HomeMy WebLinkAboutMinutes - 1972/11/13Present: Mayor Neisen Councilman Baumgartner Councilman Picker Councilman Johnson Councilman Hodges PROCEEDINGS OF THE VILLAGE COUNCIL VILLAGE OF MOUNDS VIEW RAMSZY COUNTY, MINNESOTA November 13, 1972 .he Regular Meeting of the Mounds View Village Council was called to order by Mayor Neisen at 8:00 P.M. on Tuesday, October 24, 1972 at the Village Hall, 2401 Highway #10, St. Paul, Minnesota 55112. Also Present: Clerk- Administrator Zylla Attorney Meyers Engineer Boehm MSP' (Pickar- Baumgartner) To approve the minutes of October 24th and November 8th, 1972. Residents Requests and Comments From the Floor: Mr. Tom Dougherty, President of the Mounds View Jaycees announced that the Jaycees would be donating a wreath to the Village Hall. Mayor Neisen thanked Mr. Dougherty and the Jaycees. Mr. Dougherty asked a number of questions about the proposed industrial revenue bond issue which is tentatively set between Century Motor Freight, Miller- Schroeder, and -'he Village of Mounds View. Attorney Meyers and Councilman Johnson responded to Mr. ougherty's questions assuring him that while there are a number of things yet to be done before the bond issue will be sold, the Village is proceeding with caution and taking any necessary steps to protect the interest of residents. Mayor Neisen stated that the Council met with a representative of Century Motor Freight on October 26th at which time the Council gave approval to Century Motor Freight to begin construction on the facility. The meeting was requested by Century Motor Freight after the Council refused to allow construction. (See October 24th, 1972 minutes.) Robert Eigenheer appeared to request approval of the subdivision of Lot 1, Block 1 Eigenheer 3rd Addition. Mr. Eigenheer was informed to follow procedures and appear at the next Planning Commission meeting. Mr. Eibensteiner requested permission to build a model house on the North side of Ridge Lane a few hundred feet East of Sunnyside on the property owned by Keith Harstad. There is presently a home on the parcel of property located at 2650 County Road FI2. MSP (Johnson- Hodges) Not to issue a building permit for the model house requested by Mr. Eibensteiner until the final plat for the area bordered by Ridge Lane on the South, Sunnyside xoad on the West, County Road H2 on the North, and Long Lake Road on the East, is approved and signed by the Village. 5 Ayes 5 Ayes MSP (Baumgartner Pickar) To recess the regular meeting at 8:36 P.M. 5 Ayes Mayor Neisen called the hearing to consider the vacation of a portion of proposed Sunnyside for the Abiding Savior Lutheran Church to order at 8:36 P.M. 4erk Zylla read the legal notice and attested to its publication in the New Brighton 3ulletin on November 2nd and 9th. He noted the area on a map. Mayor Neisen called for questions or objections from the floor, but there were none. MSP (Neisen- Johnson) as follows: To adopt Resolution #585 vacating the highway easement described Except Red Oak Drive, the North 202.5' of South 810' of East 528' of West 1056' of Northeast 1/4, the easement being the East 25' of said property and also that part of said property lying East of a curved line with a radius of 50 feet and whose center is on the East line of said property and 50 feet North of the Southeast corner thereof, with easement for utilities retained by the Village of Mounds View. 5 Ayes MSP (Baumgartner- Hodges) To adjourn the vacation hearing at 8:40 P.M. 5 Ayes Clerk Zylla read a request by Abiding Savior Lutheran Church to have their building permit fee abated. He asked direction. The Council discussed permit fees and the cost of inspections. '15 (Pickar- Johnson) To grant a 25% reduction on the total permit fee for the Abiding :Avior Lutheran Church. rom Dougherty and James Nerdahl objected to the Village subsidizing a religious organiza- tion. They reasoned that since the permit fees are established to cover the cost of the inspections, any permit fee less than the established rate was in effect subsidized by general taxes. Councilman Johnson withdrew his second and the motion died for lack of a second. Mayor Neisen's Report Mayor Neisen read the police report for October. -2- MSP (Neisen Pickar) To approve the request of the Mounds View Lions Club to change their place of operation for bingo from the Mermaid Supper Club to the Launching Pad Supper Club. Their previous application was approved September 25, 1972. 5 Ayes Clerk- Administrator Zylla's Report MSP (Hodges- Johnson) To approve the following licenses: Cement Barry Bjugstad, Donald Schminkey; Excavating Glenn Rehbein Excavating; General Contractor Floodmaster Engineering, Kraus- Anderson of Mpls, Inc., R. A: Helium Const. Co., DeGardner Const.; Heating Sydloski Plbg. Htg., Inc.; Rubbish Refuse Hauler Modern Services, Inc. 5 Ayes SP (Hodges Pickar) To approve the following bills with the exception of check #6747= neral checks #663+ thru #6750 and Payroll checks #3008 thru 3034. Total disbursements ,188,602.58. 5 Ayes MSP (Hodges- Johnson) To approve check #6747 in the amount of $26,225.41 for final estimate to H S Asphalt Company for Street Improvement Project 1972 -1 1A and to nter into a one year maintenance agreement. 2 (Johnson- Hodges) To recess the regular meeting at 9:00 P.M. bad. Charles Larson, who identified himself as a non Mounds View resident, stated that the station would be a great improvement to what was existing already. Moreover, the County and the Highway Department are more qualified to determine where entrances should be on Highway #10. He declared that the station was a $250,000 investment and would not send children to school. Mrs. Barbara Haake, 1740 County R -ad I added that the station may be an improvement for the corner now, but other persons will ask for the corner later. She felt that the Cation as proposed would present a traffic problem because the semiphore is slow -3- Mayor Neisen called the hearing to order to consider the issuance of a special use permit to Mobil Oil to construct a service station on the Southeast corner of Silver Lake Road and Highway #10 at 9:00 P.M. Clerk Zylla read the legal notice and attested to its publication in the New Brighton Bulletin on November 2nd and 9th. He stated that eleven (11) notices were sent to affected property owners within the 250 foot radius as required by iaw. Richard Smith, real estate representative for Mobil Oil presented a fire marshall approved plot plan for the service station property with red driveway lines drawn therein. He stated that the station would have two bays, two accesses from Silver Lake Road, and one access from Highway #10. The building would be masonary type identical to the Mobil Oil station on Highway #65 and Osborne Road. He stated that he has in hand access permits from Ramsey County and the State Highway Department. He noted that the Planning Commission had rejected the application because of a traffic hazard to people trying to cross Silver Lake Road. He added that a signalized intersection is the best place for people to cross Highway #10. Moreover, the proposed service station exists on traffic but does not generate traffic. He estimated that between 6:00 A.M. and 8:30 A.M. and between 3:30 P.M. and 6:00 P.M. there would be approximately one car arriving at the station every six minutes which would be ne half of the daily customers. Irq ,for Neisen read the Planning Commission minutes of September 27th which dealt with Oil's appearance before the Commission. The Council also had before it accident data for the Silver Lake Road, Highway #10 intersection for the last five years. Mr. Bernard Falck, 7111 Knollwood Drive stated that there was no plot map available for Planning Commission review at their meeting. He stated that the Planning Commission was opposed to entrances on Silver Lake Road because two yellow lines would have to be crossed. Mr. Smith stated that the plot plan he had tonight was dated June 26th, 1972. Mr. Robert Glazer, 2375 Hillview Road stated that this proposal demonstrated a blatant economic need by Mobil Oil to put their sign up. He added that the Village had twelve stations and there was another Mobil Oil station a mere 1/2 mile up the highway. It would affect the free flow of traffic and therefore affect the welfare of citizens of the Village. In addition, Mounds View Highway #10 was becoming gasoline alley and looked aesthetically 5 Ayes 5 Ayes; -4- turning and would cause a traffic back log on Silver Lake Road. s. Wille, 7911 Spring Lake Road stated that it was a very dangerous corner and the l ~:r rvice station would impede the free flow of traffic. Mr. Glazer produced a traffic flow map dated 1969 which showed there were 22,000 cars a day on Highway #10. Mr. Smith stated his figures were 24,000 cars per 18 hour day. He added that the traffic count on Silver Lake Road showed that there were 4100 cars South of Highway #10 and 2500 cars North of the intersection for an 18 hour period. Mr. Tom Dougherty, 2109 Laport Drive asked if the Council could override the Planning Commission's request to deny. Mayor Neisen explained that the Council could do as they felt best. Mrs. Haake inquired as to why the Highway Department would allow more exits to Highway #10. She was informed that the Highway Department cannot deny access to Highway #10. Councilman Baumgartner asked Mr. Larson what his interest was in the property. Mr. Larson stated that he was selling it to Mobil Oil. Mayor Neisen asked if there were right turns &nd speed up lanes. Mr. Smith replied there were neither. Mr. Dougherty asked how far access to the station property was from the corner of Silver Lake Road and Highway #10. Mr. Smith replied that the Highway #10 entrance was about 140 feet off the intersection. The first Silver Lake Road exit was 100 feet and the second exit was another 90 feet off the intersection of Highway #10 and Silver Lake Road. bert Glazer asked if the Highway Department performs a planning function. Attorney ',1yers explained that Highway #10 was not a limited access highway and the Highway Department can only tell persons where accesses can go. Mr. Jim Nerdahl, 7941 Edgewood Drive asked what is the project worth in dollars. Mr. Smith stated that there would be $100,000 in plant and equipment. He added that the station 1/2 mile West on Highway #10 was served by a supply agreement only. He estimated that taxes from the station would approximate $1,000 to $1,500 per year. Mr. Leo Bringewatt, 7811 Silver Lake Road stated he has an interest in the land and if the station is approved he will build a better building next to the station to enhance the station property. Mayor Neisen called for further questions or objections from the floor. There were none. Mayor Neisen closed the hearing to the public at 9:40 P.M. He advised the Council that the only factors to be considered must be health, safety, and welfare of the residents of the Village. There were no comments or questions from the Council. MSP (Baumgartner- Johnson) To deny the issuance of a special use permit to Mobil Oil to construct a service station on the Southeast corner of Highway #10 and Silver Lake Road because of the increased traffic hazard that the station would present to people and cars, especially those traveling in a North -South direction on Sill Lake Road. 5 Ayes Mayor Neisen adjourned the special hearing at 9:43 Y.M. Smith withdrew his plans and material upon denial. Mr. Smith requested a copy of the Village Council minutes. Attorney Meyers requested copy of the Mobil Oil plot plan to which Mr. Smith replied "you will see the plans when see you in court Clerk Administrator Zylla's Report (Cont'd) MSP (Hodges Baumgartner) To approve the $250,000 assignment of securities agreement with the First State Bank of New Brighton. 5 Ayes Clerk Zylla read a copy of a letter sent to Century Motor Freight from the PCA in which the PCA voiced no objections to Century Motor Freight discharges provided certain conditions are met. Clerk Zylla announced that the bond proceeds from the #385,000 temporary improvement bond sale will be deposited in our account on Tuesday. Clerk Zylla announced that several communities have been contacted and asked to pass resolutions similar to Mounds View Resolution No. 584 opposing the Metropolitan Council's possible acquisition and extension of New Brighton's trunk sewer. He stated that Fridley, Coon Rapids, Blaine, Spring Lake Park, Lexington and Circle Pines have all either passed resolutions or mailed letters expressing opposition. The Referral Committee staff report which will be acted upon this Thursday recommends against acquisition. Councilman Hodges'Report euncilman Hodges inquired of the Council whether they had received copies of the Ramsey !ounty League recommendation to abolish justice courts. Some Council members had not received the information. Councilman Johnson's Report Councilman Johnson reported that the Village maintenance truck (1972 Chevrolet 3/4 ton) has been repaired and returned to the Village. The truck had been damaged in an accident in which a Village employee was found not at fault. Total cost of the accident including truck rental was $1,182.02. Councilman Johnson reported that he received a request for street lights at Rainbow Lane and Ridge Lane and mid -block on Rainbow Lane South of Ridge Lane. Mayor Neisen suggested we delay approval until the overall plan for the newly platted area is received from our Northern States Power representative. Councilman Johnson read a letter from Fire Chief Fagerstrom in which he requested $2,125.00 from the communities served by the Spring Lake Park Fire Department to replace items previously deleted from his budget. Mounds View's payment would be $650.00 and could be paid from the Federal Revenue Sharing Fund. MSP (Johnson- Baumgartner) To approve the additional expenditure of $650.00 for the equipment requested by Fire Chief Fagerstrom, subject to the approval of Blaine and Spring Lake Park for their share of the total requested. euncilman Johnson read a brief report of the Public Works Department's activities that ave been performed since summer. -5- 5 Ayes Councilman Baumgartner's Report uncilman Baumgartner stated that a Recreation Committee meeting was held November 9th which Mr. Conover of School District #621 was in attendance. The Committee spent time discussing rink attendants, deciding to set their salary at $2.10 per hour and set a deadline for applications of November 30, 1972. MSP (Baumgartner- Hodges) To approve the increase in rink attendants salary from the previously established $2.00 per hour to $2.10 per hour. Councilman Baumgartner read the Planning Commission minutes of October 25th. He also read a letter from Mayor Neisen dated October 24th in which Mayor Nelsen requested the Planning Commission to review all site and building plans for commercial and industrial developments including multiple dwellings. Councilman Picker's Report Councilman Pickar stated that there was no Lakeside Park Commission meeting last month, but that he would have a report on the skating facilities proposed for the park next month. He was also expecting additional news on his request for traffic control devices at the Quincy Street and County Road I intersection. Councilman Pickar thanked everyone for voting last Tuesday, especially those that voted for him. 044 ttorney Attorney Freight, be ready A letter ized use Meyers' Report Meyers stated that he has received no further information from Century Motor however he understood that there was some work in process which he expected to shortly. from Ramsey County requesting passage of an ordinance prohibiting the unauthor- of an opticom was set aside until further information was available. 6- 5 Ayes Engineer Boehm's Report MSP Neisen- Hodges) To approve change order #2 on Schedule B Project 1972 -3 and accepting the letter from PBK Investment Company in which they agree to the change in construction and any additional assessments. 5 Ayes The Council decided not to proceed on the option of terminating the contract on 1972 -3 Schedule B and adding it to 1973 street improvements in Red Oak Estates Plat No. 2. The engineer had suggested this as a possibility since the street in the Industrial Park is unable to be completed this year. The Mayor's letter to the Planning Commission dated October 24th was discussed briefly. Mrs. Haake and Robert Glazer stated that they were no longer of the opinion that a pro- fessional planner was needed in order to perform the fsnction requested. .SP (Baumgartner- Picker) To adjourn at 10:29 P.M. espectfully Submitted, bLL�ti N.
