply with the building code. Councilman Pickar's Report Councilman Picker reported that he was unable to attend the last Lakeside Park meeting but that he has read the request of Mrs. Haake, acting as a private citizen, seeking to dissuade the City of Fridley from establishing another beach on the west end of the lake. He related his support for her letter. Walter Skiba reported that last Saturday he appeared in Justice Court to support a charge against a local heating contractor for failure to obtain permits. The contractor was double fee'd by the judge. Robert Glazer, Planning Commission member, related that he feels the need for a Village development plan to determine our optimum land uses. Attorney Meyers stated that he felt it may be difficult to uphold our zoning ordinance in litigation as time passes unless consideration is given to a new plan in the future. The last comprehensive plan was finished in 1960. Mayor Neisen announced that the Mounds View Appreciation Dinner has been scheduled for February 19th. Mayor Neisen also made a request for citizens in the Village to exercise courtesy by moving vehicles off the streets to that sn /plows can adequately do their job. 5 Ayes; 5 Ayes Attorney Meyers' Report Attorney Meyers reported that the Chies versus Barton Contracting plus the Mounds View versus Moen lawsuit are still open matters. The latter being assigned to Anoka District Court. Attorney Meyers reported that he has met with the Metropolitan Sewer Board at which time he presented an objection to our 1972 bill and made a formal request to be informed of the disposition of the $540,000 in cash which was acquired by the Board in the takeover of the North Suburban Sanitary Sewer District. Engineer Boehm' s Report 4 Engineer Boehm reported that the plans for street construction be ready by the next Council meeting. Engineer Boehm stated that he has received a report from Clerk submitted by Universal Tank on changing the ladder on Tower #2 Federal regulations. MSP (Johnson /Pickar) To adjourn at 9:47 P.M.
