HomeMy WebLinkAboutMinutes - 1973/12/17Present: Mayor Neisen Councilman Hodges Councilman Baumgartner Councilman Pickar Absent: PROCEEDINGS OF THE VILLAGE COUNCIL RAMSEY COUNTY, MINNESOTA Councilman Johnson December 17, 1973 A Regular Meeting of the Mounds View Village Council was called to order by Mayor Neisen at 8:00 P.M. on December 17, 1973 at the Mounds View Village Hall, 2401 Highway #10, St. Paul, Minnesota 55112. Also Present: Clerk- Administrator Zylla Attorney Meyers Engineer Bearden MSP Pickar- Hodges) To approve the minutes of December 10, 1973. 4 Ayes Attorney Meyers informed the Council that according to the law, non intoxicating off -sale licenses and intoxicating on -sale licenses are compatible unless a municipality has an ordinance to the contrary. An establishment may sell non- intoxicating off -sale liquor in an on -sale liquor establishment until 1:00 A.M. MSP (Neisen Baumgarner) To authorize the attorney to amend the municipal code to forbid the issuance of an off -sale non intoxicating liquor license in any on -sale intoxicating liquor establishment effective January 1, 1975. 3 Ayes Baumgartner Naye Baumgartner felt that the present licensed establishments should have no more than three months to comply with the new law. Manor Neisen's Report MSP (Neisen Pickar) To set the termination date for the employment of James Schlichtmann, Public Works Superintendent, for December 31st, at 4:30 P.M. Mayor Neisen explained that Mr. Schlichtmann had resigned and then later requested to be retained as a lead man. The Council felt that since not enough money was budgeted, since it would be difficult for the new superintendent to supervise an x- superintendent, that a low seniority man may have to be laid off if he is retained, and it would be unfair to the men to grant seniority to him, that he be terminated before the Village would have to pay unemployment compensation. (January 1, 1974). 4 Ayes Clerk- Administrator Zylla's Report MSP (Hodges Pickar) To approve the licenses: Cigarette Long Lake "66 Country Kitchen, Martin Oil Service, Dick's Clark Super "100 Highway #10 Service; Gasoline Station Dick's Clark Super "100 Long Lake "66 Martin Oil Services; Off -Sale Non Intox. Liquor Mermaid Cocktail Lounge, Inc., Launching Pad Supper Club. 4 Ayes -2- MSP (Baumgartner- Hodges) To approve the bills: General Fund checks #8039 thru #8078, Payroll Account checks #1060 thru #1066, Payroll checks #714 thru #743 and transfer checks #8076 transferring $10,573.97 to the Payroll Account to pay gross pay of December 28, 1973. From General $8,457.47, from Water $1,379.00, from Sewer $737.50. Transfer check #1067 transferring $19.16 to the General Fund from the Payroll Account to balance the Payroll Account 4th quarter. Total disbursements $31,195.90. Clerk- Administrator Zylla stated that he had sent a letter to Mr. Perry, Attorney for North Star Ambulance Service, inviting him to the Council meeting of December 17th, but that neither he nor Mr. Carlson, the owner of North Star Ambulance are able to attend. MSP (Baumgartner- Hodges) To hire Midwest Planning and Research to do a Mounds View Comprehensive Plan and to authorize the Mayor and the Clerk- Administrator to execute the contract. A.E.I. Design, Northwest Consultant and Midwest Planning were contacted initially by the Clerk- Administrator. Cost estimates were requested from Northwest Consultants and Midwest Planning. The Planning Commission recommended that the Council author- ize a comprehensive plan. The $16,500.00 cost of the plan is to be paid from revenue sharing. MSP (Neisen Baumgartner) To close the municipal office on December 24th provided all employees either take a vacation day, compensatory time, or a day off without pay and that at least two men in the Public Works Department be required to work until 12:00 Noon with a provision that all Public Works Department employees may be scheduled to work if the situation warrants. 4 Ayes; MSP (Neisen Pickar) To authorize the Administrator to send a letter to Abiding Savior Lutheran Church requesting that they remove their mobile home within 30 days. Council instructed the Administrator to contact Messiah Lutheran Church and inform them that their building plan addition must be approved by the Planning Commission prior to the issuance of a building permit. Administrator Zylla informed the Council that the post office did not want the street in Programmed Land First Addition to be named Liberty Street. Administrator Zylla stated that he had received a complaint from Mrs. Haake about snowmobiles on the south side of Spring Lake. She felt that snowmobiling was not compatible with pedestrians and persons sleding in the area. The office is to contact the snowmobile club to request that they police the area more carefully and post part of it with no snowmobiling signs. Councilman Hodges' Report Councilman Hodges turned over some information on Civil Defense Emergency Occupation Centers to the Administrator. He added that the State has about $30,000.00 avail- able for emergency sirens. 4 Ayes Councilman Baumgartner's Report Councilman Baumgartner acknowledged receipt of a Letter from the Office of Local Affairs which informed the Council that their grant application for park funds through LAWCON would not be funded because of its low priority and lack of funds. Councilman Pickar's Report Councilman Picker announced that the Lakeside Park skating area would be open this Saturday. Attorney Meyers' Report -3- Attorney Meyers reported that in the Sac Case the court had ordered all coumunities to pay their escrowed connection charges. Mounds View has been paying and is an involuntary defendent of the suit. Attorney Meyers stated that he has spoken with Mr. Engelsma regarding the Minar property park land appraisal and he is to meet with him in mid January. The Programmed Land appraisal has been signed and wi'1 be ready shortly. Attorney Meyers presented a memorandum regarding Lots 8 and 9, Spring Lake Park Knolls Addition. He stated that the Council may rezone the subject property by either initiating the rezoning and referring the matter to the Planning Commission for their recommendation or the Planning Commission may initiate the rezoning and report its findings to the Council. He noted that denial of a building permit on the property would be reasonable if a comprehensive plan is authorized and underway provided its conditions are defined clearly. He advised that factually supported data would be imperative to support the rezoning. Attorney Meyers stated that the question of damages to the owner of the property should not be considered by the Council in considering whether or not to rezone. MSP Neisen- Baumgartner) To authorize the Administrator to send Attorney Meyers' memorandum to each Planning Commission member together with a letter asking whether they want the Council to initiate a rezoning and refer the matter to the Planning Commission for their recommendation or whether the Planning Commission should initiate the rezoning and refer its report to the Council. 4 Ayes Howard Thorsen, apparent owner of the property was in attendance. On December 17th, he applied for a building permit to construct four 50 X 80 foot buildings on Lot 8 and the east half of Lot 9, Spring Lake Park Knolls Addition. The plans contained no structural or mechanical drawings. The Council was aware that Mr. Thorsen's representative appeared at the November 28th Planning Commission meeting and that the Planning Commission had reviewed his site plan and had found it unacceptable. In addition, the Planning Commission reported that they felt the zoning was spot zoning. Mayor Neisen stated that since the Planning Commission has not yet approved the plan, the Council could take no action affecting a building permit even if thre was not a zoning question involved. 4- Howard Thorsen asked when he would know whether or not he could be issued a building permit. Mayor Neisen commented that it would be at least February, since the Council would probably ask the Planner to look at the subject parcel. Engineer Bearden's Report Engineer Bearden reported that the proposed location of Pleasant View Drive has pretty much been determined, but that he will bring in a final drawing to the Council before the plans are drawn.
