HomeMy WebLinkAboutMinutes - 1974/04/08PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA A Regular Meeting of the Mounds View City Council was called to order by Mayor Neisen at 8:00 P.M. on April 8, 1974 at the Mounds View City Hall, 2401 Highway #10, Mounds View, Minnesota 55112. Present: Mayor Neisen Councilman Baumgartner Councilman Johnson Councilman Picker Councilman Hodges arrived late MSP (Pickar- Johnson) To approve the minutes of March 25, ,.974. MSP (Neisen Johnson) To approve the minutes of April 1, 1974. 3 Ayes Pickar abstained Residents Requests and Comments from the Floor Also Present: Clerk- Administrator Zylla Attorney Meyers Engineer Bearden Mr. Charles Hermann, 8360 Long Lake Road together with five of his neighbors appeared before the Council to request that proposed Greenwood Drive from Ardan Avenue to County Road J be constructed straight rather than curved in order to avoid the home located at 8347 Eastwood Road. Attorney Meyers explained that the home was owned by a Mr. Fulwider who was going on a total disability because of blindness. Mr. Fulwider was planning on moving, however, and selling the home to his son. The home is a small older home on a sl.,b. Attorney Meyers suggested to Mr. Fulwider moving the house, but he felt that it was not in any condition to stand a move. A curve of the road on a temporary basis was suggested by some of the residents but was found to be impractical because of the utilities. Attorney Meyers told the Council chat in terms of economics, the curved road would be less costly than buying the house. Engineer Bearden felt that the maintenance cost would be no different curved or straight, and the capital cost of construction for a curved road would add about $700.00 to the project cost. If the road goes straight the house will be about 28 feet off of the center line. Attorney Meyers estimated the cost of condemning the house at $7,000 to $10,000. The residents in attendance declined to give up their easement for $1.00 if the Council agreed to straighten the road. MSP (Neisen Baumgartner) To authorize that proposed Greenwood Drive from Ardan Avenue to County Road J be straightened and authorize the Attorney to negotiate with Mr. Fulwider for the purchase of the house and providing that if no agreement can be met that the matter be placed in condemnation. 4 Ayes Mayor Neisen's Report Mayor Neisen announced that he is a DFL candidate this November for the House of Representatives. 4 Ayes Mayor Neisen rend the Police Report fur March and announced that April 27th is City Clean Up Day. Administrator Zylla's Report MSP (Neisen- Johnson) To hire Mr. Gary Kardell in the Public Works Department effective May 1st, subject to a six -month probationary period at $50.00 per month below union scale during the probationary period. 4 Ayes MSP (Neisen- Johnson) To approve the licenses: Asphalt Buck Blacktop, Inc.; Excavating Hoffman Construction; Garbage /Rubbish Hauler Suburban Pickup Service; General Contractor Eigenheer Builders, Inc.,Quality Construction Service, Milton L. Johnson Co.; Heating Air Conditioning Northeast Sheet Metal Inc., Home -Air Trane, Inc.; Sewer Water Dean Luxenburg Construction Co.; Bingo Mounds View Lions Club (until December 31, 1974). 4 Ayes MSP (Neisen Pickar) To approve the bills which includes check No. 8420, a $4.00 payment to Mayor Neisen for a seminar registration which will be included in the bills on April 22, 1974. General Fund checks #8368 thru #8418, Payroll Account checks #1080 thru #1084, payroll checks #974 thru #997, transfer check #8419 trans- ferring $10,494.37 to the Payroll Account to pay gross pay of April 15, 1974. From General $8,875.87, from Water $859.00, from Sewer $759.50. lotal disbursements $34,632.82. 4 Ayes MSP (Johnson Baumgartner) To approve Resolution No. 625 approving the apportionment of assessments on Division No. 48049, for Programmed Land 1st Addition. 4 Ayes MSP (Neisen Johnson) To accept the Metropolitan Area Management Association Agreement with Local No. 49 which includes a provision for a two -year contrast commencing January 1, 1974 subject to the receipt of the signed, executed contract from Local No. 49 and that there are no local issues which would 9ncrease the cost of the contract. 4 Ayes MSP (Neisen Pickar) To accept the recommendation of the Administrator and provide that all receipts from special assessments exclusive of principal and interest be henceforth deposited in the revolving fund and authorize that from the tax settlement report for November 1 to February 28, 1974, $4,357.30 penalty assessments and $8,394.31 from special assessments forfeited tax sales be deposited in the revolving fund. 4 Ayes Administrator Zylla announced receipt of the signed joint powers agreement between New Brighton and the Ci_y of Mounds View relative to the control of Dutch Elm and other shade tree diseases. Administrator Zylla reported that approximately 48,000 yards of fill will be generated from Improvement Project 1973 -4. 27,000 yards are needed at Greenfield Park and 2,000 yards are needed at Groveland Park. Bill Edes of Programmed Land has requested purchase of approximately 20,000 yards for his property. Councilman Baumgartner felt that the City ought to retain an additional 4,000 yards for Woodcrest Park which would mean that the total available for Mr. Edes would be 15,000 yards. The engineer estimated that with Mr. Edes removing the fill from the present drainage pond at. Ardan Avenue and Long Lake Road the project cost could be reduced by about $15,000 to $22,000. -3- MSP (Neisen- Johnson) To direct Attorney Meyers to check out the details of entering into an agreement between Mr. Edes and the City giving Mr. Edes permission to excavate 15,000 yards of fill at Arden Park provided Mr. Edes is desirous of obtaining that amount of fill from the site. 4 Ayes! MSP (Pickar- Johnson) To authorize the issuance of a building permit for McDonald's Restaurant at 2201 Highway #10 subject to the approval of the plans and specifications by the building inspector and fire chief. 4 Ayes MSP (Neisen Baumgartner) To authorize the issuance of four building permits to construct four (35 unit) apartment buildings at Scotland Green Apartments by T. M. Willmus Construction Company. (Phase III). Councilman Hodges arrived at 9:28 P.M. 4 Ayes MSP (Baumgartner Pickar) To authorize an increase in the park and recreation budget from $65,225.00 to $69,390.00 and to amend the projected revenues in the budget for 1974 as submitted by the administrator. 4 Ayes Neisen Naye MSP (Neisen- Hodges) To approve the grading plan for Ery Herbst to grade the property behind 2299 County Road H. 5 Ayes y Councilman Johnson's Report Councilman Johnson reported that he and Councilman Baumgartner have reviewed various ordinances dealing with the parking of commercial vehicles in residential districts. He submitted the regulations to the administrator and asked him to come up with a proposed regulation for Mounds View. Councilman Baumgartner's Report Councilman Baumgartner read the Planning Commission minutes of March 27, 1974. MSP (Baumgartner- Neisen) To approve the subdivision of Doug Kazmierczak in Section 6 Unplatted land, parcel no. 030 -22 into the east 239 feet and the west 234 feet subject to a cash park land dedication in conformance with Ordinance 42.07, Subdivision 2. 5 Ayes MSP (Hodges- Johnson) To approve the subdivision of Jerry Dirks to subdivic'e Unplatted lands, Section 6,parcel no. 020 -03, into the east 1/2 and the west 1/2 thereof. 5 Ayes MSP (Neisen Johnson) To approve the subdivision changing the lot line between Lot 1 and Lot 7, Block 2, Johnson Terrace adding 29 feet to Lot 7 for Ohnestad and Culhane subject to receipt of the survey. 5 Ayes Councilman Hodges' Report Councilman Hodges said he received a call to clean up the pond area behind 2215 Bronson Drive as part of the clean up day campaign. Mayor Neisen felt that it should be handled as a special project. Attorney Meyers' Report MSP (Hodges- Baumgartner) To authorize the Mayor and Clerk to sign an agreement waiving the City's right to a five foot utility easement midway between Lot 13 Knollwood Park Addition. Attorney Meyers submitted a legal opinion to the City on the regulation or enforce- ment of speed limits in mobile home parks. Attorney Meyers presented copies of Resolution No. 624. Attorney Meyers presented the appraisal report on Lot 3, Block 1, Mounds View Industrial Park. The appraisal was necessary to determine the value of 42.86 acres for the cash dedication required by Ordinance 42.07. The cash dedication required amounted to $17,100.00. Attorney Meyers was instructed to request the total amount and if that was not possible from the owner to request 1/3 immediately and the remaining amount in two equal annual installments. Attorney Meyers reporting on the Minor property acquisition stated that the City and the owners are close to an agreement and he expects condemnation to be avoided. Engineer Bearden's Report MSP (Hodges- Johnson) To receive the bids for Water Improvement Project 1973 -5 and to award the bid to C. W. Houle Landscaping Company for a bid of $25,559.90, subject to receipt from Paster Enterprises of an easement for construction of this project on their property. Planholder Bid C. W. Engineer Bearden reported on several drainage problems he has investigated in the City on County right -of -way. He reported that the County has agreed to attempt to correct the road surface on County Road H2 between Skiba Drive and Irondale Road and on Long Lake Road in front of 8011.
