HomeMy WebLinkAboutMinutes - 1972/05/22PROCEEDINGS OF THE VILLAGE COUNCIL VILLAGE OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA May 22, 1972 The Regular Meeting of the Mounds View Village Council was called to order by Mayor Neisen at 8:00 P.M. on Monday, May 22, 1972 at the Village Hall, 2401 Highway #10, St. Paul, Minnesota 55112. Present: Mayor Neisen Councilman Hodges Councilman Johnson Councilman Baumgartner Councilman Pickar Clerk- Administrator Zylla's Report Also Present: Clerk- Administrator Zylla Attorney Meyers Engineer Boehm MSP (Hodges Baumgartner) To approve the minutes of May 8th, 1972 corrected to read on Page 3, 2nd paragraph "opposition primarily of the added parking it would generate 5 Ayes Residents Requests and Comments from the Floor: MSP (Neisen- Hodges) To approve the transfer of the on sale intoxica liquor license, the Sunday liquor license, the off -sale intoxicating liquor license, the restaurant license and the off -sale non intoxicating liquor license from Robert and Gerald Waste to Albert and Joseph Hartinger, doing business as the Launching Pad Supper Club, effective June 1st, 1972 and the issuance of a cigarette license and cabaret license, subject to payment of fees and the proof of transfer of ownership. 5 Ayes Mayor Neisen's Report Mayor Neisen announced for the months of June, July and August the agenda meeting would be scheduled for only the 1st Monday of each month due to vacation schedules, army reserve committments, and a wedding. MSP (Pickar Hodges) To approve the following licenses: Asphalt B H Blacktopping Inc.; Plastering Outside Stucco Frogner Drywall Co.; General Contractor G. James Const., Mar -Son Const., Alandale Builders, Inc.; Restaurant John Hulteen d /b /a Country Kitchen; Set -Up License and Dance License Anton E. Jambor d /b /a Bel -Rae Ballroom; Off Sale Intoxicating Liquor License Simon T. Simon d /b /a Simon's Liquor Store, Inc., Rita M. Waste d /b /a B R Liquor; Cabaret License Off Sale Intoxicating Liquor License Donald J. Marrone d /b /a Mermaid Lounge, Inc., and Anthony Donatelle d /b /a Donatelle's Supper Club. 5 Ayes MSP (Hodges Baumgartner) To approve the foliowing bills: General checks No. 6104 consecutive through 6140. Total disbursements $18,870.76. 5 Ayes MSP (Johnson Pickar) To approve the transfer of $6,590.00, check No. 6141 from the General Fund to the MSA Bond Fund to correct the bank deposit of May 12th, 1972. 5 Ayes A request by Keith Harstad for the issuance of a special use permit to remove fill from a Site North of Ridge Lane between Long Lake Road and Sunnyside Road MSP (Neisen Pickar) Councilman Pickar's Report 2 was tay_ed until later in the meeting when the developer would be present. A motion was made by Councilman Baumgartner and seconded by Councilman Hodges to approve the request, but the motion and second were withdrawn. To adopt Resolution No. 568 apportioning the assessments on Division No. 44896. 5 Ayes Councilman Hodges Report MS (Hodges- Johnson) To accept the resignation of Maxine Neumann, Administrative Secretary, effective May 31st, 1972. 5 Ayes MSP (Hodges Pickar) To approve the appointment of Mrs. Maridelle Wamhoff, as Administrative Secretary for eight hours per day effective May 23rd, 1972 at a rate ogj $2.70 per hour during the six month probationary period with an increase to $2.90 per hour thereafter; and to approve the appointment of Mrs. Arlene Stafford as Clerk Typist for six hours per day, effective June 5th, 1972 at the rate of $2.55 per ho{ir during the six month probationary period with an increase to $2.75 per hour thereafter. MSP (Neisen- Johnson) To amend the previous motion to approve the employment of both employees subject to receipt of a statement of their physical condition from their Doctor. MSP (Neisen- yckar) To approve the original motion as amended. Councilman Hodges presented a hat to Attorney Meyers which was given him to present to Mr. Meyers by Commissioner Ed Salverda. The hat was a prize awarded (supposedly because Mr. Meyers name was drawn as a lucky winner) from a drawing held by the new Horse and Rider Store which recently opened in Mounds View., Mr. Meyers graciously accepted the hat with the comment "I'll get even for this and declined to wear it for the public. Councilman Johnson's Report Councilman Johnson reported on the meeting he attended at the Fridley Municipal Building at which the Metropolitan Sewer Board presented its Five Year Capital Improvement Budget. He stated that research was contir.uing on various alternatives relative to the construction of sewer mains and facilities in an attempt to minimize costs. MSP (Johnson Baumgartner) To authorize the purchase of an auger for $157.00 for the Public Works Department to enable the Village to place and replace street sign posts and possibly hockey posts more efficiently. Councilman Pickar stated that the Lakeside Park Commission will meet on Wednesday to decide on job applicants for the summer, and that Lakeside beach will open on June 6th, 1972. Mayor Neisen called a hearing to order at 8:30 P.M. to consider the issuance of a special use permit to Keith Harstad Lo construct 72 townhouse units. Clerk 5 Ayes 5 Ayes 5 Ayes Zylla read the legal notice and attested to its publication in the New Brighton Bulletin on May llth and 18th, 1972. He stated that 12 persons were sent notice of the hearing. There would be three townhouse buildings set to the West of 'Long Lake Road and South of County Road H2 approximately 300 ft West of Long Lake Road. The area between these structures and Long Lake Road would be either dredged for a small lake or graded for use as a tennis court and a swimming pool. An additional parcel of property to the South and West of his townhouse units would be used to construct 92 single family homes after street improvements were constructed. He stated that he does not have any final plans or grading plans for the proposal at this stage due to the added expense that would be necessary, since the Council has not acted favorably upon his proposal at this time. However, he stated he would have more detailed plans if the Council indicated approval of his project. Mayor Neisen called for questions from the floor Mrs. Sickler, 5250 Long Lake Road inquired as to who was to perform the maintenance on the townhouses. Mr. Harstad answered that an association would be formed and that they would assume the responsibility. Mr. Perkins, 2559 Woodale wanted to know whether they would be rented or sold outright. Mr. Harstad replied that they would be sold in the lower $30,000.00 bracket for each unit. Mr. Perkins also wanted to know why he received notice of the March 5th hearing on the townhouse proposal, but did not receive any notice of this hearing. He was there to "bitch about it He was opposed to the added traffic it would cause and had moved out of Minneapolis and spent $34,000.00 for his home and did not want his neighborhood changed. Clerk Zylla explained that several people did not receive notice of the 2nd hearing because the 2nd proposal was changed and certain people which were in the 250 foot radius for the 1st hewing were no longer in the radiu for the 2nd hearing. Therefore, notices were merely sent to those in co9formance with the language of our zoning ordinance. Mr. Hurajt, 5256 Long Lake Road stated that he did not receive notice until Saturday, May 20th, 1972. Clerk Zylla explained that notices were mailed on Monday, May 15th, 1972. 8 4 Mr. Hurajt also wanted to know why the townhouse was on the corner of County Road H2 and Ldng Lake Road. Mr. Harstad explained that this was the only area to the West of the three townhouses that had sufficiently solid soil. Mr. Severt, 5238 Long Lake Road wanted to know where the swimming pool would be. Mr. Harstad said he would be willing to place it just about anyplace. Mr. Sickler, 5250 Lake Road asked if Mr. Harstad would have purchased the property if he had known it would have to remain single family. Mr. Harstad stated that it was purchased a number of years ago with the intention of establishing a trailer court. Mr. James Nerdahl, 7941 Edgewood asked if the development was contingent on a sale of the property. Mr. Harstad stated he will build and sell the townhouses. Mr. Williams, 5145 Eastwood wanted to know what provisions were in the Homeowners Association Agreement. Attorney Meyers stated that the conditions would become a part of the special use permit. Mr. Williams also asked whose responsibility the pond would be. Mr. Harstad stated the Association would be responsible. Mr. Perkins, 2559 Wocuale stated that the townhouses would create traffic problems. Mr. Harstad said there would be less traffic than if it were all single family homes. No matter what was developed traffic was inevitable in that area he stated. Mr. Christianson, 5273 Sunnyside Road also questioned notification of the hearing. Mr. Kishel, 5244 Long Lake Road stated that the pond would contribute to mosquitoes and traffic would filter onto Long Lake Road. Mr. Kishel also asked questions on the common area in the townhouse development. Mr. Harstad explained that all owners in the development including single family homeowners would pay a fee to the Association. Mr. Harstad stated that between 40 and 50 single family homes could be built on the area where no townhouses are designated. He stated that soil tests have shown that there is at least 15 feet of peat on the East side of the property where the ditch runs which would make it very expensive to construct single family homes. Mr. Seifer asked if Mr. Harstad was going to excavate all the trees on the property. Mr. Harstad stated that he intends to leave the trees. Mr. Seifer said he doesn't want to look at anything across the street except what is there now. Mr. Stone, 2609 Woodale asked if Mr. Harstad can build single family homes on townhouse property. Mr. Harstad answered yes, the property was presently zoned for single family. Mr. Hurajt said the area looks good now as is and told Mr. Harstad that he had made a bad investment. 5 Mr. Kishel asked the Council how they would feel if townhouses were built across from them. Owners of apartments canno. fill them now and he said that apartments and townhouses are the same thing. Mayor Neisen stated that the Planning Commission recommended the Council hold the hearing and the Council could have issued the special use permit without the hearing. Mr. Perkins said he was not sent a notice and that he would like his attorney present, a two,week postponement, and copies of the list of people that were contacted by mail. Mrs. Haake, 1740 County Road 1, a Planning Conimission member, asked if there was any compromise possible. She asked if Mr. Ha stad would drop the four townhouse buildings on the East and if then the people in the audience would feel any differently. Mr. Robert Glazer, 2375 Hillview, also a Planning Commission member stated residents in the area were at a disadvantage in that there were no detailed plans'such as parking and green area plans. Attorney Meyers stated that as Mr. Harstad had mentioned previously, the hearing tonight was just to get the general feeling of the public with respect to, the proposal. Mr. Glazer asked if there was a dedication of park property or money in conformance with the subdivision regulations. Attorney Meyers said if subdivision is over 30 acres, which it is, the option of cash or land is with the developer. Clerk Zylla stated that there is a provision in the ordinance to exempt the developer from the 107 requirment in view of the overall plan. Mr. Glazer stated that because of the townhouse proposal, the Village residents would pay a little extra in school taxes. This affects everyone's welfare. We should preserve the flood plains which we have left. Regarding safety, Mr. Glazer stated that an additional 40 cars would be added by the townhouse development over what a single family development would bring. Mr. Harstad answered by stating that we are becoming more urbanized. Mrs. Stalberger, 2613 Woodale, declared there are not that many nice residential areas in the Village. A resident asked if storm sewer was needed and who would pay for it. Engineer Boehm said if it was needed it would be assessed against the benefited property. A Council improvement hearing would be necessary and the public would be informed. Mr. Perkins stated that he was a hunter and that there was wild life on the property now. He asked if we would lose the wildlife habitat. Mayor Neisen stated he felt the property would be developed in any case. He asked if people were concerned about open space, why the November park bond issue was defeated. Mr. Harstad stated that if he could not build townhouses he would consider constructing streets in an East -West direction. He said then there would be more traffic onto Long Lake Road than if the property was developed with townhouses. Mr. said he doesn't want townhouses but wants single family structures. Mrs. Haake is in favor of the townhouses on County Road H2. Mr. Snare, 5138 Long Lake Road asked Mr. Harstad if he would meet with surrounding property owners. Mr. Harstad answered that he would but that he could not reduce his request any further. 6 Mrs. Ross, 5142 Ealtwo d asked why people would have to pay extra taxes on the development. Mr. Harstad explained that economically ehe worst tax burden is a single family home. Mr. Christianson stated that the primary objection is the townhouses on Long Lake Road. Mr. Harstad stated that he would run the townhouses on the East onto County Road H2 rather than the newly platted streets if the Council desired, in an attempt to keep traffic off residential streets. Mrs. Tschida, 5152 Eastwood asked who would buy townhouses on County Road H2. Mr. Glazer asked Mr. Harstad if he could produce figures on the number of children which would occupy the townhouses. Mrs. Christianson, 5273 Sunnyside stated the Pentom Townhouses carry a high tax burden and they would be an asset to the community. The Council decided with the concurrence of Mr. Harstad, that a meeting should be held on June 7th, 1972 at 7:30 P.M. at the '.illage Hall with Mr. Harstad, the Planning Commission and the surrounding residents, to discuss the proposal further. MSP (Neisen- Hodges) To adjourn the hearing until 9 P.M. June 12th, 1972 at which time a Council decision on the proposal would be made. 5 Ayes MSP (Neisen Johnson) To adjourn hearing at 9:58 P.M. 5 Ayes MSP (Neisen Baumgartner) To grant a special use permit to Keith Harstad to excavate up to 5,000 yards of fill from the area North of Ridge Lane and West of Long Lake Road up to June 30th, 1972, subject to him posting a $1,000.00 performance bond to guarantee that he doesn't go any deeper than the road grade and that adequate ground cover is provided. 5 Ayes Loel Uber, Chairman of the Police Civil Service Commission presented a certified list of the three highest standing potential patrolmen candidates elegible for employment with the Village of Mounds View. The Council received the list which consisted of the following names in descending order: Wayne Thompson; Thomas Teale; Larry Benolkin. Councilman naumgartner.s Keport. Councilman Baumgartner stated that the Recreation Committee had a meeting on May 17th, 1972 at which they approved the bid of Dennis Martin for $645.00 to install a fence along the North property line of Hillview Park. 0 Engineer Boehm's Report 7 MSP (Neisen- Hodges) To authorize the Engineer to investigate a complaint raised by the State Industrial Department which alleges that certain portions of elevated Tower No. bare not in compliance with the Safety Laws of Minnesota. 5 Ayes Councilman Baumgartner stated that he was personally upset when persons in attendance at the Harstad hearing got up and left the meeting room while the council meeting was still in process.
