HomeMy WebLinkAboutMinutes - 1972/09/11The Regular Meeting of the Mounds View Village Council was called to order by Mayor Neisen at 8:00 P.M. on Monday, September 11, 1972 at the Village Hall, 2401 Highway #10, St. Paul, Minnesota 55112. Present: Mayor Neisen Councilman Hodges Councilman Baumgartner Councilman Pickar Councilman Johnson MSP (Hodges Baumgartner) To approve the minutes of August 28, 1972 corrected on Page 2 to read "to recess the regular meeting at 8:32 P.M. 4 Ayes Mayor Neisen read a Mayorial Proclamation in which he proclaimed September as Modern Volunteer Army Month. He introduced two representatives from the military in attendance and posed for photographs. Councilman Johnson arrived at 8:08 P.M. PROCEEDINGS OF THE VILLAGE COUNCIL VILLAGE OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA September 11, 1972 Also Present: Clerk- Administrator Zylla Attorney Meyers Engineer Boehm Residents Request and Comments From The Floor: MSP (Hodges Pickar) To issue a special use permit to the Spring Lake Park Lutheran Church to build the Abiding Saviour Lutheran Church on Ardan Avenue between Eastwood and Red Oak Drive. MSP (Neisen- Hodges) To issue a special permit to the Abiding Saviour Lutheran Church allowing them to use one -half of the double bungalow at 2124 Laport for their church offices up to September 1, 1973, subject to receipt by the Village of a petition approving the permitted use, signed by all property owners within 250 feet of the property line. Mrs. Miriam Lewis of Lewis Lines, County Road H2 and Silver Lake Road asked the Council why her property is zoned residential and is termed nonconforming. She stated that she and her husband received approval from the Mounds View Township in 1953 for a business zoning. She felt that by rezoning her property to single family when the comprehensive plan was adopted, she was descriminated against. She wanted to know why it happened. Mayor Neisen instructed the Clerk to search the records for an apparent answer and invited Mrs. Lewis to the next Planning Commission meeting. Mayor Neisen's Report Mayor Neisen read the Police Report for August. Clerk Zylla's Report MSP (Hodges Pickar) To approve the following licenses: Cement A; :row Construction, lrydal Pearson; Heating Spriggs Plumbing Heating, Fleming Sheet Metal Co,, and 5 Ayes 5 Ayes Clarznce E. Nelson Heating Air Conditioning; Sewer Water Richfield Plumbing, Heights Plumbing, Inc., and Weleski Son; Sign Billboard Macey Sign Company. MSP Pickar- Hodges) To approve the issuance of a transient merchants license to David Courtier for 30 days subject to renewal provided that the area is kept clean and that apples are the only items sold. MSP (Hodges- Baumgartner) To recess the regular meeting at 9 o'clock P.M. Mayor Neisen called the assessment hearing for the properties on County Road "J West of Spring Lake Road to order at 9 o'clock P.M. Clerk Zylla read the legal notice and attested to its publication in the New Brighton Bulletin on August 31st and September 7th, 1972. Two notices were mailed on August 30, 1972. Clerk Zylla explained that the assessment comes about as the result of an agreement entered into by Blaine and Mounds View on March 8, 1971. The agreement allows parties on County Road "J West of Spring Lake Road to connect to the Blaine water and sewer system after established water and sewer charges are paid. Clerk Zylla stated that Mr. Earl Holmberg, 1780 County Road "J" was contemplating connecting to the Blaine system and therefore received a notice and Mr. Gary Meyer, 1748 County Road "J" had connected to the Blaine system and Mounds View had paid Blaine $999.00 on April 24, 1972 for Mr. Meyer's connection. Considerable discussion over where Mr. Holmberg should connect, whether to the Blaine system or the Mounds View system, took place. After Mr. Holmberg stated that he would connect to the Mounds View system the Council decided he no longer was a part of this hearing since he would not be assessed under the Blaine agreement. The Council recognized Mr. Gary Meyer and asked if he had any objection to the assess- ment. He had no objection and he asked whether he could combine his two parcels for tax purposes and still pay only one assessment charge. He was informed that he could do so, but when the property was subdivided again and a connection was made, an additional assessment charge would be due. MSP (Neisen- Johnson) To adopt Resolution No. 572 assessing the parcel described as follows: Auditors Subdivision #89, the West 108' of the East 432' of Lot 1, $999.00 for sewer and water over 20 years at 8% interest. MSP (Hodges- Johnson) To allow Mr. Holmberg, 1780 County Road "J to connect to the Mounds View sanitary sewer and water system at a cost of $1,368.80 (116' x $11.80) less the difference between the Mounds View charge and the Blaine County Road ''J" charge, which is $210.80, so that the net charge when he connects to the Mounds View system will be $1,158.00, due and payable when he subdivides Parcel 060 -01. His Mounds View assessment was reduced $210.80 because the Council felt he was not benefited to the extent of $1,368.80, since he had to extend the sewer and water line a great distance -2- 5 Ayes 5 Ayes Ayes 5 Ayes MSP (Johnson Pickar) To adjourn the special meeting at 8:50 P.M. 5 Ayes -3- causing an easement to be filed on 'pis future lot bordering on Spring Lake Road. 5 Ayes Clerk Zylla's Report Continued MSP (Pickax- Hodges) To approve the following bills: General checks #6423 thru #6459 and Payroll checks #2908 thru #2929. Total :isbursements $45,956.25. 5 Ayes MSP (Hodges Pickar) To approve check #6457 transferring $75,000.00 from utility funds to pay the 71/72 debt levy reduction. 5 Ayes MSP (Johnson Hodges) To adopt Resolution No. 573 apportioning the assessments on Division #45263 for Goodroad Addition. 5 Ayes MSP (Pickar- Hodges) To enter into an agreement with Ehlers Associates for bond fiscal services, to include planning and execution Parts 1 3 of the proposed agreement and to authorize the Mayor to sign it. 5 Ayes MSP (Baumgartner- Johnson) To adopt Resolution No. 574 consolidating local improvements for the Mounds View Industrial Park and Red Oak Estates Plat #2 into Project 1972 -3 and calling for the issuance and sale of $385,000.00 temporary improvement bonds. 5 Ayes Councilman Baumgartner's Report Councilman Baumgartner announced that the Recreation Committee had met on August 29, 1972. He thanked Mr. Ronald Hedin for donating his garage to be used as a warming house at Greenfield Park and stated that the next Recreation Committee meeting would be September 14, 1972. Attorney Meyers' Report Attorney Meyers stated that the trial of Moen vs Mounds View was heard on August 3, 1972 and that the court found in favor of the Village of Mounds View releasing Mounds View of a potential claim against of $9,354.00. Attorney Meyers reported he has received corporate financial statements and personal financial statements for Century Motor Freight and Mercury Motor Freight Lines, Inc. and the principals of the corporation. He replied that he was processing other credit sources as well. MSP (Neisen- Johnson) To direct Attorney Meyers to gather whatever information he could on the companies and the individuals to assist the Council in making a determin- ation as to whether or not to sell industrial revenue bonds to finance Century Motor Freight's proposed motor freight terminal in the Mounds View Industrial Park. Attorney Meyers declared that a suit was in process in the Alabama Federal Court against numerous cast iron pipe manufacturers. He stated that the Village Council had instructed him several months ago to protect their interest in this matter. He recently received a request from the State of Minnesota asking that a listing be compiled of all cast iron pipe projects with the total quantities purchased. Engineer Boehm stated that his office had compiled such a listing for the City of Fridley in about a weeks time at a 5 Ayes MSP (Hodges Pickar) To direct the Engineer to investigate and gather the data necessary to assist Attorney Meyers in the presentation of the Village of Mounds View's claim in this matter. 5 Attorney Meyers stated that he hes searched the ordinances regarding filling stations and the scope of their possible activities and determined that action could be taken against a station owner if he was harboring junk vehicles or if the station was not kept clean or in good repair. In addition, a person could not sell used cars from a filling station, since a license would be required. at a cost of $2,000.00. The Council discussed whether the expense would be worth the potential benefits of a judgement in favor of the plaintiff. Engineer Boehm's Rtport Engineer Boehm stated that he has estimated the cost of a 22' wide blacktop street, 382' long with a cul -de -sac for Edgewood Drive, South from Hillview, to be $4,500.00. James Lund seemed to indicate that he favored leaving the street unimproved and adding a stipulation to the deeds of the potential home owners in the area that abut the new street. Mayor Neisen informed Mr. Lund that we do not want to assess anyone for the street since future assessments would be due later when the MSA street was constructed and that Mr. Lund should consider either paying the $4,500.00 for the street or he would get no street.
