HomeMy WebLinkAboutMinutes - 1975/09/08A regular meeting of Mounds View City Council was called to order by Mayor Johnson on September 8, 1975, at R:00 p.m. at Mounds View City Hall, 2401 Highway 10, Mounds Viw, Mn. 55112 Present: Mayor Johnson Councilman Hodges Councilman Baumgartner Councilman Shelquist Absent: Councilman Pickar PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA Also Present: Clerk -Adm. Achen Attorney Meyers Engineer Comstock MSP Shelquist- Baumgartner) to approve the minutes of August 25, 1975 with the following corrections. Page 3, after the motion, insert Mayor Johnson reconvened the regular Council meeting. Page 7, after the motion, insert Mayor Johnson reconvened the regular Council meeting. Page 8, paragraph 8, the last sentence should be changed to read overhead to be charged to the "Construction" Fund. Page 9, Councilman Baumgartner's Report, third paragraph should read that a preliminary 1976 operating budget has been prepared by Doug Bryant and is ready but Councilman Baumgartner has not presented it to Council yet. Page 11, the motion should be changed to read "proposed 1976 Lakeside Park Commission budget. The Mounds View Park and Recreation Director, Mr. Doug Bryant was in attendance to dispatch the award presentation for the recently held name -a -park contest and for the V.I.P. (volunteer's in the parks) program. The community park along Silver Lake Road and County Road H2 was without a name and the Park and Recreation Commission decided to sponsor a contest for community youth to essay in giving the park a name. Mr. Bryant reported that there were over 450 participants, nine first place winners, and five runner ups. The title winner was "Silverview Mayor Johnson presented a certificate of award and a five dollar gift certificate to each of the nine first place winners and a certificate of award and a two dollar gift certificate to the five runner ups. He also presented awards to Julie LaVaque, Mary Parker and Dawn Noyes for their volunteer work this past summer in conjection with the Park and Recreation Department's summer playground program. Mayor Johnson on behalf of the residents of Mounds View and the City Council thanked each and everyone of the participants for their contribution to the park and recreation program and for their interest in the City. 4 Ayes MSP (Johnson- Baumgartner) to adopt Resolution No. 686 officially naming the new park "Silverview Community Park 4 Ayes Mr. Robert Waste spoke on behalf of the Mounds View Lion's request for a special use permit to operate a used car flea market at the Launching Pad parking lot on Sundays. Page 2 September 8, 1975 Administrator Achen explained that the original permit granted by Council lapsed the end of August. The Lion's had difficulty getting organized and were not able to actually hold the flea market until this past Sunday. Mr. Waste reported that the flea market last Sunday produced 16 cars on the lot with 250 people looking around. Four cars were sold on the spot and there were other requests for call backs. He asked Council permission to grant an extension to the special use permit and also to post permanent signs along the highway to advertise for the event. M (Shelquist) to extend the permit for the used car flea market up until October 12th Council meeting with provision that the signs be taken down during the week. Mr. Waste protested taking them up and down. He said he would rather a decision be made one way or the other. Motion died for lack of second. Mr. Waste said this is a non profit organization that has made a commitment for $3,500 to buy equipment for Unity hospital. They have paid them $500 and are supposed to pay $3,000 by the end of the year. This money has to be replaced in the hospital budget. The Lion's have invested $300 in signs and advertising for the flea market. MSP (Baumgartner- Hodges) to approve the request for a temporary special permit for Mounds View Lion's Club through October 12 to operate a used car flea market at the Launching Pad parking lot and that all signs north of Highway 10 on Launching Pad property be removed on October 12th and that all signs south of Highway 10 be removed on September 14, 1975. Mr. Waste asked if he could negotiate the special permit by mail to Council if the Lion's decide to cont'nue with the venture after the special permit expires. Mayor Johnson said a written request for the sign and permit could be acted on by Council without them coming back again. Mayor Johnson recessed the regular meeting at 8:35 p.m. Mayor Johnson called to order Project 1974 -1 assessment hearing continued from August 25, 1975 meeting. Mayor Johnson reported that the administrator had received word from Smith Transfer and they now agree to the assessment of the property. Engineer Bearden reported the assessment amount if $17,004.98. Shelquist Aye Baumgartner Aye Hodges Aye Johnson Aye Page 3 September 8, 1975 MSP (Hodges Shelquist) to approve Resolution No. 687 levying the assessment for Smith Transfer over a ten year period at 8% interest. 4 Ayes Mayor Johnson called to order the public improvement hearing on Project 1975 emergency exit at Mounds View Mobile Home Park. Mayor Johnson asked Engineer Bearden to review the proposed improvement project. Engineer Bearden said Council had instructed him to prepare a study for an emergency exit to the Mounds View Mobile Home Park. He read the feasibility study. Mr. Gerald Pittman, 5379 Raymond Avenue, said it is a very good idea to have an emergency exit, and it should have been installed a long time ago. Engineer Bearden explained that Council policy would be to assess the cost against the Mobile Home Park. Delores Peterson, 2133 Belle Lane, asked why this exit is necessary. Mayor Johnson said during the tornado this past spring, some emergency crews got into the mobile home park and were marooned for three hours and could not get out because the power line was blocking the one and only exit. Mr. Aldon Johnson, owner of the park wanted to know why it benefitted the park. He said when the park was first built they asked the City to permit a street and culvert in this area so people living in the trailer court could have an easier access to Pinewood School and the area west of the park. He said he could not see spending $7,000 for something that would hardly be used. He feels the City should be liable for some of the cost if they want the gate. He said if the City is going to make him put in this gate they should make the other mobile home parks do the same thing. Mayor Johnson said the City did not have an ordinance on this but because of the experience with the tornado it was decided that the Mounds View Mobile Home park needed the gate. The other courts have not been studied. Mr. Johnson said the policy should be adopted for everyone, not just one. It Ooesn't benefit the park, but rather benefits the City. Mayor Johnson retorted that it did benefit the park. Trailer owners would have better emergency service protection with the gate installed. The gate wain he used only for emergencies and would be kept locked. The police chief or fire department would be the only ones with keys to the gate. Councilman Baumgartner Said that persons from the mobile home park had asked for another exit. Page 4 September 8, 1975 Attorney Meyers stated at the time the mobile home park was pit in this street was envisioned and residents in the area came in and objected not only to the street but the park itself. Over the years it has been going along alright, but the tornado illustrated that the one exit poses a hazard. The City must provide fire, ambulance and police emergency service to the park. There is no benefit to anyone other than the persons that live in the park and owners of the property. Mr. Johnson said he received a late notice on this assessment, and because he has not had a chance to look at it, asked Council if this could be tabled in order that he may look into some other recourse. He said they are in the construction business and could possibly do the work themselves. Councilman Shelquist asked what portion of the improvement cost is for concrete curb and gutter. Engineer Bearden stated $600. Councilman Shelquist asked why this is required when none of the other city streets have it. Engineer Bearden said it was because it was proposed to be the same as the existing streets in the trailer court. He said this is an estimated cost. If the work could be done by the owner, the cost might be considerably less. Mr. Johnson said the gate would probably be used only about once every ten years, and for that reason he did not see any need for such a permanent type street installation. MSP (Johnson Hodges) that proposed improvement be referred back to the engineer and he and Mr. Johnson get together and discuss proposed improvements and methods of effecting the improvement all of which should encompass the gate. Councilman Hodges retracted his second, Mayor Johnson amended the motion to read results of negotiations are to be reported hack at the October 14,1975, meeting. Councilman Hodges seconded the revised motion. Mayor Johnson adjourned the special hearing at 9:15 p.m. and called the regular meeting back to order. Administrator Achen presented proposed Briar Lake major subdivision prelimi- nary plat stating that Council had previously approved this plat but that the 100 day period in which to file the final plat had lapsed. It is a legal formality that this plat be reprocessed. He said Council could approve the final and preliminary plat tonight, because a hearing has heen held previously. 4 Ayes Page 5 September 8, 1975 MSP (Johnson Shelquist) to approve the preliminary plat of Briar Lake dated August 18, 1975 subject to receipt of new soil boring data certified by City staff and that the basement elevations of any homes constructed on these six lots be at least five feet above the water table to be established from soil boring data, and stipulating as follows: 1) no building permits will be issued prior to May 1, 1975; 2) a certificate of occupancy will not be issued for the occupancy of any dwelling until the utility and street construction work of Project 1973 -4 has been completed; 3) it will be understood by the applicant that construction of the utilities will inconvenience home builders because the dewatering system will be exposed; 4) if construction if commenced prior to construction of the sanitary sewer, the home builder will be required to construct a ramp over the sewer lines and that during a portion of the construction it will be impossible to gain access to the property. 3 Ayes Baumgartner Naye Adminsitrator Achen reported the Planning Commission approved a request by Robert Higgins for an oversized accessory building subject to receipt of payment of the remaining $40 application fee. To date this has not been paid. MSP (Johnson- Hodges) to defer action on the request until such time as the fee is paid. 4 Ayes Administrator Achen reported the minor subdivision request of Jerry Ackermann on Spring Lake Road had been approved by the Planning Commission. Engineer Bearden explained that the present improvement project on Pleasant View Drive does not provide sanitary sewer service to the proposed new lot- He said services would have to be run in from Spring Jake Road or Pleasant View Drive and that it would probably be more economical to run it from Pleasant View. Attorney Meyers stated the owner should be assessed at this time or should sign something accepting the assessment. Mayor Johnson asked Engineer Bearden if he could make a change order to include this in the project. Engineer Bearden said it could be added to the project, but the subdivider would have to agree to be assessed, because it is too late to add it to the assessment roles. MSP (Johnson- Baumgartner) tc approve the minor subdivision of Jerry Ackermann, 8454 Spring Lake Road subject to him agreeing to pay all the special assessments applicable to 1973 -4 on the same basis as other benefitted property owners affected by that improvement. M -SP (Johnson- Shelquist) to amend the motion subject to his execution of an agreement accepting an assessment for the new lot equivalent to that of neighboring properties for the new streets, sewers and water going in that area. In addition, that executed easement agreements for drainage and utility purposes of 10 feet on the north and south boundaries of both properties, of five feet on the west boundary and of five feet each side of the new common line be granted. Vote on the main motion. 4 Arles 4 Ayes Page 6 September 8, 1975 Administrator Achen presented proposed policy regarding grace period for removal of original garage when second garage is constructed. City ordinance allows for only one garage and when persons are building new garages on their property. MSP (Hodges Shelquist) to accept the policy that the first garage must be torn down within 30 days after final inspection. 3 Ayes Baumgartner Naye Administrator Achen reported on a proposed "No U- Turn" sign on County Road H2 median and St. Stephens Street. People are going around the median u- turning into St. Stephens. The police department feels a no u -turn will deter people from making these turns. MSP (Shelquist- Hodges) that maintenance department be instructed to erect a no u -turn sign on the median on County Road H2 and St. Stephens. 4 Ayes Administrator Achen read Resolution from the Planning Commission recommending adoption of the Comprehensive Plan Update. Mayor Johnson announced the Planning Commission has had about four public hearings on the Comprehensive Plan Update. MSP (Shelquist- Baumgartner) to acknowledge receipt of the new Comprehensive Plan from the Planning Commission and to direct the administrator to refer it to the Metropolitan Council. Engineer Bearden presented final plans and specifications for improvement Project 1975 -4 Mounds View Square shopping center. Engineer Bearden said the improvement was for Highway 10 ditch between County Road I and Long Lake Road. IL consists of constructing the ditch grade to provide positive drainage and lowering of the S.E. culvert. The ditch will extend to the corner of County Road I. The County engineering department said they intend to improve both sides of County Road I. Engineer Bearden said the County expects co do the County Road I work within the next two weeks. Engineer. Bearden said if the bids were opened on September 29, completion could be affected in about 45 days. Sodding can be done until about the 1st of November. Engineer Bearden suggests sodding be done this Fall and making the contractor responsible for caring for it next Spring until it has taken root. It will have to be watered and rolled this Fall. MSP (Shelquist- Hodges) to acknowledge receipt of final plans and specifi- cations for Improvement Project 1975 -4 and to advertise for bids to be opened September 25 at 11:30 a.m., to perform drainage improvement. Mayor Johnson asked that Engineer Bearden include unit prices in the bids for concrete curb and gutter and bituminous swale work to stabilize the ditch at the corner of I and Highway 10. Administrator pi ented proposed resolution declaring certain tax forfeited lands non conservation and conservation. The Park Commission recommends that the Council acquire the property on the corner of Quincy and Hillview Road near the existing Greenfield Park. 4 Ayes 4 Ayes Page 7 September 8, 1975 Councilman Baumgartner said acquisition of this land has been considered before and the Commission would like to put an ice rink on this property. MSP (Baumgartner- Hodges) to approve Resolution No. 688 declaring certain lands as non- conservation; and requesting certain land be conveyed to the City of Mounds View for park and recreation purposes. Engineer Bearden said he met with homeowners on the north side of Ardan about a week ago. They signed the agreement to let the City do the drainage work on the driveway. He stated that the curbing installed to prevent runoff into their driveways makes it difficult to enter the driveway in a car without dragging. The quote from Bituminous Roadways seems excessive, so he has asked for prices from two other firms. Mayor Johnson s:ggested Councilmen drive by and look at the situation. MSP (Johnson Hodges) to table the subject of the improvement necessary to affect temporary drainage solution in Ardan Avenue /Red Oak area until Council has more information on the matter. Mr. Ingvald Johnson presented his preliminary plat for a major subdivision at 8384 Long Lake Road. MSP (Johnson Shelquist) to set a public hearing on Ingvald Johnson major subdivision for 8:45 p.m. on September 22, 1975. MSP (Shelquist- Baumgartner) to set a public hearing on October 6th at 7 p.m. for proposed 1975 city budget. Engineer Bearden prese a prelimi plan for construction of the city hall parking lot. The plan consists of 75 parking spaces, concrete curb and gutter around the entire parking lot with separate access on Edgewood Drive to the police department. The estimated cost for this Project is $25,150. Mayor Johnson asked about lighting for the parking lot. Engineer Bearden said flood lighting on the building or a mast with directional .`lood lights on the islands could be used. MSP (Hodges Shelquist) to accept the plan presented for construction of the parking lot to include the lighting system and the cost of the line to be installed for filtration plant #1 and to eliminate the sealcoating and eliminate five parking spaces on the southwest side of the lot for landscaping purposes. Striping of the parking lot shall be included in the bid. Stipulation that the cost of the filtration drainage pipe be paid out of the water fund and bid as a separate item. MSP (Hodges- Baumgartner) to accept the bills, General Fund checks #11051 through #11115, Payroll Acct. checks #1198 through #1199, Payroll checks #2219 through #2252, Transfer check #11113 transferring from General $21,466,86, Water $3,081.68, Sewer, $16,205.30 to Payroll to pay gross pay of 9/15/75. Total disbursements S117,219.81. MSP (Johnson- Shelquist) to accept the licenses, General Contracting Sanders Concrete Contracting Co., The Rottlund Company, Inc., Masonry Dennis Golia Const.; Sign Installation Nordquist Sign Co. Inc.; Heating A/C Advanced Heating and A /C, Denny's Plumbing, Boehm Heating Co., Gas Installer Denny's Mobilehome Service Blacktop Buck's Blacktop, Kennel! Sham -O -Jet Kennels; Solicitor Children's Theatre, waiving the fee for the Children's Theatre. Mayor Johnson acknowledged receipt of the Police Report for August. Mayor Johnson announced he would be attending a meeting tomorrow at noon. Subject: joint bargaining for police contract. All municipal mayors and city managers are gathering to discuss doing away with joint bargaining. COUNCILMAN BAUMGARTNER'S REPORT Councilman Baumgartner reported the Park and Recreation Commission met on August 28, 1975 and is beginning work on a five year capital improvement plan and priority development. A meeting will be held September 11, 1975 to further discuss the capital improvment program. School pool management program has been officially approved by the school board. Councilman Baumgartner asked Mayor. Johnson to solicit for volunteers to form a committee to prepare a trail systems plan and ask that those interested contact the City office. Mayor Johnson asked an article be written inviting anyone interested in serving on trails committee to send their names to the attention of the City Council so it may be referred to the Park Recreation Commission. Councilman Baumgartner reported that he attended a meeting last week at the Ramsey CountySheriff's office regarding establishing trains for bikes, snowmobile, jogging etc., with emphasis on a uniform snowmobile ordinance within the County. Councilman Baumgartner is to be on the ordinance writing committee. County and D N R funds are available for the trail systems. Funds for patrolling, grooming, etc., and in order to get funds you must have a committee. Councilman Baumgartner said both he and the Park Director received calls from citizens commenting on the new playground equipment at Hillview Park. The residents were pleased with the new eluipment, However, the speed limit on Long Lake Road at 40 MPH poses a potential hazard with the number of children who frequent the playground. it was suggested a four way stop sign he installed at the corner of Long Lake Road and Hillview Road. 4 Ayes 4 Ayes Page 9 September 8, 1975 Councilman Baumgartner recommended the speed limit be changed to 30 MPH on Long Lake Road from County Road H to County Road J. MSP (Baumgartner Shelquist) that City petition County to make Long Lake Road and Hillview Road a four way stop and that the County consider lowering the speed limit from County Road H to County Road J from 40 MPH to 30 MPH. ATTORNEY MEYERS' R1:PORT Attorney Meyers said he had been going over the city zoning ordinance and has a lot of questions and comments which he will air to the Planning Commission sometime. Attorney Meyers cautioned that using waivers can be ineffective in legal disputes if the signing and maintaining of these waivers is not scrupulously kept.
