HomeMy WebLinkAboutMinutes - 1974/09/23PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA A Regular Meeting of the Mounds View City Council was called to order by Mayor Neisen at 8:03 P.M., on September 23, 1974, at the Mounds View City Hall, 2401 Highway #10, Mounds View, Minnesota 55112. Present: Mayor Neisen Councilman Hodges Councilman Baumgartner Councilman Johnson Councilman Picker MSP(Hodges Johnson) To approve the minutes of September 9, 1974. Residents Reguests and Comments from the Floor Also Present: MSP (Neisen- Hodges) To acknowledge and accept her report. Clerk- Administrator Achen Attorney Meyers Engineer Bearden Betty Moller, 7925 Spring Lake Road, Mounds View representative to the Rice Creek Watershed District Study Committee, gave a progress report on the Rice Creek Watershed District. There will be a decision made October 2, 1974, on the overall plan. She and the Committee request more input from local planning commissions and encourage citizens to attend and observe meetings of the study and advisory committees. Carol Baumgartner reported on the League of Women Voter's study cf the proper spelling of the name Mounds View. She presented examples from newspapers, legal petitions, business advertisements, and various documents showing conflicting spelling; sometimes spelled as one word and sometimes two words. She cited the petition to incorporate the Village of Mounds View which used the two -word spelling, and she recommended that the Council make a definite decision one way or the other. Her preference is the two -word spelling. Mayor Neisen stated that the attorney's opinion is that, based upon the papers for incorporation, the proper spelling is two words. Mayor Neisen noted that the word City should now be used in place of Village. MSP (Hodges Johnson) To officially adopt the spelling, City of Mounds View, and to direct the city administrator to change all signs, labels, and seals on equipment and buildings to so read. Mryor Neisen read a letter from Mark Achen accepting the position of Clerk Administrator. Mayor Ncioei, read a letter from Mayor Gayle Bromander of New Brighton requesting the Mounds View City Council to join his Council in urging Ramsey County to acquire the Brightwood Hills Golf Course. The Mayor stated that the course is a valuable recreational resource and many Mounds View residents rlready use it. 5 Ayes -2- If the County does not purchase it, the owners are contemplating platting the property for residential development which would place an additional tax burden on the school district and our citizens. MSP (Neisen- Pickar) To adopt Resolution #636 stating that the City Council of Mounds View urges the Ramsey County Open Space Commission to purchase the Brightwood Hills Golf Course and that the Council desires to make this known to the Commission. Mr. Paul Kos, 5731 Quincy Street, asked if this would also cause tax burden on citizens, because the golf course would have to be maintained. Mayor Neisen responded that golf courses are revenue producing operations and usually will their own way. Mayor Neisen read a letter from Police Chief Grabowski regarding safety on County Road H for children walking to and from Sunnyside School. Chief Grabowski recommends a uniform 30 mph speed limit on this street. The Mayor read a letter from the Sunnyside PTA that included a petition recommending that the City of Mounds View study possible solutions to this same problem. They also recommended the uniform 30 mph speed limit and suggested that amber flashers be installed on the school zone signs. MSP (Neisen- Johnson) To adopt Resolution #637 requesting that the Ramsey County Engineer establish a uniform speed limit of 30 mph on County Road H from Edgewood Drive to the Anoka County line and that installation of flashing amber lights on school zone signs along County Road H be considered. The Council urges the County Engineer to make a study of the problem if one has not already been made. If such a study is or has been made, the Council requests a copy. MSP (Pickar- Hodges) To recess the regular meeting at 8:37 P.M. The Public Hearing was called to order on the assessment for improvements at Mounds View Square and Programmed Lands 1st Addition. Engineer Bearden reported that Project 1973 -5 for Mounds View Square cost $31,323.86. He recommended a ten -year term of assessment. The Mayor asked for comments from the audience, and there were none. MSP (Neisen- Johnson) To adopt Resolution #638 to assess the property as recommended by the city engineer at 87. interest and a ten year term of assessment. Engineer Bearden reported that Project 1973 -6 for improvements at Programmed Land 1st Addition totaled $34,074.93. The Mayor asked for comments from the audience, and there were none. MSP Neisen Hodges) To adopt Resolution. #639 to assess the property as reported by the city engineer at 87. interest and a ten year term of assessment. 5 Ayes 5 Ayes 5 Ayes 5 Ayes MSP (Hodges Baumgartner) To adjourn the Special Hearing at 8:43 P.M, 5 Ayes Mayor Neisen's Report -3- Mayor Neisen read a letter from Governor Anderson requesting that a representative from the Council attend the Governor's Conference on October 9;, 1974. Mayor Neisen designated Councilman Picker to attend the afternoon sessions, and Mayor Neisen will attend the evening sessions. Mayor Neisen received Inspector Skiba's report regarding Construction Equip- ment Service Company's request for a refund of a portion of their plumbing permit. Mayor Neisen requested information on how much of the plumbing project was completed at the time this company was discharged and how much city employee time was required because of the change in plumbers on the Scotland Green project. Councilman Johnson asked whether a refund would be made if the project had not been 100% completed. Mayor Neisen said "No Administrator Achen's Report MSe(Hodges- Pickar) To approve the licenses. MSP (Neisen Hodges) To amend the motion to require a Better Business Bureau background check before issuance of the licenses. 5 Ayes Ayes MSP (Neisen Baumgartner) To approve the bills: General Fund Checks 09058 thru 9127, Payroll Acct. Check #1118, Payroll Checks #1358 thru 1391; Transfer Check #9129 transferring $13,055.89 to the Payroll Account to pay gross pay of September 30, 1974 (from General $10,527.38, from Water $1,116.00, from Sewer $1,412,51). 5 Ayes MSP (Neisen Johnson) To approve Check #9130 for $400.00 for the administrator's moving expenses to be included in the next regular meeting Bills for Approval. MSP (Neisen Pickar) To designate the Mayor, Councilman Johnson, Councilman Hodges, and Clerk- Administrator Achen as the officials authorized to sign City checks. MSP (Hodges- Baumgartner) To request that Ramsey County provide snowplowing and sanding service to the City of Mounds View subject to the receipt of the applicable County rates. MSP (Neisen Pickar) To hold a public hearing on the 1975 City Budget October 7th at 7:30 P.M. MSP (Johnson- Hodges) To hire Maridelle Wamhoff as a part -time employee at the same hourly rate of pay she had been compensated as a full -time employee. MSP (Neisen- Pickar) To change the Regular Council Meetings on October to the 15th and the 29th. 5 Ayes 5 Ayes 5 Ayes 5 Ayes 5 Ayes Councilman Baumgartner read the list of proposed part -time recreational staff for the fall programs and their fees. He stated that these programs were self supporting through the fees charged to participants. 5 Ayes 4 MS? (Baumgartner- Johnson) To approve thes_ employees at the applicable rates. 5 Ayes MSP (Neisen- Hodges) To release specifications for diseased tree removal subject to approval by Attorney Meyers. Mr. Richard Huhne, 8406 Red Oak Drive asked if removal of stumps would be required under the contract and whether citizens could debark or remove their own stumps. Administrator Achen answered that the City would only require that the trees be removed in a manner that met the requirements for control of the Dutch Elm and Oak Wilt diseases. Citizens are encouraged to remove their own trees. MS 4Neises3- Baumgartner) To adopt a resolution creating a separate building fund for the city hall addition. Councilman Johnson asked if a separate fund was necessary. Attorney Meyers stated that it was not essential. A separate fund established by ordinance would simply emphasize the segregation o these monies; the fund would be closed out once construction is completed. Councilman Johnson recommended that the Clerk -check with the city auditor for a recommendation. MSP (Neisen-Pickar) to table the motion to a the resolution. MSP (Neisen- Jo" -_cn) To set 11:30 A.M., October 15, as the bid opening on Project 1973 -4. Councilman Hodges' Report Councilman Hodges asked the Administrator to be sure the problems of performance bonds and certificates of insurance on the new city hall addition are resolved. Councilman Johnson's Report MSP (Neisen Johnson) To direct the building inspector to tag construction of the city hall addition until performance bonds and signed contracts have been received. Councilman Johnson asked about the status of the Anchor Inn odor problem. Mayor Neisen stated that he had received a call from Mr. Gydeson who stated that the Polution Control Agency was coming out to make a recommendation. Councilman Johnson asked t.e Clerk to instruct the building inspectors to be more forceful in policing construction projects to prevent unsightly conditions. Mayor Neisen stated that the City should give contractors at the Scotland Green project a final warning and then a citation should be issued. Councilman Johnson asked about the status of the change to the Ramsey County Court system and how much extra cost the city would incur. Attorney Meyers stated that there were a number of problems that still needed to be ironed out but that he anticipated a definite increase in cost. He stated that the prosecutors plan to handle cases from all four cities in the New Brighton Court and are hoping to eliminate the necessity for their presence at all arraignments. 5 Ayes 5 Ayes 5 Ayes 5 Ayes He stated that plea bargaining would probably be more common under the new system and cases would not receive as much personal attention as we have been able to provide in Mounds View. Councilman Johnson suggested that the Council express its concern about the tremendous expense involved with the new court system and that theCouncil specifically ask that city attorneys not be required to be present at all arraignments. MSP (Johnson- Baumgartner) To direct the city attorney to convey these feelings to the County Court Administrator and to direct the city staff to convey these sentiments in writing. Councilman Baumgartner's Report Councilman Baumgartner reported that Midwest Planning would present a graphic map of the city's proposed comprehensive plan the second week of October. Councilman Picker's Report -5- Councilman Picker read highlights of the Lakeside Park Commission report of the past season and of projects underway. He requested that the staff check on fire insurance coverage for construction of the new city hall addition. MS (Baumgartner- Johnson) To return the Lakeside Park 1975 Budget to the Commission and request that the Budget be examined for possible reductions particularly in the landscaping.account. Councilman Johnson asked Councilman Baumgartner if he would agree to remove the specific reference to the landscaping account. MS (Baumgartner Johnson) To so amend Councilman Baumgartner's original motion. Mayor Neisen stated that he felt it was unnecessary to return the Lakeside Budget, because the Commission has not requested an increase over the 1974 Budget. Roll call was taken on the Motion to amend. Roll call was then taken on the original motion. Attorney Meyers' Report Attorney Meyers presented revisions of the code and an up -dated index. He stated the purchase cf the Silver Lake Road Park site was near completion. MSP (Neisen- Hodges) To authorize payment to Verlyn and Ardis I. Fulwider of $19,900.00 for the purchase of the home and land for project 1973 -4. Attorney Meyers recommended that the Hemsworth property also be acquired for Project 1973 -4. 5 Ayes MSP (Neisen Pickar) To authorize payment to Allan R. and Bernadine Hemsworth and Twin City Federal Savings and Loan for $25,000.00 for purchase of this property. 5 Ayes Councilman Johnson stated chat transfer of monies woull be necessary for these payments and asked the Clerk to have the appropriate transfer ready for the September 30, 1974 meeting. 5 Ayes Attorney Meyers presented proposed Ordinance #222, amending Chapter 41, to rezone the Mounds View Square property. MSP (Hodges- Johnson) To authorize the Mayor and Clerk to execute this rezoning Ordinance #222. Attorney Meyers recommended passage of Ordinance #223 making intentional false fire alarms a misdemeanor by adopting the Minnesota State statutes on this subject be reference. 5 Ayes MSP (Johnson- Pickar) To authorize the Mayor and C1.-:k to execute Ordinance #223. 5 Ayes Attorney Meyers presented the revised Junked and Abandoned Vehicle Ordinance. The Council discussed the short time allowed under Subdivision 42B for residents who might have been injured in an automobile accident and are hospitalized more than 48 hours. The Attorney was directed to again revise this proposed ordinance eliminating this subdivision and including the subdivision in the existing ordinance that declares the absence of current State license plates prima facie evidence of junked and abandoned car. Engineer Bearden's Report Engineer Bearden stated that specifications far. the 1971 uirect contractors to remove the houses and outbuildings on both the Fulwider and Hemsworth properties. Councilman Baumgartner suggested that the Park and Public Works Departments examine these buildings to see if the City might put them to use. MSP (Baumgartner- Hodges) To adjourn at 10 :53 P.M.
