HomeMy WebLinkAboutMinutes - 1972/11/27Present: Mayor Neisen Councilman Hodges Councilman Baumgartner Councilman Johnson Councilman Pickar PROCEEDINGS OF THE VILLAGE COUNCIL VILLAGE OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA November 27, 1972 Regular Meeting of the Mounds View Village Council was called to order by Mayor eisen at 8 :00 P.M. on Monday, November 27, 1972 at the Village Hall, 2401 Highway #10, St. Paul, Minnesota 55112. Also Present: Clerk- Administrator Zylla Attorney Meyers Engineer Boehm MSP (Hodges- Johnson) To approve the minutes of November 13, 1972 amended to include as an attachment the report of accidents at the intersection of Silver Lake Road and Highway 10. Residents Requests and Comments from the Floor: Ambrose Yehle, representing Tom Thumb Superette appeared requesting Village Council approval to build a superette and laundramat at the SE corner of Edgewood Drive and County Road I. Clerk Zylla stated that according to the Zoning Ordinance the plan presented was short 8 parking spaces even if 10 spaces were added adjacent to the South of the building. Mr. Yehle stated that other superettes of similar size located in New Brighton, Bloomington, Brooklyn Park and New Hope have from 20 to 35 spaces maximum and the parking has proved {iequate. Mounds View Ordinance #67 requires 41 spaces. P (Pickar- Hodges) To grant approval of the variance to the Tom Thumb Superette Company to provide 8 less parking spaces than required by Ordinance provided that a 10 foot buffer is maintained on the South side of the property and the fence proposed in the plan is increased from 4 feet to 6 feet high. MSP (Hodges- Johnson) To grant a building permit to Tom Thumb Superette to construct a Tom thumb Superette and laundramat at County Road I and Edgewood Drive, subject to the conditions as set forth in the variance approval and subject to the approval of the building inspector and fire chief. 5 Ayes A request by Mrs. Dean Mapes to park a mobile home belonging to her sister at 7980 Woodlawn Drive in order to advertise it for sale for 2 or 3 months was referred to the Planning Commission. Mr. Ted Moore, 5454 Jackson Drive asked that no parking signs be placed on the West side of Jackson Drive from Bronson Drive to Groberg Street. Since there are currently signs on the East side of Jackson Drive as requested by Mr. Moore, the Council directed the matter to the Police Chief for his recommendation. 5 Ayes 5 Ayes Mayor Neisen's Report MSP Neisen- Hodges) To accept the resignation of John Kardell from the Mounds View Police Department effective January 1, 1973. 5 Ayes MSP (Hodges Baumgartner) To recess the regular meeting at 8 :31 P.M. Mayor Neisen called the rezoning hearing to order at 8:31 P.M. to consider the request by White Oak Builders to rezone from R1 (single family) to 81 (limited business) the South 186' of Lot 96, Knollwood Park Addition. Clerk Zylla read the legal notice and attested to its publication in the New Brighton Bulletin November 16th and 23rd. Edwin Dropps, partner in White Oak Builders made the presentation. He stated that the proposed building would be 70' x 28', would generate approximately $3,000 in taxes, and would contribute no children to the school district. He stated that the property across the Street is zoned commercial at the present time. Mayor Neisen opened the hearing to the public and called for questions or comments from the floor. Mrs. Barbara Haake, 1740 County Road I asked if there was parking provided up to the property -line on Silver Lake Road. Mr. Dropps replied that the parking lot as presented on the plan was up to the boulevard. Mrs. Haake felt that a buffer should be provided between the property line and the parking lot. Mrs. LeRoy Valley, 2016 Woodale asked where the homes in the area lie in relation to the proposed building. Mr. Dropps referred to a map noting that there were homes on the South, North, and Northwest of the proposed building. Paul Winther, 2049 Woodcrest Drive presented a petition signed by ten residents (five ailies) against the proposed rezoning. Mrs. Paul Winther stated that she was against it. Mr. Winther quoted a number of permitted uses for B1 zoning taken from Ordinance #67 and stated that he did not cant an office building and a parking lot in his back yard. Mr. Valley asked why Mr. Dropps did not want to build a home on the site.. Mr. Dropps replied, no reason other than Silver Lake Road is a busy road and he has a large special assessment on the property. Mr. Dropps stated that he presently is using 7090 Silver Lake Road as a model home. Mrs. Valley replied that there is someone living upstairs in the model home. Mr. Dropps replied that he did not think it was in violation of the Ordinance. Mrs. Valley felt that the traffic on Woodale is bad now with the model home. She did not want her back yard exposed to a proposed office building. Mr. Winther stated that the police have had numerous traffic problems on Silver Lake Road. He felt any access to Silver Lake Road from the proposed parking lot would be hazardous. Mrs. Barbara Haake declared that the area East and West of Silver Lake Road, North from Rice Creek is all residential now and that a house could be built on the proposed office building site. uncilman Baumgartner inquired whether the proposed office building was in fact across om commercial property. Upon checking the map, Mayor Neisen stated that it was zoned R1 across the street. Councilman Baumgartner also asked if Mr. Dropps had commitments to rent. -2- 5 Ayes Mr. Dropps replied that he has contacted an attorney and an insurance agent who may be nterested. Councilman Baumgartner then asked if Mr. Dropps owned the property before or ter Silver Lake Road was built. Mr. Dropps stated that it was after. c ouncilman Johnson asked if the model has been sold. The reply was no it was not sold. Mrs. Valley again stated that the proposed business would draw traffic to the area. Mayor Neisen closed the hearing to the public at 8:56 P.M. He reminded the Council that the decision to rezone or not to rezone must be considered on the basis of health, safety and welfare. MSP (Baumgartner Hodges) To deny the rezoning because of the effect the proposed rezoning would have on the welfare rf residents in the area. 5 Ayes Councilman Johnson commented that he voted to deny because there was a house to the North, South and West of the site, that the lot may have a home built on it, and that there would be a traffic hazard with the proposed office building especially since there is a proposed across the street. HSP (Baumgartner Hodges) To adjourn the special meeting at 9:00 P.M. 5 Ayea Mayor Neisen's Report Cont'd May or Neisen read a letter from Fire Chief Fagerstrom in which he thanked the Council for roving his request for additional equipment, but added that Spring Lake Park has 1clined to approve his request at this time. Mayor Neisen read a letter from the principal at Edgewood Jr. High thanking Tim Smith for the excellent job he did in speaking to 1100 members of the school population. MSP (Neisen- Hodges) To adopt the following salary schedule for 1973. Dennis Zylla 1,320 per month Dorothy Sandgren $3.50 per hour Ernest Grabowski 1,250 per month Maridelle Wamhoff $3.10 per hour Walter Skiba 1,050 per month Carol Waide $3.10 per hour James Schlichtmann 1,040 per month Arlene Stafford $2.90 per hour Ralph Hanggi 72 per month Patrolmen: 0 to 1 year 838 per month 1 to 1 year 896 per month 11 to 2 years 918 per month 2 to 21 years 944 per month 21 to 311 years 976 per month after 31 years 1,006 per month Sargeant 50 per month over patrolmen Captain 85 per month over patrolmen -3- Uniform allowance from $125 to $135 per month. 5 Ayes Clerk Administrator Zylla's Report P (Baumgartner Pickar) To approve the following licenses: Cement Al Zeis Cement Co., :c.; Excavating D. MSP (Baumgartner- Hodges) To approve the following bills: General checks #6751 thru #6794, Bond checks #618 thru #619, and Payroll checks #3035 thru #3061. Total disburse- ments $236,566.51 5 Ay MSP (Neisen- Hodges) To approve the appointment by Clerk Zylla of Dorothy Sandgren as Deputy Clerk. MSP (Neisen Pickar) To authorize the Clerk to advertise for Arlene Stafford for 6 hours per day. Clerk Zylla explained that Dorothy Sandgren was presently in had asked Mrs. Nora Adleman with the consent of the Mayor to needed basis MSP (Johnson Hodges) To deny the extension of 31st to January 10th between Miller Schroeder, Mounds View and to refer the letter requesting attorney. a clerk typist to replace the hospital and that he return to work on an "as MSP (Hodges- Johnson) To authorize the Clerk to employ Mrs. Adleman as he sees fit. MSP (Neisen- Hodges) To award the bid on the 1973 police squad car to Wilkins Dodge for $3,129.88 less $900.00 for the trade in of the 1971 Ford wagon. MSP (Baumgartner Pickar) To approve the subdivision request of John Capetz to subdivide R 110' of Lot 11 Block 2 Greenfield Addition into the E 1/2 and W 1/2 thereof and to ;opt Resolution #586 levying the deferred assessment which was placed on the W 1/2 in 70. the underwriting agreement from October Century Motor Freight and the Village of approval by Miller Schroeder to the Councilman Johnson's Report MSP (Johnson Baumgartner) To approve the installation of street lights in the following locations: the corner of County Road I and Bona Road, Hillview Road and Bona Road, and 2 mid -block on Bona Road between County Road I and Hillview; 1 mid -block between County Road J and Ardan Avenue on Groveland Road (about 8400 Groveland); Laport Drive and Groveland and Laport Drive and Fairchild; 14 lights in the underground area in Red Oak Estates; 8 lights in the underground area of Dailey's Hillview Addition. Councilman Baumgartner's Report Councilman Baumgartner read the Planning Commission minutes of November 22, 1972. MSP (Baumgartner Johnson) To approve the subdivision request of Robert Eigenheer to subdivide Lot 1, Block 1 Eigenheer's 3rd Addition combining that portion of Lot 1 North of watermain with Lot 2 Block 5 Eigenheer 2nd Addition and combining that part of Lot 1 South of the watermain with Lot 2 making one lot out of the combination of the S part of ‘t 1. and all of Lot 2. 5 Ayes There was some discussion about the proposed letter to be sent to the Rice Creek "atershed District opposing their policy of requiring review of plats after review by e local Planning Commission. The Council authorized sending the letter. ouncilman Baumgartner read portions of an article which appeared in the Minneapolis Star on November 25th, which concerned Mounds View's withdrawal from the financing of the Teen Center. Mr. Baumgartner took exception to the article and stated that the person who made the comments to the press was irresponsible. MSP (Johnson- Baumgartner) To authorize the Clerk to send a letter to the Star together with a copy of the Mounds View resolution withdrawing from the Teen Center, with a copy also th the Community One Board of Directors, raising issue to the story that was contained in the Star article. 5 Ayes MSP (Nelsen- Baumgartner) To authorize the granting of three building permits for three four- pleaes on Lots 1, 2 and 3, Block 2, Parkview Terrace subject to the approval of the building inspector and the fire chief. Councilman Picker's Report Councilman Picker stated that he has no new information on ice skating this winter at Lakeside Park. Councilman Pickar stated that he has spoken to the County Commissioner's office today regarding the request for traffic control at County Road I and Quincy Street. He was informed that there has been no action for or against and he hoped to contact Engineer Anklan to find out why there was a delay. ispector Skiba's Report MSP (Neisen- Hodges) To grant Century Motor Freight 24 hours to provide Inspector Skiba with the mechanical drawings for the motor freight terminal or the building will be red tagged and construction must cease. 5 Ayes A motion by Councilman Johnson to close down the construction operation effective immediately because there were no mechanicals died for lack of a second. Attorney Meyers' Report MSP (Picker- Hodges) To adopt Resolution #587 approving the agreement between the First National Bank of St. Paul and the Village of Mounds View authorizing the First National Bank of St. Paul to serve as paying agent for Village bonds and authorizing the Mayor and Clerk to sign the agreement. 5 Ayes MSP (Baumgartner Pickar) To adopt Ordinance #195 fixing the salary of the Mayor at $2,400.00 per year and $1,800 per year for each Councilman effective January 1, 1973. 4 Ayes 1 Naye A motion to amend the motion by Mayor Neisen to provide for an increase to $2,100 per year for the Mayor died for lack of a second. Engineer Boehm's Report Q nce parking is prohibited to one side of MSA streets, a recommendation by the Engineer to post Ardan Avenue was referred to the Police Department for study. Neisen- Baumgartner) T o recommend the Police tudy'the possibility of moving a stop from the corner of Woodale! and Irondale Northbound o Irondale and Ridge Lane bound while adding a stop sign on Irondale and Ridg La S outhbound, thereby making "La =from Long Lake Road to Edgewood a through street. 5 Ayes P (Neisen- Baumgartner) To set a hearing to consider the renumbering of all buildings he Minneapolis postal zone on East -West streets for January 15, 1973 at 8 :00 P.M. iSP Baumgartner- Neisen) To change the date of the last December Council meeting roe December` +25th to December 26th and to change the date of the agenda meeting anuary "from the 1st to the 2 nd. S P Bauumgartner- Hodges) To send a letter to White Oak Builders stating that in their model home at 7090 Silver Lake Road either the family living upstairs or the business downstairs must be "removed as an ordinance violation is occuring with the present situation.
