HomeMy WebLinkAboutMinutes - 1974/08/26Present: Mayor Neisen Councilman Hodges Councilman Baumgartner Counci Johnson Councilman Pickar PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA A Regular Meeting of the Mounds View City Council was called to order by Mayor Nelsen at 8:00 P.M., on August 26, 1974, at the Mounds View City Hall, 2401 Highway #10, Mounds View, Minnesota 55112. Also Present: Clerk- Typist Peddycoart Attorney Meyers Engineer Bearden MSP (Neisen- Johnson) To approve the minutes of August 12, 1974 with the following corrections: On Page 9, second paragraph, second sentence to read "He will make a recommendation at the next Council Meeting." On Page 9, Attorney Meyers's Report, first sentence should read Red Oak Estates #3, instead of Red Oak Estates #2; and, last paragraph first sentence should read "summons and complaint" instead of summons on complaint. Residents Requests and Comments from the Floor Michael Roos, 5260 Greenfield Avenue, spoke on behalf of the residents in his area complaining about the offensive food odor from the Anchor Inn. They feel this food odor is a real nuisance and it is lowering the market value of their property. They have talked to the management of the Anchor Inn and have received almost no response and for this reason they are seeking help from the City Council in remedying this situation. There is no food odor from Donatelle's and they see no reason why the Anchor Inn cannot install some type of filtration system to eliminate this problem. MSP (Neisen- Hedges) To appoint Arlene Peddycoart Deputy Clerk to take minutes for the duration of the Council Meeting. MSP (Neisen Hodges) To receive a petition from residents on Greenfield, Jeffery O'Connell, Edgewood and Ridge Lane, and to forward it to Attorney Meyers for research and report back in two weeks. Councilman Johnson asked Mr. Roos exa,tly what kind of response he did receive from the Anchor Inn. Mr. Roos reported that they said they had a fan and he replied "yes, but your fan is blowing the odor out into the neig:iborhood." Mr. Roos suggested filters etc., but they did not respond to his suggestions. Kathy Shun, 5240 Greenfield Ave., stated she also had spoken to Anchor Inn management and they were very abrupt and offered no positive response for remedy of this situation. Attorney Meyers suggested that the City Building inspector investigate this problem and talk to Anchor Inn Management, checking into the type of system they presently use. Mayor Neisen directed the building inspector to talk to Mr. Gydeson in regard to above and report back to the Council at the neat meeting. Mrs. Fulwider requested permission for Attorney Meyers to purchase their home at 8347 Eastwood in accordance with Project 1973 -4. MSP (Hodges- Fickar) To approvt the purchase of the Fulwider home for x]9,900. 5 Ayes 5 Ayes -2- Mayor Neisen recognized Senator John Milton in the audience. Senator Milton had forwarded a copy of a resolution passed by Maplewood concerning smaller towns and municipalities receiving federal monies for acquisition of open space and protection of land and water in urban Ramsey County. The resolution from Maplewood stressed the idea proving State allocation to localities based on population densities and economic fees. Mayor Neisen read a resolution submitted by Doug Bryant, Mounds View Director of Parks end Recreation, endorsing amendments to the LAWOON program which would expand and provide a higher priority for acquisition of diminishing natural resources in urban counties such as Ramsey. MSP (Baumgartner- Johnson) to adopt Resolution #632, A Resolution Supporting and Increased Authorization to the Land and Water Conservation Fund. *(See Minutes of September 9, 1974) Mayor Neisen read a letter he is sending to Mr. Mark Achen, giving his date of hire and starting salary as City Administrator. 5 Ayes Mayor Neisen read a letter from the Bel Rae Ballroom requesting the }ours of operation at the Tuesday night Rock dances be extended to 11:30 P.M. Councilman Johnson requested that the Police Department be contacted to see what the situation is at the present time and to ask the police chief for his recommendation. Mayor Neisen asked Attorney Meyers to check the ordinance in regard to this request. MSP (Neisen-Johnson) to submit the letter to the chief of police if he has no objections he should contact Attorney Meyers to have the ordinance updated. 5 Ayes MSP (P &ckar- Johnson) to recess the regular meeting at 8:30 P.M. 5 Ayes Mayor Neisen reconvened the meeting for a decision on awarding the bid for construction of the addition to the municipal building and alterations to present building. Mr Walijarvi, architect, read the list of low bidders: General Construction Earl Weikle Sons, I $163,898.00;, second low bidder B E Enterprised, Inc. $166,415, and if certain extras are chosen they would come in lower. Mechanical C. 0. Carlson Air Conditioning, $88,880.00; low electrical Maurie Sr. Martin Electric $25,950; Grand Total $278,728.00 not including basement. *(See minutes of September 3, 1974 meeting.) The cost for the addition with the lower level: Add$54,382 to Weilke's bid, add $20,500 to Carison's bid, add $12,015 to Maurie St. Martin's bid, making a total of $86,887 for the basement or a grand total of $365,615. Using B E Enterprises as low bidder for general construction $166,415.00 main base bid and $51,000.00 to include basement. Grand total $361,891.00. Mayor Neisen stated that the building will be built from funding that is already available.. There will be no tax increase. Council felt the bids that came in were high. They were considering taking out the lock -up and doors in the lobby, at a deduction of $4,550. The plan presented is based on needs of the City government for the next ten years. It is on conservative order but still very serviceable. Mr. Johnson asked when bids expired. Mr. Walhijarvi stated they were good for 25 calendar days. Mr. Walijarvi commented in some length on the rising costs of construction and said that thereis no doubt they will continue to rise. -3- Mr. Gum, 7770 Greenwood Drive asked what the City intended to do with the existing police station. Mayor Neisen said it would become storage, and maintenance repair shop. Mayor Neisen explained that the proposed building is planned so that it could be expanded in the future if there ever is a need, but Council does not anticipate any further need at this time. Mr. Russell Paul, 7940 Greenfield Avenue, asked if it wouldn't be cheaper to build two stories instead of spreading out. Mayor Neisen explained that this would not pertain to public buildings for various reasons, such as handicapped persons, fireproofing, elevators, etc. A representative from Earl Weilke Sons asked if this bid was being let just on base bid and alternate #1. Mr. Walijarvi listed the different alternatives and explained what they were. He recommended that the Council take the base bid and the lower level. MSP (Neisen Pickar) To draw up contracts subject to posting of bonds with B E Enterprises, (General Construction), bid price $221,310. with Alternates Al (lower level), A2 (Plaza), and A3 (Rm. #119). C.O. Carlson Air Conditioning, bid price $109,578 with alternates Mi and M3, Maurie St. Martin Electric (Electrical) bid price $37,965 with alternate El (lower level). 5 Ayes MSP (Johnson Baumgartner) To amend original motion to include alternate E2 (Plaza Lighting) for $3,808. MSP (Hodges Pickar) To adjourn at 9:15 P.M. 5 Ayes Mayor Neisen called the special meeting on the semiphore installation on Highway ,110 to order. Mayor Neisen introduced Glen Van Wormer, District 9, Minnesota Highway Department. Mr. VanWormer stated that their basic proposal was to install two additional signals along Highway #10, one on County Rd. H2 and Highway #10 and one 'n County Rd. I and Highway #10. -4- Contract would be let in late fall providing we receive approval. Installation would take pla ^.e in spring and would be turned on in late spring or summer. Some improvements would be n cessary to roadway to adapt to traffic signals, such as a north bound left turn lane on County Rd. I, some bitumous work on approaches on County Rd. H2 and Highway #10. And it is necessary to install some channelized right turn islands for traffic turning offof Highway #10, Mr. VanWormer explained placement and problems of semiphores on Highway #10 by diagraming on the blackboard. His proposal was to show alternatives and get reactions from the people and not to say this is what we are 'going' to do. He presented some solution to problems that would be created on St. Stephens and County Rd. H2 and on Eastwood and County Rd. I due to semiphores. On Greenfield they would restrict the flow of traffic into that street. Mr. Merron, 5240 Greenfield, voiced concern about cutting off Greenfield Avenue. He asked how emergency vehicles would get into the area and how this would affect traffic in other areas. Mr. VanWormer said at Greenfield they could make the median longer or possibly install a sloped curb for emergency vehicles. Mr. Tom Shun, 5240 Greenfield,asked if consideration had been given to the cost of stopping and starting cars which uses more gas. Suggests acceleration lane blocking the street off so there is no left turn onto Greenfield. Mr. VanWormer said they are concerned with more than right turning traffic. Engineer Bearden asked about programming County Rd. H2, County Rd. I, and Silver Lake Road. Mr. VanWormer said they would be programming these intersections, but there are variables such as different speeds that may necessitate some stopping of traffic flow. David Fiedler, was in favor of the cul -de -sac proposal and presented a petition taken on Eastwood Road from County Rd. I to County Rd. Letters were sent to all residents on Eastwood, 30 letters were returned. Mayor Neise read the petition. MSP Neisen- Hodges) To receive the 30 letters from residents of Eastwood Road. 29 were in favor and 1 oppossed. 5 Ayes Ole Bacon, 2625 Highway #10, said blocking Eastwood Rd. would be creating a hardship for him, because his driveway ingress and egress is on Eastwood Rd.; and he is concerned about snowplowing, mail delivery, etc. He wondered if they had enough land there to make a cul -de -sac. Mayor Neisen stated that he had been in the area and there is enough area to make a cul -de -sac. -5- Wendall Erickson, 5319 St. Stephens, said he remembers being in the Village Hall about twenty years ago asking about semiphores and they were told then not to worry about Highway #10. in a very few years it's just going to be a service road. So we have now got a million doilar overpass and model freeway that ends in a swamp. If they ever get this freeway finished then what happens; will we get the semiphores removed or what. Mr. VanWormer said he did not know what the plans for freeway were but pressure would have to be put on the other communities to get some progress on it. It will take eight to ten years. Kathy Shun, 5240 Greenfield Avenue, asked if the letter sent to Greenfield and Jeffery Drive residents was also sent to people an Edgewood because traffic would be increasing on their street if people cannot turn south on Greenfield. Anchor Inn causes traffic problems also. Mayor Neisen said they did not receive a letter because Council did not know there would be a center island put through. There will be another hearing at a later date. Mrs. Edberg, 7860 Greenwood Drive, wondered where the entrance to the new shopping center is going in. If a cul -de -sac is put on Eastwood Rd. all the northerly traffic would be routed down Greenwood and Long Lake Rd. She is not in favor of the cul -de -sac. Mayor Neisen said the entrance is between Eastwood and Greenwood. Ron Johnson, 5249 Jeffery, stated that the hill on O'Connell in the winter drifts and cars get stuck, if Greenfield is restricted they won't be able to get out at all. Ed Donatelle, 5269 Jeffery did not feel restriction of traffic on Greenfield was a good idea. He was also very concerned about traffic racing through his parking lot at Donatelles making a hazardous situation caused by installation of a median in this area. Ron Meron, 5250 Greenfield Avenue, suggested a flashing red light instead of a median. Mr. VanWormer said this would not be a solution in this situation. Sharon McCarthy, 7760 Long Lake Road voiced her concern about added traffic on Long Lake Road which is an old narrow road not equipped for thoroughfare traffic. Mr. VanWormer said they have tried to figure out which alternate routes traffic would take. They don't see all the traffic now on Eastwood ending up on Long Lake Road and don't feel placement of a median or culdesac is going to make a difference as to how many people >o on a road and in any case it would amount to only about 100 to 200 additional cars, it would not be a matter of 1,000. Peter Szurok, 8145 Eastwood Rd, asked if there had been a public hearing on building the shopping center. -6- Mayor Neisen commented that there was a public hearing. Irene McCunniff, 5381 St. Stephens, stated from her experience on streets in Minneapolis where streets were blocked off in similar situations, she feels it makes a safer traffic situation. Mary Siemen, 8021 Eastwood, is concerned about safety aspect, children on bicycles etc. She feels blocking Eastwood would be a safety measure. And felt that the present yield sign on County Rd. I and Eastwood was ineffective. Mr. Bob Raes, 7715 Eastwood, suggested making one -way streets, Eastwood Rd. a one -way south and Greenwood Drive a one -way north on the end between Hillview and County Rd. I. Mr. VanWormer made a note of his suggestion as a possible solution. Ms. H. Johnson, 5297 St. Stephens said her home at present was almost unbear- able from the sound of the traffic and she wanted to know if there was some device that could be installed for a sound barrier. Mr. VanWormer said there were no plans for installing sound barriers on highway #10. Mrs. Jchnson asked if there was some special permit she could get to build a barrier herself. Mr. VanWormer said if what they wanted to do was compatible to the Highway Dept., this could be done. And if she would like to be referred to someone to pursue the matter further, he would give her names of persons to contact. Michael Roos, 5260 Greenfield, asked for an idea of how much increase there would be in traffic noise with a traffic signal. Mr. VanWormer said there should be no nc *_iceable difference. Mr. Siemen, 8021 Eastwood, expressed the traffic problem at Eastwood Rd. and County Rd. I due to people not yielding at the yield sign. Mayor Nelsen stated that a motion was placed before the chief of police a year ago and his recommendation was that the yield sign be installed there. He felt a stop sign would only cause more problems. Sam Siemen said another problem is a blue truck that obstructs the view and he wanted to know if they were licensed. The mayor said "yes" they were licensed and have been for the past few years and this would be their last year there. James Jackson, 5299 O'Connell doesn't want street blocked but would like semiphore installed. Roger Johnson, 7767 Long Lake Road, wanted to know how much more traffic would be generated. And, he is concerned about 5, and 6th grade students walking to school. -7- Mr. VanWormer said the closing of Eastwood or one of the other streets would have much less impact than the impact of the shopping center. The shopping center will generate thousands. Don Zappa, 5249 Jeffery, was concerned about traffic generated to Edgewood Dr. and the affect it would have on Edgewood Jr. High with all the children walking to school. Mr. Shun asked if anyone had ever thought of a pedestrian bridge across Highway #10. Mr. VanWormer said one of the problems with a pedestrian bridge is trying to get pedestrians to use it. Cost would be between $80,000 to $90,000. Steve Thompson, 7190 Silver Lake Road, asked Mr. VanWormer if there wTere any significant advantages in terms of planning and costs for his department by installing medians and cul -de -sacs at the same time the semiphore is put in. Mr. VanWormei said there is added cost but they probably would not be concerned about added cost because they are astronomical. The single system itself will cost $58,000 to $70,000 per signal. Sharon McCarthy asked about the possibility of installing three -way stops on all the corners at Eastwcod, Greenwood, and Long Lake Road. Mr. VanWormer did not feel it would be very effective. Tim White, 5249 Greenfield Ave., asked if we couldn't do something similar to the system on Rice Street and Vadnais. Mr. VanWormer said in this instance there was nothing they could do with the road because there was no other way of getting around. They were pressed between the freeway and the lake and they had to accept this and provide an additional phase for this traffic to come out. We had half the traffic volume and did not have to worry about left turn lane. Mr. Siemen asked what the Highway Department felt would be the best solution. Mr. VanWormer said from an operational standpoint they could asswer but from an incult impact that's why they are here. LaDean Norton, 5209 Jeffery Drive asked if because of the shopping center going in if they were going to put a signal at Long Lake Road and Highway #10. Mr. VanWormer said that they had looked at all of the intersections along Highway #10 and had talked about the coordination concept green light at all three intersections at the same time and they could not work it in on Long Lake Road, Tom Shun asked if there was a possibility of setting up a stage of the proposed program and hiring five cups and set up the system on a play basis. A dry run without the investment getting a feel for how the people are going to use the streets and a feel for what the flow will be. Mr. Van Wormer said that duplicating traffic signal by means of having some police patr•Amen set up a stage would get an entirely different impact on the driving. -8- We have no control on the individual temperament of the driver. He said we could set up a temporary signal and make some temporary measures on the other streets and try to measure the impact. But it will be impossible to measure before the shopping center goes in. Mayor Neisen asked if the semiphores were installed and it was proven that a cul -de -sac was needed at St. Stephen and Eastwood later on, who then would be responsible the City of Mounds View, State of Minnesota or County. Mr. VanWormer stated regardless of when it goes in there would be mutual concern and mutual involvement. Mayor Neisen said Highway #10 and County Rd. I would be shared 50/50 by the State and County. If Eastwood has a cul -de -sac does the City of Mounds View have to pay for it. Mr. VanWormer said that he assumed they would look to Mounds View to pick up any additional right of way. They would try to fund physical work with State Funds. Ron Meron, 5250 Greenfield Avenue, presented a letter from John L. Larson to show the increase of the foot traffic of the children going to school, with the 4th, 5th, and 6th grade students walking. Roger Erickson said he had attended a meeting of the School Board, He stated that the majority of those in attendance were not from this area. The Board stated that the police department of the individual cities would decide whether these areas were safe to walk in. Afterward he received a letter that area (Long Lake Road County Rd. I and Hillview) was considered safe for walking. Mayor Neisen decided that there were several things to be considered in the matter of semiphore installation and inquired when the Highway Department would be needing a definite answer from the Council. He would like to get some reaction from all of the concerned residents of the City. Councilman Johnson and Hodges felt it would be a good idea to have another meeting.at a later date. Mr. Erickson asked Mr. VanWormer exactly how much more traffic Long Lake Road would have due to the semiphore. Mr. VanWormer felt there would be no increase in traffic on Long Lake Road caused by the traffic signal itself. Mr. Bacon suggested that the semiphore be installed and see how much traffic is generated then if Eastwood has to be blocked off, do it then. Daryl Madison, 5200 Jeffery, inquired why a stop sign could not be put on the turn off lane on County Rd. H2 and Highway #10 instead of blocking Greenfield. MSP (Neisen- Johnson) to table the meeting and set a hearing date of September 30, 1974, at 6:30 P.M., at one of the local schools: 5 Ayes Mayor Neisen called the Regular Meeting back to order. Mayor Neisen's Report Mayor Neisen announced that the agenda meeting was changed from September 2 to September 3, 1974. Mayor Neisen read a letter from the Metro Sewer Board in regards to a letter we sent to the Sewer Board on November 6,1973, concerning payment agreements. MSP (Neisen- Hodges) receiving the letter and referring it to the attorney to contact Dennis Zylla to update himself on what went on and report back to the Council at the next regular. meeting. 5 AY Mayor Neisen acknowledged receipt of a note concerning a call from Mrs. Nylander on August 20, 1974 stating that she wants to make sure Harstad will take care of the grading between Red Oak and Sunnyside. Mayor Neisen said as of now, no right of way has been returned to the City. As soon as the plans are returned to the City Mr. Harstad can proceed. Local Bicentennial Celebration tells of ways we can get parts of $400,000 to take part in a Bicentennial celebration. Mayor Neisen returned the letter to Mr. Bryant for his disposition. Payroll Checks #1295 thru #1329. Total Disbursements $31,408.02. COUNCILMAN JOHNSON'S REPORT Councilman Johnson read the resignation notice submitted by Maridelle Wamhoff. MSP (Johnson- Hodges) To accept Maridelle Wamhoff's resignation as Administrative Secretary. Mayor Neisen expressed thanks and regrets to Maridelle. He felt she was a great asset to the City and she did a tremendous job and publicly thanked her for the great job she did while she was employed by the City. MSP (Johnson Hodges) To advertise for Administrative Secretary. Councilman Johnson inquired about the letter we sent to vsrious people to find out what the situation was on sidewalks. Acting Deputy Clerk Peddycoart reported that we had received one response from the City of St. Paul Board of Water Commissioners. Mayor Neisen, read the letter which stated if a sidewalk is constructed then the following conditions should prevail: 1. The Board will not be assessed for any such improvement. 2. In the event that maintenance of the conduits requires removal or replacement of sidewalk, such cost would be the responsibility of the City of Mound; Vim... Acting Deputy Clerk Peddycoart returned the petition submitted by John Rini at the last Council Meeting for a sidewalk along County Rd. I from Long Lake Rd. to Pinewood School. The petition did not have the required 35% signatures. Mayor Neisen asked Engineer Bearden if any other information has come in from the County. 5 Ayes 5 Ayes 5 Ayes 5 Ayes 5 Ayes Mr. Bearden said 'no' but he presented a map of proposed sidewalks in a radius of one mile from the three schools. A rough figure for costs on sidewalks would run about $214,000 or. S6.25 /foot. Different things could be investigated as far as obtaining some assistance with cost. It is possible that some costs could be picked up on MSA streets from MSA funds. Mayor Neisen said the sidewalk matter would remain tabled until we receive more information. COUNCILMAN BAUMGARTNER'S REPORT Councilman Baumgartner read the minutes of the Park and Recreation Meeting of August 22, 1974. Councilman Baumgartner announced that the Planning Commission will meet this Wednesday, August 28, 1974 at 7:30 P.M. MSP (Baumgartner- Hodges) to appoint Mr. Bob Rossman, 2504 County Rd. H2 tc complete the one year term on the Planning Commission vacated b_y Mr. Houle. The term will expire December 31, 1974. Mayor Neisen directed the office to send letters to the applicants tor the Planning Com_.iission thanking them for applying and informing them that their applications would be kept on file in case of future openings. 5 Ayes COUNCILMAN PICKAR'S REPORT Councilman Picker reported that the regular meeting of the Lakeside Park Commission was held on the 23rd of August. Lakeside Park now has 900 feet of natural trail with a crushed lime walkway. Councilman Pickar announced the annual Spring Lake Park celebration which wi11 be held the 7th and 8th of September this year. Councilman Picker requested that the 7..jman Rights Commission be dropped from the future: ale agenda i.� the ATTORNEY MEYERS' REPORT Attorney Meyers reported that the petition on 1973 -4 will be presented tomorrow to the court. The Silver Lake Property came into final agreement with attorney from Engelsma and Minor property with a price of $95,076. They have granted $25,000 for easements on the property and $120,000 worth of park land. MSP (Hodges Johnson)To authorize the Mayor and Clerk to sign the agreement and direct the closing on the property as soon as possible. Councilman Baumgartner asked whet the boundaries were on the property. Attorney Meyers stated westerly, Silver Lake Road, middle of County Rd. H2, northerly same as Wilmus property. -12- A roll call vote was taken on the motion. Pickar Aye Baumgartner Aye Johnson Aye Hodges Aye Neisen Aye Attorney Meyers presented the final draft of the Dog Ordinance amending Chapter 91, "Animals He noted a change under Subdivision 2, License Required, the word annual. should be biannual. Mayor Neisen gave remarks about Subdivision 13.4 pertaining to running dogs without a leash for training purposes. Mr. Russell Paul said he would be in favor of a dog being on a leash but felt the dog catcher should have no right to go on a person's private property. Attorney Meyers stated this provision for the dog catcher to enter private property has always been in our ordinance but it may be unconstitutional, they may have to get a warrant first. Mayor Neisen said based on his experience in the communities of Maplewood and Roseville while campaigning for representative was that the dogs are kept well under control by their owners. If a dog did get away from his owner he was immediately retrieved. Councilman Johnson felt Subdivision 13.4 wording of Section 4 should be changed to read for purpose of training and/or working dog. Attorney Meyers said the dog has to be trained first before a permit to work the dog can be issue. Councilman Baumgartner felt we should enforce our present ordinance. Some of the residents felt under the leash law the innocent were being punished along with the guilty. Councilman Johnson felt the ideal situation would be to have a strict leash law. Mrs. Buckley,7770 Greenwood Drive, said that if the special permit system was initiated one way to determine if a dog had been trained would be to ask what obedience school they have been going to. Darcy Bosell, 2601 Ridge Lane, thought that the license fee on all male dogs should be the same as female unless they were nuetered. Engineer Bearden said that a few months ago there had been discussion on the culvert at Greenwood, Clearview, and Louisa Avenue. This is a 24" Culvert tw„, to three feet long. Engineer Bearden recommended a trash guard be installed on the inlet of the culvert. The cost of this installation would be about $120.00. Cost would go on 1972 -3, 1973 -2 and would be installed by City Maintenance men, Cour,i.:iiman Johnson thought it would be useless to clean out the culvert until the residents in the area completed sodding of their lawns.
