HomeMy WebLinkAboutMinutes - 1974/03/11Present: Mayor Neisen Councilman Hodges Councilman Baumgartner Councilman Johnson Councilman Pickar PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA A Regular Meeting of the Mounds View City Council was called to order by Mayor Neisen at 8:00 P.M. on March 11, 1974 at the Mounds View City Hall, 2401 Highway #10, Mounds View, Minnesota 55112. Also Present: Clerk Administrator Zylla Attorney Meyers Engineer Bearden MSP (Neisen Pickar) To approve the subdivision request of Donovan Wendt to subdivide Spring Lake Park Knolls Addition Lot 82 and 81 except therefrom the south 38 feet, into except the west 130 feet thereof, thereby creating a lot 90 feet with a 40 foot easement subject to an agreement between Mr. Wendt and Attorney Meyers on the value of ten feet of the 40 foot easement, and subject to Council ratification. MSP (Neisen- Hodges) To set a special meeting for 7:00 P.M., March 18th, to ratify the above mentioned agreement between Mr. Wendt and Attorney Meyers, and if there is no agreement, then to cancel the meeting automatically. Mr. Robert Eibensteiner, appeared to request the vacation of five feet of a twenty (20) foot easement for sanitary sewer in order to build a $51,000.00 home on Lot 40, Block 1, Red Oak Estates No. 2. The sewer main was originally constructed between the time the preliminary plat and the final plat for Red Oak Estates No. 2 was approved. Instead of the easement being 1/2 on Lot 40 and 1/2 on Lot 39, the entire easement ended up on Lot 40. 5 Ayes; 5 Ayes! Mayor Neisen's Report Mayor Neisen read a letter of resignation from police officer, Wayne Thompson. MSP (Neisen- Hodges) To accept the resignation of Wayne Thompson effective March 15, 1974. 5 Ayes MSP (Hodges Baumgartner) To approve the minutes of the special meeting to consider the addition and alteration to the municipal building of February 25, 1974. 5 Ayes MSP (Hodges Baumgartner) To approve the minutes of the regular meeting of February 25th, and the special meeting to consider the motor freight terminal special use permit for Smith Transfer Corporation. 5 Ayes MSP (Neisen Baumgartner) To set a hearing to vacate the east five feet of the twenty (20) foot sanitary sewer easement located on Lot 40, Block 1, Red Oak Estates No. 2 for March 25th at 8:30 P.M. with the condition that the house footings adjacent to the easement be of a depth equal to the sanitary sewer, and that the builder proceeds in construction at his own risk. 5 Ayes -2- The representatives of Smith Transfer Corporation requested to be recognized through Mr. Ruben Johnson, project architect. Attorney Meyers read the special use permit agreement that he had prepared. MSP (Johnson- Pickar) To approve the special use permit subject to the condition that oil traps be installed in conformance with the request of the Rice Creek Watershed District, and that a dense planting of evergreens be provided on the rear of the property adjacent to the mobile home park; and to authorize the Mayor and C'erk to sign the agreement after it is executed by Smith Transfer. MSP (Neisen- Hodges) To appoint Wallace Mortenson as assistant weed inspector for 1974. 5 Ayes 5 Ayes Mayor Neisen read the police report for February. Mayor Neisen commended the fire department for their quick response to a fire at the old North Suburban Sanitary Sewer lift station located at County Road H and Edgewood Drive. Edward Paster, of Paster Enterprises appeared before the Council to request the re- issuance of his building permit for the shopping center development on the north side of Highway #10 between Long Lake Road and County Road I. The permit for the development was issued on September 10, 1974, subject to the condition that construction commence within 45 days. Mr. Paster noted that the only changes that have occurred since the permit was issued in September are no McDonalds or fast food restaurant is planned for the SE corner of the property; instead a Bridgeman's Restaurant is planned. Therefore the size of the building on that site has been increased from 2,475 square feet to 4,325 square feet and nine parking spaces have been eliminated. Second, the loading dock area on the east of the building has been reduced from three areas to one and made more attractive. MSP (Neisen Baumgartner) To issue a building permit to Paster Enterprises to construct a shopping center development to include in a separate building a Bridgemans Restaurant subject to the approval of plans by the building inspector and the fire chief, construction in conformance with the approved Rice Creek Watershed District drainage plan, and subject to application and payment of the building permit fee. 5 Ayes MSP (Neisen- Hodges) To readvertise for bids for Water Improvement Project 1973 -5 and to set a bid opening for April 8th, at 11:30 A.M. 5 Ayes Administrator Zylla's Report MSP (Hodges Pickar) To approve the licenses: General Contractor Able Fence Co., Bloomington Aluminum, Bob Carlson Homes, Inc.; Sewer Water Backdahl Olson Plbg. Co. 5 Ayes MSP (Pickar Baumgartner) To approve the bills: General Fund checks #8278 through #8327, Payroll Account checks #1075 through #1077, Bond Account check #112, Payroll checks #915 through #942, Transfer checks #8326 transferring $10,895.45 to the Payroll Account to pay gross pay of March 15, 1974. From General $9,23 ".19, from Water $898.76, from Sewer $759.50. Total disbursements $130,732.15. 5 Ayes Ayes Council authorized the administrator to send a letter to the various civic groups and Mounds View Commissions inviting them to participate in the formulation of goals and policies in the comprehensive plan being prepared by Midwest Planning. MSP (Neisen- Hodges) To authorize the attendance of the civil defense director at a conference on natural disasters scheduled for March 21, 1974 and to authorize the payment of the $10.00 registration fee. MSP (Neisen Johnson) Receiving the letter from Mr. Edes of Programmed Land relative to the extension of a future water main north from the existing main in Programmed Land 1st Addition to Pinecrest Addition, and providing that they accept the appropriate assessment when it is constructed. Mayor Neisen announced that the Mounds View Clean -up Day is tentatively scheduled for April 27th. Councilman Hodges' Report Councilman Hodges notified the Council that a civil defense warning plan which is a part of the Mounds View emergency plan has been completed and signed by the director. Councilman Hodges declared that there has been a report of siren failure at County Road I south of Spring Lake. Councilman Johnson's Report Councilman Johnson inquired as to the supply and cost of gasoline for the City. He was told that the present supplier anticipates no problem with continued supply and that the cost for gasoline was approximately 31 cents per gallon. Councilman Baumgartner's Report Councilman Baumgartner read the Planning Commission minutes of February 27th. MSP (Neisen- Hodges) To accept the Recreation Commission's recommendation and to request a cash dedication in the Mounds View Industrial Park prior to the approval of the subdivision request of Smith Transfer Corporation, and to refer the matter to the attorney that he may obtain the necessary property appraisal. MSP (Neisen Baumgartner) To set a hearing for Blanche Abbott to consider a rezoning of except the east 166 feet of Lot 9 Auditor's Subdivision #89 from B3 Commercial to R1 Single Family for March 25th, at 8:40 P.M. MSP (Pickar- Hodges) To grant the subdivision request of Reuben Achterkirch to subdivide Lots 13 and 15 Knollwood Park Addition into the south 150 feet and except the south 150 feet thereof, subject to the condition that the north 250 feet of each parcel be attached to the property presently zoned R -3, multiple, and recognizing the fact and sense of the Planning Commission that the property is zoned R -1 and that the zoning be maintained as such. 5 Ayes 5 Ayes: 5 Ayes 5 Ayes Councilman Pickar's Report Ayes Ayes (Neisen-Baumgartner) To concur with the Recreation Commission's recommen- dation and request a cash dedication from Keith Harstad's development located approximately north of County Road I, east of Bona Road, and south of Hillview Road. MSP (Neisen- Baumgartner) To set a rezoning hearing for Lots 8 and 9 Spring Lake Park Knolls Addition from B3 Commercial to R1 Single Family June 10th at 8:30 P.M. Councilman Baumgartne. read the Recreation Commission'minutes of February 28th. Councilman Pickar commented that the Lakeside Park Commission met on March 6, 1974. The District 16 pool director has agreed to do the hiring of the lifeguards this year. He will integrate them with his crew that is manning the school pools in the District 16 area. This will be on a no -fee basis for hiring and controlling of the lifeguards. The concession stand building at Spring Lake beach will be remodeled to meet health for concession. The building is to be ready in time for opening swimming in June. Attorney Meyers' Report Attorney Meyers announced that he was meeting with Lloyd Inglesma and Cushman Minor regarding the acquisition of 15 acres of park property on the corner of County Road H2 and Silver Lake Road on March 13, 1974. Engineer Bearden's Report Engineer Bearden reported that bids on project 1973 -6 were opened at 11:30 today. The lowest responsible bidder was C. W. Houle Landscaping Company. He recommended that the bid be awarded to them. Mr. Walter Baker, attorney for Programmed Land stated that in attendance this evening was the president of Programmed Land, a representative of McDonald's Restaurant, a representative of Kraus Anderson (the second lowest bidder), and Mr. Houle, the low bidder. Mr. Baker stated that it was in the best interest of Programmed Land to have the second low bidder construct the project and Mr. Houle was agreeable to withdrawing his bid if he did not have to forfeit his bid bond. Mr. Baker added that Mr. Houle would then receive the project through a sub- contract with Kraus Anderson. Mr. Baker said that McDonald's would have to delay construction until the road was completed if the bid was not awarded to Kraus Anderson, since Kraus Anderson is doing the work for McDonald's. McDonald's legal department will allow McDonald's to start construction provided the same contractor that is doing the building does the road extension. PLANHOLDERS C. W. He preferred that the Council award the bid to Houle and have Houle assign the contract to Kraus Anderson. When the representative from McDonald's agreed to the assignment, the Council acted on the bids. MSP (Hodges Johnson) To receive the bids and to award the contract to the low responsible bidder, C. W. W. Houle Landscaping Co. to Kraus- Anderson of St. Paul. 5 Ayes Administrator Zylla reported on the results of the fire flow test that was taken relative to the Harstad townhouse proposal along County Road H2 and Greenwood Drive. The fire chief previously reported that 1,500 gallons of water per minute was necessary before construction should be allowed. Two hydrants were tested, one produced 2,801 gallons and the other 3,886 gallons. MSP (Pickar- Hodges) To grant the issuance of the building permit to Keith Harstad to construct 66 additional townhouse units as per his previously approved site plan, the conditions set out for the special use permit agreement, and subject to the approval of the City building inspector and fire chief. 5 Ayes Dave Hawkinson of the Businessmen's Association requested clarification of Ordinance 207. The attorney explained that the ordinance only related to non intoxicating liquor and had no effect whatsoever on the issuance of any on sale or off sale intoxicating liquor license.
