The Regular Meeting of the Mounds View Village Council was called to order by Mayor Neisen at 8:00 P.M. on Monday, April 24, 1972 at the Village Hall, 2401 Highway #10, St. Paul, Minnesota 55112. Present: Mayor Neisen Councilman Hodges Councilman Johnson Councilman Baumgartner Councilman Picker PROCEEDINGS OF THE VILLAGE COUNCIL. VILLAGE OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA April 24, 1972 MSP (Hodges /Baumgartner) To approve the minutes of April 10, 1972. 5 Ayes Residents Requests and Comments from the floor Also Present: Clerk- Administrator Zylla Attorney Meyers Engineer Boehm Michael Steele and Joan Godeke of the Human Rights Commission appeared to inform the Council what the Commission has done at their Last two meetings. Mr. Steele stated that the Commission is considering requesting a small budget from the Council to conduct various human rights related activities. Robert Glazer commented on the recently published Mounds View brochure, which invited realtors to provide an impetus for commercial and industrial development within the Village. He felt that by the publication of the brochure the goals of the Planning Commission and of the Council were out of balance. Mr. Glazer stated he did not want the building community taking over the Village. Councilman Johnson answered Mr. Glazer by saying that the purpose of the letter was to promote development, and not to see how fast we could have all of our land built on, but rather, to get certain people interested in the community in order to provide necessary services while adding to the tax base. Councilman Johnson stressed that if we cannot get people to come into the community to develop various commercial and industrial areas we cannot very weil prohibit development since there is nothing for the Planning Commission and Council to consider until a request is made. Mr. Glazer stated that he was aware that the Land Use Plan was out dated, but that he felt the instructions to the Planning Commission to updaLe the plan meant that before any development was sought an updated plan would be prepared and presented to the Council. Councilman Johnson stated that the purpose of the letter was to acquaint people with Mounds View, where it is and what it has to offer and to get them to come in to talk with us. Mr. Glazer also questioned the Council on what the intent of the 621 Growth Committee was and their relationship with Northern States Power. Mayor Neisen explained that the Committee was formed to try to improve the 621 tax base, and that the power company was involved in funding the published study through their Public Service Department. Mr. Glazer commenting on the Open Space lecture by Ken Simons, Landscape Architect, went on record opposing a linear park system. He stated that open space was the first area that the Highway Department looks for in acquiring a right -of -way. In addition he was against turning green areas into storm sewer condui` Mayor Neisen's Report 2 Mayor Neisen read a report from the Police Chief stating that there had been 265 junked or unlicensed vehicles tagged in the Village. Clerk- Administrator Zylla's Report MSP (Pickar /Baumgartner) To approve the following licenses: General Contractor D. L. Scherer, David R. Mueller; Cement Contractor Leo Huot; Rooting Contractor DeRayco Contractor; Heating Contractor Swenson Heating Air Conditioning and Garbage /Rubbish Hauler Guy's Disposal, Rubbish Removal Inc, Kersten Truck Service, All -State Disposal Service, Inc., Ace Colid Waste Management Inc., and Peterson Bros. Sanitation, Inc. 4 Ayes Johnson Naye MSP (Pickar /Hodges) To approve a transient merchant license fcr Donald Rudkin, 8150 Eastwood Road, to sell watermelons on the corner of Eastwood Road and Highway #10, subject to the stipulation that the area is cleaned up and left in a presentable condition. MSP (Neisen /Pickar) To permit the transfer of the On -Sale and Off -Sale Intoxicating Liquor licenses, Sunday Liquor license, Cabaret and Restaurant Licenses of Bennett Goldberg, doing business as Mermaid Cocktail Lounge, Inc. to Donald Marrone and Charles Hall effective May 1, 1972 with the condition that the license transfers not take effect until proof of ownership is presented to the Clerk's office. MSP (Hodges /Baumgartner) To approve the cigarette license for Donald Marrone, doing business as Mermaid Cocktail Lounge, subject to the conditions set forth in the previous motion. 5 Ayes Mayor Neisen called the Eigenheer Rezoning Hearing to order at 8:33 P.M. Clerk Zylla read the legal notice and attested to its publication in the New Brighton Bulletin on April 13th and 20th. Hearing is to rezone Lot 2 and that portion of Lot 1, lying South of the water main easement, Eigenheer 3rd Addition, from R1 single family to R2 two family. Robert Eigenheer, owner of the property, explained his proposal. He stated that due to the necessity of having the area replatted at the request of the Planning Commission and the Village Council, a water main easement runs the entire length of Lot 1, causing Lot 1 to be unbuildable for a single family home. He therefore proposes to combine that part of Lot 1 lying South of the easement with Lot 2, creating a larger lot and constructing a two family residence. Mr. Robert Gaabo, 5249 O'Connell Drive, asked why the apartment building on Greenfield and O'Connell was built. Mr. Eigenheer answered that it was constructed to serve as a buffer to the commercial property. Mr. J. F. Fontaine, Jr., 5239 O'Connell Drive, asked why Mr. Eigenheer cannot build on Lot 1 and wanted to know whose fault it was. Mr. Eigenheer explained the lot was too small and that lot lines had been changed through replatting. Mr. Fontaine wanted a park for the lot, and expressed the belief that the residential area should not be changed. Mr. Eigenheer showed a house plan to the audience. Mr. William Lake, 5259 O'Connell Drive, stated that he has made an investment in his home and that a realtor with whom he had talked had stated that a double bungalow may decrease his property value. He stated he was opposed to the project. He also asked what is to stop Mr. Eigenheer from asking for a two family residence immediately South on Lot 3 which is now vacant. 4 Ayes l Johnson Naye 5 Ayes 1 3 Mr. Glazer stated that by stating that a two family residence is necessary to serve as a buffer between commercial property on #10 and residential property is to subject more people to a commercial zoning than you would if you did not buffer it. Mr. A. R. Goettsch, 5229 O'Connell Drive, stated that he was in the building trade and has seen how run down double bungalows can get. Mrs. William Lake, 5259 O'Connell Drive, asked to have the commercial property on #10 changed to residential. Mr. Eigenheer explained that his proposal would make the area better by constructing a two family residence than by attempting to divide the lots thereby constructing two or three single family homes. He stated that the price of the double bungalow would be between $45,000 and $50,000. Residents expressed the desire to know who would buy the lot South of the double bungalow and across the street. Mrs. Haake, 1740 County Road I, wanted to know if Mr. Eigenheer had planned on straddling the easement with his double bungalow. He explained that by building a double bungalow he would be using two lots, and not just the lot the easement is on. Mayor Neisen asked whether there was anyone in the audience who spoke in favor of the proposal. No one stood up in favor. Mayor Neisen closed the hearing at 9:05 P.M. Councilman Pickar asked if Mr. Eigenheer was planning on building on Lot 3 this year. Mr. Eigenheer explained that he had plans to develop all remaining single family lots in the area this year. Councilman Pickar asked whether there had been any complaints on weeds on the lots last year. Mayor Neisen confirmed that there were complaints and that they were turned over to the Weed Inspector. Councilman Baumgartner asked Mr. Eigenheer if the easement was put in before the property was bought. Mr. Eigenheer stated that it was put in after. Councilman Baumgartner asked if it would not be better to make three 75 foot lots. Mr. Eigenheer explained that the area would look worse and that the Planning Commission may not go along with the proposal. He said it would be fine with him. Councilman Johnson asked whether Mr. Eigenheer had received payment for the easement. Mr. Eigenheer replied "no Councilman Hodges stated that he could see a double bungalow as a buffer but that he felt he must consider the desire of the people living there. Attorney Meyers advised the Council that prior to a vote on the proposal they should consider it relative to health, safety and welfare, and that if they were to deny the proposal it must be on those grounds. In addition he stated that a 4/5's vote was needed for passage_ MSP (Baumgartner /Johnson) To deny the rezoning as requested. 5 Ayes Clerk- Administrator Zylla's Report (Continued) MSP (Neisen /Hodges) To set a hearing on May 8th at 8:30 P.M. to consider adopting new permit fees relative to one and two family dwellings. 5 Ayes 4 MSP (Pickax /Johnson) To adopt Resolution No. 567 requesting needed engineering and technical services from the Minnesota Department of Highways, during the year of 1972. 5 Ayes E MSP (Neisen/Hodges) To approve the following bills: General checks #6034 consecutive through 6064, Bond check #611 and Payroll checks #2668 consecutive through 2693. Total disbursements $32,425.01. 5 Ayes MSP (Johnson /Pickar) To approve check #6065 transferring $9,878.00 from the General Fund, Street Department, to the Revolving Fund to pay the cost of sealcoating for Project 1972 -2. 5 Ayes Councilman Hodges' Report Councilman Hodges stated that due to the increased work load and the rapid population increase in the last few years it has become necessary to consider advertising for additional office help. MSP (Hodges /Johnson) To advertise for a full time person for the Clerk's office for a possible June 1st starting date. Councilman Johnson's Report MSP (Johnson /Hodges) To hire Wallace Mortenson on a permanent basis with a six month probationary period for a starting salary of $772.00 per month, and to hire on a full time temporary basis LeRoy Robinson at a salary of $2.75 per hour effective May 1, 1972. 5 Ayes MSP (Johnson /Baumgartner) To schedule a public hearing for June 26th at 7:30 P.M. to consider renumbering and a change in the postal zone for the Village of Mounds View. 5 Ayes Mayor Neisen stated that Councilmen Johnson and Baumgartner are in charge of making the necessary arrangements for the hearing. 5 Ayes p Councilman Baumgartner's Report Councilman Baumgartner related that he had toured the parks on Saturday with other members of the Recreation Committee and had made up a list of things to do on the parks this summer. He reminded the audience and Council that April 29th was Clean Up Day. He also stated that on Saturday 20 trees would be planted with the $300.00 donated by the Mounds View Snowmobile Club. Councilman Baumgartner read the P'.anning Commission minutes for April 18th. MSP (Baumgartner /Johnson) To set a public hearing for May 22nd at 8:30 P.M. to consider the issuance of a special use permit to Keith Harstad to build 72 townhouse units (9 buildings) on County Road H2 between Sunnyside Road and Long Lake Road. 5 Ayes1 MSP (Baumgartner /Pickar) To table a request by Edwin Dropps to subdivide Lot 96 Knollwood Park for two weeks until the Clerk has had time to review the application. 5 Ayes_ MSP (Picker /Johnson) To table the request of Richard Hedin for a special use permit to build an oversi::ed garage at 7946 Eastwood Road, subject to payment of F_es. 5 Ayes;;. 5 Councilman Pickar's Report Councilman Pickar announced that the Lakeside Park Commission will be meeting on Wednesday, April 26th, and that a decision on life guards and caretakers for the summer season will be made at that time. Attorney Meyers' Report Attorney Meyers reported that Mrs. Lewis had contacted him and stated that the bus barn property on County Road H2 and Silver Lake Road was being cleaned up. Some buses were sold, a wrecked car was disposed of, two buses were licensed and they were looking for a place to dispose of two more buses. Engineer Boehm's Report MSP (Neisen /Hodges) To authorize the Engineer to prepare the Assessment Rolls for Street Improvement Project 1972 -1 and 1972 -1a. Engineer Boehm also stated that he has begun working on the storm sewer map requested by the Council last meeting. Mayor Neisen advised the audience that the Council had authorized the dogcatcher to do special patrol duty last Saturday and that if the dog problem becomes acute again, the Council will again take such action.
