HomeMy WebLinkAboutMinutes - 1975/07/28PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUND VIEW RAMSEY COUNTY, MINNESOTA A regular meeting of Mounds View City Council was called to order by Mayor Johnson on July 28, 1975, at 8:00 p.m., at Mounds View City Hall, 2401 Highway 10, Mounds View, Mn. 55112 Present: Mayor Johnson Councilman Hodges Councilman Baumgartner Councilman Pickar Councilman Shelquist Also Present: Clerk- Administrator Achen Attorney Meyers Engineer Bearden MSP (Baumgartner Shelquist) to approve the minutes of July 16, 1975, deleting the words "to do the" after (Orfie Sons) on Page 1, 3rd line from the bottom of the page. 4 Ayes Pickar Abstained Mrs. Judy Rowley said the context of her statement in the June 23, 1975, minutes had an improper connotation and she requested clarification be made formally correcting the statement. MSP (Pickar- Baumgartner) to reopen the minutes of June 23, 1975, in order to make proper corrections as follows. Judy Rowley, member of Lakeside Park Commission said the agreement is that Mounds View does the summer work and Spring Lake Park does the winter work. Something should be done about who does what to distribute the load. And a lot of people from Spring Lake Park and Blaine use the park and she personally has not seen very many Mounds View residents using the facility. She said Spring Lake Park Police will be called in an emergency because they are closer. Mrs. Rowley feels there is a lot of leaning toward Spring Lake Park because the chair- man and four members are from Spring Lake Park. 5 Ayes MSP (Baumgartner Pickar) to strike the last paragraph on Page 12 and correct the 1st paragraph on Page 13 as it is stated in the previous motion. The last sentence on Page 2 should be referenced as a statement made by Councilman Shelquist instead of Councilman Pickar. 5 Ayes Residents Requests and Comments from the Floor Mr. Glazer, member of Mounds View Planning Commission inquired about the status of the berm that the Planning Commission had suggested Mounds View Square developer install as a buffer. He noted that the area was being sodded and it appears that the developer doesn't intend to put in the berm. Mayor Johnson asked if landscaping was included in the approval oi the Shopping Center. Councilman Shelquist said the Planning Commission had recommended a 1 to 6 foot high screening or schrub or hedge of undulating hermsand Mr. Paster was a_.ked specifically to install berms by Bridgeman's Restaurant on Long Lake Road to improve the appearance. -2- July 28, 1975 Mr. Glazer said that because of the minimal set back at the Shopping Center without a buffering the R -1 property to the north would be subject to rezoning. Councilman Shelquist said this situation required a variance if not corrected. He asked Administrator Achen to contact Mr. Paster about the buffering. Mr. Ole Bacon, 2625 Highway 10, asked if the City would give permission for a produce truck to park on his property for the purpose of selling corn and potatoes. He stated that in the past the truck parked on the shopping center property and he has no objection to the truck parking on his land which is located on the corner of Eastwood and Highway 10. Administrator Achen reported that he has received calls from businessmen in the area that were quite displeased with these produce trucks competing with their business. Mayor Johnson said he received a call from a person objecting to the environment created around the truck. Namely the unsightly appearance of the truck and congregation of children by the truck. Councilman Baumgartner said the vendor should come to the city for a permit and discuss the situation at that time. He is not in favor of the unsightly vehicle such as the one parked on the shopping center property last year. Councilman Shelquist is opposed to the truck. He said last year it was like a mini -flea market with people selling oriental rugs and statues. If it is allowed to park and sell produce it should be allowed to park only for the day and be taken away at night. Mr. McCarthy, 7760 Long Lake Road, explained a problem he and two of his neighbors have with surface water ponding in their backyards. He said he has discussed this situation with the city administrator and has decided that the most expedient way to correct the situation was for them to dig a drainage ditch system to carry water to the storm sewer easement on his property and wants to dictate how and when it will be constructed. If he can't he said he will fill the ditch in. Mr. McCarthy wanted to know the correct procedure to follow for a situation such as this. Attorney Meyers said that a petition could be presented to the city with signatures of surrounding property owners asking for the improve- ment. This would allow the city to assess the cost of the improvement back to the property owners. Mr. McCarthy said he has a letter from the contractor stating this would be taken care of by May 1971. For this reason he would rather do the work himself and charge the contractor for it. He said he felt the city, particularly the building inspection department, should see to it that contractors provide adequate drainage to homes they construct. Page 3 July 28, 1975 Mayor Johnson reported that the drainage system in the City is designed to hold surface water in the back yard where it can either percolate into the ground or into swales and conduits and drainage ditches. Mr. McCarthy said after snow melt or storms, 75% of his back yard is covered with water. It is like a lake. Mayor Johnson stated that the City does have a problem with inadequate drainage and therefore a study will be conducted by an engineering firm to find a solution. Mayor Johnson called the public hearing on rezoning property for K L Diesel development to order at 8:50 p.rt. MSP (Baumgartner- Hodges) to defer the public hearing for K F, L Diesel because there were no representatives present and to resche- dule the hearing when someone from K L Diesel development could attend. 5 Ayes MSP (Shelquist- Hodges) to adjourn the public hearing at 8:57 p.m. 5 Ayes Mayor Johnson called the regular meeting back to order. Attorney Meyers suggested a letter be sent to K L informing them of Council's action and also that an additional fee may be required if they desired another hearing. MSP (Johnson Pickar) to direct the administrator to contact K F, L Diesel and to ll them of the deferred action. If they want to pursue the development and want another hearing, it will be set for August llth, and legal notice will be given for that time. If they are not inter- ested the request for rezoning will be cancelled at that time. 5 Ayes Mayor Johnson announced a request for special use permit to conduct a used car flea mart on Sundays on Launching Pad parking lot. Councilman Hodges explained the used car flea market would be used for people who advertise cars for sale. They can bring cars all into one lot for a fee. The Lion's Club intends to raise money this way. Cars can only be brought to the lot at a certain time and must be removed from the lot at a certain time on Sundays only. MSP (Johnson- Pickar) to approve the special use permit application for the Mounds View Lion's to conduct a used car flea market at the Launching Pad parking lot to be held on Sundays for a period of 30 days. Such cars be allowed to occupy the Launching Pad parking lot from 8 a.m. to 9 p.m., but that they must be removed by 9 p.m. MSP (Johnson- Baumgartner) to waive required fee for the Mounds View Lion's Club on the used car flea market license. 5 Ayes 5 Ayes -4- July 28, 1975 Mayor Johnson reported that Council has discussed the open endedness of the Mermaid Bowling Alley at their agenda meeting and decided that if the bowling alley was not under construction by a certain date that the building permit may be retracted. Mayor Johnson said he would like to give them until a certain time next spring for construction to be started. Attorney Meyers said a policy to this effect could be written. MSP (Johnson Shelquist) to adopt a policy with regard to the Mermaid Lounge Bowling Alley that construction must be commenced and appropriate fees at the time of construction of the Bowling Alloy be paid. Councilman Shclquist thought that the permit should have a six month restriction on completion time. MSP (Shelquist- Johnson) to amend motion to place a six month limit on the length of time that construction may be in progress after initiation of construction. Engineer Bearden presented a report to the Council on temporary drainage improvements for storm water ponding north and south of Ardan Avenue between Red Oak Drive and Fairchild Avenue. Water tight manholes with control inlets at the two backyard catch basins could be constructed for approximately $360.00. Or, a less permanent type construction could be tried to see what problems may occur. his could be accomplished by constructing a sand bag dike around each of the two catch basins to prevent water that may come out of the catch basins from running into the back yards of the adjacent property. If this method is employed the run -off from the surface that normally gets into the catch basins may have to be pumped over the sand bag dike into the catch basins. It is recommended that if this method is employed that boulevard sections be checked and graded higher, if required, to provide water storage on the streets without overflowing the boulevards. Mr. Roger Grosse, 2757 Ardan Avenue, suggestsconcrete pipe be used instead of the sand bags. Engineer Bearden said it would be possible on the north of Ardan but on the south side it is more complicated. MSP (Baumgartner Shelquist) to accept the engineer's recommendation as a temporary solution to put in a concrete pipe at a size, height and diameter as determined by the city engineer for the rear of the property north of ardan and sand bag the catch basin just off of Red Oak Drive south of Ardan and to proceed post haste. 5 Ayes 5 Ayes -5- July 28, 1975 Motion was amended that necessary waivers be obtained for the city to do this work. 5 Ayes MSP (Shelquist- Hodges) to amend the previous motion that the city administrator be directed to insure that during rain storms that someone from maintenance goes out and checks where the water flows. 5 Ayes MSP (Pickar- Hodges) that the expenditure for this improvement be paid out of Revenue Sharing. 5 Ayes Mayor Johnson acknowledged a minor subdivision request of Michael E. White for 8357 Eastwood Road to subdivide one lot into two. MSP (Johnson Shelquist) to approve the minor subdivision request of Michael E. White subject to obtaining a five foot easement on both sides of the lots and a five foot easement on Eastwood road and 30 foot casement on Greenwood drive subject to receipt of all appropriate fees and park dedication. Mayor Johnson recessed the meeting at 10:05 p.m. The regular meeting was called back to order at 10:25 p.m. Engineer Bearden presented a feasibility report on grading Mounds View Square drainage way between County Road I and Long Lake Road on the north side of Highway 10. M (Baumgartner) to accept Alternate #1 lowering the elevation of the S.E. culvert to meet the grade of the improved ditch and to receive the engineering report. Motion died for lack of a second. MSP (Johnson Shelquist) to accept the engineer's report and accept a compromise between Alternate #1 and Alternate #2 encompassing the lowering of the S.E. culvert to meet the grade of the improved ditch and lowering ditch S.E. ingress on Long Lake Road to a grade of 905.9. A letter of modification to be sent to Paster Enterprises telling them of the city's decision and informing them that direction will be given to the engineering firm to prepare specifications and to call for bids at the next Council meeting and invite them to be present. Baumgartner Aye Hodges Aye Shelquist Aye Pickar Aye Johnson Aye Administrator Achen presented the contract between the City and M.A.P.S.I.(Metropolitan Animal Patrol Service Inc.) 5 Ayes -6- July 28, 1975 MSP (Hodges Pickar) to set the contract with M.A.P.S.I. 5 Ayes Administrator Achen estimated that cost would be over $500.00 of budgeted amount based on their fees. This is not accounting for additional revenue that may be generated. The firm estimates that we could keep within the budget figure by trimming hours of patrol in November and December. Administrator Achen said M.A.P.S.I. thought we did not need more than two hours per day for patrolling. 5 Ayes MSP (Johnson- Hodges) to monitor the animal patrol services and by November and December to balance the budget. 5 Ayes Administrator Achen presented proposed Chapter 59 of Municipal Code entitled Building Permits and Fees. Council felt they would like time to study the Chapter at the next agenda meeting so Mayor Johnson tabled the matter until the next Council meeting. Mayor Johnson announced the award of contract for sealcoating Project 1975 -2 to Bituminous Roadways at $29,294.00. MSP (Pickar- Hodges) to accept the bid from Bituminous Roadways. 5 Ayes Councilman Pickar asked if Lakeside Park could be added on this contract. Engineer Bearden said they could negotiate with the contractor. Councilman Baumgartner suggested that it be added by change order. Engineer Bearden presented and read the specifications on repair of Well House #2. MSP (Baumgartner Hodges) to receive the specifications for Well House #2 that advertisement be placed for bids in the city newspaper and that the bid opening be at 11:30 a.m., Monday, August 11, 1975. Mayor Johnson called for preparation of plans and specifications for dehumidifier installation in Water Treatment Plant #1 and asked for Council's comments and recommendations. Councilman Baumgartner felt they should find out how much the repair house #2 is going to cost and proceed from there. Councilman Bodges, Councilman Pickar and Councilman Shelquist agreed. Mayor Johnson tabled the matter until further information is received on the cost of repairing Well House #2. Mayor Johnson announced the appointment of police patrolman from Mounds View Civil Service Commission list of certified applicants. 5 Ayes -7- July 28, 1975 MSP (Hodges- Baumgartner) to hire Mr. Laurence Siluk with a proposed date of hire August 11, 1975. Salary will be in accordance with Local No. 320. Administrator Achen reported on transfers recommended by the auditor which Council had approved in early 1975. Deposit of forfeited tax sales to the revolving fund approval should have been restricted only to the penalty. Interest and principal still belong to the bond redemption fund. Councilman Baumgartner's Report Councilman Baumgartner reported that there was no quorum at the last Park and Recreation Commission meeting so the park title winner could not be chosen. He said Mr. Bryant will send letters to members reminding them of their reEponsibility. The next meeting will be August 11, 1975. Councilman Hodges' Report Councilman Hodges suggesled a note be sent to the Bicentennial Committee commending them for the fine job on the celebration "Evening in the Park He mentioned that Council should look into an exit gate for Belle Lane and the Mounds View Mobile Home Park. Mayor Johnson directed the administrator to check into this. Councilman Shelquist's Report Councilman Shelquist reported on the Planning Commission meeting. He stated David Licht, Midwest Planning, was present at the last meeting. Mr. Licht suggested using his service and charging residents a flat fee of $30.00 Also that he attend Planning Commission meetirgs in an advisory capacity at $25 to $30 per hour. The Planning Commission felt that they would have him on a will -call basis but Mrs. Haake said he is leary of answering any questions not related to the comprehensive plan. Mr. Ingvald Johnson's request for subdivision was given provisional approval upon his bringing in a revised plat to the city for approval, the corrected surveyor's proposed preliminary plat, excepting Lot 2, putting the utility easement in the correct position, with 100 foot boundaries as required. Mr. Licht stressed the point that the Commission should employ his firm so that an unacceptable plat such as Mr. Johnson's would not have reached the Commission without the engineer seeing it. Mr. Donald Gimpel's request for minor subdivision was tabled until August Planning Commission. 5 Ayes 5 Ayes -8- July 28, 1975 Councilman Shelquist announced the public hearing on the Comprehensive Plan would be held August 13, 1975 at 8:00 p.m. Councilman Pickar's Report Councilman Pickar reported that the next Lakeside Park meeting would be Thursday, July 31, 1975. Administrator Achen's Report Administrator Achen reported that he had received a letter from Walijarvi architects in response to a letter they had received from B -E Enterprises. B -E requested the architect to submit a proposed change order to the city for payment with interest or there would be no work after July 31. Administrator Achen said the bill was received just before the last Council meeting and it was too late to be included in the Bills for Approval for the same evening. Tt has been submitted late by the architect in the past. Administrator Achen said he wrote a letter to B -E tellin them to go ahead with remedial work. And, a letter to Walijarvi asking for examination of the exterior tile to evaluate whether we should proceed with a solution to the water and erosion in the basement of the new city hall addition. Administrator Achen read a letter from Engineer Bearden regarding the Twin City Testing Report which stated that the procedures proposed by Twin City Testing do not assure that under all conditions the basement space will not be subject to wetness. Engineer Bearden said to prevent wetness in the basement and to protect the integrity of the building structural system. it will be necessary to provide a dewatering system that will maintain a low enough water table at the building to prevent wetness and will not remove soil from below the building foundations and basement floor slab. Administrator Achen said a remedy must be made on the situation. Mayor Johnson directed city staff to prepare a chronological listing of dates for events surrounding this situation. Administrator Achen said he received a request from the Mounds View Jaycee's for a solicitor's permit to solicit painting of mailboxes red, white and blue in keeping with the Bicentennial celebration. They want to take orders door to door and phone orders. MSP (Johnson Shelquist) to approve a solicitor's license and waive the fee. 5 Ayes -9- July 28, 1975 Administrator Achen reported the city is responsible for $16,900. in assessments on the Silver Lake Park site and approval by Council for reapportionment of the assessments is necessary. The County will then send a letter telling the city that these taxes have been vacated and it will have to be checked to see why the assessment is so large. Bond consultants feel we may have to come up with the money from somewhere. Transfers may have to be made from some fund into Bond Redemption Fund or we cannot reduce our debt levy as much annually. He recommended Council pass a resolution approving reapportionment of assessments as prepared by Comstock 4 Davis. MSP (Johnson Baumgartner) to approve Resolution 683 reapportioning assessments on the Silver Lake Park site. Administrator Achen reported he received a letter from the County on the Hemsworth and Fulwider property taxes which are due. This money could be taken from 1973 -4 Project Fund. MSP (Pickar- Hodges) to pay taxes (1974 taxes payable in 1975) on the Hemsworth and Fulwider property out of Project 1973 -4 Fund. S Ayes Administrator Achen recommended Council set a hearing on community development and housing needs with regard to the City of Mounds View application for a community development program block grant under Title I of the Housing and Community Development Act of 1974. MSP (Baumgartner- Hodges) to set a public hearing for August 11, and August 25, at 9:00 p.m. on community development and housing needs with regard to application for a community development program block grant under Title I of the Housing and Community Development Act of 1975. MS (Pickar- Hodges) to accept licenses as requested Councilman Baumgartner noted that the motion should be amended to say the John Washburnsolicitor and peddler license be approved if it does not cause a traffic problem. If there is a problem the license will be revolked. Councilman Shelquist stated that other vendors should be informed that if they set up without a license they will not be allowed to operate. MSP (Johnson Shelquist) to amend the motion to read that the license request for John L. Washburn be considered separately from the other license applications. Total disbursements $52,941.5 bills: General Fund 1190, Recreation Transfer check #10835 94, Sewer 1,900.30 3. MSP(Johnson- Baumgartner) that city staff be directed to diligently and s :renuously enforce the council policy, that the licenses be issued and approved by Council. MSP(Johnson- Pickar) to approve license application for Bituminous Raodways for contracting if and when they should be required to sealcoat. Attorney Meyers' Report Attorney Meyers presented the development agreement to be signed by the City and Mr. Herbst for Perkins Pancake Steak. Attorney Meyers read a letter on Random lots. Random wants to dedicate these lots to the City. There is $6400. owing in back taxes. Engineer Bearden's Report Engineer Bearden said the contractor is ready to go into the proposed White Oak Estates #3 area and there is no record of a platting. If the plat is recorded in the next week a change order can be issued co the contractor so improvements can be added to this area.
