CITY OF MOUNDS VIEW

A regular meeting of Mounds View City Council was called to order by
Mayor Johnson on October 27, 1975, at 8:07 p.m., at Mounds View City
Hall, 2401 Highway 10, Mounds View, Mn. 55112

MSP (Baumgartner- Hodges) to approve the minutes of October 14, 1975
Council meeting with the following corrections:
Page 4, 10th paragraph, second sentence should read, Councilman Shelquist
said County Road J is classified as a minor arterial. He said he talked
to Mr. Clark of Ramsey County Records and Research who showed him a map
of the existing County Road J road bed after being relocated in Blaine.
Page 6, 4th paragraph, should be corrected to read, M (Shelquist) to
amend the previous motion to grant a variance as requested by Duane
McCarty, 8060 Long Lake Road between his home and the home of William
Frits, 8206 Long Lake Road, because of the several misunderstandings
and inconveniences caused these people by the city office and because
the Planning Commission indicated approval when they heard it as a
non -fee item. The motion was withdrawn because Attorney Meyers ruled
that Council did not have the power to grant variances.
Page 6, 6th paragraph, should read Councilman Baumgartner said he feels
the $50 fee should still be paid, because the office staff made an
innocent mistake.
Page 6, 4th paragraph from bottom of page, second sentence should read,
He said it is unsightly but has no objection to one permanent sign to adver-
tise the market.
Page 6, fifth line from bottom of page, should read M(Shelquist) that
the multiple signs be taken down.
Page 7, 7th paragraph, should read MSP (Johnson- Hodges) to approve
the minor subdivision request of Mr. Schluter creating two lots on
Pleasant View and one on Spring Lake Road.
Page 7, fifth line from bottom of page, should read MSP (Baumgartner
Johnson) to reconsider the original motion of Schluter minor subdivision
request.
Page 8, second paragraph from bottom of page, the word "to" should be
inserted between the words drainage and ditch.

Page 8, third paragraph from the bottom of page, Engineer Comstock
reported the plans from the state highway department work to be done
by Paster is to lower the culvert under the shopping center driveways
and ditch construction on ditches from Long Lake Road to CountysRoad 1.
The State highway department is to lower, the culvert under Long Lake:Road
and the Phillip 66 service station to to do ditch work from Long Lake
Road to the southeast. The City of Mounds View is to do surface restoration
of the Phillip 66 service station ingress and egress and Long Lake Road.
Page 11, Engineer Comstock's Report, second sentence, first paragraph,
should read, He said the State agreed to start work on October 20th and
finish the project in three to four days.
Page 9, the special note should be referenced to Lot 116, Spring Lake
Park Hillview reapportionment for Leo Bringewatt.
CITIZEN'S COMMENTS AND REQUESTS FROM THE FLOOR
Mr. Darold Hanson, 8171 Eastwood Road, said the cesspool went out at
his mother's home today, and it is urgent that they hook up to city
sewer services. He asked that Council waive the waiting period for
the contractor's license for Partkra Plumbing, presently licensed in
Plymouth.
Attorney Meyers advised that Council could give a conditional approval
contingent upon his record being checked and insurance certificates
being presented to the City office.
MSP (Johnson Shelquist) to approve the license request of Partka
Plumbing subject to the receipt of applicable fees and subject to the
background check being done by the city staff and subject that there are
no problems with that check and that no work is to be done prior to this
information being obtained by city staff.
Mayor Johnson presented the minor subdivision request of Timothy Le'iz,
8331 Red Oak Drive. This is a lot split between Red Oak and Sunnyside
Road creating two lots (183 X 101.25') and (282 X 101.25').
Mayor Johnson asked Mrs. Lewis if there were any drainage problems. She
said the lots are high.
Councilman Shelquist reported that there is an easement for underground
utilities.

MSP (Johnson- Hodges) to approve the lot split for Timothy Lewis, 8331
Red Oak Drive, as presented on the sketch plan. 5 Ayes
Mayor Johnson acknowledged the minor subdivision request of Ernest
Danielson, 8445 Eastwood Raod, creating two 85 X 234 foot lots and
one 264 X 235 foot lot.
Mayor Johnson asked Mr. Danielson if he had problems.

Mr. Danielson said all of the lots used to be dry until an incline
was made on one lot on Long Lake Road which has 6 to 8 inches of
water standing. He said that the problem would be taken care of by
grading when they built on this lot.

MSP (Shelquist- Johnson) to approve the subdivision request of Ernest
Danielsoh, 8445 Eastwood Drive creating three lots, two lots 85 X 264
feet less a 30 foot road easement on Greenwood Drive and the third lot
264 X 235 feet less a 30 foot road easement on Greenwood Drive.
Attorney Meyers asked Mr. Danielson when the water main easement on
the north was granted.
Mr. Danielson said three or four years ago on the old improvement.
Attorney Meyes noted that when the deed comes into the office for
the clerk's signature the legal on this lot should reflect this ease-
ment.
Mayor Johnson presented proposed change order to Project 1973 -4 to
provide utility service for Jerry Ackerman minor subdivision, 8454
Spring Lake Road.
Engineer Bearden explained the change order. It is for installing sanitary
sewer services and water services on 84th Avenue, N.E., between Pleasant
View Drive and Spring Lake Road. The cost is $6,830.15. He said the project
contractors are about ready to install the permanent street, so they need
to have this change order effected immediately.
Attorney Meyers advised that if Council wanted to proceed and put the
assessment in with one person being assessed, he did not know for sure
if the letter from Mr. Ackerman could be considered as a petition. He
said "ouncil could proceed under MSA Chapter 429 and assess it later,
or the City could enter into an agreement with Mr. Ackerman but it must
be in advance of the improvement.
MSP (Johnson- Hodges) to approve Change Order #3 to Project 1973 -4 to
extend utility services into the Jerry Ackerman subdivision at 8454
Spring Lake Road and to the property immediately south thereof subject
to the receipt of an official petition from the property owner, Jerry Ackerman,
indicating that he desires the improvement and that he will agree to pay
the normal assessment cost for this improvement.
Attorney Meyers indicated that Mr. Ackerman could send the City a telegram
indicating such petition and acceptance of the assessment.
Mayor Johnson noted receipt of the proposed contract with Banister, Short,
Elliott, Hendrickson and Associates, Inc., to provide storm water drainage
engineering services.
Mr. Short, representing that firm, was present_ in the audience. Mayor
Johnson told Mr. Short the consensus of the Council at this time is that
they are in favor of going ahead with the study and the contract.
However, there are some words within the contract the Attorney would like
to have time to ponder and talk to Mr. Short about so that alternative
wording can be inserted in the contract.

Mayor Johnson said Councilman Shelquist will represent the Council
in terms of meeting with the Attorney and Mr. Short and of accepting
the contract language.
Mayor Johnson polled the Council to see what the feelings of Councilmen
are if the contract language is corrected and assuming the maximum cost
of the project is $40,400.
Councilman Hodges stated yes.
Councilman Baumgartner stated yes.
Councilman Pickar was in favor.
Councilman Shelquist also was in favor of the contract if the language
could be corrected and if the maximum cost is $40,400.
Administrator Achen announced receipt of bids for the purchase of a police
patrol car. He read the two bids. He said it is staff recommendation
that Council accept the Barnett Chrysler Plymouth bid of $4774.33 with
a trade in allowance of $800, leaving a net bid of $3974.33 for 1976
delivery, because it is u 1976 budgeted item. He asked that Council
directed the staff to sell the used vehicle at bid prior to trade in,
if more than the $800 trade in allowance could be obtained for the used
car.
Mr. Ernest Danielson suggested taking the used car to Hopkins, on County
Road 18, where they hold auctions twice a year. He said this type of
vehicle was going quite high at auction.
MSP Pickar- Hodges) to accept the bid of Barnett- Chrysler Plymouth for the
1976 Grand Fury in the amount of $4774.33 and directing the staff to see
the trade -in at bid if more than $800 can be obtained.
Administrator Achen explained that the staff has been examining photo-
copying machines for over two months. The Keelox machine was removed last
July because the company went out of business. There are quite a variety
of machines on the market in regard to quality of copy, speed, noise and
maintenance. The recommendation of the staff is to accept the second low
bid based upon the quieter operation and newer design of the Toshibafax.
Mayor Johnson said the technology in these copy machines changes so much
that it is almost necessary to get a new machine every two years. He suggested
that a leased machine might be better.
Administrator Achen said the total price amortized over a five year period
was quite a bit higher for leasing. That is why it is suggested that a
copy machine be purchased rather than rented or leased.
Mayor Johnson asked if there is money budgeted in 1975 for this purchase.
Administrator Achen reported $1,000 in the general administrative capital
account the balance is to be paid from the Sewer and Water capital account.
Mayor Johnson said he would like time for Council to consider it until the
next Council meeting.

Mr. Bill Wilson of Johnson Wilson Builders was present in the audience
and presented plans for the Mounds View Mobile Home Park emergency exit.
Engineer Bearden reviewed the plans which included a driveway and a 16 foot
gate across the driveway to be kept locked and used only in emergency
situations. The driveway is to be located on Raymond Avenue between
Bronson and Belle Lane.
Mayor Johnson asked Engineer Bearden if he was satisfied with the plans
as presented.
Engineer Bearden said the only thing to be added is top soil on the sides
of the driveway.
MSP (Johnson- Hodges) to accept the plans and specifications for Improvement
Project 1975 -7 for the addition of an emergency exit at Mounds View Mobile
Home Park. The plans and specificationspresented should also incorporate
construction of a locked gate to correspond with existing fences in the area
and the side slopes are to be covered with black dirt and sodded. The
gate is to be maintained free of snow and ice during periods of inclement
weather. The fill material is to be compacted to 95% standard density. The
keys, which lock the gate, shall be kept by the fire. police and civil defense
departments. 5 Ayes
Mr. Wilson wanted to know who will be responsible for the city side of the
gate as far as snow removal. He said when the plows go through, if the
gate is not cleared, the snow banks may become hardened and very difficult
to remove.
Councilman Shelquist said in some suburbs, the plows have wings that drop
into driveways to clear the snow. He has seen Ramsey County plows with
these wings and suggests it may be feasible to have them wing out the
snow by the emergency drive and gate.
Mayor Johnson told Mr. Wilson he would need a permit, license and perfor-
mance bond in an amount sufficient to complete the Project on file at the
city office before he could begin work.
MSP (Hodges Pickar) to approve the bills with the following changes, that
the maintenance superintendent investigate checks #11325 and #11326 to
see if the prices charged the city are fair. To void checks #11319 and #11320
and to issue check #11377 ($4,161.95) to B -E Enterprises for normal work in
construction of the city hall building. General Fund checks #11300 through
#11373, and 11376, Payroll Account checks #1207 through 1212. Payroll checks
#3035 through 3070 to pay gross pay of October 30, 1975. Transfer check
#11374 transferring from General $13,960.03, from Water $1,040.00, from
Sewer $1,549.12 to pay gross pay of October 30, 1975. Transfer check #11375
transferring 2,068.50 from General to Payroll to pay back health
insurance premiums as a result of Local 320 arbitration award. Total
Disbursements $51,614.30.
Administrator Achen read the license for approval.
MSP (Pickar Hodges) to appr ve the license: Water proofing Meridian

Administrator Achen said the contract for the storm water drainage study
to be done by Bannister -Short stipulates that the city will provide
as -built plans for all public improvement project. We have blueprints
of all these projects in the city office but no reproducible copies. He
said the drainage study requires profiles on street grades, locations of
underground utilities, etc. Administrator Achen anticipates that once the
city has a resident engineer, he will want to have the original plans
for all future projects. For completed projects, we can obtain reproducible
copies from Comstock Davis. The cost of the reproducible copies would be
between $2- $2.50 a sheet. There are about 1,100 sheets to copy. To
obtain blue -print copies, the cost would be 40$ per sheet. He recommends
to wait on obtaining reproducible copies until we hire a resident engineer.
MSP (Johnson Shelquist) that we obtain blueprint copies of all public
improvement project as- builds from Comstock Davis for use by Bannister-
Short in the storm drainage preliminary study, and that the estimatd
cost of 40* per sheet be paid out of the Revenue Sharing Fund which will be
used to finance the storm drainage feasibility study.
ATTORNEY MEYERS' REPORT
Attorney Meyers commented on a complaint he had received from an individual
involved in the tornado disaster last May at the Mounds View Mobile Home
Park. The person called several times complaining abut being charged $18
for gas inspections that took four to five minutes. The person wanted
to know why the city required this inspection of the gas lines. The inspections
were performed by Northern Propane who charged a minimum fee of $18 for each
unit. Attorney Meyers said he wrote a letter to Northern Propane regarding
this charge with a copy to the Better Business Bureau. He said Northern
Propane points a finger at the city concerning this matter.
COUNCILMAN BAUMGARTNER'S REPORT
Councilman Baumgartner reported the next Park and Recreation meeting would
be Thursday, November 13th at 6:30 p.m.
COUNCILMAN PICKAR'S REPORT
Councilman Pickar reported that Mike Dailey, member of the Lakeside Park
Commission has resigned. The Commission is looking for another member.
