HomeMy WebLinkAboutMinutes - 1975/10/14PROCEEDINGS OF THE CITY COUNCIL CITY OF MOUNDS VIEW RAMSEY COUNTY, MINNESOTA A regular meeting of Mounds View City Council was called to order by Mayor Johnson on October 14, 1975, at 8:04 p.m., at Mounds View City Hall, 2401 Highway 10, Mounds View, Mn. 55112 Present: Mayor Johnson Also Present: Clerk -Adm. Achen Councilman Hodges Attorney Meyers Councilman Baumgartner Engineer Comstock Councilman Pickar Councilman Shelquist MSP (Shelquist Pickar) to accept the minutes of September 22, 1975, Council meeting with the following corrections. Page 1, second motion, the second should be changed from Hodges to Baumgartner. Page 4, MSP (Johnson Shelquist), the word "prevent" should be changed to "encourage Page 6, James Nichols should be followed by his position title of accountant. Dale Olson should be followed by his position title of public works maintenance man. MSP (Pickar Johnson) should be changed by inserting the word "and" after "day labor and before the words "to buy seed." Page 8, MSP (Pickar- Baumgartner) approval of licenses, Mike DeMars should be omitted because he was approved at a previous meeting. Page 8, ninth line, Attorney Meyers suggested looking into the city requiring contractors to be bonded. 4 Ayes Hodges Abst MSP (Pickar Shelquist) to approve the September 25, 1975, minutes as presented. MSP (Shelquist- Hodges) to approve the October 6, 1975, minutes as presented. Representative Howard Neisen was present in the audience. He said he wanted to arrange with Council to discuss the pending land use legislation at some later time because he did not want to take up that much time at a Council meeting. He also told Council that the Legislature would be in session again on January 27th and if there is any legislation the Council or citizens would like to give input on, he would like the information as sson as possible so he has time to work on it before the session starts. He also ng on October 15th want him to vote when cities to put aside Also, a Bill to Mayor Johnson asked Administrator Achen if the 1975 Labor Agreement with Teamster's Public Law Enforcement Employees Local No. 320 has been finally interpreted and if there are any ambiguities. 4 Ayes Johnson Abst. 5 Ayes Page 2 October 14, 1975 Administrator Achen said Mounds View had no problems concerning the agreement, all points were mutually agreed upon and the contract was ready for execution. Mayor Johnson asked what impact the new contract had on the City and what percent increase there is in the cost of police services as a result of the contract. Administrator Achen reflected some changes in compensation and fringe benefits. An increase in city costs of 181fi percent, some resulting from scheduling changes lost time. Salary increases amounting to around 16 to 17 percent per individual officer depending on tenure. Holiday credits, eleven per year. An additional days vacation Per Year not to exceed 20 days for over ten years of service. Uniform allowance increase from $175 in 1975 to $200 for 1975. Addition to educational incentive and longevity. Injury in the line of duty benefits,' allows the city to pay of to 60 days sick leave, paying the difference between employees regular rate of pay and any workmen's comp benefits for a period not to exceed 60 days beginning with the sixth working day of such injury. Such time not to be charged against employee's sick leave. The basic salary of a patrolman if $1230.00 per month retroactive to January 1, 1975. Administrator Achen added that this is a contract for the 1975 calendar year. Councilman Baumgartner emphasized that this contract was a result of an arbitration award through State negotiation teams and union arbitrators under State statutes. He feels it is a very generous award. He said the City tries to maintain a dollar amount level above patrolman for sergeant, lieutenant, captain and chief, making additional costs in readjusting these other salaries. MSP (Hodges Pickar) to accept the contract and agreement with the Union and authorizing the Mayor and Council to execute the agreement. Mayor Johnson acknowledged the subdivision request of Arlue Smith. dividing one 115' X 423.2' lot at 8461 Groveland Road into two lots 115'X 245'and 115' X 178.2'. He asked Ms. Smith if the back lot lines corresponded with other lot lines in the area. She stated yes. Councilman Shelquist read an exerpt from the Planning Commission minutes concerning thi: subdivision, Mayor Johnson asked if the easements shown on her sketch plan were drainage easements. Ms. Smith said she had whatever the requirement was on her sketch. Councilman Shelquist explained that the sketch shows a five foot easement on the ncrth east /west property line and a ten foot easement on the south east /west property line. Councilman Shelquist said the sketch indicates tive feet on each side of the rear property lines. Mayor Johnson asked Ms. Smith if she had signed with NSP for easements. Ms. Smith said her stepfather had torrence title and she was sure he signed easement agreements with NSP. Mayor Johnson asked Ms. Smith if the east /west easements on the north and south property lines were actually easements or if they could be setbacks. Ms. Smith stated she did not know what he meant by easements or setbacks. Mayor Johnson explained the setbacks would be for allowing setbacks on houses, garages, etc., easements would allow the city to dig holes or whatever may be necessary to maintain certain public services. Mayor Johnson asked what the elevation of the streets is. Ms. Smith said she did not know the exact elevation but that water stood in the southeast corner of the street after a rain. MSP (Johnson Shelquist) to approve the minor subdivision request of Arlue Smith creating two lots, one 115' X 245' fronting on Groveland, one 115' X 178.2' fronting on Fairchild. A utility easement of a ten foot strip at the point 211 -1/2 feet back on the westerly lot and a drainage easement on the north easttivest line of ten feet and five feet on the south east /west line, and further that elevations of the homes or dwellings are to be constructed so that the drainage flows from the back lot lines out to the streets. Councilman Shelquist said he feels if there are no drainage easements on adjacent lots that this is not necessary on this lot. MSP (Shelquist Pickar) to amend the moticn to direct the administrator to investigate the five and ten foot drainage easements on the sketch and if they do not exit that these easements be deleted from this plat. Vote on the main motion. Mayor Johnson directed the administrator to inform the building inspector that at such times applications are taken to review and make sure they are clear, concise ana accurate. Mr. Donald Balk, 2656 County Road J, spoke on his major subdivision request. He said he has been trying to get his property divided since June. He said he was delayed initially because of surveyor problems and when he finally went to the Planning Commission with his preliminary plat, the Planning Commission had a letter from Ramsey County saying they were taking an additional 16 feet of right of way for the County Road J which made it difficult for the Planning Commission to decide if they should allow six lots on Sunnyside or not. So rather than wait any longer, he decided to go into 5 Ayes 5 Ayes Page 4 October 14, 1975 a lot division with five lots on Sunnyside to allow for this road easement. He had his surveyor redraw the plat into five lots. Then, in attemps to sell the lots, interested parties were no longer interested after they heard the costs of the assessments. He said it seems nobody wants to pay that much for that size lot. He said Ramsey County ultimately decided not to ask for the additional 16 feet. They said it was a misunderstanding because of an incorrect drawing made by his surveyor. Mr. Balk said he would like to go back to his original request of six lots on Sunnyside. Mrs. Haake, Planning Commission Chairwoman, said the Planning Commission was concerned if the City would want to take the full 16 feet and she feels the City should get together with the City of Blaine to see what their plans are for County Road J. Mayor Johnson said he feels County Road J is a problem that will be kicked around for a long time unless in some way they are able to free money for the highway. It may not be a good idea at this point to make the corner lot 116 feet. Councilman Hodges felt Mr. Balk should be given an opportunity to get as many lots as possible. Mr. Balk said he would like to know what he would be allowed to do concerning the platting of his land considering all of the items he mentioned. Mayor Johnson said the City should allow for the road easement at this time because it cannot be recovered later on. Councilman Hodges said as long as the County does not need the additional easement, he sees no reason to request it. Councilman Baumgartner feels a 33' road bed should be kept which will have to be continued along County Road J and a 49 foot right of way would only leave way for inviting a four lane highway. Councilman Pickar does not see a need for requesting a 116' lot on this corner. Councilman Shelquist said County Road J is classified as a minor arterial. He said he talked to Mr. Clark of Ramsey County Records and Research and he showed him a map which showed the existing Co. Rd. J roadbed after being He doesn't see a need for a 116' lot on the corner of this particular relocated parcel. However, on allowing this he would like to add that in addition in Blaine. to a 33' setback, that an additional 16 feet setback be requested for the house, protecting future homeowners. MSP (Johnson- Hodges) to set preliminary plat hearing on the Duane R. are Diane E. Balk Subdivision for 8:30 p.m., October 27, 1975, and that the Council will permit on this particular subdivision a 100 foot corner lot and that the City of Blaine, County of Ramsey, and State Highway Department be notified that the Council wil be considering a preliminary and final plat on this development with the anticipation of approving a 100 foot corner lot on County Road J and if they have anyobjections they should be encouraged to inform us of these objections. MSP (Baumgartner Hodges) to amend the motion to maintain a 33 foot road easement on County Road 5 Ayes Page 5 October 14, 1975 Vote on main motion. MSP (Shelquist- Johnson) to set the subdivision hearing for Donald Balk previously schedules for Monday, October 27, 1975, at 8:30 p.m., to Monday, November 10, 1975, at 8:30 p.m. Mrs. Haake stated that the Planning Commission will be meeting in the future on the second and fourth Wednesday of the month starting in November. Councilman Baumgartner asked if Council was establishing a policy along County Road J with this last motion because the Planning Commission will have to know very soon what policy to follow on County Road J. Mayor Johnson said he feels barring any opposition, he would go along with the 33 foot easement. Councilman Shelquist went on record stating to avoid future problems we should ask for 49 feet. He said it was only Balk's subdivision on which he felt it would be feasible to take only 33 feet because the property is so situated that it will not be affected by the future road. Mayor Johnson acknowledged the minor subdivision request of Ione Anderson, for 7310 Silver Lake Road. Mrs. Anderson represents Mrs. Virgil Horst, owner of the property. Mrs. Haake explained the subdivision to Council and stated the Planning Commission's recommendation as per their minutes. She said they were aware of the land locked property but this division did not affect that part of the parcel. This division was necessary to reduce the cost of the house on proposed Lot A. Councilman Shelquist further explained that the land locked lot was a result of past Council action. Councilman Shelquist read the Planning Commission minutes. The Planning Commission recommended that Council grant her minor subdivision at 7310 Silver Lake Road creating Lot A of 101' X 200.58' and Lot B of 101' X 178' on County Road H2, with the provision that before a building permit is issued on Lot B they present a drainage and fill plan to the Planning Commission and get approval from the Planning Commission for a road easement if necessary in the future on the west lot line. Mayor Johnson recessed the meeting. Mayor Johnson called the meeting back to order at 10:33 p.m. MSP (Johnson Shelquist) to approve the minor subdivision of Mrs. Virgil Horst represented by Ione Anderson, for 7310 Silver Lake Road, creating lots A B as noted on Exhibit "A (105'X 200.58'and 101.3'X 178'). 5 Ayes 5 Ayes 4 Ayes Baumgartner Naye Mr. William Frits, 8072 Long Lake Road, said he had a problem regarding a request for variance by himself and his neighbor, Duane McCarty. He said in the first place he did not think property owners should have to have permission from the City to do what they wanted on their own property. He said they were opposed to paying a fee of $10 to get a variance and he understands that the fee is now raised to $50. Page 6 October 14, 1975 Administrator Achen said there is a question of whether two fee applications are required because two properties are involved. Councilman Pickar suggested Council take action in this case to charge only one $10 fee and return the other $10 fee. MSP Pickar- Hodges) to accept the, payment of the $10 variance as full fee for Duane McCarty's variance and return Mr. Frits $10 fee. 4 Ayes Baumgartner Naye M (Shelquist) to amend the previous motion to grant a variance as requested by Duane McCarty, 8060 Long Lake Road between his home and the home of William Frits, 8206 Lor.g Lake. Road, because of the several misunderstandings and inconveniences caused these people by the city office and because the Planning Commission indicated approval when they heard it as a non -fee item. And, the motion was dropped because Attorney Meyers ruled that Council did not have the power to grant variances. Councilman Baumgartner said he feels the $50 fee should still be paid because of an innocent mistake in the office. Mayor Johnson read a citizen request for a street light on Woodlawn Drive between Hillview Road and Sherwood Drive. MSP (Johnson- Hodges) to request NSP to install a street light in that area. 5 Ayes Mayor Johnson read a letter from the Mounds View Lion's Club requesting permission for a permanent special use permit to conduct a used car flea market at the Launching Pad. Mayor Johnson said he was concerned about creating a lot of used car jockeys within the City using their garages for workshops. Councilman Hodges said he had been at the flea market and most of the cars there were newer model cars. MSP (Baumgartner Pickar) to extend the special permit only until the first of December and that signs on the north of Highway 10 be removed on December 1st and that the Lion's Club reapply at such time they wish to resume the flea market. Councilman Shelquist said he objected to the set of signs on the Highway. He said it is unsightly but he has no objection to one permanent sign to advertise the market. M (Shelquist) that the multiple signs be taken down. Motion died for lack of second. Vote on main motion. 4 Ayes Shelquist Naye Councilman Shelquist noted that his Naye vote was due to the signs. Page 7 October 14, 1975 Mayor Johnson read the letter from Mr. Jerry Ackerman, requesting a sanitary sewer service for subdivided property at 8454 Spring Lake Road. Administrator Achen reported that Mr. Ackerman had been notified by letter that in order to effect this extension of services it would be necessary to respond as soon as possible as to his intention. Because we did not receive any response prior to this letter the change order was not processed. Ice Comstock stated that the project is very close to completion and this would now involve extension of the project time and additional cost will be involved. MSP (Johnson- Hodges) to direct Engineer Comstock to determine the approximate cost of the change order to extend facilities to Mr. Ackerman's property and that these cost estimates be given to Mr. Ackerman to see if he is willing to pick up the whole cost of the extension and also to accept the letter from Mr. Ackerman as a formal petition for this project. Mayor Johnson announced the subdivision request of Marvin Schluter, 831 Spring Lake Road. He read the Planning Commission recommendation concerning this request. Mr. Jerry Foss was representing Mr. Schluter and he went over the subdivision with Council. and one lot on Spring Lake Road, MSP (Johnson Hodges) to approve th minor subdivision request of Mr. Schluter creating two lots on Pleasant View as drawn on Exhibit Al creating three lots Lot A 120' X 207', Lot B 120' X 239' X 125' X274' and Lot C 125' X 241' X 120' X 209' stipulating that a five foot utility easement be granted on the west lot line of Lot C, and that an additional five foot utility easement be added onto the existing road easement on the east line of Lot C, and a similar five foot utility easement to be added to the road easement on the west line of Lot B. Mayor Johnson presented the subdivision request of Mr. Brogger, 8316 Spring Lake Road. MSP (Johnson Shelquist) to approve the minor subdivision request of Larry Brogger creating three lots. Lot A 228' X 151', Lot B 2.18' X 152' X 171' X 161', Lot C 241' X 154' X 285' X 161', subject to dedication of a five foot utility easement on the back lot line of the westerly lot and further that a five foot utility easement fronting on the westerly lot and middle lot on Pleasant View as noted on Exhibit A2. 5 Ayes 5 Ayes MSP (Baumgartner- Johnson) to reconsider the original motion of the Schluter 5 Ayes subdivision. MSP (Johnson- Baumgartner) to amend the motion stipulating the original five feet utility easement of the Schluter minor subdivision on the back of the westerly lot be granted. 5 Ayes Vote on the main motion. 5 Ayes Page 8 October 14, 1975 Mayor Johnson presented the proposal of the emergency entrance to Mounds View Mobile Home Park. Engineer Comstock said a meeting was held between Mr. Aldon Johnson, owner of the Park, Administrator Achen and Engineer Bearden on Spetember 24th to discuss the emergency exit followed up by communications on October 2nd The proposal was checked with the fire and police chiefs and they were satisfied with the proposed drive construotion. The fire department was concerned, however, that snow be removed from the area around the gate. Administrator Achen added that the engineering costs should be included in this project. MS (Shelquist- Hodges) to ask that the engineer be directed to amend the plans and specifications for the emergency access to the mobile home park and to get together with Mr. Johnson about the requirements and have his engineer provide plans for Council's review. Councilman Hodges withdrew his second. MSP Shelquist- Hodges) to direct the city engineer to see that plans and specifications are drawn up to be available at the Council meeting October 27th to be reviewed by Council. Mr. Drone, 8407 Spring Lake Road, asked about NSP's procedures and charges for installing gas service to the new streets. Mr. Foss said he talked to NSP and so far there was only one request and they will not bring in gas until neighboring lots pay at deposit. Persons in the middle of the block cannot develop until everyone down the line does. He said NSP will refund money on deposits if gas service is hooked up within two years. Engineer Comstock said concerned citizens should contact the Public Service Commission which regulates the power and gas companies. Mayor Johnson directed the city engineer and administrator to look into this matter. Mayor Johnson presented the proposed drainage improvement to Mounds View Square Shopping Center Engineer Comstock reported the plans from the Highway department state work to be done by Paster is to lower the culvert under the shopping center driveway and ditch construction on ditches from Long Lake Road to County Road I. The State highway department is to lower the culvert under Long Lake Road and the Phillip 66 service station and _o do ditch work from Long Lake Road to the southeast. The City of Mounds View is to do surface restoration of the Phillip 66 service station ingress and egrees and Long Lake Road. Engineer Comstock said it was Engineer Bearden's recommendation that the City approve this offer if Ramsey County can convey their drainage to the ditch as proposed. Administrator Achen said the dollar amount is limited as to what the City can spend on these projects. 5 Ayes Page 9 October 14, 1975 MSP (Johnson- Baumgartner) to concur with Engineer Bearden's recommendation and authorize him to proceed with the State of Minnesota in implementation of the improvement on Hlghway 10 and that the City may need to incur a minimal amount of expense in resurfacing the Long Lake Road ingress and egress to the Phillip 66 service station. Administrator Achen requested Council pass resolutions for reapportionment of assessments for recent subdivisions. MSP (Johnson Hodges) to approve Resolution #693, reapportioning assessments on Greenfield Addition,, (Keith T. Harstad). MSP (Johnson- Hodges) to approve resolution #694, reapportioning the assess ments Lots 84 and 85 Spring Lake Park Knoll's Addition, (Lorraine Skog). MSP (Johnson- Hodges) to approve resolution #695, reapportioning assessments on Clearview Addition Lot 1, Block 1, and Clearview Addition, Lot 2, Block 1, (Ronald and Patricia Michna). MSP (Johnson- Hodges) to approve resolution #696 reapportioning the assess ments of Rasmussen Addition, (Harley and Marie F. Rasmussen). MSP (Johnson- Hodges) to approve resolution #697, rea portioning assessments on Auditor's Subdivision No. 89, (Victoria Bruflodt). MSP (Johnson Hodges) to apprnve resolution #698, reapportioning assessments on Spring Lake Park Hillview Lot 116, (Leo A. Bringewatt). (Special note: that when there is a development of the south 80 feet, $226.50 for sewer and water hookup will be due on Lot 116 Spring Lake Park Hillview.) MSP (Hodges- Baumgartner) to hire Pat Casci as clerk- typist at a six month probationary wage of $3.15 per hour on the CETA program. MSP (Baumgartner Shelquist) to approve instructors and salaries as indicated below and to ask the recreation department to explain the variation in salaries and or correct if in error. Gagnon Concrete Masonry; heating The Dixon Company. Administrator Achen reported that Midwest Planning and Research had requested a contract between their firm and the City of Mounds View. Mayor Johnson suggestea getting back with them and coming up with a revised contract more clearly defining costs, etc. Councilman Baumgartner's Report Councilman Baumgartner commented on the letter to the Planning Commission from Mrs. Haake on mobile home lot garages. Mayor Johnson felt the Planning Commission should make a recommendation to the Council as far as garages on mobile home lots are concerned. Councilman Shelquist agreed that the Planning Commission should come up with a policy on this matter. He said this subject was the result of a request by one person who wanted to build a pole type garage within four feet of his mobile home. Councilman Baumgartner noted that the new park is spelled with two words, Silver View. Councilman Baumgartner read the following park fund dedications accepted by the Park and Recreation Commission: Balk- $273.00, Brogger- $138.00, Schluter $115.00, Anderson Horst $55.50, Smith $53.00 Councilman Pickar's Report Councilman Pickar reported the resignation of a Lakeside Park member. He said the Commission would be looking for a new member. Attorney Meyers' Report Attorney Meyers said the attorney for Mr. Dumas has filed an appeal to protect his client's interest in regard to the 1973 -4 Improvement Project. Attorney Meyers reported that there may be a possible consolidation of the court system, this side of Ramsey County would go to Roseville. He said he feels it is more convenient to keep it at New Brighton. Page 11 October 14, 1975 Engineer Comstock's Report Engineer Comstock reported on the drainage ditch for Perkins Cake and Steak. He said state agreed to start work on October 20th and finish the project in three to four days. Rice Creek Watershed District issued a permit for the project. Engineer Comstock stated Rice Creek Watershed was also overlooking the cit hall parking lot construction plan. A change order will be necessary to satisfy Rice Creek Watershed District. An addition of $900 in project cost will be required to install inlets to the catch basins. The plans include a baffled weir. He suggested adding this cost to the present contract. MSP (Shelquist- Hodges) to accept Change Order #1 for city hall parking lot construction.
