PROCEEDINGS OF THE VILLAGE COUNCIL
VILLAGE OF MOUNDS VIEW
RAMSEY COUNTY, MINNESOTA
November 12, 1973
A Regular Meeting of. the Mounds View Village Council was called to order by
Mayor Neisen at 8:00 P.M. on November 12, 1973, at the Mounds View Village
Hall, 2401 Highway #10, St. Paul, Minnesota 55112.

Mayor Neisen read the Police Report for October.

MSP (Pickax- Baumgartner) To appro- the minutes of October 23, 1973 and
November 7, 1973. 5 Ayes
Mayor Neisen read a letter from George Richardson, Principal of Red Oak
School, thanking the Council for the tentative support they have given for
a temporary classroom building at Red Oak School.
Mayor Neisen read a petition from several residents in the vicinity of Jackson
Drive and County Road H2 opposed to the establishment of a truck terminal east
of the Launching Pad parking lot. They requested a public hearing before any
permit be issued. Mayor Neisen explained that he knew of no request for a
truck terminal at this location and signing this petition was unnecessary.

Pavemaster's Inc; General Contractor B E Fence Co., F. P. Lutz Co.,
Anoka Co. Roofing Inc., Leslie Tranby Roofing Siding, Menard's Agri Bldgs.,
DaVerne Corporation; Heating Air Conditioning Barry's Heating Air
Conditioning; Masonry A. A. Construction; Plaster /Stucco 'Bob Johnson
Stucco Co; Sewer Water Spriggs Plumbing Heating; Peddler Solicitor

MSP (Hodges Pickar) To approve the bills: General Fund check #7850 thru
7950, Payroll Account checks #1053 #1054. Payroll checks #630 thru #654,
and transfer check #7951 transferring $10,472.89 to pay gross pay of November
15, 1973. From General $8,186.08, from Water $1,379.00, from Sewer
$907.81. Total disbursements $29,669.18
MSP (Baumgartner- Hodges) To adopt Resolution No. 615 approving the entering
into a joint powers agreement with School District #621 to allow the Village

to construct a free skating ice rink on the Edgewood School property and
authorizing the Mayor and Clerk to execute the agreement.
Councilman Hodges' Report
Councilman Hodges requested that after the Civil Defense Plan has been retyped,
it be sent to Ramsey County for review.
Mayor Neisen noted that he had appeared before the Blaine City Council to
discuss a joint powers agreement for a three community civil defense director.
He expects to have Blaine's response by November 15, 1973.
MSP (Picker- Johnson) To recess the regular meeting at 8:16 P.M.
Mayor Neisen called the hearing to consider the street vacation requested by
Programmed Land for a part of Programmed Land 1st Addition to order at
8:17 P.M.
Clerk Zylla read the legal notice and attested to its publication in the New
Brighton Bulletin on November 1, 1973.
Attorney Meyers explained that the vacation is a corrective action and that
by platting Programmed Land 1st Addition, the Village will receive a new
street. He suggested that the Council condition approval of the vacation on
final approval of the plat.
MSP (Hodges Pickar) To adopt Resolution #616 vacating the street described
in the legal notice published November 1, for Programmed Land subject to final
approval of Programmed Land 1st Addition. 5 Ayes
MSP (Baumgartner- Johnson) To adjourn the special hearing at 8:23 P.M.
Mr. Bill Edes of Programmed Land then requested preliminary plat approval of
Programmed Land 1st Addition He explained to the Council that on part of
the property he has given an option for a 103 to a 150 unit motel and a
McDonald's restaurant.
Attorney Meyers suggested that the service drive be noted as Liberty Street
in the plat. On questioning Mr. Edes it was found that proposed Clifton Street
is also dedicated right of way which was constructed by the property owners.
The Council felt inclined to leave Clifton as a dedicated street in order to
provide better access to (from) Highway Avenue. It appeared from the _re-
liminary plat that concrete curbs were constructed in the Clifton right of
way by the property owners.
Attorney Meyers noted that the Council should consider requesting a land or
cash dedication for parks in conformance with our subdivision regulations.

A question of interpretation developed between Attorney Meyers and Mr. Edes.
Mr. Edes felt that since the Rice Creek Watershed District has required a
dedication in excess of 10% of his property for holding pond purposes that
he has met the Village ordinance requirements. Attorney Meyers disagreed.
MSP (Neisen Pickar) To schedule a special meeting with the Village Council,
Park Commission, Planning Commission and Attorney Meyers for November 20,
1973 at 6:30 P.M., regarding cash or land dedication in proposed subdivision. 5 Ayes
The Rice Creek Watershed District is to be invited to the meeting also.
MSP (Johnson- Hodges) To recess the regular meeting at 8:59 P.M. 5 Ayes
Mayor Neisen called the continued drainage hearing on Sherwood Road and
Jackson Drive to order at 8:59 P.M.
Attorney Meyers read a letter of correspondence from Arvid Birkeland's
attorney in which Mr. Birkeland agreed to a $525.00 assessment on Lot 10
if no other lot in the Birkeland Addition except Lot 7 is assessed.
After entertaining a few comments from the floor the Council decided the
following:
MSP (Johnson Pickar) To table the request for a drainage improvement in
the aforementioned area until next summer in which preceeding time some
sight inspections will be made, and providing that during the continued
months Attorney Meyers be instructed to continue negotiations with Arvid
Birkeland's attorney.
MSP (Baumgartner- Hodges) To adjourn the hearing at 9:26 P.M.
Councilman Johnson's Report

Councilman Johnson asked Attorney Meyers whether the lawsuit with several sewer
pipe manufacturers has been settled. Attorney Meyers noted that some smaller
settlements have been reached, but most of the larger ones are still under
consideration.
The Council directed Clerk- Administrator Zylia to begin gathering information
on parking and garage requirements for new construction of multiple dwellings.
In addition Councilman Johnson requested an investigation into what type of
ordinance other communities have, if any, limiting the parking of commercial
vehicles in residential areas.
Councilman Baumgartner's Report
Councilman Baumgartner read the Recreation Commission minutes of October 25,
1973, and the Planning Commission minutes of October 24, 1973.

Clerk- Administrator Zylla informed the Council that as requested he had sent
a letter to the Mounds View Human Rights Commission noting that a charge of
discrimination had been brought against a member of the Mounds View Police
Department.
Attorney Meyers' Report
MSP (Johnson Pickar) To adopt Resolution #617 approving the easement vacation
and exchange for the drainage pipe located on the Anchor Inn property (hearing
held October 9, 1973). 5
Engineer Bearden was instructed to oversee the a &sement relocation construction
at the Anchor Inn property site.
