HomeMy WebLinkAboutMinutes - 1974/10/15PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA A regular meeting of the Mounds View City Council was called to order by Mayor Neisen at 8 :07 P.M., on October 15, 1974, at the Mounds View City Hall, 2401 Highway #10, Mounds View, Minnesota 55112 Presen. Mayor Neisen Councilman Hodges Councilman Baumgartner Councilman Johnsen Councilman Pickar Also Present: Clerk-Administrator Achen Attorney Meyers Engineer Bearden MSP (Hodges Pickar) To approve the minutes of September 23, 1974, regular meeting. MSP (Baumgartner- Hodges) To approve the minutes of September 30, 1974, special hearing. MSP (Pickar Hodges) To approve the minutes of October 7, 1974, special hearing. Residents Requests and Comments from the Floor Mr. George Brooks, 8490 Spring Lake Road presented a prepared statement to the Council regarding payment for sewer repairs at his address. Mayor Neisen stated that the public works superintendent was not present and that the Council would put this subject on the agenda for the next regular Council meeting October 28, 1974, and requested that the public works superintendent also attend the meeting. Mr. Donald Balk, 2656 County Road J, stated that he owns a large parcel of land that will be affected by the 1973 -4 project. He expressed concern that the slow economy might prevent property owners from recouping the additional assessment costs by selling subdivided lots. He has owned the property for five years and stated that he had six potential lots. Mayor Neisen stated that the assessments will not appear on taxes until 1976, and that will allow property owners a two -year grace period. Mr. Balk stated =hat his area still does not have city sewer and that he knows of no plans for it to be available in the near future. Mayor Neisen requested the city engineer to look into this problem and recommended that Mr. Balk contact Engineer Bearden. Mayor Neisen's Report Mayor Neisen read a letter from the Ramsey County engineer responding to our resolution requesting a uniform speed limit of 30 mph and pedestrian safeguards on County Road H and Long Lake Road. 5 Ayes 5 Ayes 5 Ayes October 15, 1974 Page 2 Mayor Neisen directed Administrator Achen to contact Mrs. Krystofiak of the Sunnyside PTA and County Commissioner Ed Salverda concerning the matter. Councilman Baumgartner stated that the letter gave no definite indication of when the County expected to complete its study of the problem. Mayor Neisen read the Police Report for September. Administrator Achen's Report MSP (Neisen Johnson) To approve the licenses: Heating J. D. Refrigeration; General Contractor G K Builders. MSP (Neisen Hodges) To approve the bills: General Fund Check No. 9131 thru 9237, Payroll Account Checks No. 1119 thru 1125, Transfer Check No. 9134 transferring $i7,000.O0 to Revenue Sharing from the Park Fund to pay for Minor property; Check No. 9135 transferring $24,000.00 to Project 1973 -4 from the Revolving Fund to pay Fulwider and Hemsworth properties; Transfer Check No. 9136 transferring $12,476.25 to the Payroll Account to pay gross pay of October 15, 1974. From General $10,050.54, from Water $1,143.38, from Sewer $1,282.33; Payroll Checks No. 1392 thru 1421. Total Disburse- ments $174,132.35. 5 Ayes 5 Ayes MSP (Pickax- Baumgartner) To amend the original motion to approve the bills to hold Check No. 9213 pending verification that the architect and the city both have received copies of soil tests run for the city hall addition. MSP (Neisen Johnson) To approve appointment of Gary Kardell as a regular full -time employee effective November 1, 1974, on the recommendation of the public works superintendent. MSP (Neisen Hodges) To approve the appointments of recreation program leaders as recommended by the park and recreation director. MSP (Neisen Pickar) To approve the appointment of Jeannine McDonald to the position of administrative secretary on the recommendation of the clerk administrator and specifying a salary of $3.1O /hour for the first three months $3.30 /tour for the fourth through sixth months, and $3.50 /hour upon completion of the probationary period. MSP (Hodges- Johnson) To hire the firm of George M. Hansen Company to conduct the 1974 city audit at the estimated fee of $3400 to $3600. MSP (Neisen Pickar) To appoint the clerk- administrator as the city's fuel coordinator and to so inform the State Energy Agency. MSP (Neisen- Baumgartner) To change the date of the Council's first regular meeting in November to Tuesday the 12th because Veteran's Day falls on the second Monday. MSP (Hodges Johnson) To adopt Resolution No. 644 restricting the parking to motor vehicles on the north side of Arian Avenue at all times and authorizing the Mayor and Clerk to sign it. 5 Ayes 5Ayes 5 Ayes 5 Ayes 5 Ayes 5 Ayes 5 Ayes 5 Ayes October 15, 1974 Page 3 Councilman Johnson's Report Councilman Johnson asked what the current status of the investigation of the Compassion Christian Center was. Administrator Achen stated that he was waiting for a report from the Mounds View School District on certification of the educational program and teachers there. Mayor Neisen requested the city attorney to investigate the legal status of the Center. Mayor Neisen read Chief Fagerstrom's report on the same. MSP (Johnson Hodges) directing the staff to send a letter requesting the presence of a representative from the Compassion Christian Center at the next regular Council meeting. 5 Ayes MSP (Baumgartner Pickar) To direct the fire chief to investigate the printing operation at the Compassion Christian Center and to proceed under the code. 5 Ayes Mayor Neisen stated that the fire chief should also be instructed to attend the next Council meeting. Councilman Johnson asked whether Midwest Planners had been paid in full. Administrator Achen answered that a balance of $1700.00 due upon the completion of their service was still outstanding. Councilman Baumgartner stated that the staff should maintain close contact with the planning firm. He noted that Mr. Licht had verbally agreed at the last Planning Commission Meeting to see the plan through, including a public hearing and the Metropolitan Council review, at no extra cost. Councilman Johnson asked about the status of the Civil Defense Program. Councilman Hodges stated that it is most important to maintain the paperwork in order to receive Federal funding and that the city could expect ample warning prior to cut off of these funds. He stated that he had been in touch with the area director about our problem and that he had told the director we would have it solved by the first of the year. Councilman Baumgartner Report Councilman Baumgartner stated that the minutes of the October 10th Park Commission Meeting were not available. Councilman Baumgartner read the Planning Commission minutes of September 25, 1974. He stated that there is ambiguity in our code regarding the definition of accessory buildings and garages. Attorney Meyers stated that a special use permit is needed to construct two garages on one lot. MSP (Baumgartner Picker) To affirm the Planning Commission's denial of a special use permit to Mr. Joseph Christy. Pickar Aye Baumgartner Aye Johnson Aye Hodges Aye Nelsen Naye October 15, 1974 Page 4 Mayor Nelsen stated that he felt the storage of Mr. Christy's boats in the accessory garage would benefit the community in terms of appearance. Councilman Baumgartner stated that the Planning Commission has requested the attorney to examine the definition of garages and accessory buildings and to present any changes that might eliminate the ambiguity. Councilman Baumgartner recommended that the Council approve the subdivision request of Mr. Bruce Lawson, 2332 Laport Drive. Attorney Meyers stated that the Council should be sure that the sale of this subdivided land is consummated so that a separate 40 foot subdivision is not created. MSP (Baumgartner- Johnson) To al.prove Mr. Lawson's subdivision request creating a 85' X 210' lot and a 40' X 210' lot subject application and payment of proper fees, preservation of existing easements and special assessments, and receipt of a fileable deed transferring the latter lot from Bruce Lawson to Dale Solbreken. 5 Ayes Councilman Pickar asked Mr. Lawson what the relation of his buildings would be to the new lot line. Mr. Lawson stated that his garage would be moved to satisfy city code, He noted that his lot could not really be subdivided and that by transferring this land his neighbor, Mr. Solbreken, could create two 82.5' lots. MSP (Nelsen- Johnson) To approve the issuance of a special use permit to Mr. John Westling as recommended by the Planning Commission in their September 25, 1974, minutes. Councilman Picker's Report Councilman Pickar gave a report on the Lakeside Park Commission meeting. He noted that a new sign will be erected this fall in the park to indicate that Mounds View is a co -owner of the park, that the City of Spring Lake Park will flood this winter to condition the ice for skating, and that the Commission is considering the purchase of vandalism insurance. Attorney Meyers' Report Attorney Meyers stated that purchase of the Minor property was now complete but that approval was necessary for payment of the city's pro -rata share of the 1974 taxes. He stated there is approximately $16.)00.00 in outstanding special assessments that the city must either decide to pay yearly from the General Fund or to abate. MSP (Neisen- Hodges) To authorize signing of a check payable to M E Realty for $1,262.63 for the city's pro -rata share of 1974 taxes on the Minor property. Attorney Meyers presented the city's new seal which includes the title "City of Mounds View He asked that the Council consider whether to include funding of Project 1973 2,3,5, and 6 and 1974 -1 in the up- coming bond sale for 1973 -4. 5 Ayes 5 Ayes October 15, 1974 Mayor Neisen directed the administrator to contact the financial consul- tant regarding the possibity of selling temporary bonds and to request that a representative of the financial consultant attend the October 21st agenda meeting. Attorney Meyers presented a check from P.B.K. Investment Co., for final payment of their Park Fund dedication. MSP (Neisen-Baumgartner) To accept this check as final payment and direct that it be deposited in the Park Fund. Mayor Neisen directed the city attorney to investigate the legal ramification of the sewer repair problem at 8490 Spring Lake Road. Attorney Meyers presented a revised version of the junked and abandoned vehicles ordinance. Councilman Johnson asked whether Subdivision 8 would inhibit police enforce- ment of the ordinance. Attorney Meyers stated that it would not and that the police have authority to enforce it without first receiving a complaint from the Council. MSP (Neisen Pickar) To adopt Ordinance No. 224 revising the Junked and Abandoned Vehicles Code. Engineer Bearden's Report Engineer Bearden reported the results fo the bidding on Project 1973 -4. He noted that all the bids except one were very close and that he was pleased with the bidding. MSP (Neisen Johnson) To receive the bids and to tenatively plan to award the contract to the low bidder at the November 12th Council meeting subject to the sale of bonds for the Project. Engineer Bearden reported that a hydrant extension was necessary for Project 1973 -6; that materials to install the extension would cost about $150 and that city staff could provide the labor. MSP (Neisen- Hodges) To direct city staff to purchase the necessary materials and install them and that the expense be charged to Project 1973 -6. MSP (Baumgartner Hodges) To adjourn at 10:34 P.M.
