Present: Mayor Neisen Councilman Baumgartner Councilman Pickar Councilman Johnson Absent: Councilman Hodgµs PROCEEDINGS OF THE VILLAGE COUNCIL VILLAGE OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA October 24, 1972 MSP (Baumgartner- Johnson) To approve the minutes of October 10, 1972. 4 Ayes Residents Requests and Comments from the Floor: Also Present: Clerk- Administrator Zylla Attorney Meyers Engineer Boehm Mr. Vincent Dahle, Attorney, representing Abiding Savior Luthern Church requested vacation of highway right -of -way (proposed Sunnyside) Which was omitted in the vacation hearing of June 22, 1970. "SSP (Neisen Pickar) To set a hearing to consider the vacation of a portion of proposed unnyside for the Abiding Savior Lutheran Church for November 13, 1972 at 8:30 P.M. with .he Village retaining all utility easements therein. 4 Ayes The building permit for the Abiding Savior Lutheran Church was discussed and it was decided that any discussion of fee waiver would be delayed until formal application for their building permit was made. Mayor Neisen's Report Mayor Neisen declared that PERA granted John Kardell a line of duty disability on October 19, 1972. Mr. Kardell has requested a delay on Council action to consider his termination until he visits his doctor on Thursday. MSP Neisen- Pickar) To turn John Kardell's case over to the Police Commission for a determination as to his fitness for work if Mr. Kardell does not submit a letter of resignation by November 1, 1972. Clerk- Administrator Zylla's Report 4 Ayes MSP (Johnson Baumgartner) To approve the following licenses and to waive the fee for the Boy Scout Troop 714: Asphalt Darrell's Exc. Blacktopping; General Contractor Stuart Construction Co., Berg Builders; Heating Mill City Heating A.C. Co.; Residential Kennel David Connie Bissonnette; Transient Merchant David C. Carlson, and Boy 'cout Troop #714. 4 Ayes r 1P (Picker- Baumgartner) To approve the following bills: General checks #6575 thru 6633 and Payroll checks #2980 thru #3007. Total disbursements $27,301.25. 4 Ayes MSP (Nelsen- Johnson) To approve check #6632 transferring $4,654.77 from Sewer Utility to Project Fund 1972 -3 until the bond proceeds are received. 4 Ayes The Council discussed various types of underground street lighting available for newly platted residential underground areas. They decided to invite the NSP street lighting representative to the November 6th agenda meeting. MSP (Baumgartner Pickar) To adopt Resolution #583 apportioning the assessments for Division #045445, T. V. Construction, Inc. Plat #1 subject to the payment of additional assessments totaling $963.00 for Lot 1, Block 1. 4 Ayes Clerk Zylla received Council permission to attend a revenue sharing seminar scheduled for November 24, 1972 at the Holiday Inn on 494 and Highway 100. MSP (Johnson Baumgartner) To adopt Resolution #584, opposition to the acquisition of the Village of New Brighton trunk sewer by the Metropolitan Council, and to authorize the Clerk to send copies to the Referral Committee and member communities of Sewer Service Area #2. 4 Ayes Councilman Johnson's Report nuncilman Johnson read a letter from Jim Schlichtmann, Superintendant of Public Works, ecommending that Wallace Mortenson be advanced to full pay scale and other employee benefits as of November 1, 1972, the end of his six month probationary period. Councilman Johnson inquired as to whether the owner of the Skelly Station on Groveland Road was selling cars from his property and whether anything on the property met the definition of a junk car. Clerk Zylla informed the Council that about one month ago the Police did make a visit to the property and he was not in violation of the used car lot ordinance though he did have some debris scattered around the property which he later took care of. Councilman Johnson asked Mr. Meyers if there were any new developments on the cast iron pipe manufacturers law suit. Attorney Meyers stated that he had submitted the data to the State by the required deadline. Engineer Boehm stated that his bill for services connected with the case was included in tonights disbursements and amounted to less than one half of the estimated $2,000.00 figure. Councilman Johnson discussed the 1973 Spring Lake Park Fire Department budget noting that Mounds View was the only community that was paying their bill for fire protection on time. He also noted that the Fire Dept. was constantly borrowing money and in effect spending more each year than they took in, in receipts. The Clerk was directed to send a letter to the Fire Department asking them to seek to bring other member communities on a current basis as far as protection payments were concerned. The Council suggested asking• the Fire Dept. to bill Blaine and Spring Lake Park for the interest charges for borrowing money because they are not paying current. The letter to the Fire Dept. was o include a statement that they make "actual expenditures in accordance with budget -2- councilman Baumgartner's deport Juncilman Baumgartner stated that the Recreation Committee met on October 12th, and their next meeting is scheduled for November 9th. He noted that David Conover, Director of School District #621 Community Education will be in attendance at the next Recreation Committee meeting. The Council decided that no building permit should be issued until they have received PCA approval to do so and until the Council was sure that the building was in conformance with the special us? permit. In addition, Attorney Meyers felt that the Village should have an opportunity for a thorough plan reviewal since we were requested to sell bonds 'o construct the facility and lease the facility to Century Motor Freight. Attorney lyers stated that no proposed lease agreement had been sent to him. The Council decided not they could not grant approval for construction of footings if no building permit was issued and they could not issue the building permit until certain Village requirements were met. Councilman Pickar's Report Councilman Pickar announced that the Lakeside Park Commission will meet on October 25th. He also stated that he would be in attendance at the October 25th County Board meeting to present Mounds View's resolution requesting additional traffic control at the County Road I and Quincy Street intersection. Inspector Skiba presented plans for the new Century Motor Freight terminal. MS (Neisen Pickar) To allow Century Motor Freight to pour the footings for their motor freight terminal at their own risk (no building permit has been issued) because of weather, subject to conformance with the set backs in the special use permit. Councilman Pickar withdrew his second and Mayor Neisen withdrew his motion. Attorney Meyers' Report Attorney Meyers stated that the Metropolitan Sewer Board budget,which was recently adopted,calls for a new billing method known as a service availibility charge. He stated the SAC charge represents a significant policy change and the Council ought to be aware of its implications. MSP (Johnson Baumgartner) To approve the release in the Chies Brothers, Barton Contracting, Ramsey County, and Village of Mounds View, Silver Lake Road Project of 1966 and to authorize the Mayor and Clerk to sign it and to allow the Attorney to sign the stipulation of dismissal. 4 Ayes Engineer Boehm's Report MSP (Pickar- Johnson) To adopt Change Order #1 Schedule A Sewer Water and Street Improvement 1972 -3. -3- 4 Ayes P (Baumgartner Pickax) To adopt Change Order #1 Schedule B Sewer Water and Street ..mprovement Project 1972 -3.
