HomeMy WebLinkAboutMinutes - 1973/11/26PROCEEDINGS OF THE VILLAGE COUNCIL RAMSEY COUNTY, MINNESOTA November 26, 1973 A Regular Meeting of the Mounds View Village Council was called to order by Mayor Neisen at 8:00 P.M. on November 26, 1973 at the Mounds View Village Hall, 2401 Highway #10, St. Paul, Minnesota 55112. Present: Mayor Neisen Councilman Hodges Councilman Baumgartner Councilman Johnson Councilman Pickar Residents Requests and Comments from the Floor Also Present: Clerk- Administrator Zylla Attorney Mayers MSP (Hodges Pickar) To approve the minutes of November 12, 1973. 5 Ayes Robert Waste, owner of the B R Liquor Store and Grocery Store appeared before the Council to request permission to enlarge his liquor store into the area presently used as his grocery store. He stated he was going out of the grocery store business. Attorney Meyers stated that according to Mounds View Code 100.08, (5) "no license shall be effective beyond the compact and contiguous space named in the license for which it is granted The Council suggested that Mr. Waste be referred to the Planning Commission. Mr. Waste saw no need to go to the Planning Commission because his proposed use of the building would generate less traffic, would be 23 less hours of operation, and have no Sunday traffic or no additional lighting. MSP tBaumgartner- Pickar) To refer Robert Waste to the November 28th Planning Commission meetin3 for their review and comment of his proposed remodeling and expansion of his liquor store. MSP (Neisen Baumgartner) To call a special meeting of the Council for December 3, 1973 at 7:00 P.M. to consider the Planning Commission recommendation relative to Mr. Waste's proposal. 5 Ayes Since several persons were in the audience relative to a contraversy about proposed street lights on Ridge Lane between Long Lake Road and Rainbow Lane, the Mayor turned the meeting over to Clerk- Administrator Zylla for an explanation. Cle :k- Administrator Zylla stated that in October of 1972 the Council ordered two mid block lights on Ridge Lane. NSP inadvertently omitted installing the lights. After a new request was initiated and the light stakes were stationed, a property owner in the area named Peter Hanslip objected to the lights because they would devalue his property and the light would shine into his bedroom. Based on his objection, a survey was made of the residents on Ridge Lane and it was found that 11 favored the lights as proposed, 2 were opposed, and 1 had no response. Shortly after a petition was received requesting that only one light be installed. Yet, another petition was circulated requesting that some lighting be installed. 5 Ayes -2- Clerk Zylla felt that at least two lights were necessary on the block, but if the Council was inclined to only install one light the light between 2563 and 2601 Ridge Lane should be the one installed. Mrs. Bosell, 2601 Ridge Lane advocates that both lights be installed as originally proposed. Mr. Hamad'', 2613 Ridge Lane thought that after the first letter was sent that there would be no lights if both lights were not installed. He wants the light proposed between 2609 and 2613 installed one lot further east. Mrs. Long, 2604 Ridge Lane stated that several homes had their bedrooms in the front. That the solution is to buy a shade. Mre. Rowley, 2562 Ridge Lane presented the latest petition which requested that some lighting be provided. Mrs. DeBerg, 2600 Ridge Lane questioned why the lights if reordered could take as much as four to six months to install. MSP (Johnson- Neisen) To order the installation of the street lights on Ridge Lane between Long Lake Road and Rainbow Lane as per, the original request with one light between 2563 and 2601 and one light between 2609 and 2613. Mayor Neisen's Report Mayor Neisen read the list of proposed energy conservation measures directed by Clerk Administrator Zylla to be implemented by the various department heads and employees. MSP Neisen- Johnson), To authorize the Police Civil Service Commission to begin testing, for the position of patrol sergeant in order to determine if there are any qualified applicants. 5 Ayes MSP Neisen- Hodges) To accept the list of three certified applicants from the Police Civil Service Commission for the office of police patrolman, the list including Larry Benolkin, Roland'Partyka, and Jack Chambers, and to authorize that Mr. Chambers be hired effective January 1, 1974. 5 Ayes Clerk- Administrator Zy11a's Report MSP (Pickar-Hodges) To approve the licenses: Excavating A.M. Zappe Exc. Grading, Crown Construction Co.; General Contractor Random, Inc., Geo. W. Olsen Const.; Heating Air Conditioning A. Binder Sons, Inc.; Sewer Water Surma Plumbing Co. MSP (Hodges Baumgartner) To approve the bills: General Fund checks #7952 thru #7990, Payroll Account checks #1055 thru #1057, Bond Account check #107, Payroll checks #655 thru #689. Transfer check #7991 transferring $11,205.71 to pay gross pay of November 30, 1973. From General $9,014.65, from Water $1,453.56, from Sewer $737.50. Total disbursements $249,955.97. Clerk- Administrator Zylla said that a partial settlement involving the suit brought against several cast iron pipe manufacturers has been received amounting to $784.29. Clerk- Administrator Zylla announced that 48 persons had not complied with the house numbering ordinance and would be issued tickets. He added that two persons had stated they are having difficulty arranging to have their sewer connected before January 1, 1974, which is the Metropolitan Sewer Board's deadline. Clerk Zylla said that a letter was sent to each homeowner not connected to sewer on March 5, 1973 telling them that the charge would increase effective January 1, 1974. He suggested that since some persons may be having trouble arranging an excavator that anyone wishing to connect after January 1, furnish us with a letter from their contractor informing us that the work cannot be done before January 1, that the connection fee be paid prior to January 1, that the person be given 60 to 90 days to make the connection after January 1, and that the person sign a statement in which he agrees to indemnify the Village for the additional $150.00 if the Metro Sewer Board takes action to recover the same from the Village of Mounds View. MSP Neisen- Pickar) To approve the recommendations of the Clerk granting an extension from the Metro Sewer Board policy provided that the connection charge is collected before December 15th, provided that connection be made no later than February 28, 1974, and provided the owner agrees to indemnify the Village of Mounds View if the Metro Sewer Board tries to collect the additional charge from the Village. 3 Ayes Johnson Naye, Baumgartner Abstained i MSP (Johnsun-Pickar) To call a brief recess to the regular meeting at 9:25 P.M. 5 Ayes Mayor Neisen called the regular meeting back to order at 9:40 P.M. Mr. Bill Edes of Programmed Land requested approval of his preliminary plat. In attendance with Mr. Edes was Walter Baker, his attorney and a court reporter. Attorney Meyers reviewed Mounds View Municipal Code 42.07, Subdivision 2. He noted that on November 20th, the Planning Commission, Recreation Commission, Village Council and Rice Creek Watershed District met to formulate a policy relative to the ordinance he outlined. The policy as developed stated that all plats are to be referred to the Recreation Commission for their determination with Council approval whether or not cash or land is wanted by the municipal4ty. MSP (Johnson Baumgartner) Whereas there is no formal recommendation from the Recreation Commission on the preliminary plat of Programmed Land 1st Addition as to whether the Recreation Commission wants cash or land, that the matter be referred to the Recreation Commission for their comment. Mr. Walter Baker declared that there is no reference in the existing ordinance to refer the matter to the Recreation Commission. Attorney Meyers commented that at the last regular Council Meeting a joint meeting was proposed at which time the formulation of a policy was discussed. Mr. Baker requested approval of the preliminary plat at this time adding that he had been told by the staff that the Council would not refer this plat to the Recreation Commission. He added that to send the plat to the Recreation Commission was unreasonable and that the ordinal ,e was unconstitutional. The Council voted on the Motion on the Floor. Attorney Meyers requested a copy of the transcript. Mr. Edes was informed that the Park Commission would meet Thursday at 6:30 P.M. Mr. Edes wanted to know how much money would be requested by the Council, and how the money could be paid. 5 Ayes He added that he was willing to make a cash payment within reason. He said there is a problem in determining the value of the property. Attorney Baker stated that it is in the best interest of his client to get the preliminary plat approved and there is no reason to delay. Attorney Meyers retorted that if the Recreation Commission wants land it may make a decision which will affect the preparation of the final plat. He said that after the Recreation Commission meets, if they want cash, that steps be taken to hire an appraiser immediately. Mr. Edes agreed to make a cash contribution, but he would like to negotiate the figure. He still wants preliminary plat approval. He felt it would be a good development for the Village. He said the court reporter was here tonight to insure that he he treated reasonably. Mayor Neisen asked if any of the Council wanted to rescind the previous motion. There was no response. Attorney Baker asked if the Council would approve the preliminary plat if the Recreation Commission wanted a cash dedication. All Councilmen with the exception of Councilman Johnson responded that they saw no problems with the plat. Councilman Johnson would not take a position at this time. The Regular Meeting resumed at 10:32 P.M. Councilman Baumgartner's Report Councilman Baumgartner stated that they are still advertising for rink attendants until December 3, 1973. Councilman Baumgartner acknowledged receipt of the land appraisals for the Minor and the Downing properties. He thanked Gene Skiba of the New Brighton Bulletin for his article on park vandalism. Councilman Picker's Report Councilman Pickar reported that the Human Rights Commission meeting was held last week. Also, that the Commission is in need of two members. Attorney Meyers' Report MSP (Pickar-Johnson) To approve Resolution #618, determining that certain property located in the Village of Mounds View is not tax exempt. 5 Ayes Attorney Meyers also presented a copy of Resolution #617 and #615 which were approved at the last Council Meeting. Attorney Meyers announced that the offer from Arvid Birkeland to contribute to the drainage solution at Sherwood Road and Jackson Drive has been withdrawn. MSP (Neisen- Hodges) To cancel the December 24th Council Meeting and to reschedule it for December 17, at 8:00 P.M., and to set a special meeting for January 2, 1974 at 7 :00 P.M. 5 Ayes -5- The Council tentatively set December 5, 1973 at 7:00 P.M. to meet with Kenneth Walijarvi, Village Architect, to review the result of the Village space needs study. The Council decided to request that James Schlichtmann continue his employment with the Village of Mounds View until we are able to get his replacement or until he has to leave for personal reasons.
